4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: An evaluator is required to monitor, evaluate and measure the achievement of the program goals and gauge the effectiveness of the program.
 
Solution: The Program evaluator will monitor the performance and compliance of the project with model fidelity to keep court personnel and all program staff aware of the program standards and issues. This includes preparing and submitting quarterly, and annual performance reports as required by the Grant.
 
Result: The evaluator will ensure the program is in full compliance with grant requirements to meet goals and objectives for the success of the program.

a.   Discussion and possible action to approve the acceptance of overtime and fringe benefits of the grant funded State and Local Overtime and Authorized Expense/Strategic Initiative Program under the Organized Crime Drug Enforcement Task Force.  OCDETF will cover $20,708.00 in overtime from Fund Source 2602.  Also, to increase fringe benefits accounts of $4,827.00 by Constable Pct.4 State Forfeiture Fund #2201 to cover fringe benefits, therefore no impact to the General Fund.

9.   Economic Development
 
a.   Discussion and possible action to authorize Webb County Economic Development Department to develop and submit a FEMA Hazard Mitigation Grant Program (HMGP) DR-4705 application for the development of a Webb County Hazard Mitigation Plan, not to exceed $500,000.00; and authorizing the County Judge to act as the Authorized Representative in all matters pertaining to the County's request for HMGP funding. This application requires a $125,000.00 cash match, account for matching funds shall be determined upon award of grant funding.  All required documents have been reviewed by the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Webb County does not have a Hazard Mitigation Plan in place for reduction of loss of life and property due to natural disaster.

a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

16.   Discussion and possible action to authorize Webb County Purchasing agent to purchase four (4) EZ-GO 1200x Cushman 13HP Haulers, one (1) Express S6 six passenger transportation cart, and one (1) 1200 Cushman 1200 13hp Ball Picker in an amount not to exceed $83,510.00 from Mission Golf Cars (Buy-Board Contract No. 706-23) pursuant to the Texas Local Government Code; §271.101, 271.102, Sub-Chapter F. Issue: Currently the Casablanca golf course does not adequate working transportation haulers to be able to move and work efficiently throughout the course safely. CBGC also doesn’t have a working ball picker to pick the range safely with built in cage. We are having to pick range balls unsafely throughout the day. Additionally, we need a 6-passenger utility cart for transportation needs in special events.

Solution: To authorize purchasing agent to purchase these units for the course in order to work safely and provide the necessary transportation for guests at events and tournaments.

Result: The purchase of these units will allow us to work safer, faster and provide adequate transportation to our guests.

17.   Discussion and possible action to authorize the Purchasing Agent to solicit Request for Qualifications (RFQ) for architectural services for the redesign of parking area and expansion/construction of the clubhouse and cart barn, to potentially include the relocation of the maintenance barn, at the Casa Blanca Golf Course, in accordance with the professional service procurement act; and any other matters incident thereto.
 
Issue:
The Casa Blanca Golf Course is in need of additional and expanded parking at the facility. Expansion of the clubhouse is also needed to accommodate for larger capacity due to large events at the golf course. 
 
Solution: Hiring a qualified architect would allow for bids for construction of said scope of work.
 
Result: Casa Blanca Golf Course will be able to better accommodate large events being held at the facility.

Fire Suppression & EMS Services
 
18.   Discussion and possible action to authorize the payment to Rush Truck Center, Inc. for the engine overhaul repairs to Emergency Fire truck Unit 5810 in an amount not to exceed $30,346.00 for the Fire Department and to further authorize a transfer of funds from the General Operating Reserve account (#1001-1130-001-431007-010) to the Fire Departments Repairs and Maintenance to Vehicle account (#1001-3140-001-443000-075) and any other matters incident thereto. Issue: The emergency fire truck unit was sent to the Road and Bridge Department for diagnosis and repair.  The Road and Bridge department recommendation was for the unit to be repaired by Rush Truck Center which will require an engine overhaul after performing a comprehensive diagnosis of unit.  Due to unit being non-operational, securing other price quotes is not a viable process for the repair of this unit.
 
Solution: Authorize the payment for repairs to emergency unit and corresponding diagnostic fees and approval of transfer of funds.  Utilizing the existing fire department budget would not leave sufficient funds to cover annual projected vehicle and maintenance expenses for fiscal year 2024.   
 
Result: Proceed with payment to vendor upon completion of services to repair this emergency vehicle, repairs are estimated to take up to six weeks contingent upon availability of parts.

19.   Discussion with possible action to approve the Texas County & District Retirement System (TCDRS) Plan Agreement for Plan Year 2024 with a retirement plan required rate of 13.12% effective January 1, 2024, and any other matters incident thereto.
 
Issue: The current employer retirement plan required rate for Webb County is 13.00%, The TCDRS employer required rate for 2024 is 13.12%. The employee deposit rate remains at 6.00%. This revision must be made before December 15, 2023.
 
Solution: Approval of the recommended revision at this time will help Webb County keep retirement up to par with the 2023 - 2024 budget.
 
Result: Approval of this revision will be within the TCDRS timeline and will be in line with TCDRS 's employer required contribution rate.

20.   Discussion and possible action to approve the release of the withheld partial retainage payment in the amount of $5,838.73 from the original invoice amount of $116,761.00 payable to Schindler Elevator Corporation Invoice #7401594696 and authorize the County Judge to execute all relevant documents; and any other matters incident thereto. Issue: Elevator improvement was completed as detailed under contract specifications.

Solution: Commissioners Court authorizes the release of retainer fee for the modernization of the Webb County Title Building elevator.

22.   Discussion and possible action to enter into an Agreement with Audio Dynamics, Inc. for Audio/Video Conferencing Technology Upgrades to the Judicial District and County Courts at Law in an amount not to exceed ONE HUNDRED FIVE THOUSAND FIVE HUNDRED FORTY-THREE DOLLARS ($105,543.00) with a time frame of Forty-Five (45) calendar days to complete the Project, authorizing the County Judge to execute all relevant documents and any other matters incident thereto. Issue: One (1) sealed proposal was submitted in response to this public solicitation for restaurant and concession operations at the Webb County Fairgrounds facility. 
 
Solution: Consideration to approve award to sole respondent.  Suarez Restaurant has serviced the Laredo community for over 30 years in the food industry and has provided related services in the past to LIFE fair and other local government entities.  
 
Result: If approved, Civil / Legal Department will negotiate the terms, conditions and related fees for approval and execution of service agreement by Commissioners Court.

27.   Discussion and possible action to accept the rankings and award Request for Proposal (RFP) 2023-015 "Webb County Fairgrounds - Special Events Decorating Services" to the highest ranking respondent as recommended by the scoring committee and the Webb County Purchasing Agent in accordance with the Texas Local Government Code; §262.030 (Alternative Proposal Procedures for Certain Goods and Services) and to further authorize the Civil legal department to negotiate the terms & conditions of the service agreement with selected respondent and any other matters incident thereto. [Account #2031-1010-001-432001 (Webb County Fairgrounds - Professional Services)]

Result: If approved, Civil / Legal Department will negotiate the terms, conditions and related fees for approval and execution of service agreement by Commissioners Court.

28.   Discussion and possible action to award Invitation to Bid (ITB) 2024-04 "Generator Maintenance Repairs - Two (2) Year Contract" to lowest responsible bidder, Total Energy Solutions in an amount not to exceed the formal bid pricing submitted for thirty-two (32) generators pertaining to Webb County facilities pursuant to the Texas Local Government Code, Sub-Chapter C. (Competitive Bidding in General), Section §262.021 (County Purchasing Act) and to authorize the Civil Legal Division to execute the two (2) year service agreement and to further authorize the County Judge to sign all relevant documents and any other matters incident thereto. [Multiple GL Accounts]
 
Issue: Formal bids were secured for the general maintenance, repair and inspection of thirty-two (32) generators located throughout Webb County owned facilities. 
 
Solution: Three formal bids were submitted.  Recommendation to award bid to Total Energy Solutions, lowest and responsible bidder. 
 
Result: The Civil Legal department will prepare the service agreement for County Judge’s signature/approval as per formal Court action.

29.   Discussion and possible action to approve a construction contract between Webb County and JJ Roofing & Construction (Choice Partners Contract No. 23/041MR-07 - Roofing, Waterproofing, and related items) for roof repairs at the Sheriff's administrative building located at 1002 Farragut Street in an amount not to exceed $196,409.24 to include all labor, materials, equipment, insurance, and P&P bonds pursuant to §271.101, 271.102, Sub-Chapter F. Issue:
 Recent heavy rainfalls resulted in a significant amount of water intrusion into the new Sheriff's administrative building located at 1002 Farragut Street.   In order to prevent further water intrusion and possible damage to County property an approximate 15,500 square feet of roof area needs to be repaired.    

Solution: Approve the proposed scope of work to address the roof repairs required for facility.  Vendor has an approved cooperative contract through Choice Partners meeting the competitive bidding requirements of the State as per the Local Government Code.

Result: Proceed with the execution of a construction contract and required documentation in order to proceed with the removal & disposal of non-working HVAC rooftop equipment, repairs and sealing of rooftop area to prevent further water intrusion during heavy rainfalls.
