4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

 
CONSENT ITEMS
 
5.   Community Action Agency
 
a.   Discussion and possible action to authorize the Webb County Community Action Agency to enter into an annual agreement with the Neighbor-to-Neighbor Progran; Direct Energy, CPL Retail Energy, WTU Retail Energy, First Choice Power, and Bounce Energy. Effective as of January 1, 2017, and shall continue in effect for an initial term through December 31, 2017, and may be renewed annually each January with the signatures of both parties. The purpose of the agreement is to assist low income clients pay their electric home energy expenses thru the Neighbor to Neighbor Program. Also included is a check in the amount of  Eleven Thousand Dollars ($11,000.00) to be used in accordance with this Neighbor- to-Neighbor Program Agreement. [Account #2924-5170-521]

Issue: Webb County Community Action Agency will enter into an annual agreement with the Neighbor to Neighbor Program.

Solution: The Neighbor to Neighbor Program will provide funding to the Retail Energy Providers low income clients pay their electric home energy expenses.

Result: Qualifying recipients will receive payment for their home energy expense for up to $700.00 per household, per year.

b.   Discussion and possible action to approve a contract between Webb County, on behalf of Webb County Community Action Agency and Capluck, Inc. (CAP60) for the purchase and implementation of client-tracking software for social services and case management services at the Webb County Community Action Agency. The annual subscription price is Three Thousand Eight Hundred Dollars ($3,800) which includes: Unlimited access to CAP60 Solution (Unlimited number of users) Unlimited Live technical support, Application Hosting and Bandwidth, All Updates and Enhancements, Regular Nightly Backup and Regularly scheduled on-line training. Funding shall be provided from the Texas Department of Housing & Community Affairs (TDHCA) 2017 Community Social Services Block Grant (CSBG) Program and authorize the County Judge to sign all relevant documents. The term contract will be a One (1) year term (March 27, 2017- March 24, 2018. [Account #2368-5170-521-457008]

Issue: The annual subscription price is $3,800 which includes: Unlimited Web Access to CAP60 Solutions (Unlimited number of users). Unlimited Live technical support. Application Hosting and Bandwidth. Regular Updates and Enhancements. Regular Nightly Backup. Regularly scheduled on-line training. Access to all CAP60 Video Library.

Solution: CAP60 will be renewed to continue implementing client-tracking software for social services and case management services at the Webb County Community Action Agency.

Result: This will help Program staff have a better client-tracking system.

c.   Discussion and possible action to approve the posting and filling of the following Slots, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective April 10, 2017:

Issue: Slot #1856 is vacant. Driver will be using a county vehicle, so mileage claims will not be allowed. Slot #1217 is vacant. The slot can pay up to $10.00 per hour, 20 hours per week, but starting pay will be base $9.36 per hour. Slot #1216 is vacant. Rate change in the general order-to have all slots at the same rate of $9.36 per hour, 20 hours per week.

Solution: The request is being made to fill the vacant Food Transporter positions.

Result: The filling of slots will allow the Meals on Wheels program to effectively continue to provide home delivers meals to qualifying program consumers.

Issue: New proceeds under Chapter 59.06 of the Texas Code of Criminal Procedure have been awarded and may be spent by the attorney representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

16.   Honorable Martin Cuellar, Sheriff
 
a.   Discussion and possible action to authorize the acceptance of a grant award from the National Rifle Association (NRA) Foundation in the amount of $2,800 for the purchase of rifles, and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match.

Issue: The Webb County Sheriff’s Office must continually equip its sworn officer force with an important array of duty gear, other critical safety equipment, and essential, but costly expendable supplies, such as ammunition, utilizing limited local funds.  Moreover, the vast majority of federal and state grants do not allow for the purchase of firearms and/or ammunition as an eligible grant expense.

Solution:  Grant award from the National Rifle Association (NRA) Foundation to provide a firearm as a supplemental source of this needed equipment and consumable supplies/materials.

Result:  The Webb County Sheriff’s Office sworn officer force will be provided with additional firearms.

b.   Discussion and possible action to approve a reimbursement agreement between Webb County Sheriff's Office and the Organized Crime Drug Enforcement Task Force (OCDETF) during the performance period of January 1, 2017 through September 30, 2017 for an amount not to exceed $3,000 in overtime for Webb County Sheriff’s Office deputies through the OCDETF Investigation/Strategic Initiative, and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. Estimated applicable fringe benefits in the amount of $741.90 for this overtime will be covered by state forfeiture funds; and, thus, this agreement will have no impact to the general fund. Issue: Collaboration between federal, state and local law enforcement agencies is necessary to pursue and dismantle organized crime organizations along the Texas border and within our community.
 
Solution: Accept federal assistance to continue local participation in OCDETF investigations, strategic initiatives, and prosecution of organized crime.
 
Result: Disruption of organized crime activity along the Texas border and in Webb County; prosecution of individuals responsible for organized crime.

Issue: The accounts listed above (Materials & Supplies, Rents, Drug Free Campaign, Administrative Travel, K9 and Invest. Expenses) require a transfer of funds to cover estimated forecasted expenditures. The increase on Payroll Cost fund is to cover forecasted salary increase expenditures for the Public Information Officer and Finance Director slots as previously approved on Commissioners Court on 3/27/17.

Solution: Utilize the savings from selected accounts to cover request for payments, purchase orders and payroll cost and to avoid these accounts from reaching deficits.

Result: The Line Item Transfer of funds will cover the estimated expenditures.

d.   Discussion and possible action to approve a Management Control Agreement between Texas Department of Public Safety (DPS), FBI Criminal Justice Information Systems and Webb County Sheriff’s Office and Informational Technology Department.  Agreement will establish and enforce access and use of the Texas DPS Law Enforcement and associated systems with the assistance of a non-criminal justice governmental agency. a.   Discussion and possible action to approve a refund in the amount of $14,503.55 to Corelogic Tax Services. Accounts #92300004108 through #99010008020 had over-payments for tax year 2016.  [Account #1001-209415] 

Issue: Upon receiving payment from Corelogice Tax Services, the above-mentioned accounts had adjustments to taxable values or had been previously paid by another entity resulting in the over-payment of taxes for 2016.

Solution: Refund said amount to Corelogic Tax Services for the over-payments.

Result: The monies will be reimbursed to the appropriate taxpayers.

REGULAR AGENDA
 
Honorable Isidro Alaniz, District Attorney
 
19.   Discussion and possible action to authorize the Webb County District Attorney's Office to submit an application to the Office of the Attorney General for an Other Victims Assistance Grant (OVAG); to designate the County Judge as the County’s Executive Officer and Authorized Representative in all matters pertaining to the County's participation in this grant. The District Attorney's Office will utilize the grant to fund the position of Victims Coordinator for the Domestic Violence Unit. The amount of the funding request shall not exceed $42,000.00. There is no matching funds requirement for this grant. Contract Term: September 1, 2017 to August 31, 2018.

Issue: This grant funds the position of the Webb County District Attorney's Victim Coordinator. The Coordinator works closely with prosecutors, investigators and counselors to meet the needs of crime victims including the following:

a) Assisting victims in completing applications with the Office of the Attorney General’s Crime Victims Compensation Fund.
b) Assisting families and victims of crime with information regarding the status and the legal process of their case.
c) Assessing and making immediate referrals to community agencies that provide needed services to victims of crime.
d) Providing crisis intervention to victims of crime and the non-offending parent. 
e) Serving as an advocate when cases are set for trial, providing a victim impact statement, and assisting in the completion of related documents.
f) Providing follow-up services, including reassurance and supportive listening to victims assisted in the Domestic Violence Unit.

Solution: Authorize the submission of the grant application as set forth above to ensure that the crime victims coordinator can continue to provide necessary services to victims of crime.

Result: Victims of Crime Coordinator will continue to provide the services outlined above to victims of crime in Webb County.

Honorable Monica Notzon, 111th District Court Judge
 
20.   Discussion and possible action to approve and fund the purchase of Audio and Video equipment for the courtroom at the 111th District Court using Capital Outlay funds in the estimated amount of $15,500. [Account #3015-7050-001-470000-075]

Issue:  Two months ago, the downtown area was struck with a power outage while our court was beginning a Murder Trial. Our trial continued, but when the power came back up, our audio and visual equipment failed to work. Since then we have a portable monitor being used by both counsel and the jurors to use as Audio/Visuals and a battery operated microphone on the jury stand. We have had two more trials and continue to have constant audio and visual issues.

Solution: MIS has looked at the equipment, which is over 12 years old, and recommended that we upgrade as most of the current equipment has long been discontinued.

Result: Working Audio and Visual equipment in the courtroom.

Fire Suppression & EMS Services
 
21.   Discussion and possible action to authorize the Webb County Volunteer Fire Department to submit a Texas Forest Service Fire Department Grant Assistance application for up to $12,500.00 for volunteer firefighter training, and authorizing the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's request for Texas Forest Service Fire Department Assistance funding. This application does not require County matching funds.

Issue: To provide volunteer firefighters with reputable and cost effective fire training.

Solution: Apply for Texas Forest Service funding for training through HB2604, rural volunteer fire department assistance program.

Result: Volunteer firefighters will be provided with hands-on skills training. This will also assist Webb County Fire to motivate and retain volunteers.

22.   Discussion and possible action to approve Work Authorization No. 4 for the Espejo-Gates Project under the County Transportation Infrastructure Fund (C.T.I.F.) in the amount of $27,500.00 for contract between Webb County and S&B Infrastructure to make revisions and reduce project scope as directed by Webb County due to budgetary constraints. Termination date of September 22, 2017 will remain; and have the Webb County Judge sign all relevant documents. [Account #3720-7230-001-432001]
 
Issue: Meet funding constraints.
 
Solution: Modify roadway design due to budget.
 
Result: Eliminate two (2) bridge crossings (as a separate project, bridge crossings will be done in the future, through other Texas Department of Transportation funding) and modify roadway design in order to meet funding available.

23.   Discussion and possible action to purchase Time Clock Plus hand scanners in an amount not to exceed $12,000.00 and to authorize a transfer of funds from Fund #3015-7050-001-470000-075 (Comprehensive Contingency Fund) to Fund #3015-1280-001-470000 (Capital Outlay - Information Technology); and any other matters incident thereto. [Requested by Delia Perales, Webb County Treasurer]

Issue: As per Commissioners Court approval on March 27, 2017, all county employees will require clocking in through the county's current biometric system. Shortage in scanners has required the additional purchase of these items.

Solution: Purchase necessary equipment to ensure all employees have access to biometric system scanning.

Result: All employees complying with court order.

24.   Discussion and possible action to award RFQ 2017-001 "Mirando City Water Storage Standpipe Tank Design Project" to Porras Nance Engineering, authorize County Staff to negotiate fees associated with the overall design phase, preparation of specifications and bid construction documents, and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. Issue: Mirando Rural Water Supply Corporation is under a TCEQ corrective order to improve their water system's storage capacity or face stiff fines.

Solution: Webb County has secured a formal solicitation from a qualified Engineering firm for this project in order to improve Mirando's City water system storage capacity.

Result: The approval of this award for engineering services will assist the residents of Mirando City Texas by improving their water system and will meet Texas Commission on Environmental Quality requirements.

Issue: Existing cameras have failed due to electrical outage.

Solution: An upgrade of the Utilities security system is recommended to provide security surveillance and digital recording during and after hours of operation and new inventory control facility.

Result: The installation of this necessary equipment will secure facilities and will deter of any potential theft.

Issue:
Currently using cell phones to communicate with servicemen out in the field and calls go straight to voice mail or go into roaming.

Solution: Purchase of portable radios a better communication tool for emergencies and customer service.

Result: Utilizing this communication tool, utilities employees keep in contact among each other and the Main Office as they undertake their daily duties and deal with irate customers.

Issue: The 2016-2017 adopted budget only partially funded the officer slots filled with five (5) post 9/11 U.S. military veterans with funding termination dates ranging from 1/22/2017 to 6/10/2017. These post 9/11 U.S. military veterans will eventually lose their jobs.

Solution: Direct the budget office to find funding within the general operating budget utilizing salary savings or other viable options to continue to fund these slots and place these slots on the upcoming 2017-2018 Webb County budget.
 
Result: Post 9/11 U.S. Military veterans who have faithfully served with the Webb County Sheriff’s Office since 2013 will continue to serve the citizens of Webb County.

Issue: The court authorized the county attorney’s office to enter into formal contractual negotiations with Laredo Four Winds II and 4V Holdings, Ltd. for a potential Chapter 381 ad-valorem tax abatement agreement with the county.
The county attorney’s office is requesting outside legal counsel from Mr. Jim Allison who is an expert in these matters.
 
Solution: Retain the legal services of Allison, Bass & Magee, LLP to assist in this matter.
 
Result: Finalize legal questions surrounding request for Chapter 381 abatement agreement with the county.
