4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

6.   Civil Legal Division
 
a.   Discussion and possible action to enter into a One Month (May 30, 2023 through June 30, 2023) "Partnership Memorandum of Agreement" between the Laredo Independent School District ("LISD") and Webb County for the Development and Support of an Internship Program for LISD students in order to provide the students with meaningful county administrative work experience, and authorizing the Webb County Judge to execute all relevant document and any matter incident thereto. [No Financial Impact to Webb County]

Issue: Webb County offers a plethora of government services related to improving our community and by which LISD student interns will be afforded the opportunity for meaningful work experience with the county which may prepare them for positions in the fields of their selected program of study.

Solution: At no financial cost, Webb Count will provide sixteen (16) LISD interns with meaningful county administrative work experience.

Result: LISD interns will gain real life exposure to county government work.

b.   Discussion and possible action to enter into a professional services contract with Timothy J Tubbs for law enforcement consulting work, in accordance with Texas Local Government Code 262.024 (Discretionary Exemption) (a.) (4.) Professional Services for a performance period of Twelve (12) months at a cost of Eight Hundred Dollars ($800.00) per month, effective June 1, 2023 through May 31, 2024, for an amount not to exceed $9,600, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This professional services contract will be paid through forfeiture funds; and, thus, will have no impact to the general fund. [Requested by the Webb County Sheriff's Office, Account #2152-3010-001-432001 (Professional Services)]

Issue: The Webb County Sheriff's Office requires the services for specialized law enforcement training and Intel gathering.

Solution: Enter into contracted to Intel gathering and specialized training. 

Result: The Webb County Sheriff’s Office will receive specialized training for law enforcement personnel, provide support with ongoing and future investigations, provide recommendations on standard operating procedures, consult on Border Security issues and serve as an advisor/liaison with federal, state, and local law enforcement authorities, provide research and recommendations concerning US federal and state legislative issues.

c.   Discussion and possible action to approve a Professional Services Agreement between Webb County for the benefit of the TEND Court Program and Dr. Frances Bernat to provide research and evaluation for the Texas (Trafficking) Network Diversion (TEND) Court Program, Grant #4325002, commencing May 1, 2023, through September 30, 2024, subject to annual grant budgetary appropriations, in the amount not exceed Five Thousand Dollars ($5,000.00) for the 2023-2024 grant cycle; and authorizing the Webb County Judge to sign and all relevant documents, and any other matters incident thereto. Issue:
An evaluator is required to monitor, evaluate and measure the achievement of the program goals and gauge the effectiveness of the program.
 
Solution:
The Program evaluator will monitor the performance and compliance of the project with model fidelity to keep court personnel and all program staff aware of the program standards and issues. This includes preparing and submitting monthly and annual performance reports as required by the Grant.
 
Result:
The evaluator will ensure the program is in full compliance with grant requirements to meet goals and objectives for the success of the program.

d.   Discussion and possible action to approve a Professional Services Agreement between Webb County for the benefit of the TEND Court Program and Rhonda Kuykendall to provide training and counseling services for the Webb County Trafficking Emergency Network Diversion Program in an amount of $60 dollars/hr. under TEND Grant #4325002 commencing May 19, 2023, through May 31, 2024, subject to annual grant budgetary appropriations, and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. [Requested by Child Protection Court, Selina L. 8.   Community Action Agency
 
a.   Discussion and possible action to authorize the Webb County Community Action Agency to enter into an annual vendor agreement with Retail Energy providers (listed below) for the implementation of Community Services Block Grant (CSBG) and the Comprehensive Energy Assistance Program (CEAP). This vendor agreement is a Texas Department of Housing and Community Affairs (TDHCA) requirement for the implementation of the programs, authorizing the County Judge to sign all relevant documents and any other matters incident thereto. XOOM ENERGY

Issue: Webb County CAA will enter into an annual vendor agreement with Retail Energy Providers for the implementation of Community Services Block Grant (CSBG) and the Comprehensive Energy Assistance Program (CEAP).

Solution: These vendor agreements are a Texas Department of Housing and Community Affairs (TDHCA) requirement for the implementation of the programs.

Result: Texas Department of Housing and Community Affairs (TDHCA) will provide funding to be used for payment of qualifying low-income client’s home energy expense

b.   Discussion and possible action to approve Amendment #2 to Contract #58230003850 for the Comprehensive Energy Assistance Program (CEAP) from Texas Department of Housing and Community Affairs (TDHCA) for FY-2023, in the amount of FOUR HUNDRED SIXTY EIGHT THOUSAND TWENTY-ONE DOLLARS ($468,021.00) and authorizing the County Judge to sign all relevant documents. This Amendment #2 will increase funding from $1,773,871.00 to $2,242,892.00. This action will not have an impact to the General Fund.  All required documents were sent for review through Economic Development Department and the solicitation with Webb County Single Point of Contact (SPOC) procedures.

Issue: The Texas Department of Housing and Community Affairs (TDHCA) has increase contract to Webb County Community Action Agency the amount of $468,021.00 under the Comprehensive Energy Assistance Program (CEAP).

Solution: The Court approval will allow the Webb County CAA to provide direct services to eligible low-income residents of Webb County under the CEAP Program.

Result: These funds are intended to assist eligible Webb County residents with up to 12 months of energy consumption.

9.   Economic Development
 
a.   Discussion and possible action to approve the submission of a grant application as prepared and submitted by the Webb County Head Start and Early Head Start Program to the Department of Health and Human Services Administration for Children and Families for Fiscal Year 2023 - 2024 Refunding, Cost of Living Adjustment (COLA), and Quality Improvement (QI) grant in the amount of $12,551,420 (Federal) and $3,137,855 (Non-Federal) for a total amount of $15,689,275 for services to 1,290 eligible children and their families; and authorizing the Webb County Judge to execute all relevant documents related to this grant; and other matters thereto. Furthermore, this grant does not require a cash match; and thus will have no impact to the General Fund.  All required documents were sent to review through the Economic Development Department and the solicitation is compliant with the Webb County Point of Contact (SPOC) procedures. [Requested by Aliza Oliveros, Head Start Director] Click to View
 
b.   Discussion and possible action to approve the submission of a grant application as prepared and submitted by the Webb County Early Head Start Child Care Partnership Program to the Department of Health and Human Services Administration for Children and Families for Fiscal Year 2023 - 2024 Refunding, Cost of Living Adjustment (COLA), and Quality Improvement (QI) grant in the amount of $972,899 (Federal) and $243,225 (Non-Federal) for a total amount of $1,216,124 for services to 72 eligible children and their families; authorizing the Webb County Judge to execute all relevant documents related to this grant; and any other matters incident thereto.  Furthermore, this grant does not require a cash match; and thus will have no impact to the General Fund.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedure. [Requested by Aliza Oliveros, Head Start Director] Click to View
 
c.   Discussion and possible action to accept the award from Substance Abuse and Mental Health Administration (SAMHSA) Grant, #5H79TI081929-05, Year 5 Continuation grant, in the amount of FOUR HUNDRED THOUSAND DOLLARS ($400,000.00) beginning May 31, 2023, for the Webb County Veterans Treatment Program, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. There is no match required, therefore there is no financial impact to the general fund. All required documents were sent for review to the Economic Development Department and the acceptance of the Continuation grant is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Notice of Award was received by the Funding Agency on 5/17/2023, acceptance by Commissioners Court is required.
 
Solution: Accept award for the Webb County Veterans Treatment Program and proceed with continuity of co-occurring substance abuse treatment services to the Webb County Veteran population and adjacent counties.
 
Result: Funding in year 5 will be utilized to provide substance abuse and mental health services to all qualifying Veteran candidates.

10.   Head Start
Disclaimer: All Head Start monies are 100% Federal funds
 
a.   Discussion and possible action to approve the 2023 - 2024 Training and Technical Assistance Plan.

Issue: The Head Start / Early Head Start / Child Care Partnership Program is mandated to have a staffing plan that addresses staff qualifications, job descriptions, staffing levels, and linkage to education and training that will allow staff to advance through various roles with increasing levels of responsibility and comprehension.

Solution: Approve and implement the 2023 - 2024 Training and Technical Assistance Plan.

Result: The Program will have an approved plan in place  to address staff training and educational needs.

b.   Discussion and possible action to approve the Head Start, Early Head Start, and Child Care Partnership Local Self-Assessment and Program Improvement Plan based on the results of the 2022 - 2023 Local Self-Assessment.

Issue: The Head Start Program Performance Standards mandate an annual local self-assessment.

Solution: Review and approve the local self-assessment results and the Program Improvement Plan.

Result: The Program will be in compliance with effectively overseeing progress toward program goals on an on-going and annual basis.

c.   Discussion and possible action to approve the Head Start, Early Head Start, and Child Care Partnership 2023 Community Assessment Update.

Issue: In accordance with Head Start Program Performance Standards, determining community strengths, needs and resources, in order to design a program that meets community needs and builds on strengths and resources, a program must conduct a Community Assessment at least once over a five-year grant period with updates. The Community Assessment must use data that describes community strengths, needs, and resources.

Solution: Review and approve the 2023 Community Assessment Update

Result: The Program will be in compliance with Head Start Program Performance Standards.

d.   Discussion and possible action to approve the Head Start / Early Head Start / Child Care Partnership 2023 Strategic Plan Update.

Issue: Head Start programs are mandated to develop multi-year (long-range) programs goals and financial objectives that address the finding of the Community Assessment that are consistent with the philosophy of the program and reflects the findings of the program's annual Self-Assessment. 

Solution: Provide input, discussion, and feedback for program planning and approve the 2023 Strategic Plan Update.

Result: The Program will continue with on-going, systemic processes of program planning in consultation with program staff, parents, Policy Council, and Webb County Commissioners Court.

Solution: Request for approval to post and fill Slot #2615 Medical Death Investigator. Promote an employee to Slot #3003 Autopsy Technician and to fill the remaining vacant slots.

Result: By approving this will allow our department to promote from within and fill remaining vacant slots and will allow us to alleviate the overload for efficiency and productivity of the work within the Department.

12.   Planning & Physical Development
 
a.   Discussion and possible action to issue a “Certificate of Compliance with Plat Requirements” to authorize an electrical and water service connection pursuant to Section 232.029(c)(2), Local Government Code., to an unplatted 1.1519 acre tract of land, more or less, known as Tract 26, Los Corralitos Subdivision, as further described in Volume 5263, Pages 556-559, Webb County Deed Records.
 
Issue: Item is a regulatory compliance issue regarding real property development provisions of state law and local regulations with particular emphasis on the Model Subdivision Rules enacted for residential subdivisions. Commissioners Court must certify to certain property conditions before utility service connections may be authorized.
                
Solution: As reflected in agenda backup, staff has verified compliance matters and recommends the Court’s approval of this certificate.

Result: If approved, applicant may connect property to electrical and water utility services.  If not approved, utility connection to property is prohibited.

14.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

b.   Discussion and possible action to authorize the Purchasing Agent to advertise an Invitation to Bid for a 26’ Deck Low Bed Trailer – 3 axle with a self-contained hydraulic system and a Tractor Trailer with a winch for the Road and Bridge Department and any other matters incident thereto. [Account #2007-7150-001-470000 (Road & Bridge Fund - Road Maintenance General - Administration-Capital Outlay)]
 
Issue: Department has reported that reoccurring repairs are required for the aging low bed trailers and tractors currently being used (Model 2004’s, 1996 and 1985). Department is requesting new heavy equipment by securing competitive bids.
 
Solution: Authorize the Purchasing Agent to seek formal bids from the public and return with a recommendation to award to the lowest and responsible bidder. Based on budget availability, the Road and Bridge Director is seeking permission to purchase up to two (2) tractor-trailers w/low bed trailers and recommended equipment.      
 
Result: If approved, the Purchasing Agent will return to Commissioners Court with a recommendation on lowest bidder and availability/delivery of capital equipment during the first or second regular meetings of June 2023.

c.   Discussion and possible action to award Invitation to Bid 2023-005 Ballistic Shields for Webb County Sheriff to the lowest and best bid for the purchase of ballistic shields to be utilized by the Webb County Sheriff's Office for an amount not to exceed $285,740.00 from CCF Tactical, LLC., and any other matters incident thereto [2745-3010-001-470000 (Ballistic Shield Program 4582901-Sheriff Patrol-Administration-Capital Outlay)]
 
Issue: Current threats to schools and locations where public gatherings bring large amounts of people together require special and specific threat mitigation tools made and rated for rifle caliber assaults. More rifle rated shields are needed to cover the county effectively. On March 13th, 2023, Commissioners Court authorized the Purchasing Agent to advertise for formal bids.  Multiple bids were submitted and reviewed to determine best value bid.
 
Solution: Consideration to approve the award to the lowest and best bid submitted by CCF Tactical, LLC.  The Webb County Sheriff’s Office reviewed all bids and this bid is the best in value and meets all requirements for the ballistic shields they require for law enforcement tactical operations.
 
Result: Proceed with the Order and meet grant deadlines for completion of approved purchase under the Ballistic Shield Grant.

d.   Discussion and possible action to award Invitation to Bid 2023-006 "Commercial Panel Christmas Tree for Webb County" to the lowest bidder Downtown Decorations, Inc. for a 46 ft. Panel Christmas Tree with colored LED lamps to include a five (5) year warranty for an amount not to exceed $63,555.00 and any other matters incident thereto. [Account #1001-1130-001-470000 (General Operating Exp-Administration-Capital Outlay)] 
 
Issue: Commissioners Court authorized the Purchasing Agent to secure formal bids for a commercial sized Christmas Tree for Webb County Courthouse decorating.
 
Solution: Consider approval of lowest responsible bidder for selected commercial size panel tree for County use.
 
Result: Proceed with order if approved by Commissioners Court. Setup and storage will be provided by the Webb County Building Maintenance Department.

e.   Discussion and possible action to ratify the authorization to temporarily transfer one (1) 2012 Chevy Suburban (VIN #1GNSC5E05CR292421) previously approved for auction to be temporarily transferred to the Webb County Constable Pct. 3 Office pending the delivery of new police package vehicles (PPV) ordered through the leasing program and any other matters incident thereto. Issue: Constable Pct. 3 Office has reported multiple mechanical issues with existing fleet and requested a temporary vehicle to assist with daily law enforcement operations. 
 
Solution: Approve the authorization of the temporary transfer until new PPV arrive and old police units are turned over to the Purchasing Agent for future public auction as per Court’s formal action.
 
Result: If ratification is authorized, fixed asset records will reflect the temporary assignment to Constable Pct. 3 Office.  Department currently has both fuel and maintenance accounts to cover related expenses for their fleet.

19.   Discussion and possible action to authorize Raba Kistner Consultants, Inc. to proceed with Phase II – Design and Construction Phase Services (fees will be based on 6.75% of construction cost for the Webb County Justice Center Roof Project as per the Professional Services Contract dated August 23, 2022) and any other matters incident thereto; authorizing the County Judge to sign all relevant documents.

Issue: After many years the Justice Center has developed leaks in the roof which causes offices and courtrooms to have water damage anytime there is a substantial rain event. In August of 2022 the Court entered a contract which provided for an assessment of the roofs condition, recommendations regarding repair/replacement (Phase 1) and for design and construction administration services (Phase 2).  The assessment has been completed and reveals substantial repair and replacement of the building’s roof is necessary and the probable cost estimated by the Consultant is $4,403,000. The fees for the Consultant are based on construction contract on a sliding scale, the estimate of probable cost indicates the fee would likely be based on 6.75% of construction cost.

Solution: Authorize the Consultant to proceed so the Project can be designed and bid.

Result: Consultant can immediately begin designing construction plans for bid.

20.   Discussion and possible action to issue a letter of support in accordance with 25 TAC 157.11 to Acute Specialty Transport with notice to the Costal Bend Regional Advisor Counsel that Acute Special Transport is approved to operate in Webb County, Texas.

Issue: Coastal Bend has their offices in Webb County and advises they will be providing service on a State contract and statewide basis and will not be providing service in Webb County unless directed to by the State during an emergency. 

Solution: Issue a Letter of Support and Approve Acute Specialty Transport to operate in Webb County, Texas.

Result: Will have additional EMS services in Webb County, Texas.

24.   Discussion and possible action to approve Change Order No. 1 to Howland Engineering and Surveying Co., for additional construction material testing (Box Culverts) in the amount of $3,400.00 for the Webb County Welch Road Project; and have the County Judge sign any relevant documents; and any other matters incident thereto. Issue: We currently have exceeded the contract amount of $5,305.00 (Purchase Order 2023-00001293). This project required additional concrete sampling for the concrete culverts proposed for the project. Based on our observations, the concrete culverts were initially to be pre-cast as opposed to cast-in-place. Due to the aforementioned, concrete samples were taken for every day's pour. Additionally, extra density tests were taken within the backfill for the box culverts and the roadway improvements. Based on current progress with this project, we are still in need of performing additional tests. Howland has updated the CMT (Construction Material Testing) quantities with the cast in place culvert concrete cylinders along with additional density and asphalt tests.

Solution: Approval of the new proposed changes in order to finish and close this road project. This project is an in-kind project with the Texas Department of Transportation (TxDOT) for future projects.

Result: Approval of change order will continue and finish with project modifications.

25.   Discussion and possible action to approve Change Order No. 2 for SAL Construction Management for the County Transportation Infrastructure Fund (CTIF) Wormser Road Project. There will be no monetary change to the contract only the addition of Sixty (60) days to the contract; and have the County Judge sign any relevant documents; and any matters incident thereto. Issue: Days are needed to complete items previously approved in Commissioner Court dated April 11, 2023 (Agenda Item No. 17) which Project Engineer, Sherfey Engineering has just finished designing, as per the Texas Department of Transportation and the City of Laredo.

Solution: Approval of change order to finish and close out this road project.

Result: Approval of change order will continue and finish with project modifications.

Issue: On Monday, May 08, 2023, Commissioners Court approved the lease agreement for three (3) Ford Police Interceptors (Explorers).  APX Mobile Radios were not included in the initial after-market costs. These radios are purchased separately from Motorola and delivered to outfitter for installation.
 
Solution: Purchase APX 6500 mobile radios for law enforcement use, this model is same equipment ordered for all other police units assigned to Webb County law enforcement agencies. Installation will be done by CAP Fleet.
 
Result: New police package vehicles ordered will include the required mobile radios for law enforcement purposes.

Issue: The Purchasing Agent was authorized to solicit proposals for the upgrading of the Webb County Courthouse audio, video and broadcasting equipment including streaming services.  Project is being funded by the American Rescue Plan Act, State and Local Fiscal Recovery funds.
 
Solution: Consider approving the award to the highest ranking respondent for the equipment portion of this formal solicitation. Streaming services will be recommended to another vendor at the next regular court meeting.
 
Result: If approved, authorize General Counsel to execute the contract for awarded sum and optional support plans, if selected to include any federal provisions required, when applicable.
