4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: The program had a cost savings with the resignation of three employees (Nutrition Assistant, Head Cook I, and Head Cook II). Due to the expansion of integrated classrooms with LISD and UISD, these positions will be eliminated from the budget.  There is a need for additional funds in the Bulk Food line item to complete the fiscal year. 

Solution: Ratify the Line Item Transfer of the cost savings to the Bulk Food line item. 

Result: The Bulk Food line item will be properly funded for the remainder of the fiscal year.

a.   Discussion and possible action to authorize Webb County to execute an Order of Acceptance for the dedication of One (1) Roadway Right-of-Way Easement out of Ranchitos Los Nopalitos Subdivisions and Nine (9) Roadway Right-of-Way Easements out of Ranchitos Los Mesquites Subdivision for the purpose of acquiring these necessary easements by Webb County to perform road maintenance and improvements to facilitate transportation needs for residents including emergency medical services and school bus pickups for students, and to authorize the Webb County Judge to execute all relevant documents; and any other matters incident thereto. b.   Discussion and possible action to approve a two (2) year hunting and grazing lease renewal term extension between Webb County as Lessor, and James E. Kainer, Lessee, commencing October 13, 2018 thru October 12, 2020, with annual rent of $37,290.84 or $16.27 per acre per year, pursuant to prior award of No. 2015-3 “Lease of Cuchillas and Lomas Pastures,” as approved by the Commissioners Court on September 14, 2015. These 2 pastures combined contain approximately 2,292.00 acres of land as granted to Webb County School Lands by the State of Texas being out of Abstract 1890, survey 1687, containing 2111.39 acres and abstract 911, survey 577, containing 174.61 acres, and authorizing the Webb County Judge to execute any and all relevant documents; and any other matters incident thereto. c.   Discussion and possible action by the Webb County Commissioners Court authorizing the Webb County Judge to execute an Order approving, authorizing and directing the Webb County Clerk to waive the payment of recording fees for filing of real property documents and records in order to assist qualified persons of low or moderate income who are selected to participate in the Webb County Community Action Agency Self-Help Center Housing Rehabilitation/Reconstruction Loan Program only, as per Texas Local Govt. Code Section 118.0135 (a) & (b), and authorizing the Webb County Judge to execute any and all relevant documents; and any other matters incident thereto. Issue: The high cost and financial burden of real property document recording fees can be an obstacle to affordable home ownership for qualified persons of low or moderate income who have been selected to participate in the Webb County Community Action Agency Self-Help Center Housing Rehabilitation/Reconstruction Loan Program only. 
 
Solution: Approve a waiver of recording/filing fees for real property records as authorized by Texas Local Govt. Code Section 118.0135 for qualified persons of low or moderate income.
 
Result: Reduced costs and fees for qualified persons of low or moderate income helps to promote affordable housing and home ownership in our community.

7.   Community Action Agency
 
a.   Discussion and possible action to authorize Webb County Community Action Agency to enter into an annual vendor agreement with Retail Energy Providers (Listed below) for the implementation of Community Services Block Grant (CSBG) and Comprehensive Energy Assistance Program (CEAP). These vendor agreements are at Texas Department of Housing and Community Affairs (TDHCA) requirement for the implementation of the programs.

Issue: The Webb County CAA will enter into an annual vendor agreement with Retail Energy Providers for the implementation fo the Community Services Block Grant (CSBG) and the Comprehensive Energy Assistance Program (CEAP).

Solution: These vendor agreement are a Texas Department of Housing and Community Affairs (TDHCA) requirement for the implementation of the programs.

Result: The Texas Department of Housing and Community Affairs (TDHCA) will provide funding to be used for payment of qualifying low income clients home energy expenses.

Result: The attorney representing the State can utilize the new proceeds for the official use of his office.

10.   Economic Development
 
a.   Discussion and possible action to accept a grant from the Texas Department of Transportation in the amount of $30,000.00 for the 2018 Click It Or Ticket Campaign, designating the Webb County Judge as the authorized official in all matters related to this grant, and any other matters incident thereto. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Rodolfo “Rudy” Rodriguez, Jr., Constable Pct. 1; Account #2660-3150-330300]

Issue:
Texas Law requires drivers and passengers regardless of where they are seated in a vehicle to be secured by a safety belt or a safety seat for children under the age of 8, unless they are 4 feet 9 inches tall. However many drivers and passengers off all ages continue to ride in a motor vehicle without a safety belt or safety seat.

Solution: Constable Pct. 1 has been awarded a state grant so it can join forces with other State and Local Law Enforcement Agencies to aggressively enforce the seat belt laws in Webb County.

Result: To increase occupant restraint use in all passenger vehicles and trucks by conducting an intense occupant protection enforcement and public information and education effort during the enforcement period.

b.   Discussion and possible action to approve the submission of a grant application as prepared and submitted by the Webb County Head Start and Early Head Start Program to the Department of Health and Human Services Administration for Children & Families for a Fiscal Year 2018 - 2019 Refunding grant in the amount of $10,068,938 (Federal) and $2,517,235 (Non Federal) for a Total Amount of $12,586,173 for services to 1,290 eligible children and their families; and authorizing the Webb County Judge to execute all relevant documents related to this grant; and other matters thereto.  Furthermore, this grant does not require a cash match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. 13.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code; Section 263.152 (Disposition) and authorizing the Purchasing Agent to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value for the purpose it was originally intended for and/or surplus property that that is no longer needed by the department and may have some usefulness for the purpose it was intended and would be transferred for use by another County department or auctioned online to the general public.
 
Solution: Attempt to sell the County surplus or salvage property by competitive bids or auction, dispose or destroy property that cannot be sold through auction and/or competitive bids because it has deemed worthless or dispose through a and/or competitive bids because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.
 
Result: Generate revenue from sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets turned in by County departments.

14.   Water Utilities
 
a.   Discussion and possible action to authorize the Purchasing Agent to solicit for Competitive Bids in accordance with the Texas Government Code 2269.101; Sub-Chapter C. (Competitive Bids) to furnish and install above grade motor operated butterfly valve and other appurtenances associated with the El Cenizo Control Valve Improvements project in order to provide compliance with the Texas Commission on Environmental Quality (T.C.E.Q.) requirements, and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. Issue: Although water service meets all TCEQ standards regards to pumping capacities, requirements set forth by TCEQ required sufficient operational Elevated Water Storage Capacity in which the El Cenizo requires distribution system modifications.

Solution: Furnish and install above grade motor operate butterfly valve, electromagnetic flow meter, piping and appurtenances, as shown on the plans and specifications.

Result: Improved operations of the water distribution for the community of El Cenizo and meeting TCEQ compliance requirements.

Issue:   Line item transfer to cover future expenditures and to avoid deficit on account.  These include pending requisitions to process for the jail under Materials & Supplies and Repair Maint. Building.  The transferred funds for minor tools will provide for life-saving tools, including Automated External Defibrillators (AEDs) and QuickClot Belt Trauma Kits (BTKs).

Issue: The Repair & Maintenance Vehicles, Books & Subscriptions, Professional Services, and Minor Tools & Apparatus accounts all had unforeseen expenses. Repair & Maintenance Vehicles funds were depleted when one of the vehicles needed extensive repairs. Books & Subscriptions funds were also depleted when additional users were added to the LexisNexis, Accurint, program. Professional Services funds are needed to pay an invoice to International Bank of Commerce for research they conducted on the bank accounts of the previous administration. Minor Tools & Apparatus funds are needed to pay an invoice to Hamer Enterprises for teller scanners. Issue: 
The current term of the Webb County Casa Blanca Golf Course Management agreement with Southern Golf Management, LLP., expires on October 31, 2018. 

Solution: Authorize the Webb County Purchasing Agent to issue and publish a formal request for qualifications (R.F.Q) from an experienced golf course management company to negotiate the terms, management fees, conditions and/or other matters as needed to enter into a new golf course management agreement to maintain and operate the daily operations of the Webb County Casa Blanca Golf Course and clubhouse facility commencing November 1, 2018.

19.   Discussion and possible action to approve the revisions to the existing El Aguila Drug and Alcohol Policy, pursuant to the new federal DOT drug and alcohol test standards; and any other matters incident thereto.
 
Issue: New federal Department of Transportation Drug & Alcohol addendum needed to be approved by Commissioners' court to comply with new federal DOT drug and alcohol test standards, and implemented to the existing El Aguila Drug and Alcohol Policy.
 
Solution: The drug & alcohol addendum was approved by Commissioners Court on April 24, 2018.  The existing El Aguila Drug & Alcohol policy was revised and the addendum has been implemented within said policy.
 
Result: To comply with federal DOT test standards and have the current drug and alcohol policy up to date.

20.   Discussion and possible action to authorize the Purchasing Agent to solicit Request for Qualifications (RFQs) for material testing under the TCDP Contract # 7217491 Pueblo Nuevo Colonia – Street Improvements Project in accordance with the Texas Government Code; Chapter 2254 (Professional and Consulting Services).  This action will have no impact on the County’s General Fund Budget. (Funding Source: Texas Department of Agriculture; Account No 3521-7230-001-432001)  
 
Issue:   Colonia Pueblo Nuevo has streets that are aged and deteriorated, resulting in a potential threat to public safety and frequent maintenance issues.
 
Solution:  Webb County shall reconstruct streets to remove a potential threat to public safety and to improve access. Webb County shall reconstruct approximately four thousand linear feet (4,000 l.f.) of street utilizing a six-inch (6”) caliche base, two-inch (2”) HMAC, and all associated appurtenances.  Roadway construction shall take place in Colonia Pueblo Nuevo.
 
Result:    The performance of the roadway improvements in Colonia Pueblo Nuevo shall remove a potential threat to public safety and improve roadway access for area residents.

23.   Discussion and possible action to approve a Resolution for the collection of an additional penalty to defray costs of collection of ad valorem taxes that remain delinquent on July 1, 2018, and all subsequent years, by the attorney contracted to collect for Webb County, and authorizing the County Judge to sign all relevant documents.

Issue: Pursuant to Section 33.07 of the Texas Property Tax Code, official action by the governing body needs to be taken in order to collect attorney's fees for ad valorem taxes that remain delinquent on July 1st. 

Solution: Approve and sign the resolution.

Result: The County will be compliant with state law and be able to impose the additional penalty of attorney's fees.

24.   Discussion and possible action to modify the job description of the following Three (3) slots, Slot #0120 - Motor Vehicle Investigation Supervisor, Slot #0127 - Motor Vehicle Supervisor, and Slot #0881 - Records & Reports Supervisor, from "not covered by Civil Service" to "covered by Civil Service," subject to the Webb County Civil Service Commission approval and any applicable guidelines; and any other matters incident thereto.

Issue: The aforementioned slots are currently not covered by Civil Service.

Solution: Approve the change in job descriptions.

Result: The aforementioned slots will be covered by Civil Service pending approval from the Webb County Civil Service Commission.

25.   Discussion and possible action to rescind action taken by Commissioners Court on March 26, 2018 and April 9, 2018 on the following two (2) items at the request of the Auditors Department, Agenda Item #7207 - "Technique Data Systems Agreement" at a cost of Thirty One Thousand Two Hundred Forty Three Dollars ($31,243.00), and Agenda Item #7262 - "Ricoh Agreement" at a cost of Twenty Three Thousand Seventy Five Dollars and Ninety Cents ($23,075.90); and any other matters incident thereto.

Issue: The Auditors Department requested the aforementioned items be rescinded due to improper funding source.

Solution: Approve the rescission of the items.

Result: The Webb County Tax Assessor-Collector's Office may request allocation of funds on Item #7380.
