4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

5.   Honorable Joe Lopez, 49th District Court Judge
 
a.   Discussion and possible action to approve payments for memberships to non-profit state association for the 49th District Court for fiscal year 2022 as required by Local Government Code Section 89.002 subject to funds and any other matters incident thereto.

Issue: Local Government Code 89.002 Requires that: The Commissioners Court may spend, in the name of the county, money from the county for membership fees and dues of a non-profit state association of counties.

Solution: Obtain court approval as required.

Result: Purchase Orders for state associations approved by Commissioners Court will be processed for payment.

Issue: Meals On Wheels Requires funds to be transferred into Materials & Supplies to cover the raise in cost for trays used for the Home Delivery Meals.

Solution: By Commissioners Court ratification of the approval, we will have funds to continue to cover cost.

Result: With funds available, the department will be able to cover the cost for the home delivered meals and congregate meals program.

Issue: New equitable shared funds have been awarded to the District Attorney's Office and may be spent after a budget for the expenditure of the proceeds has been submitted to the Governing Body. The budget must be detailed and clearly define the categories of expenditures.

Solution: Submit a budget to the Governing Body that clearly defines the categories of expenditures to be incurred with the new proceeds.

Result: The District Attorney's Office will add the new proceeds to its current expenditure budget to be utilized for law enforcement purposes in accordance with the Department of Justice Equitable Sharing Guidelines.

a.   Discussion and possible action to enter into a two-year Option Extension Agreement (October 1, 2022 through September 30, 2024) between Angel Care Ambulance Service, LLC and Webb County for medical ambulance services at a monthly cost of Sixty Two Thousand Dollars ($62,000.00) for a total cost of One Million Four Hundred Eighty-Eight Thousand Dollars ($1,488,000) over the two year term extension, subject to annual budget appropriations, and authorizing the County Judge to sign and execute all relevant documents; and any other matters incident thereto. Issue: Residents of the unincorporated areas of Webb County do not have access to emergency ambulance care services as do residents living within the corporate limits of the City of Laredo.

Issue: This added module will allow potential employees to fill out required forms paperless and contactless which will expedite the pre-employment process more effectively.
 
Solution: NEOGOV provides existing software used by County Human Resource Services department for Webb County employees. The onboard subscription service agreement would be an added module to enhance existing services for new hires. This subscription service agreement is being recommended from only once source due to existing software in place in order for it to be compatible.
 
Result: Onboard provides potential employees with a pre-start date checklist driving visibility and new hire engagement, paperless and contactless.

Issue: The Texas Comptroller of Public Accounts is compiling the 2023 Sheriffs’ and Constables’ Fees report as required under Texas Local Government Code, Section 118.131. This law requires each Commissioners Court to set fees charged for civil services by the Sheriffs’ and Constables’ and directs that these fees be reported to the Comptroller. These fees must be set before October 1st of each year and are effective the 1st of January.

Solution: Commissioners Court approval of new fees for civil services to meet October 1st deadline.
 
Result: Webb County and the Constable Offices will meet the requirements required by the Texas Comptroller of Public Accounts.

h.   Discussion and possible action to enter into a one year (September 1, 2022 through August 31, 2023) Interlocal Agreement with United Independent School District (“UISD”) for juvenile court coordinators for the Justice of the Peace Court Precinct 2, Place 1, in the amount of Seventeen Thousand Two Hundred Ninety-Five Dollars ($17,295.00) being the County’s Share and Twenty-Five Thousand Three Hundred Sixty-One Dollars ($25,361.00) being the County’s share for the Justice of the Peace Precinct 4 for a total amount for both Justice of the Peace Precincts being Forty-Two Thousand Six Hundred Fifty-Six Dollars ($42,656.00).[Juvenile Case Manager Fund J.P. Issue: Webb County Justices of the Peace Courts provide truancy court for juveniles referred to their Courts by school districts for violation of compulsory state attendance laws.  The Justices of the Peace require the presence of school district Attendance Officers in order to enforce these school compulsory attendance laws. These Attendance Officers assist the Justices of the Peace in providing court coordination of the truancy services, which requires
 
Solution: UISD and Webb County each pay ½ the salaries for Attendance Officers acting as Justice Court Coordinators overseeing the truancy court docket.

Result: Provide truancy court for juveniles referred to Justice of the Peace Courts by school districts.

i.   Discussion and possible action to approve a Memorandum of Understanding between Webb County for the benefit of the Webb Sheriff's Office and Homeland Security & Investigations for reimbursement of employee overtime incurred from joint law enforcement operations, for the performance period of October 1, 2022 through September 30, 2023, in the amount of Fifteen Thousand Dollars ($15,000.00). Forfeiture funds will be utilized to cover the applicable fringe benefits associated with this project's employee(s) overtime, therefore there will be no impact to the General Fund; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. [Requested by Webb County Sheriff, Martin Cuellar; Fund-2601 Homeland Security and Fund 2150 State Forfeiture Funds for Fringe]
 
Issue: Collaboration between Federal, State and local law enforcement agencies is necessary to combat criminal organizations illegally exploiting America’s travel, trade, financial and immigration systems.
 
Solution: Accept Federal assistance to continue local participation in Homeland Security investigations, strategic initiatives and prosecution of organized crime.
 
Result:
 Disruption of organized criminal activity in Webb County and along the Texas border.

j.   Discussion and possible action to enter into a one year (September 12, 2022 through September 11, 2023) “Local Partnership Agreement” between The National Center for Missing and Exploited Children (“NCMEC”) and the Texas (Trafficking) Emergency Network Diversion (TEND) Court Program overseen by Judge Selina Mireles wherein NCMEC will provide, at no cost to Webb County, “NetSmartz and KidSmartz facilitator training (one day) to a person designated by the TEND Court Program which will allow said person to provide school and community based presentations involving Missing and Exploited Children and authorizing the County Judge to execute all relevant documents. [Requested by Judge Selina L. a.   Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective September 12, 2022:

b.   Discussion and possible action to accept Amendment No. 18 for the Health and Human Services Commission (HHSC) Contract #000158100 for the fiscal Year 2022-2023, in the amount of ($529,465.21) Five Hundred Twenty-Nine Thousand Four Hundred Sixty-Five Dollars and Twenty-One Cents and authorizing the Webb County Judge to sign all relevant documents, any other matters incident thereto. This action will not have an impact to the General Fund. Documentation has been reviewed by Webb County Economic Development Department and is compliant with SPOC policies and procedures. [Grant Account #2371-5150-521-330300]

Issue:
Texas Health and Human Services Commission (Region 11, HHS Contract No 000158100) is an ongoing amendment that is ratified every year.  The contact is amended to establish the fiscal Year 2022-2023 budget by adding funding in the amount of $529,465.21 for the home delivered meals program.
 
Solution: 
The discussion and possible action is to accept Amendment #18 with the current HHSC contract to provide Home-Delivered Meals to the elderly, home-bound residents of Webb County.
 
Result:
The HHSC contract will provide an estimated 99,711 Home Delivered Meals from October 1, 2022 through September 30, 2023.

c.   Discussion and possible action to award RFP 2022-003 "Self-Help Center Home Construction Program - TCDP #7220013 501(c)(3) Non-Profit Corporation" to Habitat for Humanity of Laredo, Inc., contingent upon the receipt of the final Executed Contract Amendment #1 for the Self-Help Center Program Contract #7220013 and authorize the County Judge to sign all relevant documents and any other matters incident thereto.

Issue: Webb County solicited Request for Proposals (RFP 2022-003) 3/2/22 - 3/23/22 for a 501(c)(3) Non-Profit Corporation to construct new homes in Partnership with the Self-Help Center Program. A Budget Amendment is being finalized and routed for signatures by the Texas Department of Housing and Community Affairs (TDHCA) that will fund this activity.  TDHCA Board voted to approve the Amendment on July 6, 2022.

Solution: Award RFP 2022-003 to Habitat for Humanity Contingent upon the receipt of the final executed Amendment from TDHCA.

Result: A minimum of two (2) new homes will be built for eligible colonia families by Habitat for Humanity of Laredo in partnership with Webb County Self-Help Center.

d.   Discussion and possible action to approve the posting and filling of the following to be funded from the Comprehensive Energy Assistance Program Grant (CEAP) Account #2362-5150-3303000 and Community Services Block Grant (CSBG) Account #2368-5170-33033000. This position will be 100% grant funded and there will be no impact to the General Fund.

9.   Economic Development
 
a.   Discussion and possible action to authorize the Economic Development Department to develop and submit a U.S. Department of Agriculture Rural Development (USDA RD) Emergency Community Water Assistance Grant application for up to $1,000,000.00 for reimbursement on expenses made to haul water to Colonia La Presa and Highway 59 Colonias Group; approving a resolution for authorization of grant submission to USDA RD; and authorizing the County Judge to act as the Authorized Representative in all matters pertaining to the County's request. This application does not require match. 

Issue: Submission of an application to USDA RD for the Emergency Community Water Assistance Grants that will provide safe and reliable drinking water to residents in La Presa and Highway 59 Colonias Group.

Solution: The Economic Development Department will develop and submit the application.

Result: If funded, Webb County will provide safe and reliable drinking water to residents in La Presa and Highway 59 Colonias Group.

b.   Discussion and possible action to authorize the submission of a Bullet-Resistant Shield grant application by the Webb County Sheriff’s Office Grant Writer to the Office of the Governor Public Safety Office Criminal Justice Division in the amount roughly estimated at $571,559 for ballistic shields for the Sheriff’s Office sworn peace officers ; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Recent tragic events have emphasized the need for ballistic protection for peace officers responding to active shooters armed with high powered machine guns.  

Solution: Grant application to provide ballistic shields for the peace officers of the Webb County Sheriff’s Office. 

Result: Peace officers of the Webb County Sheriff’s Office will be equipped with ballistic shields.

c.   Discussion and possible action to authorize the submission of a ALERRT Training Travel Assistance grant application by the Webb County Sheriff’s Office Grant Writer to the Office of the Governor Public Safety Office Criminal Justice Division in the amount estimated at $25,000 for training/travel assistance for the Sheriff’s Office sworn peace officers; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Solution: Grant application to provide needed travel assistance for Train-the-Trainer ALERRT trainings for the peace officers of the Webb County Sheriff’s Office. 

Result: Peace officers of the Webb County Sheriff’s Office will be able to attend ALERRT Training.

d.   Discussion and possible action to accept the Substance Abuse and Mental Health Administration (SAMHSA) Grant Award, #5H79TI081049-05, Year 5 Continuation award, in the amount of FOUR HUNDRED THOUSAND DOLLARS ($400,000.00) beginning September 30, 2022 through September 29, 2023, for the Webb County Court-at-Law II DWI Court Program, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. There is no match required, therefore there is no financial impact to the general fund. All required documents were sent for review to the Economic Development Department and the acceptance of the Continuation grant is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Victor Vasquez III, DWI Court Program Director]

Issue: Notice of Award for the Webb County Court-at-Law II DWI Court Program, SAMHSA Grant Year 5 was received on 06/27/2022, acceptance by Commissioners Court is required. 

Solution: Accept the notice of award for year 5. The Commissioners Court approving the budget as submitted to, and approved by, SAMHSA.
 
Result: Funding in year 5 will be utilized to provide substance abuse and mental health services to all qualifying candidates.

Issue: 
Webb County has seen a dramatic rise in cases involving domestic violence. These cases involve victims of crime that suffer emotional trauma and physical injuries. The State of Texas has set up a Victim of Crime Compensation Fund that provides benefits to victims of these types of crimes; however, the system is complex and normally victims have to document their benefit eligibility while still under emotional trauma and physical distress. This grant funds the position of a victim assistance coordinator that will work closely with prosecutors, investigators and counselors to meet the needs of crime victims.

Solution: Accept the grant award from the Office of the Texas Attorney General.

Result: The victim assistance coordinator will continue to provide the services outlined above to victims of crime in Webb County.

f.   Discussion and possible action to ratify the submission of a County Essential Services grant application by Economic Development on behalf of the District Attorney's Office; to the Office of the Governor, Public Safety Office in an amount estimated at $319,092. This grant will cover extraordinary costs associated with investigation or prosecution of a capital murder or crimes committed because of bias or prejudice as defined in Article 104.004 of the Code of Criminal Procedure. This formal request shall authorize the County Judge to execute all relevant documents, including the resolution; and any other matters incident thereto. There is no cash match requirement for this grant; All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Costs associated with investigation / or prosecution of a capital murder or crimes committed because of bias or prejudice can be extraordinary. Some expenditures that may be incurred within these types of cases are costs related to expert witness, prosecution costs, courtroom security, juror expenses, and investigative services resulting in a need for additional financial resources.

Solution: Governing Body approval to submit the grant application for funding.

Result: The District Attorney’s Office will have an opportunity to request financial assistance to help defray the costs associated with the investigation/or prosecution of a capital murder or crimes committed because of bias or prejudice as defined in Article 104.004 of the Code of Criminal Procedure.

Issue: Victims of violent crime suffer significant financial duress, emotional trauma, and physical injuries. While the State of Texas has set up a system to compensate these victims for their expenses and financial losses due to death, disabling injuries, and emotional trauma utilizing collected court costs from convicted offenders, the victims often must navigate the complex state compensation system and extensively document their benefit eligibility while still under emotional and physical distress.

Solution: The Webb County Sheriff’s Office grant funded Crime Victim Advocate will offer critical support, facilitate/expedite filling out detailed paperwork, provide needed guidance through the bureaucratic process, and deliver outreach/education to the local community.

Result: Victims of violent crime in Webb County, including victims from special populations, such as children, youth, rural, colonia, monolingual, and elderly populations, will be provided with direct victim services, training, and outreach/education.

h.   Discussion and possible action to adjust pay rates for Webb County Adult Drug Court (TI081059) and Veterans Treatment Program (TI081929) Key Personnel effective August 2, 2022, as indicated on the Notice of Award, and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. Salary for Key Personnel is 100% funded by the grant and does not require any match, therefore it will not impact the general fund. All required documents were sent for review through the Economic Development Department, and solicitations to the applications is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Changes in the Director position of the Veterans Treatment Program (TI081929) were approved by SAMHSA effective August 2, 2022 with the Change in Key Personnel pay rate and a decrease in level of effort 20%. SAMHSA also approved a change in pay rate and decrease in level of effort to 80% for the Director position also a Key Personnel under Grant No. TI081059 effective August 2, 2022.

Solution: Changes in Pay rate and level of effort for both grant program require Commissioners Court Approval. 

Result: Approval of Change in Key Personnel will allow both programs to fully operate without interruption of services.

25.   Discussion and possible action to approve the purchase of a Progressive TDR-X 10.5' Roller Mower in the amount of $32,833.00 from John Deere to efficiently cut the roughs at the Casablanca golf course. Currently, Casa Blanca Golf Course does not own a pull behind deck mower with enough capacity and length to efficiently mow the roughs at the course. This is the last piece of machinery needed for the golf course. 29.   Discussion and possible action to approve a construction contract between Webb County and Waukesha-Pearce Industries, LLC (Buy-Board Cooperative Contract #657-21) for the delivery, setup, installation and startup of two (2) industrial size Generac diesel Generators (50kw / 25kw) and transfer switches for the Quad City Fire Station and JP/Constable Building in an amount not to exceed $156,112.00 pursuant to the Texas Local Government Code; Sections 271.101, 271.102, Sub-Chapter F. Cooperative Purchasing Programs and to further authorize the Webb County Judge to execute all relevant documents and any other matters incident thereto. Issue: On June 13, 2022, during a regular meeting, Commissioners Court voted to add the JP and Constable Building to the backup generator project originally planned for the Quad City Fire Station. 
 
Solution: Proceed with recommended changes and cooperative price proposal for the installation of two industrial-size generators to provide backup power to both the Quad City Fire Station and to the JP/Constable’s Office.
 
Result: If approved, construction contract can be executed and notice to proceed issued.  Expected lead time on equipment is 20-26 weeks.

Issue:
Current grant funding expires on September 30, 2022. The Texas (Trafficking) Emergency Network Diversion (TEND) Court Program has not received notice of award for the new grant. Unless this item is approved, personnel working under this said grant will not be paid after September 30, 2022. 
 
Solution: Grant a 90-day payroll extension for personnel working under this grant.
 
Result:
The Texas (Trafficking) Emergency Network Diversion (TEND) Court Program in Laredo/Webb County will continue to identify and provide services to youth aged 10 to 17 and, who are at risk of sexual exploitation in the 4th Administrative Judicial Regions Child Protection Court.
