4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

c.   Discussion and possible action to retain the legal services of David Garcia, Attorney at Law, P.C. to negotiate, on behalf of Webb County, a Non-Surface Use Oil and Gas Lease with Proven Energy, LLC. for a fee not to exceed One Thousand Two Hundred Dollars ($1,200.00), and any matters incident thereto. Issue: At its August 14, 2023, meeting, the commissioners court authorized the Purchasing Agent to solicit bids for the lease of a 3.5-acre tract for mineral development (oil and gas) as provided by State Law (Texas Natural Resource Code).  At its February 26, 20214 meeting, the court award the bid to Proven Energy LLC; however, the lease terms and conditions still need to be negotiated.

 Solution: Retain the legal services of David Garcia Attorney at Law, P.C. to negotiate a “Non-Surface Use Oil and Gas Lease with Proven Energy, LLC on behalf of Webb County.

 Result: Mr. Garcia will be negotiating the best lease term and conditions regarding the Non-Surface Use Oil and Gas Lease on behalf of Webb County with Proven Energy LLC.

7.   Community Action Agency
 
a.   Discussion and possible action to approve the posting and filling of the following Slot fully paid with Grants funds, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective March 11, 2024:

b.   Discussion and possible action to approve Driscoll Healthcare as Representative Organizations for Category "C" of the Webb County Community Action Agency Advisory Board; and any other matters incident thereto.

Issue: State mandates the filling of vacancies when applicable terms end as per Texas Administrative Code Chapter 5 Rule 5.215.

Solution: Vacancies will be filled.

Result: The Agency will comply with Texas Department of Housing and Community Affairs (TDHCA)- Texas Administrative Code, Chater 5 Rule 5.215.

c.   Discussion and possible action to end negotiations and rescind award to Slay Architecture, LLC for the Webb County Colonia Fund Construction Housing Rehabilitation Grant and to further withdraw the Request for Qualifications RFQ 2024-003 and any other matters incident thereto.

Issue: On August 28, 2023, Slay Architecture, LLC was awarded this project.  Contractor has communicated with the Webb County Community Action Agency, Purchasing and Legal Departments that they will not be able to develop the scope of work as required under this contract due to time constraints.  

Solution: Rescind the award to Slay Architecture, LLC and withdraw the RFQ.

Result: Terminate negotiations and contract execution with Slay Architecture, LLC. and submit a contract and budget amendment to the Texas Department of Agriculture to reclassify professional services line item to construction management services line item.

d.   Discussion and possible action to approve the submission of a contract and budget amendment request to the Texas Department of Agriculture (TDA) Texas Colonia Fund – Construction Program Contract No. CFC22-0089 and authorize the County Judge to sign all relevant documents and any other matters incident thereto. All required documents were reviewed by the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.

Issue: On August 28, 2023, Slay Architecture, LLC was awarded this project. Contractor has communicated with the Webb County Community Action Agency, Purchasing and Legal Departments that they will not be able to develop the scope of work as required under this contract and due to time constraints.  

Solution: Submit a contract and budget amendment request for the Texas Colonia Fund Construction Program Contract No. CFC22-0089 to eliminate professional services and modify the contract’s performance statement to reclassify professional services line item to construction management services line item.

Result: The department will be able to proceed with contract activities in a timely manner.

e.   Discussion and possible action to approve the submission of a budget amendment request to the Texas Department of Housing and Community Affairs (TDHCA) Comprehensive Energy Assistance Program (CEAP) Contract No. 58240004040 and authorize the County Judge to sign all relevant documents and any other matters incident thereto. The solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [CEAP Account #2362-5360-521]

Issue: Funds available in account will not cover costs needed to continue operation of service through the Comprehensive Energy Program (CEAP).

Solution: Submit a budget amendment request for the CEAP Contract No. 58240004040 to modify the contract’s Budget Category to reclassify fund allocations.

Result: Once a budget amendment has been submitted, there will be additional funds available to continue operations through the CEAP program.

a.   Discussion and possible action to accept Constable Pct. 1 Racial Profiling Report to be In compliance with Texas Occupations Code1701.164 and Code of Criminal Procedure Article 2.1031-2.138.

Issue: Chief administrators of law enforcement agencies that meet the criteria must submit racial profiling reports to their governing body, as well as TCOLE.

Solution: Record Constable Pct. 1 Racial Profiling Report.

Result: Will be in compliance with Texas Occupations Code1701.164 and Code of Criminal Procedure Article 2.1031-2.138.

9.   Economic Development
 
a.   Discussion and possible action to accept grant award and authorize Webb County to enter into a grant agreement with the Texas Parks and Wildlife Department for the Community Outdoor Outreach Program in the amount of $91,251.00 with no cash match for a series of recreational workshops that will held on site at several State Parks and Natural areas to expose youths of our community; an authorize the Webb County Judge to sign all relevant documentation. This contract and agreement commences on March 1, 2024, and terminates September 1, 2025. All required documents were reviewed by the Economic Development Department and the solicitation is complaint with the Webb County Single Point of Contact (SPOC) procedures. 

Issue: Webb County submitted a COOP grant application to TPWD.

Solution: Accept award and enter into an agreement.

Result: Webb County is able to implement the project.

b.   Discussion and possible action to approve the posting and filling of the following slot paid with General funds, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective March 11, 2024:

c.   Discussion and possible action to amend a resolution that was approved on January 9, 2023 under "item 10.f." for a grant application as developed, written, and submitted by and for the Webb County Sheriff's Office to the Office of the Governor Criminal Justice Division in the amount estimated at $30,000 for Body Worn Camera (BWCs) equipment, software, and supplies; This grant still requires cash match of 25% or an estimated amount of $10,000, which will be met utilizing the Sheriff’s Office forfeiture funds (Fund #2152) for a total project cost estimated of $40,000; and, thus will have no impact to the general fund. The Public Safety Office ("PSO") requested a change in the resolution which will not change the substance of the Commissioner Court's previous action to approve the resolution; and authorize the Webb County Judge to sign the amended resolution and any other matters incident thereto.[Requested by Martin Cuellar, Webb County Sheriff; Grant Fund #2743] Click to View
 
d.   Discussion and possible action to ratify the development and submission of the Federal Emergency Management Administration (FEMA) FY23 Assistance to the Firefighters Grant Application in the amount up to $350,000.00 and authorizing the County Judge to act as the Authorized Representative in all matters pertaining to the County’s request for Assistance to Firefighters Grant Program funding. This application requires a non-federal match in an amount equal to not less than five percent (5%) of the federal funds awarded; amount should not exceed the sum of $17,500.00.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.
 
Issue: Submission of Assistance to Firefighters Grant (AFG) Application to benefit the Webb County Volunteer Fire Department through the acquisition of PPE and firefighting equipment. 
 
Solution: The Economic Development Department developed and submitted the application on behalf of the Webb County Volunteer Fire Department.
 
Result: Well-equipped firefighters to respond to safely to emergency incidents, and meet required standards.

14.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to the public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose of or destroy property that cannot be sold through public auction because it has been deemed worthless or disposed of through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

b.   Discussion and possible action to authorize the purchase of six (6) Esprit Thermal Camera kits to include power- over-ethernet technology, mounting hardware, mobile router, cabling, and installation for a total not to exceed $119,983.98 from Motorola (HGAC Contract No. RA05-21) for the Webb County Sheriff's Office and in accordance with the Texas Local Government Code; Sub-Chapter F. Issue: Expanding border security efforts and integration with real-time crime center requires expansion of the current infrastructure as well as modern NDAA-compliant solutions. These are necessary to continue Law Enforcement efforts for border security and RTCC purposes. This purchase is supported through the State of Texas Operation Lone Star Grant Fund. 
 
Solution: Consideration to authorize grant funded equipment for law enforcement use. Motorola has a cooperative contract with HGAC, meeting all competitive bidding requirements of the State of Texas.  
 
Result: If approved, proceed with placing the order. This equipment will enhance existing and continued efforts to protect our border in Webb County.

c.   Discussion and possible action to authorize the purchase of two (2) VECTOR ALPR Rapid Deployment Trailers with a 20' mast and a Bosch PTZ Surveillance Camera to include 24V lithium batteries, delivery, installation, testing, TraffiData Software license and cloud services per camera for an amount not to exceed $249,800.00 from Jenoptik-Smart Mobility Solutions for the Webb County Sheriff's Office pursuant to the Local Government Code; 262.024 (7) (A) items for which competition is precluded because of the existence of patents, copyrights, secret processes, or monopolies and any other matters incident thereto. Issue: The Sheriff's Office, with the support of Commissioners Court, continues to utilize Operation Lone Star funds for border security operations. The proposed purchase will enhance existing efforts in the collaboration between Webb County and the State of Texas Governor's office along with other participating border communities in protecting our Texas borders. 
 
Solution: Consideration to authorize the purchase using Operation Loan Star Grant Funds awarded by the Texas Governor's Office and approved by the Webb County Commissioners Court. 
 
Result: If approved, the original border security equipment can be redeployed along with the new equipment to the areas needed to enhance border security operations.

16.   Discussion and possible action to continue paying grant funded personnel under the High Intensity Drug Trafficking Area (HIDTA) Task Force Agreement, DEA Narcotics Task Force, for Ninety (90) days, until notification about grant continuation award from the U.S. Department of Justice Drug Enforcement Administration [Fund #2592]. [Requested by Isidro "Chilo" Alaniz, District Attorney; Account #1001-1160-001-463903-025]

Issue: Current grant funding expired on December 31, 2023. The District Attorney’s Office has not received notice of award for new grant. Unless this item is approved, employees working under said grant will not be paid.

Solution: Grant a 90-day payroll extension for employees working under this grant.

Result: The DEA HIDTA Task Force will be able to continue to disrupt the illicit drug traffic in Laredo and surrounding areas.

18.   Discussion and possible action to enter into a Contractual Agreement with Midas Contractors, LLC for a renovation project involving the removal and installation of commercial grade modular carpet tile for the Webb County Justice Center Courtrooms and corresponding office areas of the 49th, 111th, 341st, 406th Judicial District Courts; Statutory County Court at Law No. 1, Child Support Courtroom, and Central Jury Room in the amount ONE HUNDRED EIGHTY THOUSAND EIGHT HUNDRED THIRTY-SIX DOLLARS ($180,836.00) and any matters incident thereto, and authorizing the County Judge to execute all relevant documents. Issue: 
Justice Center courtrooms, other than County Court at Law No. 2, are in need of having existing carpeting removed and new carpeting installed.  The Commissioner Court authorized the Purchasing Agent sent out an "Invitation to Bid ("ITB") 2024-001" for such work.

Solution: At the Commissioners Court meeting of February 12, 2024, the court awarded ITB 2024-001 to Midas Contractors, LLC to do the renovation project.

Result: The Contractor will substantially complete the project within 150 calendar days from the issuance of the "Notice to Proceed" by the engineering department.

20.   Discussion and possible action to authorize and make an exception for a one-time charge not to exceed Two Thousand Two Hundred Eighty Dollars ($2,280.00) for an annual subscription from Monday.com Work Management Pro Platform for the Webb County Community Action Agency Department utilizing the Webb County credit card designated only for airfare related expenditures and any other matters incident thereto. Issue: The Webb County Community Action Agency is purchasing a work management platform to improve efficiency within the department. The platform accepts purchase orders for an Enterprise Plan and at a cost of $5,280.00 for ten users.  This is THREE THOUSAND DOLLARS ($3,000.00) greater than if the county would pay using a credit card. 

Solution: Consideration to authorize the use and make an exception to the rule of using the County Credit Card for only Airfare related expenditures.
 
Result: If authorized, the order will be processed using the Credit card, this system will enhance overall operational efficiency of the department.

21.   Discussion with possible action to authorize the hiring of all temporary Election Workers through a temporary staffing agency provider and to further authorize the Purchasing Agent to solicit competitive proposals for the requested services pursuant to the Texas Local Government Code; §262.030 Alternative Competitive Proposal Procedure for Certain Goods and Services and any other matters incident thereto. Issue: The Elections Department hires hundreds of temporary Election Workers for short periods of time throughout the year through the Webb County employee hiring process (see below). Hiring through Webb County requires numerous steps and manual processes which may reduce efficiencies and increase liabilities.  Although temporary staffing agencies charge a mark-up for services, in analyzing costs, the potential additional costs may be justifiable compared to the current practice in place.

Solution: Consideration to approve the recommendation by Staff and further authorize the Purchasing Agent to secure competitive proposals for requested services in the best interest for Webb County.
 
Result: Ability for the Election Department to expedite their hiring and payroll process for temporary Election Workers subject to approval of future award of selected offeror providing the best value proposal.

22.   Discussion and possible action to purchase 20 laptop computers from Dell laptops in an amount not to exceed $18,875.60 and 2 Lexmark printers in an amount no to exceed $10,400.00 for the elections office (Sub-Chapter F Cooperative Purchasing Program) to be paid from Account #1001-1130-001-470000-001 (Capital Outlay Non-Capitalized Items) alternative funding source Account #3015-1010-001-460105 (Minor Tools & Apparatus) and any other matters incident thereto.

Issue: There are PC's throughout the elections office used office used at polling locations that are in need of replacement and a printer used to print voter registration certificates. 

Solution: Authorize the purchase for new computers under the DIR cooperative contracts from the Capital Outlay Non-Capitalized Items 1001-1130-001-470000-001.

Result: Elections will have updated printer and PC's.

23.   Status report by Rick Solis from Frank Architects regarding the construction progress and completion date for the Webb County Sheriff's Office Building Renovation Project; with discussion and possible action, and any other matters incident thereto. Click to View
 
24.   Discussion and possible action to authorize the Webb County Engineering Department in conjunction with Frank Architects to expedite a temporary Certificate of Occupancy for the Webb County Sheriff’s Office Building with discussion and possible action and any other matters incident thereto; also, a presentation to Commissioners Court regarding the project status will be presented by Frank Architects.
 
Issue: The completion of the Webb County Sheriff's Office project is pending the delivery of generators, roof replacement, and elevator refurbishment. As per City regulations, all pending items must be finished before the building can be occupied, and a Certificate of Occupancy can be issued.
 
Solution: To expedite the occupancy process, discussions with the City of Laredo are underway to obtain a temporary Certificate of Occupancy. The main Critical Path element is primarily the replacement of the building roof, which needs completion for final inspections and overall project finalization. Once the roof replacement is finished, the remaining work on generators and elevator refurbishment will continue, leading to the issuance of the final Certificate of Occupancy.
 
Result: Occupancy of the Webb County Sheriff's Office will be achieved sooner with the potential for a temporary Certificate of Occupancy, allowing for early use of the building while remaining compliant with city regulations and simultaneously continue through completion of the project by others not responsible to the General Contractor.

25.   Discussion and possible action to reject all proposals submitted for Request for Proposal (RFP) 2024-005 "Client Tracking Management Software" for the Community Action Agency Social Services and any other matters incident thereto. 

Issue: 3 proposals were submitted for the Client Tracking Management Software for CAA Social Services.  After careful review, the Scoring Committee is recommending for CCT to reject all proposals due to lack of acceptable options.    

Solution: Consideration to reject all proposals. The CAA Director will be reviewing other viable solutions prior to returning to court with a recommendation on any future procurement requests for software solutions for client tracking software. 
 
Result: If approved, all proposals will be rejected. The Purchasing Agent will notify each proposer in writing of final court action.
