CALL TO ORDER BY THE HONORABLE TANO E. TIJERINA, WEBB COUNTY JUDGE

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

7.   Community Action Agency
 
a.   Discussion and possible action to approve the extension of FY 2022 Federal Rural Public Transportation Grant; 5311-2022-WC00082 from Texas Department of Transportation. The extension is from December 31, 2023, through May 31, 2024. No impact to General Fund. All required documentation has been submitted to the Economic Development Department and the solicitation is compliant with Webb County (SPOC) Single Point Contact Procedures.


Issue: Rural Public Transportation contract Fed 2022 5311-202-WC-00082 ends in December 31, 2023

Solution: Through the extension by Texas Department of Transportation through May 31, 2024, will allow department to exhaust funds. 
 
Result: Approval of contract extension will ensure continuation of transportation services to the rural areas of Webb County.

b.   Discussion and possible action to approve the posting and filling of the following Full-Time Slot position with benefits, to be funded from the Community Services Block Grant (CSBG) Account #2368-5170-521-410000. This position will be 100% grant funded and there will be no impact to the General Fund.

8.   Honorable Marco Montemayor, County Attorney
 
a.   Discussion and possible action to authorize the reclassification of Slot #2084 from Assistant County Attorney to Assistant County Attorney II. and any other matters incident thereto.

Issue: The County Attorney's Office is currently short-staffed and in need to fill this position.

Solution: The reclassification of slot 2084 currently classified as Assistant County Attorney, Grade 22 position to Assistant County Attorney II, Grade 23 position will resolve the issue above.

Result: The Webb County Attorney's Office will be able to obtain a larger pool of applicant.

b.   Discussion and possible action to enter into a Memorandum of Understanding between Webb County (for the benefit of the Webb County Attorney's Office) and Local HIDTA Task Force agreement with United States Department of Justice, Drug Enforcement Administration for the period of one year (June 01, 2022 to September 30, 2023 being FY 2023) and authorizing the Webb County Judge to sign all relevant documents and any matters incident thereof.

Issue: Collaboration between Federal, State and Local law enforcement agencies is necessary to combat criminal organizations.

Solution: Through the collaboration of the multi-agency operation of the Drug Enforcement Administration, the task force can continue to supplement other state and local law enforcement agencies to conduct international drug investigations, covert surveillance operations and dismantle drug trafficking organizations.

Result: Disruption of organized criminal activity in Webb County.

9.   Economic Development
 
a.   Discussion and possible action to accept and execute award FY 2023-2024 Federal Grant 5311-2023 -WEBB CO- 00005 and enter into agreement with the Texas Department of Transportation (TXDOT) for Webb County Community Action Agency - El Aguila Rural Transportation in the amount of FOUR HUNDRED EIGHTY-THREE THOUSAND SEVEN HUNDRED SEVENTY DOLLARS ($483,770.00). Requires a county match in the amount of FIFTEEN THOUSAND DOLLARS ($15,000). All required documentation has been submitted to the Economic Development Department for review and the solicitation is compliant with Webb County (SPOC) Single Point of Contact procedures. [Account #2661-5150-337800 (Revenue Matching Funds)] 

Issue: El Aguila rural transportation is grant funded agency. 

Solution: Acceptance and execution of funds will benefit both operating and administrative and allow for continued transportation services. 

Result: Continuation of services throughout the rural areas of Webb County.

b.   Discussion and possible action to accept and execute award FY 2023 STATE -R-2023 -WEBB CO- 00033 and enter into agreement with the Texas Department of Transportation (TXDOT) for Webb County Community Action Agency- El Aguila Rural Transportation in the amount of THREE HUNDRED FIFTY-TWO THOUSAND ONE HUNDRED FIFTY-ONE DOLLARS ($352,151.00). No county match required. All required documentation has been submitted to the Economic Development Department for review and the solicitation is compliant with Webb County (SPOC) Single Point of Contact procedures.

Issue: El Aguila rural transportation is grant funded agency. 

Solution: Acceptance and execution of STATE funds will benefit both operating and administrative expenses and allow for continued transportation services. 

Result: Continuation of services throughout the rural areas of Webb County.

c.   Discussion and possible action to approve Amendment No. 1 for ARPANGO-0008 Imaginarium of South Texas in the amount of $19,762.92. Imaginarium of South Texas is requesting a change to the Performance Statement in their contract to assist in the mission in tutoring services to elementary students who are struggling in math and science. This action will not have an impact to the General Fund. Documentation has been reviewed by Webb County Economic Development Department and is compliant with SPOC policies and procedures.

Issue: Imaginarium of South Texas will not be expending $19,762.92 (Supplies/Materials: $4,332.82, Equipment: $15,430.10) for remainder of contract. 

Solution: Transfer $19,762.92 (Supplies/Materials: $4,332.82, Equipment: $15,430.10) for remainder of contract to Salaries for tutors. 

Result: Elementary students who are struggling in math and science will benefit.

d.   Discussion and possible action to award and enter into agreement with the South Texas Food Bank for the Non-Governmental Organizations ARPA Sub-Award in the amount of $200,000.00; authorizing the County Judge to sign all relevant documents; and any other matters thereto. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. No impact to the general fund.
 
Issue: NGO ARPA has funds available from deobligated funds from other awards.   
 
Solution: To approve award and enter into agreement with the South Texas Food Bank.

Result: NGO ARPA funds will allow to supplement South Texas Food Bank’s purchase and distribution of food.

e.   Discussion and possible action to authorize the submission of a FY 2023 Justice Assistance Grant application to the Bureau of Justice Assistance (BJA) as prepared, coordinated, written, and submitted by the Webb County Sheriff’s Office Grant Writer in conjunction with the City of Laredo for equipment, minor tools, services, training/travel, and supplies for a total amount estimated at $34,693 and authorizing the Webb County Judge to execute all relevant documents related to this grant; and any other matters incident thereto. This grant has no match requirements; and, thus, is at no cost to the general fund.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Supplemental equipment and supplies will allow the Webb County Sheriff’s Office to provide better and more enhanced law enforcement services.

Solution: Grant application to allow for the leveraging of federal grant JAG funds in order to provide supplemental equipment/supplies for the Webb County Sheriff’s Office.

 Result: The Webb County Sheriff’s Office and its staff will be equipped with needed equipment and supplies.

f.   Discussion and possible action to authorize the development and submission of an application and Resolution for continuation of the Office of the Governor Homeland Security Grants Division FY 2024 Operation Lone Star Grant Program (OLS), in the amount up to $1,000,000.00, and authorizing the County Judge to act as the County’s Executive Officer and Authorized Representative in all matters pertaining to the County’s participation in the program. There is no financial impact to the General Fund. All required documents were sent for review to the Economic Development and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.

Issue: There is an unprecedented crisis at our border, dealing with a sharp increase in drug trafficking, human smuggling and weapons. This situation gives way for the need to request additional resources to deter this criminal activity.

Solution: Accept the grant award to provide supplemental resources to assist in combating this illicit criminal activity.

Result: Webb County will have additional resources to deter and interdict criminal activity and to assist in the execution of border security.

a.   Discussion and possible action to approve an Audio-Visual Streaming Equipment System Service Contract with Granicus, LLC. to provide broadcast streaming services of County Commissioner meetings which includes Hardware, Licenses, Setup, and three (3) year Support in an amount not to exceed TWENTY-FIVE THOUSAND SEVEN HUNDRED TWENTY-EIGHT DOLLARS SEVENTY-SIX CENTS ($25,728.76), authorizing the County Judge to execute all relevant documents and any other matters incident thereto. Issue: Commissioners Court seeks to upgrade its broadcast streaming services of its courtroom meetings.

Solution: Request for Proposals were solicited by the Webb County Purchasing Agent for said broadcasting streaming services of Commissioners Court meetings.

Result: At the June 12th Commissioners Court Meeting, the Commissioners Court approved to award Granicus, LLC. the Project (broadcasting streaming services).

14.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

b.   Discussion and possible action to ratify the approval to purchase three (3) AXIS Q8752-E Zoom 30 FPS Outdoor PTZ Bi-spectral Cameras from Turn-Key Mobile, Inc. (OMNIA/National IPA Cooperative Contract No. 226017-02) for an amount not to exceed $62,442.00 for the Webb County Sheriff’s Office pursuant to the Texas Local Government Code; Sections 271.101, 271.102, Sub-Chapter F. Cooperative Purchasing Programs and any other matters incident thereto. [Account #2475-3010-001-470000 (Sheriff - Operation Lone Star -Sheriff Patrol-Administration-Capital Outlay)]
 
Issue: The Sheriff’s Office is utilizing Operation Loan Star grant funds to purchase three outdoor PTZ cameras with capability to detect persons as far as 3 km with electronic image stabilization and thermal detection for border surveillance.  Border security operations need the latest technology to combat drug and human trafficking, these cameras will enable the Sheriff’s Office to upgrade current surveillance technology in order to enhance public safety.
 
Solution: Due to grant deadlines, the Purchasing Agent approved the order using Operation Loan Star grant funds.  Although vendor has a cooperative contract, it has always been the Purchasing Agent’s practice to bring all purchases under a cooperative contract exceeding $50,000.00 to Commissioners Court. 
 
Result: Secure approval on ratification of grant purchase in order to meet OLS grant deadline and secure equipment due to limited availability of specialized camera equipment for border security.

c.   Discussion and possible action to ratify the approval to purchase twenty-one (21) Generation 3/Level 1 – White Phosphor Night Vision Monocular(s) from B&H Photo Video (OMNIA Cooperative Contract No. R201202) for an amount not to exceed $59,379.00 for the Webb County Sheriff’s Office pursuant to the Texas Local Government Code; Sections 271.101, 271.102, Sub-Chapter F. Cooperative Purchasing Programs and any other matters incident thereto. [Account #2475-3010-001-460105-015 (Sheriff - Operation Lone Star -Sheriff Patrol-Administration-Minor Tools & Apparatus-Equipment)]
 
Issue: The Webb County Sheriff’s Office Deputies working Operation Lone Star need the ability to effectively monitor and operate in the dark of night, this equipment will afford the deputies that ability.  Enhancing the safety of Deputy(s) and the public in general.
 
Solution: Due to grant deadlines, the Purchasing Agent approved the order using Operation Loan Star grant funds.  Although vendor has a cooperative contract, it has always been the Purchasing Agent’s practice to bring all purchases under a cooperative contract exceeding $50,000.00 to Commissioners Court. 
 
Result: Secure approval on ratification of grant purchase in order to meet OLS grant deadline and secure equipment due to limited availability of specialized night vision equipment for approved border security operations.

d.   Discussion and possible action to authorize the Purchasing Agent to solicit Request for Proposals (RFP's) for a three (3) year Fuel and Lubricant Service Agreement in accordance with the Texas Local Government Code; Section 262.030 (Alternative Competitive Proposal Procedures for Certain Goods and Services) and any other matters incident thereto.
 
Issue: The Purchasing Agent is recommending to secure a longer service agreement term for the delivery of fuel and lubricants to the Road and Bride Department and participating County departments. 
 
Solution: Authorize the Purchasing Agent to solicit for formal proposals in accordance with the Texas Local Government Code; §262.030 in order to rank potential respondents to include best and final offers if applicable from all respondents.
 
Result: Return to Commissioners Court for their consideration to award best value proposal for the requested services for a term of thirty-six (36) months.

16.   Honorable Patricia Barrera, Tax-Assessor- Collector
 
a.   Discussion and possible action to approve the annual payment for memberships dues for four TAAO Membership, the membership dues are in the amount of $90.00 Dollars each totaling $360.00. [Account #1001-1320-001-464010 - (Dues & Memberships)]

Issue: To better serve our employees must be trained and updated on the most current Tax Issues.

Solution: Memberships enables the Webb County Tax Office to train our staff accordingly.

Result: Our employees will be able to get the most updated resources from TAOO and assist our customers better.

b.   Discussion and possible action to enter into a Three (3) year (July 24, 2023 - July 23, 2026) Car Dealer Subcontractor Contract, on behalf of the Webb County Tax Assessor with Powatoy of Laredo to authorize Powatoy of Laredo to act as an agent of the Tax Assessor-Collector in the issuance of Motor Vehicle registration license validation stickers and license plates, and in the application for vehicle titles and any matters incident thereto; authorizing the County Judge to sign all relevant documents. There will be no impact to the General Fund.

Issue: The state motor department requires that we have a contract with all subcontractor and all franchise motor vehicle dealers.

Solution: Commissioners court authorization to renew contracts.

Result: To be in compliance with the Texas Department of Motor Vehicle requirements.

Issue: Webb County approved the grant funds awarded through the Texas Department of Housing and Community Affairs Office of Colonia Initiatives (TDHCA-OCI) Contract No. 7220013.  The purpose of the grant funds is to rehabilitate one (1) single family, owner occupied unit (7523 Kay Bailey, Laredo, Texas).  The targeted area is the Colonia of San Carlos II.  In part, the purpose of the assistance is to provide a decent, safe, and sanitary housing environment for residents in compliance with all Model Subdivision Rules (MSR) and Texas Minimum Construction Standards.
 
Solution: Award to sole bidder, Midas Contractors LLC., and authorize the execution of construction contract.
 
Result: Proceed with execution of contract and notice to proceed once all the insurance and bonding requirements are submitted.

Issue:
Current threats to schools and locations where public gatherings bring large amounts of people together require special and specific threat mitigation tools made and rated for rifle caliber assaults.  More rifle rated shields are needed to cover the County effectively.  Recently, the Webb County Sheriff’s Office (WCSO) requested a no cost amendment to the Ballistic Shield Grant Program.  The low bid previously awarded left substantial savings in the grant allowing the WCSO to request the use of remaining funds to purchase an additional twenty (20) ballistic shields.   
 
Solution: Consideration to authorize the purchase of additional ballistic shields for law enforcement use.  The Purchasing Agent is recommending the use of vendor's cooperative contract in order to meet the competitive bidding requirements of the State and to further meet the deadlines of grant close out and lead time on production of shields.   
 
Result: Proceed with the Order and meet grant deadlines for completion of approved purchase under the Ballistic Shield Grant.
