Discussion and possible action to approve the execution of a twenty-four (24) month building lease contract effective October 1, 2023 and ending September 30, 2025 between Webb County and McPherson Plaza, LTD, for approximately 3,000 square feet of building space located at 5711 McPherson Road for the purpose of continuing the housing of the Webb County Sheriff’s Safe Haven program for a total rental amount not to exceed $151,296 and authorizing the Webb County Judge to execute any and all relevant documents; and any other matters incident thereto. [DOJ Grant #2018-FJ-AX-0007; Account #2611-1150-001-444100 (Space Rental OVW Justice for Families Program)]

Issue: The Sheriff’s Office has secured additional grant funds to continue supporting the Safe Haven Program.  Grant funds are allocated for space rental expenditures that will cover a fixed lease for 24 months to expire 09/30/2025.  Subject to approval by Commissioners Court.  
 
Solution: Execute the space rental lease for 24 months to expire September 30, 2025.  Current lease extension expires 09/30/2023.  
 
Result: The Sheriff’s Office will be able to continue operations from current location, where the current facility provides a safe environment for visitation for custodial and non-custodial clients.  Space rental expenditures are covered 100% from grant funds.
Background:
In the past, after soliciting a number of sources, competition is determined inadequate.  The Purchasing Agent has solicited for qualified proposals twice in prior years and none of the properties inspected met the GRANTORs requirements.  Additional City owned properties were also inspected and did not meet the requirements of the Safe Haven program.
 
Under DOJ guidelines, it allows a non-competitive process to take place.  The existing lease area located on 5711 McPherson Road meets those minimum standards of Grantor and the Webb County Purchasing Agent’s recommendation is to continue leasing existing space through September 30, 2025.   After lease expires, the Safe Haven operation will be transferred to the new Sheriff’s Administrative building formally known as the downtown HEB building.  
 
Previous Court Action:
On September 12th, 2022, Commissioners Court authorized a one year lease extension for space rental located at 5711 McPherson Road to terminate 09/30/2023 between Webb County and McPherson Plaza, LTD.
