Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

7.   Economic Development
 
a.   Discussion and possible action to authorize the submission of a grant application completed and submitted by the Webb County Sheriff’s Office to the Bureau of Justice Assistance (BJA) for a FY 2021 State Criminal Alien Assistance Program (SCAAP) grant for reimbursement of costs already incurred for the incarceration of undocumented criminal aliens at the Webb County jail; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any cash match; and, in fact, is a reimbursement of costs already incurred. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Although immigration matters, including illegal immigration, are constitutionally established as existing under the legal jurisdiction and regulation of the federal government, state prisons and local detention facilities, such as the Webb County jail, incurs significant costs incarcerating undocumented foreign aliens who commit crimes in the United States. This includes but is not limited to supervision, housing, feeding, clothing, any medical and transportation expenses, and other associated detention costs.

Solution: Grant application to obtain reimbursement of a small percentage of the incurred correctional officer salary costs associated with detaining undocumented criminal aliens who had at least one felony or two misdemeanor convictions for violations of state or local law and who were incarcerated at the Webb County jail for at least four (4) consecutive days during the reporting period of July 1, 2020 through June 30, 2021.

Result: Webb County will be reimbursed by the federal government a limited percentage of the amount

b.   Discussion and possible action to authorize the submission of a grant application for and acceptance of the grant award of the Fiscal Year (FY) 2021 Operation Stonegarden (OPSG) as prepared and submitted by the Webb County Sheriff’s Office to the Office of the Governor Homeland Security Grants Division in the amount of $2,714,250 for overtime, associated fringe benefits, equipment, supplies, fuel, helicopter maintenance/fuel, vehicle/tire maintenance, data services, Management & Administration (M&A), and maintenance of OPSG-acquired assets for Webb County local law enforcement agencies, including the Sheriff's Office, the Offices of the Constable, Pct. 1-4, and the Webb County Attorney's Office Investigators; and any other matters incident thereto. There is no cash match; and, thus, no cost to Webb County. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Complex and dynamic law enforcement challenges exist in the Southwest border area of the United States, including Laredo/Webb County. For example, transnational criminals seek to exploit existing law enforcement jurisdictional boundaries by conducting their illegal enterprises across traditional jurisdictional divisions. The 2014 Texas Gang Threat Assessment expounds, “Gang activity remains widespread throughout all regions of Texas…Gang activity is also prevalent in the Texas counties adjacent to Mexico and along the key smuggling corridors, since Texas-based gangs are used for cross-border smuggling and trafficking in the state. Many transnational gangs operating in Texas….engage in criminal activity in Mexico as well as in Texas and elsewhere” (Texas Department of Public Safety April 2014).

Solution: Grant application: (1) to ensure first responders are equipped with enhanced tools/equipment/resources needed to confront well-funded criminal organizations and (2) for the coordination of law enforcement efforts between various local and federal law enforcement agencies.

Result: Enhanced capabilities of local law enforcement responders; further coordination of response across local and federal jurisdictions.

c.   Discussion and possible action to develop and submit a Medina Electric Community Empowerment Program (CEP) grant for 2022 for up to $2,000.00, and authorizing the County Judge to act as the Authorized Representative in all matters pertaining to the County's request for funding. The purpose of the application is to purchase face pieces for department’s back-up self-contained breathing apparatus (SCBA) for use by fire personnel. This application will require a cash match up to $500.00.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Fire Suppression & EMS Services; Account #1001-3140-001-460105 (Minor Tools & Apparatus]

Issue: As the Webb County Volunteer Fire Department expands to insure the safety of Webb County residents, so does the demand for a well-equipped department.

Solution: The acquisition of grant funds will aid with the purchase of face pieces for SCBA used by fire personnel.

Result: A well-equipped department ready to assist at any incident.

d.   Discussion and possible action to proclaim April 2022 as the 54th Anniversary of Fair Housing Month, April 11-15, 2022 as Fair Housing Week and designating the Webb County Community Action Agency to monitor Fair Housing in Webb County.

Issue: In order to continue to apply for grants, it is a federal requirement that Webb County promotes Fair Housing within its jurisdiction. 

Solution: Promotion of Fair Housing in Webb County and designating a week during the month of April will help inform citizens of Webb County of their legal rights in housing discrimination. 

Result: The federal requirement for Fair Housing will be met by promoting Fair Housing within Webb County's jurisdiction, This will allow Webb County to continue to apply for grants.

10.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

25.   Discussion and possible action to authorize services between ClearGov (Buy-Board Contract No. 607-20) and Webb County for annual subscription services in an amount not to exceed $34,500.00 annually with a one-time setup fee of $7,200.00 to generate online digital budget books and not limited to related financial data collection such as capital budgeting, personnel budgeting and operational budgeting in accordance with the Texas Local Government Code; Sections 271.101, 271.102, Sub-Chapter F. Cooperative Purchasing Programs and any other matters incident thereto [Fund #2703 American Rescue Plan Act of 2021 / Sub-category: Loss Revenue Replacement]
 
Issue: The Budget Officer is recommending the subscription services in order to prepare annual digital budget books online to streamline the process, by utilizing professional software for collection of budget data from our financial system, automation of budget reports, and to produce a more effective and efficient public record to view.
 
Solution: Authorize the annual subscription services under a cooperative contract, in addition the purchase of services also qualifies under the CFR 200.320 Methods of Procurement for non-competitive procurement for micro-purchases and single source due to copyrights, patents and other proprietary reasons. 
 
Result: Proceed with order of subscription services as authorized by Commissioners Court.

26.   Discussion and possible action to authorize the frequency licensing services from RZ Communication for the five (5) tower sites, 6-channel P25 simulcast trunking system to gain permanent authorization by obtaining FCC Licenses for each tower site plus a UPS racking system for 911 Dispatch and to further approve by order a discretionary exemption in accordance with the Texas Local Government Code; Section 262.024 (a.)(4) professional services in an amount not to exceed $34,600.00 and any other matters incident thereto. [Account #1001-1130-001-432001 – Professional Services]
 
Issue: Under the current System Purchase Agreement between Webb County and Motorola, these frequency licensing services are the responsibility of Webb County.
 
Solution: Proceed with recommended vendor to initiate administration of securing the FCC licensing for each site.  For a total of 60 licenses that need to be obtained from the FCC.  Pursuant to Systems Purchase Agreement approved by Commissioners Court on October 26, 2020.
 
Result: Professional services will be authorized contingent upon Commissioners Court approval.
