Discussion and possible action to authorize the Economic Development Department to assist in the development and submission of a grant application to the Texas Indigent Defense Commission for the TIDC FY 2019 Discretionary Grant – Webb County Integrated Defense Project for $377,472 in grant funds requiring a cash match of $373,164 over the four (4) year grant period. The required match shall be committed in a four-year sliding scale (1st year - 80%/20%, 2nd year - 60%/40%, 3rd year - 40%/60% and 4th year - 20%/80%). All required documents were sent for review through the Economic Development Department, and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) policy. Issue: The Public Defender’s Office is in need of an immigration attorney and a mental health social worker.

Solution: The Public Defender’s Office proposes to apply for the Texas Indigent Defense Commission FY 2019 Discretionary Grant. To qualify for this grant, it is necessary to first submit a Letter of Intent for this multi-year grant that requires a county cash match. The Texas Indigent Defense Commission (TIDC) pays up to 80% of the total project cost for the 1st year ($154,435.20), 60% the second year ($111,518.40), 40% for the third year ($74,345.60), and 20% for the fourth year ($37,172.80). Webb County will be responsible for 20% of the cost of the project the 1st year ($38,608.80), 40% the second year ($74,345.60), 60% the third year ($111,518.40), and 80% in the last year ($148,691.20). The cash match from the County for the four year period will be a total of $373,164.00 and will come from the General Fund.

Result: This grant will allow the Public Defender’s office to provide clients and Assistant Public Defenders consultation services on complex immigration issues, and early intervention for clients with mental illness/mental retardation with the goal of keeping the clients from re-entering the criminal justice system.
