Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

a.   Discussion and possible action to enter into a four (4) year (June 13, 2023 to June 13, 2027) Memorandum of Understanding (“MOU”) with Stay Kind to Minds (Stay Kind), where the Webb County Jail agrees to provide referrals to Stay Kind for males or females that are living with substance use disorders and struggling with mental health issues as a mutual benefit to the community at no cost over the term of the MOU. b.   Discussion and possible action to enter into an agreement with GenCore Candeo, Ltd. D/B/A The Genisis Group to provide highly technical software that manages and tracks bail bonds and is the sole source provider for this software. This software is grouped with the necessary component services pursuant to 262.024 (a) (7) Texas Local Government Code. (Sole Source - discretionary exemption). The agreement covers the cost for all services required for the implementation, processing of transactions, training, estimated fees, expenses, and annual maintenance subscription for the Webb County Jail electronic bonding software; and authorize Webb County Judge Tano Tijerina to sign all relevant documents; and any other matters incident thereto. c.   Discussion and possible action to approve an amendment to the CoreCivic Inter-Governmental Service Agreement (IGSA) 70CDCR18DIG000004 at the Webb County Detention Center in Laredo, TX, in order to incorporate Wage Determinations (WD) by the Department of Labor for positions not listed in WD 2015-5240. Said positions shall include reconformance of Assistant Shift Supervisor, Laundry Supervisor, Recreation Supervisor and Senior Detention Officer; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. d.   Discussion and possible action to approve a one-year agreement from (May 31, 2023 through May 30, 2024) between Webb County for the Veterans Treatment Court Program and La Familia Consulting and Counseling Services L.C. for professional services associated with Substance Abuse and Mental Health Services Administration (SAMHSA) Grant Award #5H79TI081929-05, funding Opportunity #5 H79 TI081929-05 at a cost of Three Thousand Dollars ($3,000.00) a month for a total cost not to exceed Thirty-Six Thousand Dollars ($36,000); and authorizing the County Judge to sign all relevant documents, and all other matters incident thereto. [Requested by Margarita H. Issue: The approval of the budget by the Commissioners Court is required in order to utilize the professional services of a counseling company for the treatment of Veterans.

Solution: The Commissioners Court approving the agreement.

Result: The Veterans Treatment Program will be able to continue to provide services and operate fully.

e.   Discussion and possible action to ratify a 12 month (May 31, 2023 through May 30, 2024) software agreement for the software and maintenance of the Drug Court Case Management Software Program (“DCCM”) for the Veteran’s Treatment Program for the fixed one-time fee of Seven Thousand Dollars ($7,000.00) and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. Issue: Software provides tracking of services and documents all case management and compliance of each participant in the program.

Solution: Authorize the payment for the software being utilized to track grant requirements.

Result: By obtaining the services of the (DDCM) satisfies key component of grant requirements.

f.   Discussion and possible action to ratify a one (1) year agreement beginning (May 31, 2023, through May 30, 2024) for professional services between Christina Garza and Webb County for the Veterans Treatment Program to provide mental health and drug and alcohol abuse treatment services at a biweekly cost not to exceed Three Thousand Three Hundred Sixty-Seven Dollars ($3,367.00) for a total cost not to exceed Eighty-Seven Thousand Five Hundred Forty-Two Dollars ($87,542.00) and authorizing the County Judge to sign and execute all relevant documents and any other matters incident thereto. [Requested by Margarita H. g.   Discussion and possible action to ratify a One (1) year renewal Professional Service agreement with Recovery Monitoring Solutions, to provide continuous alcohol monitoring, breath-alcohol testing and/or drug patch services for the Webb County Veterans Treatment Program commencing May 31, 2023, through May 30, 2024. 7.   Community Action Agency
 
a.   Discussion and possible action to approve Amendment #2 to 2023 Community Services Block Grant Program (CSBG) Contract #61230003814 by and between the Texas Department of Housing and Community Affairs (TDHCA) for FY-2023, in the amount of THREE HUNDRED THREE THOUSAND SIX HUNDRED NINETY-FIVE DOLLARS ($303,695.00) and authorizing the County judge to sign all relevant documents. This Amendment #2 will increase funding from $303,695 to $607,390.00. This action will not have an impact to the General Fund. All required documents were sent for review through Economic Development Department and the solicitation with Webb County Single Point of Contact (SPOC) procedures.

Issue: The Texas Department of Housing and Community Affairs (TDHCA) has increased Contract to Webb County under the CSBG Program. 

Solution: The Court approval will allow Webb County CAA to provide direct services to eligible low-income residents of the Webb County under the CSBG Program.

Result: These funds are intended to assist eligible low-income Webb County residents transition out of poverty.

8.   Economic Development
 
a.   Discussion and possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Sheriff's Office to the Office of the Governor Homeland Security Grants Division in the amount estimated at $3,000,000 for the FY 2024 Operation Lone Star (OLS) Grant Program for overtime/applicable fringe benefits, part-time/ temporary employees salary/fringe benefits, equipment/software, training/travel, and supplies; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires no match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Local law enforcement working in international border communities must work within limited budgetary constraints to provide both proactive and responsive law enforcement services while transborder criminal organizations possess unlimited funding to access the latest technology and equipment to avoid detection/disruption of their activities utilizing their proceeds obtained through illegal but highly lucrative drug trafficking and other unlawful enterprises.

Solution: Supplemental grant award to provide supplemental resources to assist in combating illegal drug trafficking and provide enhanced border security for the residents/citizens of Laredo/Webb County.

Result: The Webb County Sheriff’s Office and its sworn officer force will be equipped with needed additional resources.

b.   Discussion and possible action to approve to submit an application for the Emergency Food Grant in the amount of TEN THOUSAND DOLLARS ($10,000.00) from Emergency Food & Shelter Program (EFSP) Phase #40 American Rescue Plan Act (ARPA) and authorizing the County Judge to sign all relevant documents. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. There is no County Match and will not have an impact on the County's General Fund.

Issue: There is a greater demand for food assistance in the area of Webb County than there is funding.

Solution: By applying to the Emergency Food Grant provided by the Emergency Food and Shelter Program (Phase 40), Webb County Community Action Agency seeks to address the hunger needs of the community using partnership method with the local food banks.

Result: If awarded the grant, Webb County Community Action Agency will be able to assist eligible households with emergency food items.

c.   Discussion and possible action to submit FY 2023– 2024 Federal application 5311- 2023- WEBB CO- 00005 Rural Transit Grant for Webb County Community Action Agency - El Aguila to The Texas Department of Transportation (TxDOT) in the amount of FOUR HUNDRED EIGHTY-THREE THOUSAND SEVEN HUNDRED SEVENTY DOLLARS ($483,770.00). This grant includes a proposed County Match in the amount of FIFTEEN THOUSAND DOLLARS ($15,000.00). All required documentation has been submitted for review to the Economic Development Department and the solicitation is compliant with Webb County Single Point of Contact (SPOC) procedures. Issue: El Aguila is a grant funded agency. 

Solution: Application for Federal funds will benefit both administrative and operations expenses and allow continued transportation service to the rural areas of Webb County. 

Result: Continuation of services throughout the rural areas of Webb County.

d.   Discussion and possible action to authorize a change to the grant Authorized Representative (AR) for SAMHSA TI081929-05 from 341st Judicial District Court and authorizing the Webb County Judge, Tano E. Tijerina, as the sole Authorized Representative (AR) and authorizing the County Judge to act as the Chief Elected Official in all matters pertaining to the County's request. The change in grant AR does not require a change in the approved budget nor does it affect the general fund. All required documents were sent for review through the Economic Development Department and the request is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Tano E. Tijerina, County Judge]

Issue: A change in management administration is necessary for the above reference grant.

Solution: If approved, the request will allow official change to the grant account numbers.

Result: The Veterans Treatment Program will officially be under the purview of the Webb County Judge.

e.   Discussion and possible action to submit application for Project Grant Agreement STATE-R- 2023- WEBB CO - 00033 for Webb County Community Action Agency- El Aguila Rural Transportation from the Texas Department of Transportation (TxDOT) in the amount of THREE HUNDRED FIFTY-TWO THOUSAND ONE HUNDRED FIFTY-ONE DOLLARS ($352,151.00). This grant does not require a County Match. All required documentation has been submitted to the Economic Development Department for review and the solicitation is compliant with Webb County (SPOC) Single Point of Contact procedures. No Impact to the General Fund.

Issue: El Aguila Rural Transportation is a grant funded agency.

Solution: Application for State funds will benefit both operations and administrative expenses and allow for continued transportation services to the rural areas of Webb County.

Result: Continuation of services throughout the rural areas of Webb County.

f.   Discussion and possible action to authorize the acceptance of the renewal grant award and budget by the Texas Veterans Commission (TVC) to the 406th Judicial District Court, South Texas Veterans Treatment Court Program (VTP) in the amount of $300,000. The grant is effective July 1, 2023, and runs through June 30, 2024. This action authorizes the County Judge to sign and execute all relevant documents, and any other matters incident thereto. All required documents were sent to the Economic Development Department for review and were found to be in compliance with the Single Point of Contact (SPOC) policy. There is no matching funds required. [Requested by 406th Judicial District Court; Grant Fund #2872]

Issue: During the 2022-23 grant year, the VTP exceeded grant performance measures, as a result, the VTP was awarded a continuation grant by TVC. By accepting the award, the Commissioners Court would allow the 406th Judicial District Court Veterans Treatment Program to receive $300,000 to continue supporting veterans and their families.

Solution: The Commissioners Court authorizing the acceptance of the grant funds and approving the budget to support and enhance services offered by the 406th Judicial District Court Veterans Treatment Program to veterans involved in the judicial system, and which will allow for services to continue uninterrupted.

Result: Veterans in Webb and surrounding counties will benefit from services which may not be available without these funds, pursuant to §123.003.

g.   Discussion and possible action to allow the acceptance of a grant from the Texas Department of Transportation in the amount of $12,565.34 for the 2023 STEP - Operation Slowdown Campaign, effective July 11, 2023 and designate the Webb County Judge as the authorized official in all matters related to this grant, and any other matters incident thereto. This grant requires a 20% match totaling $2,570.34 for fringe benefits. All required documents will be sent for review to Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Mike Villarreal, Constable Pct. 2; Account #2183-3180-001-413000 (Forfeiture Funds)]

Issue: To increase effective enforcement and adjudication of traffic safety- related law to reduce fatal and serious injury crashes and public information and education effort during the Enforcement period.  

Solution: Constable Pct. 2 has been awarded a state grant so that for the first time it can join forces with other State and Local Law Enforcement Agencies to aggressively enforce the seat belt laws in Webb County.

Result: Webb County Constable Pct. 2 will be enforcing safety related and seat belt laws for the public safety.

10.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

12.   Discussion and possible action to authorize the Webb County Economic Development Department to develop and submit a 2024 Local Parks Non-Urban Outdoor Recreation application and resolution to the Texas Parks and Wildlife Department (TPWD) in the amount of $1,170,000.00 in which $585,000.00 will be in grant funds for the construction of aquatic recreation activities (splash pads) in Las Blancas Park, El Cenizo Activity Center (rear) and the Fred and Anita Bruni Community Center Park (Colonia Peñitas West); and authorizing the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in the 2024 TPWD Local Parks Non-Urban Outdoor Recreation Grant Program. If funded, this application will require a 50% cash match of $585,000.00. Total project cost shall be $1,170,000.
 
Issue: Las Blancas Park, El Cenizo Activity Center (rear) and the Fred and Anita Community Bruni Center Park (Colonia Peñitas West) do not have access to any aquatic recreational activities in their communities.
 
Solution: Webb County proposes to construct a first time aquatic recreational activity (splash pad) in Las Blancas Park, El Cenizo Activity Center (rear) and the Fred and Anita Bruni Community Center Park (Colonia Peñitas West), creating an aquatic recreational system in the County.
 
Result: Webb County proposed to apply for a 2024 Local Parks Non-Urban Outdoor Recreation Grant through the Texas Parks and Wildlife Department application to construct three splash pads in Las Blancas Park, El Cenizo Activity Center (rear) and the Fred and Anita Bruni Community Center Park (Colonia Peñitas West).

13.   Discussion and possible action to supplement the Fiscal Year 2023 Regional Solid Waste Grant Contract No. 23-19-02, originally budgeted for Sixty-Nine Thousand Two Hundred Seventy Four Dollars ($69,274.00) in grant funds, with up to Sixty Thousand Dollars ($60,000) from the General Fund to complete tire pickup activities in Precinct #1, Precinct #2 and Precinct #4 for a total project amount of One Hundred and Twenty-Nine Thousand Two Hundred and Seventy-Four Dollars ($129,274) and; authorizing the Webb County Judge to sign all pertinent contract funding supplement documentation, and any other matters incident thereto. The contract implementation schedule is projected to run from April 1, 2023 until July 31, 2023.  [Co-Sponsored by Commissioner Jesse Gonzalez, Pct. 1 and Commissioner Ricardo A. Issue: In May, 2023, Webb County staff commenced tire pickup activities in Precinct #2 including marketing, illegal tire dumping sites clean-up and establishing tire community collection sites. Throughout the month of May, 2023, Webb County staff encountered significantly higher participation and expenditure rates than as projected and experienced in past years. In June, 2023, tire pick-up activities commenced in Precinct #1 and the high levels of participation and expenditures continued. Therefore, grant funds were exhausted before Precinct #1 and Precinct #4 were completed.

Solution: To supplement the Fiscal Year 2023 Regional Solid Waste Grant Contract No. 23-19-02, in the amount of Sixty-Nine Thousand Two Hundred Seventy-Four Dollars ($69,274.00) in grant funds with up to Sixty Thousand Dollars ($60,000) from the General Fund to complete tire pickup activities in Precinct #1 and Precinct #4.

Result: In cooperation with Community Action Agency, the Webb County Building Department, the Webb County Sheriff’s Office and the Road & Bridge Department will complete the remaining tire pickup activities in Precinct #1 and #4.

14.   Discussion and possible action to approve Change Order No. 2 in the amount of $381,449.25 to Summit Building & Design for the Webb County Sheriff's Administration Office Remodeling Project; and have the County Judge sign any relevant documents and any other matters incident thereto. Issue: Installation is needed for future generator connections.

Solution: Extend 8 runs of 4" conduits to feed Automatic Transfer Switch, install a 7'x4'x2' box for splice connections, feeders from main disconnect to transfer switch and from transfer switch to main switch board.

Result: Ratify approval of change order to continue and finish with project modifications.

18.   Discussion and possible action to award Invitation to Bid 2023-005 Ballistic Shields to Body Armor Outlet, LLC., for the purchase of fifty-two (52) ballistic shields to be utilized by the Webb County Sheriff’s Office for an amount not to exceed $205,649.60 and any other matters incident thereto. [Account #2745-3010-001-470000 (Ballistic Shield Program 4582901-Sheriff Patrol-Administration-Capital Outlay)]
 

Issue: Current threats to schools and locations where public gatherings bring large amounts of people together require special and specific threat mitigation tools made and rated for rifle caliber assaults. More rifle rated shields are needed to cover the county effectively. On March 13th, 2023, Commissioners Court authorized the Purchasing Agent to advertise for formal bids.  Multiple bids were submitted and reviewed to determine best value bid. 
 
Solution: Consideration to approve the award to the lowest and best bid submitted by Body Armor Outlet, LLC.  The Webb County Sheriff’s Office and Purchasing Agent reviewed all bids and this bid is the best in value and meets all requirements for the ballistic shields they require for law enforcement tactical operations.
 
Result: Proceed with the Order and meet grant deadlines for completion of approved purchase under the Ballistic Shield Grant.

19.   Discussion and possible action to authorize the purchase of one (1) North Star hot water commercial washer trailer with two (2) wands - 4,000 PSI, 7.0 GPM, Kohler Engine, and a 525 gallon capacity from low bidder Northern Tool & Equipment for an amount not to exceed $16,999.99 and to further authorize the transfer of funds from the General Operating Reserve account (1001-1130-001-431007-010) in an amount not to exceed $17,000.00 to the Building Maintenance Capital Outlay account (1001-1100-001-470000) and any other matters incident thereto [1001-1100-001-470000 (General Fund-Building Maintenance-Administration-Capital Outlay)]

Issue: The downtown County owned buildings require pressure washing and outsourcing the work is not cost-effective.   Staff is requesting the purchase of one (1) pressure washer to be assigned to the Building Maintenance Department.

Solution: Four (4) informal bids were secured by the Purchasing Agent.  Recommendation to proceed with Northern Tool & Equipment, low bidder.  Estimated time of arrival after order, 3-5 business days.    

Result: If approved, the Purchasing Agent will order equipment after line item transfer is posted to GL accounts.  Equipment will be assigned to the Building Maintenance Department.

20.   Discussion and possible action to authorize the leasing of parking spaces at the county parking lot located at the corner of Washington and Convent St., designating the amount of parking spaces authorized to lease and approving the monthly rate and terms to be approved by the court; and any other matters incident thereto.

Issue: Individuals employed at federal building along with other agencies have expressed interest in purchasing “Memberships” or “Reserving” parking spaces at the Tex-Mex Parking Lot.
 
Solution: Reserve and offer no more than 15 parking spaces, first come basis, to individuals wanting to rent a parking space at Tex-Mex Parking Lot. Individuals will sign a 6 month parking contract with full payment ($600.00) due upon the execution of the contract at the Webb County Treasurer’s Office. (See Attached)
 
Result: Tex-Mex Parking Lot will be one step closer to full utilization. If all 15 spaces are contracted this will bring in $9,000.00 in revenue for Webb County.
