4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue:  Grant award was issued by the funding agency after the grant performance start date; the grant-funded position had to go through the posting/intake/interview/selection process; and the selected candidate had to go through the pre-employment process.  Consequently, grant funds for salary/fringe benefits were projected to left unused unless a budget adjustment was approved by the funding agency. 

Solution:  A budget adjustment was approved by the funding agency.

Result: With the court’s authorization, grant funds may be effectively and efficiently utilized.

6.   Civil Legal Division
 
a.   Discussion and possible action to enter into a one (1) year (September 1, 2019 through August 31, 2020) Participating Entity Services Agreement between Appriss, Inc. and Webb County. The agreement is by and through the State of Texas, Department of Information Resources for products and related services with Appriss, Inc. and will provide appropriate maintenance to the software used with VINE (Victim Information and Notification Everyday Program) at a total cost of Thirty Thousand one Hundred Seventy Dollars ($30,170.32) that will be paid by the Office of The Attorney General. Issue: The Webb County CAA will enter into an annual vendor agreement with Retail Energy Providers for the implementation of the Community Services Block Grant (CSBG) and the Comprehensive Energy Assistance Program (CEAP).

Solution: These vendor agreements are a Texas Department of Housing and Community Affairs (TDHCA) requirement for the implementation of the programs.

Result: The Texas Department of Housing and Community Affairs (TDHCA) will provide funding to be used for payment of qualifying low income clients home energy expenses.

9.   Honorable Rudy Rodriguez, Constable Pct. 1
 
a.   Discussion and possible action to approve a reimbursement agreement between Webb County Constable Precinct 1 and the Organized Crime Drug Enforcement Task Forces program (OCDETF) for an amount no to exceed $18,649.00. The total reimbursement amount covers overtime for investigator assigned to the Drug Enforcement Administration (DEA) Task Force.  The period of performance for this award is October 1, 2019 through September 30, 2020. State Forfeiture funds will be utilized to cover the fringe benefits allocated to the overtime therefore no impact to the General Fund.

Issue: Collaboration between federal, state, and local law enforcement agencies is necessary to pursue and dismantle organized crime organizations along Webb County and the Texas.

Solution: Accept federal assistance to continue local participation in Joint Operations under the Organized Crime Drug Enforcement Task Forces Program.

Result: Disruption of organized crime activity along the Texas border and in Webb County.

10.   Honorable Harold Devally, Constable Pct. 4
 
a.   Discussion and possible action to approve the reimbursement of expenses incurred in accordance with the Memorandum of Understanding (MOU) with HSI/ICE enforcement Task Force for payment of overtime fringe benefits associated with Constable Harold DeValley's, Pct. 4 for the (2019-2020) fiscal year, Deputy assigned to the HSI/ICE Task Force. HSI/ICE will cover $12,000.00 in overtime from Fund #2603. Also to increase fringe benefits accounts of $2,816.00 by Constable Pct. 4 Federal Forfeiture Fund #2201 to cover fringe benefits.

Issue: Approval from Commissioners Court to provide fringe benefits covered by Constable Pct. 4.

Solution: Approval by Commissioners Court to pay fringe benefits.

Result: Constable Pct. 4 will provide fringe benefits to the designee.

11.   Economic Development
 
a.   Discussion and possible action to authorize the Economic Development Department to develop and submit a Fiscal Year 2020 Border Zone Fire Departments (BZFD) Grant application to the Office of the Governor, Public Safety Office: Homeland Security Grants Division for up to $50,000.00, and authorizing the County Judge to act as the Authorized Representative in all matters pertaining to the County's request for funding. The purpose of the application is to acquire a removable skid unit for installation on a Webb County Fire Department owned military truck for fire suppression and high water rescue. This application has no impact on the County Fund for the duration of the grant. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: As the Webb County Volunteer Fire Department expands to ensure the safety of Webb County residents, so does the demand for additional units or modification of units already in service to meet community needs.

Solution: The acquisition of a removable skid unit for use on a military truck that would aid with fire suppression and rescue.

Result: A safer resilient community and a well-prepared fire department.

Issue: 
Webb County Commissioners Court authorized the award of Schindler Elevator Corporation to modernize all County elevators on June 24, 2019.  The current priority for modernization include units 1&2 located on the southern end of the Justice Center. These units are utilized by majority of visitors and County employees on a daily basis.

Solution: Approve the execution of the contract to authorize Schindler Elevator to order parts and schedule the modernization of both elevators.

Result: Modernizing the elevators will improve the operation and reliability of the units. Reduce maintenance costs, downtime and improve customer satisfaction on ride quality.

19.   Discussion and possible action to appoint/re-appoint the Civil Service Commissioners, for a Two-year term, commencing January 1, 2020 through December 31, 2022; and any other matters incident thereto.

Issue: Term will expire for the current Commissioners Roberto Santos, Edward Sherwood and Remy Salinas.

Solution: In order for the Civil Service Commissioners to conduct business, a quorum is required.

Result: The appointment or re-appointment of the commissioners will insure smooth and efficiently run Commission, and will provide good continuity for such an important function.

20.   Discussion and possible action to approve the purchase of Two (2) Optiplex 7060 SFF computers with monitors at a cost of Three Thousand One Hundred Forty-Nine Dollars and Seventy-Six Cents ($3,149.76), and Two (2) software licenses at a cost of Eight Hundred Ninety-Eight Dollars and Eighty-Two Cents ($898.82) for a total cost of Four Thousand Forty Eight Dollars and Fifty-Eight Cents ($4,048.58). Issue: The Public Defender's Office currently has several computers that are out of warranty. At this time, we are requesting the approval to replace a portion of these computers and software at a cost of $4,048.58. 

Solution: Request is being made to approve the purchase of computers and software through the Operational Reserve account.

Result: The approval of the purchase of the computers and software will allow the Public Defender's Office to continue to function efficiently and effectively.

22.   Discussion and possible action to authorize the purchase of a parking management system from Parking Boxx in an amount totaling $44,422.50 for the property located at 1200 Washington Street. This parking management system will control access to the County’s public parking lot. [2019A Bond Series – Account #3872-7230-001-474501 Construction in Progress]
 
Issue: Commissioners Court authorized the construction of a new parking lot at 1200 Washington St., a parking management system is required in order to charge parking fees as authorized by commissioners court.
 
Solution: Approval of the parking management system will generate revenue for Webb County, monitor usage and provide adequate parking services for the general public.
 
Results: Authorize the Purchasing Agent to proceed with the purchase of the parking management system which includes installation and corresponding software/equipment.

23.   Discussion and possible action to accept the rankings listed below and award Request For Proposals (RFP) 2020-001 (Los Botines Fire station Fence Project) to the highest-ranking company Romo Contractors for the purchase and installation of a 1,740 linear feet of decorative metal fencing at Los Botines Fire station located at San Juan Road and US Highway 83 in accordance with the Texas Local Government Code, Sub-Chapter C. (Competitive Bidding in General) and to further authorize staff to negotiate a best and final offer with awarded contractor and return to Commissioners Court with a final recommendation for execution of contract. Issue: Existing Pipe Depth at Interconnection Points requires Additional Fittings and an Air Release Valve.
 
Solution: Award Change Order to sole proposer so that project can be finished up as the Existing Pipe Interconnections were not aligned.
 
Result: The El Cenizo Control Valve Improvement Project will be finalized.

25.   Discussion and possible action to approve the continued payment of overtime and fringe benefits of the grant funded State and Local Overtime and Authorized Expense/Strategic Initiative Program under the Organized Crime Drug Enforcement Task Forces for Thirty (30) days, until receipt of the agreement with the signature by the Organized Crime Drug Enforcement Task Force (OCDETF) or his designee. Webb County has already been notified of said agreement and returned ot to OCDETF with the required signature by the authorized official for Webb County, the Webb County Judge, in reference to this agreement. OCDETF will cover $18,343.00 in overtime from Fund Source 2602.  Also to increase fringe benefits accounts of $4,304.00 by Constable Pct. 4 Federal Forfeiture Fund #2201 to cover fringe benefits. State Forfeiture funds will be utilized to cover the fringe benefits allocated to the overtime therefore no impact to the General Fund.

Issue: Approval from Commissioners Court to continue providing fringe benefits covered by the Constable Pct. 4.

Solution: Approval by Commissioners Court.

Result: Constable Pct. 4 continue providing fringe benefits to the designee.
