4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Result: The District Attorney's Office will add the new proceeds to its current budget to be utilized for law enforcement purposes in accordance with the Department of Justice Equitable Sharing Guidelines.

Issue: Funds Available in accounts will cover cost needed to continue operation of service.

Solution:By Commissioners Court approval, accounts line items transfers will have funds to cover until the extension that CAA requested to TDHCA until June 30, 2019. After court approval staff will submit ratification of transfers to TDHCA for their approval.

Result: There will be sufficient funds in both mentioned line items which will allow for continuation of service.

6.   Civil Legal Division
 
a.   Discussion and possible action to enter into a Twenty Four (24) month (June 10, 2019 through June 9, 2021) Dish Machine Rental Agreement between SSDC Sustainable Solutions and Webb County for the Casa Blanca Golf Course for an ADS-Model: AF-DS, 3 door Dish Machine at a cost of Ninety Five Dollars ($95.00) per month for a total amount of Two Thousand Two Hundred Eighty Dollars ($2,280.00) over the term of the agreement, subject to budget appropriation and authorizing the County Judge to sign and execute all relevant documents. b.   Discussion and possible action to enter into an agreement with AT&T to purchase (40) GPS trackers and associated monthly data service fees for the Webb County Sheriff's Office fleet (pursuant to Sections 271.001 and 271.102 of the Texas Local Government Code, Cooperative Purchasing Program DIR Agreement TSO-3420) for a total of $29,981.80 for two (2) years and four (4) months, subject to annual budgetary appropriation, authorizing the County Judge to execute all relevant documents and any matters incident thereto.  [Requested by Martin Cuellar, Webb County Sheriff, Grant Account #2597-3010-001-457008 (Contractual) and #2597-3010-001-460105 [Minor Tools and Apparatus)]

Issue: For officer safety within the vast network of rural, ranch land, and ranch roads of Webb County, it is important to be able to accurately locate Webb County Sheriff's Office first responder vehicles.

Solution: Utilize grant funds to purchase GPS trackers and data service fees to be better able to track Webb County Sheriff's Office units. 

Result: The Webb County Sheriff's Office first responders and radio personnel will be available to provide needed back up and other assistance to fellow officers within the vast and mostly rural areas of Webb County.

Issue: In one account there is a negative balance due to the transition from part-time to full-time. In addition, there is a zero balance for Court Interpreter/Reporter and pending invoices to be paid. 

Solution: Transfer money to no longer be in a deficit and to allow money to be used for future invoices. 

Result: There will not be any interruption in payments.

9.   Economic Development
 
a.   Discussion and possible action to authorize to enter into a contract, Vehicle Miles (VM) Amendment One to Federal 5311 Grant RPT 1901 (22) 39_19 with the State of Texas acting through the Texas Department of Transportation; wherein Webb County CAA El Aguila Rural Transportation accepts an increase of ONE HUNDRED NINE THOUSAND SIX HUNDRED THIRTY TWO DOLLARS ($109,632.00) and authorize the County Judge to execute all relevant documents. All required documentation has been sent for review and the solicitation is compliant with Webb County (SPOC) Single Point of Contact procedures. No impact to the General Fund. Issue: El Aguila is a grant funded agency. 

Solution:  Federal budget will increase and benefit both administrative and operations expenses allowing for continued transportation services to the rural areas of Webb County.

Result: Continuation of services to the rural areas of Webb County.

10.   Public Defender
 
a.   Discussion and possible action to authorize the modification of the Social Worker job description for grant funded slot #2917 to accurately reflect the current job duties and any other matters incident thereto. If approved by this court, the modifications to the job description will be taken to the Civil Service Commission for Certification. There will be no financial impact to the grant or the general fund.

Issue: In order for Social Workers to be eligible to obtain certification as a Licensed Clinical Social Worker, certain criteria must be met and reflected in the job description.  While the duties required for the certification are being performed, they are not reflected in the current job description.

Solution: Modify job description for Social Worker in order to accurately reflect the current job duties being performed.

Result: The job description will be an accurate description of the job duties as implemented, and in addition, allow Social Workers to meet the criteria for further certification.

Issue: 
Commissioners Court approved and has received bond money allocated for this project from the 2019A Bond Series.

Solution: Authorize the Purchasing Agent to solicit formal proposals for this project in accordance with Section 2269.151 of the Texas Government Code.  

Result: Secure formal proposals for consideration of award by Commissioners Court.

c.   Discussion with possible action to authorize the Purchasing Agent to solicit Request for Proposals (RFP’s) for the rehabilitation of the Colorado Acres Water Treatment Facility including the pretreatment of well raw water, reverse osmosis (RO) water filtration, disinfection, pumping plant improvements, and system control in accordance with the Texas Local Government Code, Section 262.030 (Alternative Competitive Proposal Procedure for Certain Goods and Services). [Funds available under 2019A Bond Series (3869-7230-001-474501-030); Requested by Adrian Montemayor, Utilities Director]
 
Issue: Under current conditions and due to equipment in disrepair, the Colorado Acres RO facility has been out of service requiring the delivery via truck and tanker and an average of 40,000 gallons of water daily for the use of residents of the Las Lomas colonias. If the rehabilitation of the existing facilities sufficient water could be provided for these residences without significant expenditure of labor, equipment, and fuel.
 
Solution: Rehabilitation and improvements of the inoperative equipment to current standards to provide services without the cost of trucking water.
 
Result: Reduced operational expenditure and cost of service.

d.   Discussion and possible action to authorize the donation of seven (7) used computers from Larga Vista Community Center to the Laredo Gateway Rotary Club in order to use them for an International Project with Nuevo Laredo, Mexico. Webb County previously accepted seven (7) new computers from Laredo Gateway Rotary Club to replace the used computers being requested for donation in accordance with the Texas Local Government Code; Section 263.152 (Disposition) (4).

Issue: Laredo Gateway Rotary Club donated new computers to Larga Vista Community Center.  Laredo Rotary is requesting permission from Commissioner Court for the donation of the used computers previously replaced for education purposes.

Solution: Authorize the donation as per Texas State law.

Result: Continue partnerships with charitable organizations to benefit Webb County citizens utilizing the Community Centers and also help out our Sister City with education needs for those schools that are in dire need of instructional resources and can't afford to purchase new computers.

Solution:  Request authorization from the Webb County Commissioners' Court and the Webb County Civil Service Commission to change the job title and description for a specific slot. 

Result:  The Webb County Sheriff's Office will be better able to serve the needs of the local community.

Casa Blanca Golf Course
 
14.   Discussion and possible action to approve a disbursement request from Webb County to Touchstone Golf, in the amount of $46,598.57 for the purchase of new and/or used maintenance equipment, including but not limited to a greens aerification unit, fairway aerification unit, an equipment lift, walking green mower, spare mowing heads for greens and other miscellaneous items within the funding amount requested from the Certificate of Obligations Series 2013; and any other matters incident thereto. Issue: The golf course is in need of equipment for the golf course to continue with improvements.

Solution: Allowing Touchstone to use the disbursement will provide funding for these major improvements.

Result: It is anticipated that remaining bond funds will be fully utilized with the acquisition of the equipment.

15.   Discussion and possible action for Commissioners Court to order and enforce Local Government Code Sec. 352.051 "Regulation of Restricted Fireworks" for the Fourth of July fireworks season in all the unincorporated areas of Webb County and other applicable statutes. A violation of this Order is a Class C misdemeanor, punishable by a fine not to exceed $500.00.

Issue: The current Keetch-Byram Drought Index (KBDI) average for Webb County is 360 and may reach the index trigger of 575 immediately preceding the Fourth of July holiday. (The KBDI scale ranges from 0-800, with 800 representing severe drought conditions). These conditions create a high risk for wildfires to damage life and property.

Solution: Order a restricted fireworks ban on those items classified under 49 C.F.R. Sec. 173.100 (r) (2) (10-1-86 edition), as "skyrockets with sticks" and "missiles with fins" to be enforced by the Sheriff's Office to discourage use of those fireworks to in order to prevent ignition of wildfires and damage to life and property.

Result: A conscious effort to mitigate the effects caused by fireworks and wildfires.

16.   Report from Human Resources regarding the final proposed list of approvals for departments and officials as suggested by the Segal Water Employee Classification and Wage Study report, with discussion and possible action to review and finalize proposed adjustments in job titles, classifications and salaries; including the request to add additional pay grade levels to the current wage and pay scale. Additional authorization is requested to approve a budget amendment by order into all payroll line items affected by the implementation of these revisions; and any other matters incident thereto. Result: To efficiently and effectively fill these positions with individuals for the success of the department.

Community Action Agency
 
18.   Discussion and possible action to review and approve the annual evaluation of Javier Ramirez, Executive Director, Community Action Agency (CAA). Said evaluation was reviewed and approved by CAA's Advisory Board, on Wednesday, May 22, 2019. Mr. Ramirez was given an overall Excellent to Outstanding rating.

Issue: Under the Texas Department of Housing and Community Affairs (TDHCA), Webb County Community Action Agency must adhere to Organizational Standards.

Solution: Webb County Community Action's Advisory Board met on Wednesday, May 22, 2019. They reviewed and approved Mr. Javier Ramirez's annual evaluation. By complying with TDHCA Organizational Standards, 7.4 and 7.5, it puts CAA on compliance with said standards.

Result: Webb County CAA Advisory Board is fully aware of Mr. Ramirez's evaluation.

19.   Discussion and possible action to accept the rankings and award RFQ 2019-005 "Independent Consulting Services for Webb County’s Worker’s Compensation and Property/ Casualty/General Liability Programs" to the highest ranking firm RWL (Robert W. Lazarus) Group and to further authorize the Civil/Legal Department to negotiate the terms and conditions of agreement and all necessary fees. [Requested by Dr. Pedro F. Issue: Property and Casualty insurances require evaluation on an annual basis to include Worker’s Compensation analysis reports.  Commissioners Court authorized the solicitation for request for qualifications for an independent consultant.

Only three (3) proposals were submitted. The proposals were ranked and tabulated as shown above.

Result: Staff is recommending top ranked firm for award.  Should County and highest ranked firm not come to an agreement, the County would proceed with the next highest-ranking firm.

20.   Discussion and possible action to accept the rankings and award the Request for Qualifications 2019-007 “La Presa Community Water Dispenser Project” to the highest ranking firm, Porras Nance Engineering, for engineering services for the preparation of design plans, specifications, and project oversight of La Presa Community Water Dispenser Project and to further authorize the Civil Legal Department to further authorize the Civil/Legal Department to negotiate the terms and conditions of agreement and all necessary fees. 21.   Discussion and possible action to approve an Elevator Modernization Plan for Webb County to include selection of a vendor through a cooperative state contract meeting all the competitive bidding requirements and to further authorize the annual maintenance plans for County wide coverage [Requested by the Purchasing Agent; 2019A Bond Series; 3868-7230-001-443000-250, 3868-7230-001-443000-255].

Issue:
Several County elevators are reaching their useful life and require upgrades/modernization of equipment.  The recent Bond Series 2019A has funding allocated for this project.

Solution: Authorize the Purchasing Agent to proceed with the recommended elevator modernization plan as presented.

Results: Proceed with the replacement of the most critical areas and as outlined in the modernization plan.  Replacement of elevators will be limited to the allocated funding within the 2019A Bond Series.  Those units with a longer life span will be addressed at a later time with future bond proceeds and/or as authorized by Commissioners Court.

22.   Discussion and possible action to approve the repairs to a county unit in the amount of SIXTEEN THOUSAND NINE HUNDRED THIRTY-NINE DOLLARS AND SIXTY CENTS ($16,939.60) as a result of a motor vehicle collision which occurred on February 19, 2019 involving a Webb County Sheriff Department unit. [Account #1001-1180-001-452007-340 (Claims Paid)]

Issue:
 A two vehicle collision involving a Sheriff Department unit #27-309 and a 2009 Dodge Ram Pick-up on the 3200 block of Bob Bullock. Both vehicles sustained damage in which the third party was cited.

Solution: Vehicle was appraised by the contracted vendor and will be repaired pending court approval.

Result: If approved vehicle will be repaired with no further issue.

23.   Discussion and possible action to approve repairs to a county unit in the amount of NINE THOUSAND FOUR HUNDRED EIGHTY-ONE DOLLARS AND THIRTY CENTS ($9,481.30) as a result of a motor vehicle collision which occurred on March 31, 2019 involving a Webb County Sheriff Department unit. Issue: While traveling West Bound on Hwy 59, driver lost control of unit #27-298, due to inclement weather, hydroplaned and collided with fence of a ranch property. No other vehicles were involved.

Solution:  Vehicle has been appraised by contracted vendor and will be repaired pending court approval. 

Result:  If approved, vehicle will be repaired with no further issue.
