Presentation, with discussion and possible action, to consider recommendations in the creation of a proposed county ordinance under §364.012, Health and Safety Code identifying areas of the county suitable for the disposal of municipal or industrial solid waste; authorizing the preparation and publication of a proposed county ordinance under §364.012, Health and Safety Code together with associated public notices and assessments as prescribed by State law; setting of a public hearing; and any other matters incident thereto.

Issue: In conformance with the Commissioners Court action of September 26, 2016 (Item 53), staff has prepared recommendations for the Court’s consideration for the development of a proposed county ordinance under the authority of §364.012, Health and Safety Code to identify areas of the county that may be suitable for municipal or industrial solid waste disposal. While the adoption of such an ordinance will not affect existing permitted sites or sites in which an application is currently pending before the TCEQ, such an ordinance can guide the placement of future disposal sites.

To finalize the draft of the proposed ordinance and required publications, staff needs direction from the Court regarding the acceptance, rejection, modification, deletion or addition of controlling factors that will establish the basis of the proposed ordinance and authorization to proceed with publications and the setting of the public hearing.

Solution: Evaluate recommendations to approve, reject, modify, delete or add criteria to prepare a proposed county ordinance to identify areas of the county which may be suitable for municipal or industrial solid waste disposal and grant/deny authorization to proceed with required publications and the setting of a public hearing necessary for the Court’s adoption of an ordinance under §364.012, Health and Safety Code.

Result: If implemented by the Commissioners Court, an ordinance established under the authority of §364.012, Health and Safety Code could enhance local measures for the protection of environmentally and socio-politically sensitive areas that could be adversely impacted by the effects of future municipal or industrial solid waste disposal sites.

Background:

Item is a presentation of staff’s recommendations relating to a proposed county ordinance pursuant to agenda item #53 from the commissioners court meeting of 9/26/2016 regarding the identification of suitable areas of the county for the disposal of solid waste. To finalize the draft of the proposed ordinance and required publications, staff needs direction from the Court regarding the acceptance, rejection, modification, deletion or addition of controlling factors that will establish the basis of the proposed ordinance and authorization to proceed with publications and the setting of the public hearing.
