Subject:
Discussion and possible action to authorize the Purchasing Agent to solicit for Competitive Bids in accordance with the Texas Government Code; Subchapter C. Competitive Bidding Method, Section 2269.101 for Espejo Gates roadway improvements to include but not limited to roadway reconstruction, grading, lime treatment, reworking sub-grade, other related road improvements and to approve rescinding all proposals for RFP 2016-04. This is a Texas Department of Transportation funded project (Infrastructure Fund Grant Agreement #CTIF-01-240) which allows up to 90% of allowable project costs to be reimbursed to the County, the remaining 10% is a local match by Webb County. [Account #3720-7230-001-470000 (Capital Outlay)]

Issue: On May 22, 2017 the Court rescinded the award to Martinez Paving.  Contractor informed Webb County that they could no longer commit to the project. In addition, on May 23rd TXDOT notified Webb County that the deadline to perform work and seek reimbursement for construction work has been extended until June 20, 2021.
 
Solution: Authorize the Purchasing Agent to solicit for competitive bids in accordance with State procurement laws.
 
Result: Start the formal solicitation process for this project based on competitive bids.
Background:
Webb County secured grant funding for Roadway Reconstruction improvements for approximately 27,575 feet (5.2 miles) in length of street improvements in Webb County.    To include but not limited to roadway reconstruction, grading, lime treatment, reworking sub-grade, additional base material, hot mixed asphalt/ concrete paving, drainage structures, roadside swales, and pavement markings.

On October 24, 2016, Commissioners Court awarded the project to Martinez Paving.  An executed contract has not been finalized due to value engineering figures pending in order to stay within project budget.  On May 9th, our project engineer (S&B Infrastructure, Ltd.) informed the County Engineer that the contractor will not be able to commit to the project.  Subsequently, the Contractor submitted a written notification to the Purchasing Agent explaining that they can't proceed with project due to length of time that has expired and could not commit to original pricing submitted with RFP.

Due to change in scope it would be prudent for Webb County to solicit for competitive bids versus going with next highest ranking contractor.
Previous Court Action:
On May 22, 2017 the Court approved to rescind the award to Martinez Paving.
