4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. 6.   Civil Legal Division
 
a.   Discussion and possible action to readopt the Title VI 1964 Civil Rights Plan (Title VI) for year 2023 as required by the federal government. The submittal and re-adoption of the Title VI Plan incorporates a Limited English Proficiency Plan (LEP) into the Federal Transit Administration (FTA) Region Office; This Title VI plan has and/or shall be presented for review and approval by the Webb County CAA Advisory Board and Texas Department of Transportation. [Requested by Roberto Martinez, Director Webb County El-Aguila Rural Transportation Dept. There will be no impact to the General Fund]

Issue: FTA requires that every three (3) years transit systems receiving federal financial assistance to update their Title VI Plan (LEP included) in the form of a revised Title VI circular to grant recipients, which requires careful evaluation of the impact of proposed services and fare changes on minority riders.

Solution: Obtain approval and re-adoption of the Title VI requirements by the respective designated board/court, and submit the newly re-adopted Title VI Program/LEP Plan to FTA to continue grant funding for El Aguila.

Result: Compliance with FTA with proper documentation fully executed with approvals that secures grant funding for the next three years.

b.   Discussion and possible action to enter into a One (1) year (September 1, 2023 through August 31, 2024) non-financial senior job skills training program agreement by and between Webb County (“Host Agency”) and AARP Foundation Senior Community Service Employment Agency Program, to provide job training to senior citizen volunteers at NO COST to Webb County, and authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto. [Requested by Dr. Pedro Alfaro, Webb County Risk Management Administrator] Click to View

d.   Discussion and possible action to enter into a Memorandum of Understanding with Texas A&M International for an internship program to promote quality public administration education and training for Criminal Justice and Sociology majors for the term beginning August 1, 2023 and ending May 31, 2024 and authorizing the County Judge to sign all relevant documents. Issue
: Webb County provides law enforcement and various social services to county residents by which student interns will be afforded the opportunity for meaningful work experience with the county which may prepare them for positions in the fields fo their selected program of study.

Result: Texas A&M International intern will gain meaningful work experience in their field of study. 

Solution: At no financial cost, Webb County will provide Texas A&M International interns with meaningful county administrative work experience.

e.   Discussion and possible action to enter into a Two (2) year (September 1, 2023 through August 31, 2025) Non-financial Inter-local Agreement for E9-1-1 Public Safety Answering Point Services with the City of Laredo as administrator for South Texas Development Council (STDC) which is a regional planning commission. Webb County is a local government that operates Public Answering Points (PSAP) and assists in implementing the strategic plan as approved by the commission, there will not be an impact on the county budget, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. j.   Discussion and possible action to enter into amendment no. 1 between Webb County and Anderson-Columbia, Co., Inc., for the Pueblo Nuevo Street Improvement Project to amend Section 30 entitled “Exhibits” by adding the Section 3 contractual provisions to allow for Economic Opportunities for Section 3 Residents and Section 3 Business Concerns to subsection “Exhibit No. 7” entitled “Federal Requirements”, making this Contract subject to the requirements of section 3 of the Housing and Urban Development (HUD) Act of 1968, as amended, 12 U.S.C. 1701u (section 3). The purpose of section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing.  The parties to this Contract agree to comply with HUD's regulations in 24 CFR part 75, which implement section 3, as evidenced by their execution of this Contract.  Authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. 7.   Community Action Agency
 
a.   Discussion and possible action to authorize the release the ten percent (10%) retainage payment in the amount of $9,777.94 to Clayton Homes for a manufactured home purchased under the Self-Help Center Grant Program and authorizing the County Judge to sign any relevant documents and any other matters incident thereto.  [Account #2529-206000]

Issue: Commissioners Court approval is required in order to release final retainer payment.

Solution: Place Agenda Item in order to obtain Commissioners Court approval to authorize this payment.

Result: Clayton Homes will receive payment for services rendered.

8.   Economic Development
 
a.   Discussion and possible action to ratify the submission and authorize the Webb County Commissioners Court to approve a Resolution for the submission of a grant proposal to the Texas Department of Housing and Community Affairs, Office of Colonia Initiatives for the Self Help Center Grant Program for funding in an amount not to exceed $800,000 and authorizing the County Judge to sign all relevant contract documents and any other matters incident thereto. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.

Issue: Additional funds are available through the Texas Department of Housing and Community Affairs.  A proposal was required to be submitted by July, 27, 2023 in order to request the available funds.  A Resolution is required from the Commissioner's Court in addition to the proposal.
  
Solution: Obtain Commissioners Court authorization to Ratify the grant submission and issue the Resolution.

c.   Discussion and possible action to authorize the resolution and submission of a grant application as developed, written, and submitted by the Webb County Sheriff's Office in collaboration with Economic Development and other Webb County Dept./Offices to the Office of the Governor Homeland Security Grants Division in the amount estimated at $3,800,000 for the Sheriff's Office and up to $1,500,000 for the other Webb County Offices for a total of an estimated $5,300,000 for the FY 2024 Operation Lone Star (OLS) Grant Program. The Sheriff’s Office portion requests grant funding for overtime operations/applicable fringe benefits, equipment/minor tools/software/internet, and supplies while the other Webb County offices/depts.are requesting funding for personnel and overtime; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires no match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Local law enforcement working in international border communities must work within limited budgetary constraints to provide both proactive and responsive law enforcement services while transborder criminal organizations possess unlimited funding to access the latest technology and equipment to avoid detection/disruption of their activities utilizing their proceeds obtained through illegal but highly lucrative drug trafficking and other unlawful enterprises.

Solution: Supplemental grant award to provide supplemental resources to assist in combating illegal drug trafficking and provide enhanced border security for the residents/citizens of Laredo/Webb County.

Result: The Webb County Sheriff’s Office and its sworn officer force will be equipped with needed additional resources.

10.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

b.   Discussion and possible action to authorize a Thirty-Seven (37) month storage rental agreement between Webb County and Portabull Storage, LLC., for one (1) ground level refrigerated 40’ container for the Webb County Medical Examiner at a rate not to exceed $825.00 per month effective September 1, 2023, through September 30, 2026, and any other matters incident thereto [Account #1001-3100-001-444500 (General Fund-Medical Examiner-Administration-Equipment Rental)]   
 
Issue: The existing 40’ refrigerated container has had reoccurring issues that have become very costly for the Medical Examiner department, unit is currently out of service.  Thermo King warranty representatives have been non-responsive and have in the past refused to provide service/inspection to unit.
 
Solution: Lease a 40’ refrigerated container which will include a tracking device for company to remotely identify temperature fluctuations and system errors, 24/7 service department to monitor temperatures, and Portabull will take care of all service and maintenance if there are any performance issues.       
 
Result: If approved, replace existing unit with a new leased unit that will eliminate costly repairs, downtime and continue to maintain the storage requirements of the Medical Examiner without interruption.

c.   Discussion and possible action to authorize the Purchasing Agent to advertise for formal Request for Proposals for Cloud based file management and application software for the Webb County Planning Department pursuant to the Texas Local Government Code; Sec. 262.030.  Alternative Competitive Proposal Procedure for Certain Goods and Services and any other matters incident thereto.
 
Issue: Cloud based file management and application software needed in order to streamline and improve/modernize application submittal, payment, inspection, review and approval process for public services provided by the Webb County Planning Department, including, but not limited to floodplain determination & development permits, public water & sewer, OSSF, electrical services, platting and investigation of environmental complaints. 
 
Solution: Authorize the Purchasing Agent to seek competitive proposals in accordance with the Texas Local Government Code; §262.030.  Alternative Competitive Proposal Procedure for Certain Goods and Services.
 
Result: Proceed with a formal advertisement to secure proposals for scope of work being requested by the Planning department. Return to Commissioners Court with a recommendation for award at a future scheduled public meeting.

Solution: Approval of the applicable payroll costs and fringe associated with the two (2) HITDA investigators assigned to the Laredo Police Department Task Force.

Result: The Webb County Sheriff's Office will continue to employ two (2) HIDTA funded investigators who will actively participate and help the task force fight against the continued flow of illicit drugs and related crime within the South Texas region.

Solution: Authorize the Purchasing Agent to seek competitive sealed bids pursuant to the Local Government Code for this project.

24.   Discussion and possible action to approve a non-financial Driver’s Education Services, and E-Driving Online enrollment support agreement between Webb County and Region One/E-Driving Course.com, LLC, d/b/a Driving Quest (hereinafter referred to as “Driving Quest”), to enable Webb County teens, students and adults to enroll online, and take the driving course required to obtain a valid Texas Driver’s License; and authorizing the Webb County Judge to sign any and all relevant documents and any other matters incident thereto. Issue: From the period of 01/01/2019 to 01/25/2023, JP 2-1 has a total of 5,307 citations issued for driving without a driver’s license.  Webb County has seen dramatic increase in the number of citations issued to young students and adults for Driving without a valid Texas Driver’s License. Texas Dept. of Licensing and Regulation has provided grant funding to Region One in order to provide Driver’s Education Services and E-Driving Online Courses at a reduced cost from traditional driving school Programs in order to combat this growing threat to the motoring public and overall public safety in Webb County. Region One as the Driver Education and E-Driving On-Line Services provider will use One-Time marketing initiatives to provide notice out to these individuals about the program and the reduced costs and possible time requirements that shall be paid for by Region One. Judge Quintana seeks permission and authority from the Commissioner’s Court to release names and address to Region One for a mass marketing mail out about this pilot program available to them.
 
Solution: Approve the execution of the agreement to enable students and adults to sign up for and pay and/or obtain financial support to take Driver’s Education Services, and E-Driving Online Courses with help and assistance from the staff from the Webb County Justice of the Peace Pct. 2, Place 1, Courthouse. The Court will be providing a designated computer/sign-up area for the Court approved students, defendants, participants and/or the general public to enroll in the Driver’s Education Courses as directed by Court Order, the Justice of the Peace or the Court as a required condition for the successful completion of probation, deferred adjudication, reduced fines, etc. assessed by the Court.
 
Result: Judge Quintana, being among the first Texas Justice of the Peace Courthouses in Texas to implement this pilot program to provide driver education services to our youth hopes to have a lasting and positive public impact on our community, reach our goal to increase driver and pedestrian safety in Webb County, Texas, and to have this pilot program implemented by other Justice of the
Peace Courts and Municipal Courts in the surrounding South Texas border areas. Webb County will hopefully see a dramatic increase in the number of students and adults who will be participating in these Driver’s Education Courses and obtain a valid Texas Driver’s License, and in return a dramatic reduction in the number of citations issued to young adults and adults for Driving without a valid Texas Driver’s License by Webb County and Laredo Law Enforcement Officers by approving the agreement and approve the mass mail out notice about this program in order to help us to kick start the program.

29.   Discussion and possible action to approve a burn ban Order for a maximum of Ninety (90) days of all outdoor burning in all the unincorporated areas of Webb County commencing August 14, 2023 pursuant to Local Government Code §352.081 and other applicable statutes, a violation of this Order is a Class C misdemeanor, punishable by a fine not to exceed $500.00; and any other matters incident thereto.


 
Issue: The current Keetch-Byram Drought Index (KBDI) average for Webb County is high and may reach a maximum of 733 within the next fourteen days. (KBDI scale ranges from 0-800 with 800 representing extremely dry conditions) These conditions create a high risk of wildfires with danger to damage life and property.
 
Solution: Order an immediate burn ban for a maximum of 60 days (or until conditions are considered safe) to be enforced by the Sheriff’s Office to discourage outdoor burning in order to prevent spread of wildfires and loss of life and property.
 
Result: Discourage citizens from outdoor burning in the unincorporated areas of Webb County in order to prevent wildfires and enforce a fine of up to $500 by the Sheriff’s Office for those citizens that do not abide by burn ban.
