Discussion and possible action to approve retaining the legal services of Allison, Bass & Magee, LLP as counsel in the defense of the case entitled Cynthia Mares vs. Webb County, Texas; in Cause No. 2016CVQ002952D2, pending in the 111th District Court, Webb County, Texas; and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. [Executive Session is requested pursuant to Texas Government Code, Title 5, Subchapter D, Section 551.071(1)(A)(Consultation with Attorney regarding contemplated litigation)] [Requested by Leroy Medford, Commissioners Court Administrator]

Issue: Due to a conflict of interest, the county attorney’s office is unable to assist in the legal representation in the aforementioned lawsuit. The time-frame for a response is within 20 days of the filed suit. With this in mind, legal representation is needed as quickly as possible. The firm of Allison, Bass & Magee has been retained by the county on other issues and deemed necessary to retain them for this new legal matter.

Solution: Authorize the use of said law firm to acquire the immediate legal representation needed.

Result: County will have legal representation.
