4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

b.   Discussion and possible action to enter into a Memorandum of Understanding (MOU) between Webb County (the Webb Sheriff’s Office Safe Haven Program, the 406th District Court) and Casa Misericordia Domestic Violence Shelter that documents and memorializes the coordination, collaboration, and partnership critical to the implementation to the Justice for Families Grant Program. This MOU is required as part of the grant application to be requested to be authorized for submission by the Webb County Commissioners’ Court on February 14, 2022, and is “a vital component” of the application to the Office on Violence Against Women (OVW) (Pages 12 and 17 of Request for Proposal). The aforementioned grant has no cash match and will have no impact on the general fund. If awarded, this highly competitive grant is anticipated to start on October 1, 2022 and continue until September 30, 2025.  [Requested by Sheriff Martin Cuellar]
 
Issue: Violence against women is among the most intractable and deadliest criminal justice problems in the United States, especially domestic violence and in the South Texas area. According to published statistics, the number of American women between 2001-2012 who were murdered by current or ex male partners in the United States was 11,766. That's almost double the amount of casualties lost during wars in Afghanistan and Iraq. Women who will be victims of severe violence by an intimate partner in their lifetimes are 1 in 4. ("30 Shocking Domestic Violence Statistics That Remind Us It's An Epidemic" Vagianos 10/23/2014)
 
Solution: Casa Misericordia Domestic Violence Shelter, the 406th District Court, and the Webb County Sheriff's Office seek to continue their coordinated, collaborative efforts to assist victims of domestic violence in the local Laredo/Webb County Community.
 
Result: Victims of domestic violence, sexual assault, dating violence, and stalking in the Laredo/Webb County area will continue to receive improved, enhanced services from the Casa Misericordia Domestic Violence Shelter, the 406th District Court, and the Webb County Sheriff's Office Safe Haven Program to assist them with needed recovery, restitution, privacy, justice, and dignity.

c.   Discussion and possible action to enter into a 10 month Non-Financial Memorandum of Understanding (MOU) beginning January 11, 2022, through October 1, 2022 and which will renew automatically every October 1st, between Webb County and the City of Laredo in which the City's Health Department will perform health services for the Webb County population at four of Webb County's Community Centers (La Presa Community Center at: 1983 Mangana Hein Rd. Solution: Accept Federal assistance to continue local participation in USMS investigations, strategic initiatives and prosecution of organized crime.
 
Result: Disruption of organized criminal activity in Webb County and along the Texas border.

Result: Texas Department of Housing and Community Affairs (TDHCA) will provide funding to be used for payment of qualifying low-income client's home energy expenses.

c.   Discussion and possible action to authorize Webb County Community Action Agency (WCCAA) to maintain its membership in the Texas Association of Community Action Agencies, Inc. (TACAA) 2022 Corporate Membership in the amount of $3,850.00. TACAA's membership is from January 01, 2022 through December 31, 2022. The membership supports the Organization in Texas representing the network of Community Services Block Grant (CSBG) entities. Grant funds will be used to pay for membership. Issue:
Approve TACAA 2021 Corporate Membership in the amount of $3,850.00.

Solution: TACAA advocates for the best interest of Community Action Agencies (CAA's) at the State, regional and national levels.

a.   Discussion and possible action to authorize the submission of a Fiscal Year 2023 Local Border Security Program (FY 23 LBSP) grant application as developed, written, and submitted by the Webb County Sheriff’s Office Grant Writer to the Office of the Homeland Security Grants Division (HSGD) in the amount estimated at $200,000 for peace officers' overtime and applicable fringe benefits to provide enhanced border security in the Laredo/Webb County area, and authorizing the Webb County Judge to execute all relevant documents, including the resolution; and any other matters incident thereto. This grant does not require a match; and, thus, will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fluidity of border crossings, heavy commercial activity, and interdependence of the international border communities’ economies. These socio-economic pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.

Solution: Grant application to provide enhanced border security in Laredo/Webb County in order to fulfill State of Texas local border security program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas.

Result: Enhanced/increased patrol and investigative capacity for certified peace officers working at the Webb County Sheriff’s Office.

b.   Discussion and possible action to authorize the Webb County Sheriff’s Office to apply to the Office on Violence Against Women (OVW) for a Fiscal Year (FY) 2022 Justice for Families Program grant as coordinated, developed, written, and submitted by the Webb County Sheriff’s Office in conjunction with the 406th District Court and the Casa Misericordia Domestic Violence Shelter in the amount roughly estimated at $550,000 for full-time/part-time personnel, training/travel, leasing, utilities, contractual services, equipment/supplies, and other needs to support the Webb County Sheriff's Office Safe Haven Program, and designating the Webb County Judge as the authorized official in all matters pertaining to this grant; and any other matters incident thereto. However, this grant only funds the provision of supervised visitation and safe visitation exchange of children and youth by and between parents in situations involving domestic violence, dating violence, child sexual abuse, sexual assault, or stalking (i.e. not cases of contentious divorces and/or general familial discord/strife regarding custodial legal matters that do not involve these types of violence crimes against women and/or children).  This grant does not require a match; and, thus, will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The announcement of the closing of Safe Haven's doors (currently averted) was recent and unforeseeable, leaving the Sheriff's Office and the rest of Webb County scrambling to find the necessary resources to support the program and the families who have come to rely on its services.  Thus, there is extremely limited funding now available to supply the staff and other needs  for the Safe Haven  Program, which provides for secure and supervised visitations and safe exchanges of minor children in the Laredo/Webb County community. This is a crucial need in the local community for families who have experienced contentious custody disputes, allegations of child abuse/neglect, a documented history of family/domestic violence, and other allegations of physical confrontations and/or severe familial discord.  

Solution: Apply for grant funds to help secure funding to help fund the needs of the program and its participants from the community.

Result: If grant funded, the Webb County/Laredo community’s needs for this type of service will be met. Serious familial violence can be diminished and/or prevented through this program.

c.   Discussion and possible action to approve the submission of a revised proposed budget summary for payroll and related fringe benefits for Two (2) High Intensity Drug Trafficking Area (HIDTA) Investigator positions assigned to the Laredo Police Department Task Force in the amount of $186,070, including $171,070 grant and $15,000 cash match for FY 2022 for the performance period effective January 1, 2022 through December 31, 2022.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. This includes an estimated cash match of $15,000 for some applicable fringe benefits, which shall be paid through the Sheriff's Office state forfeiture funds.  [Requested by Martin Cuellar, Webb County Sheriff; Account #2906 (Grant Revenue)]

Issue: HIDTA is a multi-agency task force that continues to gather intelligence and disrupts the illicit flow of narcotics and money laundering activities along the South Texas Border region.  South Texas HITDA is an alliance of over 57 federal, state, and local law enforcement agencies working together to combat drug trafficking and related crimes.

Solution: For the Webb County Sheriff's Office to continue supporting HIDTA by employing grant funded investigators and continue coordinated efforts with other law enforcement agencies to push forward the mission and goals of the South Texas HIDTA task force.

Result: The Webb County Sheriff's Office will continue to employ two (2) HIDTA funded investigators who will actively participate and help the task force fight against the continued flow of illicit drugs and related crime within the South Texas region.

d.   Discussion and possible action to approve the acceptance of a reimbursement agreement for overtime expenses as per the Memorandum of Understanding between Webb County Sheriff's Office and the Southern District of Texas (79), United States Marshals Services, and authorizing the Webb County Judge to sign all relevant documents; and any other matters incident thereto. The performance period for this agreement is October 12, 2021, through September 30, 2022. The Webb County Sheriff's Office will receive an amount not to exceed Sixteen Thousand Dollars ($17,500.00) in support of Joint Law Enforcement Operations Project JLEOTFS4. Applicable estimated fringe benefits in the amount of $4,200 associated with this overtime will be covered using state forfeiture funds. Issue: Various criminals with felonious charges, such as but not limited to murder, robberies, sexual assault of minors, all gang-related felonies, and aggravated assaults with deadly weapons, abscond from the local jurisdiction in order to avoid justice for their crimes. Due to the limited manpower and other resources of local law enforcement agencies, these criminal can sometimes continue to successfully evade arrest with impunity.

Solution: 
Through joint law enforcement overtime (OT) operations, members of the U.S. Marshal’s Service Multi-Agency Task Force can continue to assist other local law enforcement agencies, such as the Laredo Police Department and the Zapata County Sheriff’s Office, to conduct necessary investigations, covert surveillance and undertaken arrests of absconders who have outstanding warrants for their felonious crimes. 

Result: Webb County/Laredo citizens will be safer once these criminals are captured and taken out of the local community in order to face justice for their felonious crimes.

e.   Discussion and possible action to ratify a Resolution for approval to submit a grant application to the Office of the Governor Public Safety Office Criminal Justice Division for a County Innovations Grant estimated at $250,000 over the term of the contract. Issue: Section 127.1232 of Texas Election Code (12/2/2021) mandates any county with a population over 100,000  to implement a video surveillance system that retains a record of areas containing voted ballots from the time the voted ballots are delivered to the central counting station until the canvas of precinct elections returns.  Additionally, it reads that the video shall be made available the public by a livestream.  
 
Solution: Authorize the use of a cooperative contract vendor for the State of Texas who has met all the competitive bidding requirements of the State. 
 
Results: Order will be placed immediately after Court approval and transfer of funds. Estimated time of delivery is 1 week.

35.   Discussion and possible action to award a contract in the amount of $68,080.00 to American Generator Services LLC, to modify and upgrade our current backup Transfer Switch Sequence/Operation Programming for the power outage generators located at the Rio Bravo Water Treatment Plant and to further grant by order of the Commissioners Court an exemption in accordance with the Texas Local Government Code; Section 262.024 (Discretionary Exemptions)(a.)(2.) an item to preserve or protect the public health or safety of the residents of the County; and any other matters incident thereto. [Account #7220-7280-001-443000-035, Repairs & Maintenance Equipment (2016 Water Utility Improvement Series)]
 
Issue: When the Rio Bravo Water Treatment Plant as built and put online in 2006 the generators were installed and programmed with natural gas as the primary source for power and the electrical utility generators to be used as a secondary backup power source.  We currently have system running with electrical utility due to the cheaper cost compared to natural gas powered generators, which are more expensive to run due to the high cost of natural gas.  The dual source power programming is will give the Utilities Dept. to automatically switch from one source of power i.e.; gas to electric or electric to gas as the main power source for the generators in the event of a power outage.
 
Solution: Approve and authorize the Backup Generator upgrades to our Transfer Switch Station.  Annual contract vendor was not able to provide contracted pricing since it will require additional programming in addition to the electrical upgrades being requested.  A discretionary exemption is being recommended in order to process this scope of work in a more timely fashion to avoid any issues with the backup generators to the Water plant.
 
Result: Department will have the ability to automatically transfer from electrical to natural gas power for the Backup Generators in the event of a Power Outage and ensure continuance of utility services to both Rio Bravo and El Cenizo.

36.   Discussion and possible action to enter into a bulk water sales agreement for a three month period between Webb County (Webb County Utilities Department) and SUN Coast Resources, Inc. for the sale of potable water from the Rio Bravo Water Treatment Plant in an amount not to exceed 12,000 gallons per day at the following price: Up to 3,000 Gallons/$88.00, plus any additional gallons priced at 1,000 gal./$3.90 (pro-rated) and any matters incident thereto; authorizing the Webb County Judge to sign all relevant documents.

Issue: Company is seeking to purchase Potable Water from the Rio Bravo Water Treatment Plant for the temporary Migrant Tent Center

Solution: Approve the service to Sun Coast Resources.

Result: Provide Service to Company who is contracted out with the Migrant Tent Center.
