4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

6.   Civil Legal Division
 
a.   Discussion and possible action to approve the acceptance of a reimbursement agreement for overtime expenses as per the Memorandum of Understanding between Webb County Sheriff's Office and the Southern District of Texas (79), United States Marshals Services, and authorizing the Webb County Judge to sign all relevant documents; and any other matters incident thereto. The performance period for this agreement is October 02, 2022, through September 30, 2023. The Webb County Sheriff's Office will receive an amount not to exceed Eighteen Thousand Five Hundred Dollars ($18,500.00) in support of Joint Law Enforcement Operations Project JLEOTFS4. Applicable estimated fringe benefits in the amount of $4,500 associated with this overtime will be covered using state forfeiture funds. Thus, this cooperative agreement will continue to have no impact on the general fund. [Requested by Martin Cuellar, Sheriff; Fund #2599; Cash Match from Fund #2150 (State Forfeiture Fund)]
 
Issue: Various criminals with felonious charges, such as but not limited to murder, robberies, sexual assault of minors, all gang-related felonies, and aggravated assaults with deadly weapons, abscond from the local jurisdiction in order to avoid justice for their crimes. Due to the limited manpower and other resources of local law enforcement agencies, these criminal can sometimes continue to successfully evade arrest with impunity.
 
Solution: Through joint law enforcement overtime (OT) operations, members of the U.S. Marshal’s Service Multi-Agency Task Force can continue to assist other local law enforcement agencies, such as the Laredo Police Department and the Zapata County Sheriff’s Office, to conduct necessary investigations, covert surveillance and undertaken arrests of absconders who have outstanding warrants for their felonious crimes.
 
Result: Webb County/Laredo citizens will be safer once these criminals are captured and taken out of the local community in order to face justice for their felonious crimes.

b.   Discussion and possible action to approve a Professional Services Agreement between Webb County, and Dr. Marcos Hinojosa, for their Webb County Headstart Program/Early Child Headstart Care Partnership (EHS-CCP) for use in their early head start programs.  This agreement establishes the terms and conditions under which this professional service provider shall be providing their professional expertise in the field of vision/eye disease related medical services to the children under the Webb County Head Start (EHS-CCP).  The annual fee amount schedule for the various medical/vision eye treatments to be provided are attached hereto as Exhibit “A”.  The term of this agreement shall be for a five year (5yr.) term commencing retroactively from September 1, 2022 thru August 31, 2027; and authorizing the County Judge to sign and execute all relevant documents, and any other matters incident thereto. 7.   Community Action Agency
 
a.   Discussion and possible action to approve the posting and filling of the following slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective January 23, 2023:

b.   Discussion and possible action to approve contract extension request to contract #58220003600 (“Contract”) for the Comprehensive Energy Assistance Program (CEAP) from the Texas Department of Housing and Community Affairs (TDHCA) for FY-2022 extending the contract from January 01, 2022 and February 28, 2023 and authorizing the County Judge to sign all relevant documents. Contract commenced on January 01, 2022 and will not have an impact to the General Fund. Documentation has been reviewed by Webb County Economic Development Department and is compliant with SPOC policies and procedures.

Issue: Approve CEAP contract extension request from Texas Department of Housing and Community Affairs (TDHCA) for the Program Year 2022.

Solution: The Court approval will allow the Webb County CAA to provide direct services to eligible low-income residents of Webb County under the CEAP Program.

Result: These funds are intended to assist qualifying clients with their home energy expenses.

9.   Economic Development
 
a.   Discussion and possible action to approve the submission of a grant application to the Office of the Governor Public Safety Office Criminal Justice Division for a County Innovations Grant estimated at Two Hundred Fifty Thousand Dollars ($250,000) over the term of the contract; approving a resolution for authorization of grant submission to the Office of the Governor. The Laredo/Webb County, Texas Emergency Network Diversion (TEND) Court Program will utilize this funding opportunity to prevent, investigate, and/or prosecute the commercial sexual exploitation of foster youth in Laredo/Webb County. This formal request shall authorize the County Judge to act as the County Executive Officer and Authorized Representative in all matters pertaining to the County's participation in this grant. There is no match requirement for this grant. All grant documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Contract Term: October 1, 2023, to September 30, 2024. [Requested by Child Protection Court, Selina L. Mireles, Associate Judge]

Issue: There is a need for resources to address the issue of sexual exploitation in our community. Persons who have suffered abuse in childhood or adolescence are susceptible to being sexually trafficked or exploited. There is a need to train the community and those involved in the criminal justice system on how to identify potential and current victims and stop the cycle of exploitation. The Office of the Governor of Texas has provided available resources through a grant opportunity to enhance awareness, intervention, and prevention of this serious issue.
 
Solution: Authorize the submission of the grant application as set forth above to ensure that the Laredo/Webb County, CPS, and Child Protection Court, may continue the Texas Emergency Network Diversion Court Program, a diversion program for potential and current victims of sexual exploitation.
 
Result: The Texas Emergency Network Diversion Program will be in compliance with SPOC, and with the submission rules and regulations set forth by the funding agency.

b.   Discussion with possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Adult Drug Court Program to the Office of the Governor, Public Safety Office, Criminal Justice Division Specialty Courts Grant Program, FY2024 in an amount not to exceed Three Hundred Thousand Dollars ($300,000) and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any kind of match; thus, will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the soliciation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Margarita Herrera-Garza, Director]

Issue: Enhance the capacity of the program’s availability of treatment services by integrating family–based therapy and interventions to qualifying participants that is also extended to their family members to receive family-based interventions and counseling.

Solution: Authorize the submission of the OOG for Specialty Courts Program for fiscal year 2024, year 2.

Result: The Webb County Adult Program will remain in compliance with the submission rules and regulations set forth by the funding agency.

c.   Discussion and possible action to approve 2022 TxCDBG Colonia Fund: Planning and Needs Assessment-Interlocal Cooperation Contract Between Zapata County and Webb County and Resolution required by Texas Department of Agriculture (TDA). Zapata County and Webb County agree to enter into this Interlocal Cooperation Contract as authorized by Texas Government Code, Chapter 791 (Interlocal Cooperation Act) and Texas Local Government Code, Chapter 262; and authorizing the County Judge to sign all relevant documents. This action will not have an impact to the General Fund. All required documents were sent for review to the Economic Development and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.

Issue: The Texas Secretary of State’s Office of Colonia Initiatives (OCI) has been dissolved and reports produced by the office in 2014 may no longer reflect the current needs of colonia communities.
 
Solution: Complete a new needs assessment of colonia communities to remain compliant with federal requirements in partnership between Zapata County and Webb County.
 
Result: The newly completed needs assessment will form the basis of the Colonia fund with all projects funded though the colonia set-aside expected to be supported by the 2022 planning document or subsequent updates.

d.   Discussion and possible action to authorize the development and submission of an application and Resolution of the Texas Department of Transportation (TX-DOT) FY 2023 Transportation Alternatives Set-Aside Program, in the amount of $1,344,000.00, and authorizing the County Judge to act as the County’s Executive Officer and Authorized Representative in all matters pertaining to the County’s participation in the program. There is no financial impact to the General Fund. All required documents were sent for review to the Economic Development and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.

Issue: Identified sidewalks located in different Colonia areas in Webb County are in need of repair and improvements.

Solution: The Texas Department of Transportation released applications for the 2023 Transportation Alternatives Set-Aside Program for bicyclist and pedestrian infrastructure.  

Result: If awarded, the funding will improve safety, access, and mobility for the residents of Webb County of all ages and abilities.

11.   Planning & Physical Development
 
a.   Discussion and possible action to issue a “Certificate of Compliance with Plat Requirements” to authorize an electrical service connection pursuant to Section 232.029(c)(2), Local Government Code., to an unplatted 1.96 acre tract of land, more or less, being part of Tract 38 & 39, La Presa Subdivision, located in Porcion 42, as described in Volume 3840, Pages 0161-0165 (ID 12417).
 
Issue: Item is a regulatory compliance issue regarding real property development provisions of state law and local regulations with particular emphasis on the Model Subdivision Rules enacted for residential subdivisions.  Commissioners Court must certify to certain property conditions before utility service connections may be authorized.
                
Solution: As reflected in agenda backup, staff has verified compliance matters and recommends the Court’s approval of this certificate.
 
Result: If approved, applicant may connect property to electrical utility services.  If not approved, utility connection to property is prohibited.

12.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

b.   Discussion and possible action to authorize the purchase of seventeen (17) Glocks Blue Label 45/26 Gen 5 - 9mm weapons from Primary Arms, LLC., in an amount not to exceed $7,325.48 and any other matters incident thereto. [Account #2202-3170-001-457006 (Constable Pct. 4 Federal Forfeiture - Law Enforcement - Other)]
 
Issue: Due to recent reports of accidental misfires without trigger being touched with the Sig Sauer P320 weapons, the Constable’s Office is recommending to replace current weapons with Glocks.      
 
Solution: Two price quotes were secured. Recommendation to purchase from low bidder.  
 
Result: New weapons will be purchased utilizing federal forfeiture funds. Order will be placed after Court approval. The Purchasing Agent and Constable for Pct. 4 will return to Commissioners Court at a later date with final recommended disposition of current weapons being replaced.

c.   Discussion and possible action to authorize the purchase of police equipment for two (2) 2023 Chevrolet Tahoe’s from Silsbee Ford (TIPs Contract No. 210907) for an amount not to exceed $52,235.76 pursuant to the Texas Local Government Code; Sections 271.101, 271.102, Sub-Chapter F. Issue: Webb County Volunteer Fire Department has identified the need of reliable firefighting apparatus to properly respond to emergency incidents.

Solution: Submission of FY 2022 Assistance to Firefighters Grant Program) Application to benefit the Webb County Volunteer Fire Department through the acquisition of personal protective equipment for firefighters.

Result: If awarded, the funding will provide well-equipped firefighters to respond safely to emergency incidents.

Issue: During the FY 2022-2023 Budget Process JP Pct. 1/Pl1 Office requested funding for the renovations to Courtroom, office and lobby area to include removal and replacement of Courtroom carpet, refurbishing all Courtroom pews, jury chairs, reconstruction of customer service windows, modifying the work area to create an open space concept and refurbishing customer lobby benches, to include all materials, labor, equipment and local building permits required to provide the requested scope of work.
 
Solution: Consideration to award to sole bidder, Romo Contractors, LLC.   
 
Result: If approved by Commissioners Court, proceed with notice of award and execution of contract subject to insurance and bonding requirements.

Issue: The following positions have been reviewed by the Wage Review Committee, and it was determined that the positions in question were not accurately reviewed by Segal back in 2019 causing an inability to fill the positions in the affected departments. CDL requirement listed in the job description plays a huge factor in the return results from Segal or any salary review company for that matter.

Solution: Approve the proposed changes discussed and approved by the committee.

Result: Ability for department to hire certified CDL drivers and certified mechanics necessary for the departments to function adequately.
