4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

a.   Discussion and possible action to approve the Webb County Deputy Sheriff’s Association’s ("Association") request pursuant to the Collective Bargaining Agreement 2021-2027 (“CBA”) and Sections 155.001 and 155.002 of the Texas Local Government Code to automatically withdraw from Association members paychecks an additional $10 dollars a pay period for Union Dues; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. b.   Discussion and possible action to enter into a Professional Services Agreement between Webb County (for the benefit of the TEND Court Program) and Rhonda Kuykendall to provide training and counseling services for the Webb County Trafficking Emergency Network Diversion Program in the amount of $81.25 dollars/hr or $650.00 dollars for group youth meetings under the TEND program under Grant #4325003, commencing May 20, 2024, through September 30, 2024, subject to annual grant budgetary appropriations, and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. [Requested by Child Protection Court, Selina L. Issue: 
Webb County seeks the assistance of a qualified Engineering Firm to undertake a Phase I Environmental Site Assessment of two properties (1401 Guatemozin & 603 N. Loring) where the Meals on Wheels Program will be located.

Solution: Work Authorization Number 1 enables Raba Kistner, Inc. to provide the services authorized under the Work Authorization.

Result: Webb County will be able to determine whether there are environmental issues with the mentioned properties.

9.   Community Action Agency
 
a.   Discussion and possible action to approve Amendment No. 5 to extend the duration of term for the Low Income Household Water Assistance Program (LIHWAP) to Contract Number #34210003698 from the Texas Department of Housing and Community Affairs (TDHCA) for FY-2021. The amendment extends the contract from December 31, 2023, to March 15, 2024, with no additional funding and authorizing the County Judge to sign all relevant documents. This contract will not have an impact on the General Fund. Documentation has been reviewed by Webb County Economic Development Department and is compliant with SPOC policies and procedures.

Issue: Texas Department of Housing and Community Affairs (TDHCA) has awarded Amendment No. 5 to Contract Number #34210003698 under the LIHWAP Program. 

Solution: Court approval of Amendment No. 5 to LIHWAP contract #34210003698.

Result: The court approval will allow Webb County CAA to continue performance under the LIHWAP program.

b.   Discussion and possible action to authorize the use of CAA - El Aguila County buses to be used by the Washington's Birthday Celebration Association (WBCA) at the upcoming events Caballeros Cocktail Friday, February 16, 2024, Mr. South Texas Luncheon Saturday, February 17, 2024, and Wednesday, Stars and Stripes Air Show February 25th 2022 allowing a reimbursement in the amount of Three Thousand Two Hundred Fifty Dollars ($3,250.00) for the requested transportation services; and any other matters incident thereto. a.   Discussion and possible action to approve the closeout and release of 5% retainage in the amount of $20,224.50 to Anderson Colombia for the construction of the Texas Community Development Block Grant Program, TCDP Contract CDV21-0485, Community Development Fund-Pueblo Nuevo Street Improvements Project and have the County Judge sign any relevant document and any other matter incident thereto. Issue: Five percent (5%) of the construction project amount is held in retainage from the contractor for 30 days from completion date of each project to ensure that any deficiencies which may arise are addressed by the contractor. The contract amount is $404,490.00 and 5% retainer amount is $20,224.50.

Solution: Commissioners Court authorizes the release of the retainer funds to the contractor.

Result: The contractor will be paid for services rendered.

c.   Discussion and possible action to authorize the submission of a Fiscal Year 2025 Local Border Security Program (FY 25 LBSP) grant application as developed, written, and submitted by the Webb County Sheriff’s Office Grant Writer to the Office of the Homeland Security Grants Division (HSGD) in the amount estimated at $250,000 for peace officers' overtime and applicable fringe benefits to provide enhanced border security in the Laredo/Webb County area, and authorizing the Webb County Judge to execute all relevant documents, including the resolution; and any other matters incident thereto. This grant does not require a match; and, thus, will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fluidity of border crossings, heavy commercial activity, and interdependence of the international border communities’ economies. These socio-economic pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.
 
Solution: Grant application to provide enhanced border security in Laredo/Webb County in order to fulfill State of Texas local border security program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas.
 
Result: Enhanced/increased patrol and investigative capacity for certified peace officers working at the Webb County Sheriff’s Office.

d.   Discussion and possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Sheriff's Office in collaboration with Economic Development and other applicable/participating Webb County Dept./Offices to the Office of the Governor Homeland Security Grants Division in the amount estimated at $2,500,000 for the Sheriff’s Office portion of the FY 2025 Operation Lone Star (OLS) Grant Program. The Sheriff’s Office portion requests grant funding for overtime operations/applicable fringe benefits, equipment/minor tools/software/internet, and supplies; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires no match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Local law enforcement working in international border communities must work within limited budgetary constraints to provide both proactive and responsive law enforcement services while transborder criminal organizations possess unlimited funding to access the latest technology and equipment to avoid detection/disruption of their activities utilizing their proceeds obtained through illegal but highly lucrative drug trafficking and other unlawful enterprises.

Solution: Supplemental grant award to provide supplemental resources to assist in combating illegal drug trafficking and provide enhanced border security for the residents/citizens of Laredo/Webb County.

Result: The Webb County Sheriff’s Office and its sworn officer force will be equipped with needed additional resources.

a.   Discussion and possible action to authorize the Purchasing Agent to solicit Requests for Qualifications (RFQ's) for Civil Engineering services to do a roadway speed study for the installation of speed humps in the City of Oilton Texas, pursuant to the Professional Services Act and any other matters incident thereto.

Issue: Oilton City residents have voiced concerns regarding automobiles speeding in the area on all sides of the park along the following county roads: Mackin Avenue, Welhausen Road, Jim Neal Avenue and Torrecillas Road.

Solution: Approval of agenda item to proceed with the future installation of speed humps around the City of Oilton Park and Baseball Field area.

Result: Safe roads for the residents of the City of Oilton Texas and surrounding areas.

b.   Discussion and possible action to authorize the Purchasing Agent to solicit bids for the Las Lomas Road Paving Project as per Webb County and the Texas Department of Transportation (TxDOT) specifications pursuant to the Texas Government Code; Subchapter C. Competitive Bidding Method, §2269.101 (Contracts for Facilities: Competitive Bidding and to further designate a licensed engineer from the Engineering Department to prepare the construction documents required for this project in accordance with §2269.101 (Use of Architect or Engineer) and any other matters incident thereto. a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to the public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose of or destroy property that cannot be sold through public auction because it has been deemed worthless or dispose of  through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

Issue: Funding from the Rife-Resistant Body Armor Grant Program for FY 2024 was awarded to Webb County for the purchase of Rifle Resistant body armor for Webb County law enforcement Officers. 
 
Solution: Pricing from vendors using state and national purchasing cooperatives were solicited for the specifications needed for the rifle body armor carriers with protective plates.  Galls LLC., meets all requirements and delivery expectations and is an established vendor with State-approved cooperative contracts. 
 
Result: Proceed with the order and meet grant deadlines for completion of the approved purchase under the Rifle Resistant Body Armored Grant Program.  The approximate delivery is 60 days from the date ordered.

17.   Risk Management
 
a.   Discussion and possible action to approve a Non-Financial Memorandum of Understanding (MOU) between Texas A&M International University (TAMIU) and Webb County to provide Criminal Justice and Sociology students credit by completing 160 hours of internship work with Webb County Departments. The term of the MOU will be from January 1, 2024 through December 31, 2025, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. Click to View

Issue: Funds needed to cover costs associated with repairs to overhead door inside fairground pavilion. Currently, the overhead door is unable to close, allowing wind to sweep dirt into the pavilion. Equally important, it poses a safety risk. A person can enter the fairgrounds on foot and enter the pavilion through the open overhead door.

Solution: Transfer monies from one account to another to cover the cost to repair.

Result: Overhead door will be fixed, and accessible for vendors, and pavilion lessees.

Issue: Sales tax remittance is required for some of fairground services chosen by clients based on the Texas Tax Code.
 
Solution: Webb County to apply for a new sales tax location.
 
Result: Comply with Texas Tax Code statutes.

Issue: Short staffed situation at the Medical Examiner’s office has resulted in the need to fill part-time temporarily.
 
Solution: Approve transfer to have funding available for part-time.
 
Result: Dedicated part-time staff to fill in for the duties of the office.

Issue: Commissioners Court authorized the Purchasing Agent to seek out qualification statements from qualified law firms to provide a variety of legal services on an as-needed basis.  This solicitation requested legal services for expertise in labor and employment law.   Two (2) firms submitted by deadline and were evaluated as per weighted criteria published.
 
Solution: Consideration to accept the rankings and award to the highest ranking firm as presented by the Purchasing Agent and in accordance with the Texas Professional Services Act.

22.   Discussion and possible action to award Invitation to Bid (ITB) 2024-001 "Carpet Removal and Installation Project" to lowest and responsible bidder, Midas Contractors LLC, in accordance with the Texas Local Government Code, Sub-Chapter C. Issue: Commissioner Court authorized the Purchasing Agent to secure formal bids for the removal and installation of new carpet for all Judicial District Courts, County Court of Law No. 1, Child Support Court and the Central Jury Room. Four (4) sealed bids were submitted by deadline, one of which was disqualified due to incomplete bid pricing. 
 
Solution: Consideration to accept the lowest and responsible bidder’s price proposal as presented by the County Purchasing Agent for each courtroom and/or to reject all and rebid if it's in the best interest for Webb County.
 
Result: If approved, authorize General Counsel to execute the contract for the awarded sum(s).

Issue: The Webb County Fairgrounds department is requesting portable lighting towers to enhance the lighting in the parking lot areas in preparation for the upcoming events.
 
Solution: Consideration to authorize the purchase of the recommended light towers under a buy board cooperative contract, meeting all the competitive bidding requirements of the State.  
 
Result: If approved, the towers will be ordered contingent upon the transfer of funds by the Budget and Auditors' office. ETA for delivery by or before February 23, 2024.

The Webb County Fairgrounds Department requested and as authorized by Commissioners Court the rental of portable restrooms for the upcoming events between February 24th – March the 3rd.  
 
Solution: Authorize the rental of three (3) units as presented by the Purchasing Agent. The 9th unit includes 4-private stalls for women w/sink and 2-private stalls/3 urinals for men w/sink and the 4-station unit includes 2-private stalls for women w/sink and 1-private stall / 1-urinal for men w/sink.   Informal bids were advertised and only one STWS submitted a bid for the scope of services requested.
 
Result: If approved by the Commissioners Court, order will be placed contingent upon posting of the budget amendment for the requested sum of $13,350.00.

27.   Discussion and possible action to authorize the purchase of one (1) Heavy Duty 5 Gang Golf Ball Picker with Universal A-Frame Attachment from Range Servant America, Inc. for an amount not to exceed $7,290.42, for the Webb County Casa Blanca Golf Course and to further authorize the transfer of funds form the General Operating-Reserve account #1001-1130-001-431007-010 to the Casa Blanca Golf Course – Capital Outlay account #7100-6080-001-470000 and any other matters incident thereto. Issue: The Webb County Casa Blanca Golf Course requested, and is in need of one (1) new ball picker for the driving range.  Golf Course management is in the process of making improvements to the driving range section to improve the surface area to minimize the wear and tear on ball picker equipment.   
 
Solution: Authorize the purchase as presented by the Purchasing Agent.  Informal bids were secured for this purchase.  Range Servant America has provided the lowest and best bid.

Result: If approved by Commissioners Court, order will be placed contingent upon posting of budget amendment for the requested sum of $7,290.42.

Issue:
A two-vehicle collision involving Sheriff motor vehicle unit 27-396 (2021 Ford Explorer) and a 2007 Chevrolet Suburban driven by Gamboa Parez, damage was sustained on both vehicles.

Solution: To approve the property settlement regarding Sheriff motor vehicle unit 27-396.

Result: Once property settlement is approved, Webb County, as Claimant, will release Mr. Parez and his insurance carrier (Kemper) for all property claims regarding Unit 27-396.
