COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

a.   Discussion and possible action to authorize the development and submission of a 2020 Census Funding Texas Counts Pooled Fund Grant Application from the Center for Public Policy Priorities and Communities Foundation of Texas in an amount not to exceed Seventy Thousand dollars ($70,000.00); and authorizing the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation. 8.   Community Action Agency
 
a.   Discussion and possible action to authorize the Webb County Community Action Agency to enter into annual vendor agreements with Retail Energy Providers (listed below) for the implementation of Community Services Block Grant (CSBG) and the Comprehensive Energy Assistance Program (CEAP). These vendor agreements are a Texas Department of Housing and Community Affairs TDHCA requirement for the implementation of the programs.

Issue: The Webb County CAA will enter into an annual vendor agreement with Retail Energy Providers for the implementation of the Community Services Block Grant (CSBG) and the Comprehensive Energy Assistance Program (CEAP).

Solution: These vendor agreements are a Texas Department of Housing and Community Affairs (TDHCA) requirement for the implementation of the programs.

Result: The Texas Department of Housing and Community Affairs (TDHCA) will provide funding to be used for payment of qualifying low income clients home energy expenses.

b.   Discussion and possible action to approve conducting a Category "B" Election to fill current vacancy as per the Governing Regulations of the Advisory Board of the Webb County Community Action Agency. (The Advisory Board shall be composed of membership that complies with the Community Services Block Grant - Texas Administrative Code Rule 5.215). Election will be held on Thursday, December 19, 2019 for a Representative and Alternate for the Area VII-Santo Nino in the Larga Vista Community Center, 5401 Cisneros from 9:00 a.m. till 5:00 p.m.

Issue: To hold Election to fill current vacancy for Representative and Alternate for Area VII- Santo Nino.

Solution: The Advisory Board shall be composed of membership that complies with the Community Services Block Grant- Texas Administrative Code Rule 5.215.

Result: Once the Election is held CAA will comply with the Texas Administrative Code Rule 5.215.

9.   Economic Development
 
a.   Discussion and possible action to approve the submission of a grant application to the Office of National Drug Control Policy for the continuation of a High Intensity Drug Trafficking Area (HIDTA) Grant estimated at $530,150 over the term of the contract. This formal request shall authorize the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in this grant. Although there is no cash match requirement for this grant; however, the District Attorney's Office requests funds to cover expenditures in excess of the grant award. The amount of $100,125 is requested each year through the county's budget process. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Contract Term: January 1, 2020 to December 31, 2020. [Requested by Isidro "Chilo" Alaniz, District Attorney; Fund #2592]

Issue: There is evidence that trafficking in narcotics and dangerous drugs exists in Laredo, Texas and that such illegal activity has a substantial and detrimental effect on the health and welfare of the people of Texas.

Solution: Gather and report intelligence data relating to trafficking in narcotics and dangerous drugs. Conduct undercover operations and engage in other traditional methods of investigations.

Result: Disrupt the illicit drug traffic in Laredo by immobilizing targeted violators and trafficking organizations.

b.   Discussion and possible action to approve the submission of a grant application as developed, written, and submitted by the Webb County Sheriff's Office to the Office on Violence Against Women (OVW) for a FY 2020 Improving Criminal Justice Responses to Sexual Assault, Domestic Violence, Dating Violence, and Stalking Grant Program in an amount estimated at $500,000.00 to enhance investigations in all matters relating to domestic violence, sexual assault, stalking and dating violence through the continuing payment of the salary and fringe benefits of a grant-funded investigator and to sustain legal advocacy efforts by the Casa de Misericordia Domestic Violence Shelter; and designating the Webb County Judge as the authorized official in all matters related to this grant; and any other matters incident thereto. This grant does not require any type of match and, thus, will have no impact on the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Violence against women is among the most intractable and deadliest criminal justice problems in the United States, especially domestic violence and in the South Texas area.  According to published statistics, the number of American women between 2001-2012 who were murdered by current or ex male partners in the United States was 11,766.  That's almost double the amount of casualties lost during wars in Afghanistan and Iraq.  Women who will be victims of severe violence by an intimate partner in their lifetimes are 1 in 4.  ("30 Shocking Domestic Violence Statistics That Remind Us It's An Epidemic" Vagianos 10/23/2014)

Solution: Casa Misericordia Domestic Violence Shelter and the Webb  County Sheriff's Office seek to continue their coordinated, collaborative efforts to assist victims of domestic violence in the local Laredo/Webb County Community.

Result: Victims of domestic violence, sexual assault, dating violence, and stalking in the Laredo/Webb County area will continue to receive improved, enhanced services from the Casa Misericordia Domestic Violence Shelter and the Webb County Sheriff's Office to assist them with needed recovery, restitution, privacy, justice, and dignity.

10.   Planning & Physical Development
 
a.   Discussion and possible action to issue a “Certificate of No-Plat Required” pursuant to Section 232.0015(f), Texas Local Government Code and the provisions of the Webb County Subdivision Regulations Section XVI.1B(2) to a replat of all of tract C-47 and the South ½ of tract C-46, into tract C-47A and tract C-47B of the Botines Subdivision (ID 10110). b.   Discussion and possible action to adopt an order to amend Section 2.1 of the Solid Waste Management Regulations to authorize an exemption certificate to implement a temporary exception to the service agreement mandate for properties in the County in which no service provider offers garbage collection services as recommended by staff in the agenda backup.
 
Issue: The current order prohibits the issuance of a permit (including electrical services) to any property that has not provided evidence of trash collection services; however, there are portions of Webb County in which no service provider of trash collection is available.  
 
Solution: Adopting the amendment will allow an exemption to properties that comply with certain criteria.
 
Result: The proposed amendment will allow for a temporary exception until a service provider becomes available.

11.   Purchasing
 
a.   Discussion and possible action to award Annual Contract Bid No. 2020-04.2 Flexible Base (Caliche) to Julio Perez, III and authorize the County Judge to sign all relevant documents and any other matters incident thereto.

Issue: The previous awarded vendor’s flexible base failed to meet the specifications required for use on County roads.  Commissioner Court authorized the Purchasing Agent to re-solicit formal bids for an annual contract.
 
Solution: Approve the sole bid for flexible base and execute annual contract effective December 9, 2019.
 
Result: Annual Contract will provide stable, lowest available and cost efficient prices from responsible bidder and more specifically servicing road projects in the Quad Cities, Webb County.

b.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value for the purpose it was originally intended for and/or surplus property that that is no longer needed by the department and may have some usefulness for the purpose it was intended and would be transferred for use by another County department or auctioned online to the general public and/or donated as permitted by law.
 
Solution: Attempt to sell the County surplus or salvage property by competitive bids or auction, dispose or destroy property that cannot be sold through auction and/or competitive bids because it has deemed worthless or dispose through and/or competitive bids because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.
 
Result: Generate revenue from sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets turned in by County departments.

c.   Discussion with possible action to award RFP 2020-002 “Prisoner Transportation Services (2 Year Contract)” to the sole proposer US Corrections LLC; and to further authorize the Webb County Judge to execute all relevant documents; and any other matters incident thereto. Issue: The contract for these services has expired.
 
Solution: Award RFP to sole proposer to provide prisoner transportation services for the Webb County Jail.
 
Result: The Webb County Jail shall have continued Prisoner Transportation services for the next 2 years.

d.   Discussion and possible action to approve the payment of a membership for a non-profit state association as required by Local Government Code Section §89.002 for the County of Webb in the amount of Five Thousand Seven Hundred Fifty Dollars ($5,750.00) Dollars to the Alliance for I-69 Texas regarding the annual membership dues. This annual membership fee will be added to the membership master list. [Requested by Tano E. Tijerina, County Judge; Account #1001-1020-001-464010 (Dues and Memberships)]
 
Issue: Local Government Code Section §89.002 requires that the Commissioners Court may spend, in the name of the county, money from the county's general fund for membership fees and dues of a nonprofit state association of counties if:
 
 (1)  a majority of the court votes to approve membership in the association;
 (2)  the association exists for the betterment of county government and the benefit of all county officials;
 (3)  the association is not affiliated with a labor organization;
 (4)  neither the association nor an employee of the association directly or indirectly influences or attempts to influence the outcome of any legislation pending before the legislature, except that this subdivision does not prevent a person from providing information for a member of the legislature or appearing before a legislative committee at the request of the committee or the member of the legislature;  and
(5) neither the association nor an employee of the association directly or indirectly contributes any money, services, or other valuable thing to a political campaign or endorses a candidate or group of candidates for public office.
 
Solution: Obtain court approval as required by State law.
 
Result: Pay pending invoices for Alliance for I-69 Texas Association.

Issue: Term will expire for the current Commissioner Remy Salinas.

Solution: In order for the Civil Service Commissioners to conduct business, a quorum is required.

Result: The appointment of the commissioners will insure smooth and efficiently run Commission, and will provide good continuity for such an important function.

14.   Discussion and possible action to authorize Webb County to enter into a Five (5) year Lease/Purchase with SHI for Microsoft Software licenses at an annual cost of $84,618.77 starting on December 30, 2019 subject to annual budget appropriations for a total cost of $423,093.85, pursuant to Sections 271.101 and 271.102 of the Texas Local Government Code, Cooperative Participation Program (Contract No. DIR-TSO-4092); and further authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. [Account #1001-1130-001-470000]
 
Issue: Microsoft Licenses must be purchased for new and existing equipment in order to have all computer systems in accordance with Webb County’s Technology Capital Improvement Plan.

Solution: To purchase the requested licenses.

Result: Core servers will be in compliance with software license regulations.

15.   Discussion and possible action to authorize Webb County to enter into a Five (5) year Lease/Purchase with Dell for seven (7) servers at an annual cost of $20,579.32 subject to annual budget appropriations for a total cost of $93,798.16, pursuant to Sections 271.101 and 271.102 of the Texas Local Government Code, Cooperative Participation Program (Contract No. DIR-TSO-3763); and further authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. [Account #1001-1130-001-470000]

Issue: Servers for Public Safety (3), Jail and Case Management(3), and Financial(1) software will no longer be supported in the near future.

Solution: To purchase the requested servers.

Result: Core servers for Webb County will be upgraded and supported for at least the next five (5) years.

16.   Discussion and possible action to approve Change Order #1 in the amount of $386,727.90 to Summit Building & Design for the Webb County Youth Village Rehabilitation Center Project. All the items included are considered upgrades with the exception of the drive loop wide-outs, which are being requested by the Fire Department prior to permitting; and authorize the Webb County Judge to execute all relevant documents; and any other matters incident thereto. LED fixture upgrades.

Solution: Approve Change Order #1 and proceed with the additional project improvements.

Result: Project will be completed as detailed under the proposed Change Order.

Issue:  The residents of Bruni, Texas and surrounding areas do not have a Public Health Facility.  Residents must travel a significant distance to Laredo to acquire healthcare services.  Webb County Commissioners Court authorized the Purchasing Agent to solicit formal RFQ for this project being funded through the Texas Community Development Block Grant (TxCDBG) Community Enhancement Fund Grant. 

Solution: Accept the rankings as submitted by the Purchasing Agent and approve the award to the highest ranking firm Redline Architecture, LLC.

Result: Proceed with negotiations to finalize an architectural agreement between Webb County and Redline Architecture and return to Commissioners Court for final approval of all terms and conditions and associated fees for scope of work.
