On March 16, at the Attorney General's request, Gov. Greg Abbott utilized Section 418.016 of the Government Code to suspend certain requirements of the Texas Open Meetings Act (TOMA) in light of the ongoing COVID-19 emergency. Tex. Gov't. Code Ann. Section 418.016 (Vernon 2017). The Governor suspended provisions of TOMA that require a quorum of the governing body and the general public to be together in a single location in order to allow videoconference or telephonic meetings.

CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: The  HIDTA Task Force Grant has provided supplemental funds for overtime (OT) operations by the two (2) grant-funded HIDTA Officers at the Webb County Sheriff's Office.

Solution: Submit a budget increase request to utilize this new grant revenue. 

Result: The investigators can conduct overtime (OT) operations with the task force for the increased security of the local community.

9.   Civil Legal Division
 
a.   Discussion and possible action to enter into Amendment #2 to the County Transportation Infrastructure Agreement Fund Grant for 2014 allowing the County to add additional projects to the program and requiring all invoices for reimbursement to be submitted on or before May 14, 2021 and any other matters incident thereto; authorizing the County Judge to sign all agreements and relevant documents. 10.   Community Action Agency
 
a.   Discussion and possible action to authorize the release of the following 10% retainer payment to Habitat for Humanity of Laredo, Inc., in the amount of $7,500, contingent upon passing the final inspection and completion of the required 30 day waiting period. Project location is 122 Milagro, Pueblo Nuevo Subdivision.  This action will not impact the County's General Fund. [Account #2530-206000]

Issue: Ten percent (10%) of the new construction project amount is held in retainage from the contractor for 30 days from the completion date of each project to ensure that any deficiencies which may arise are addressed by the contractor.  Contract amount is $75,000 and 10% retainer is $7,500. 

Solution: Commissioners Court authorizes the release of the retainer funds to the contractor.

Result: The contractor will be paid for services rendered.

b.   Discussion and possible action to authorize the release of the 10% retainer payment to Romo Contractors, in the amount of $5,392, contingent upon passing the final inspection and completion of the required 30 day waiting period for project located at 7379 Adelita Rd., San Carlos I.  This action will not impact the County's General Fund. [Account #2530-206000]

11.   Honorable Isidro Alaniz, District Attorney
 
a.   Discussion and possible action to authorize the transfer of a 2015 Chevy Tahoe (VIN: 1GNLC2EC3FR610859) Unit No. 0982 from the District Attorney’s Office to the Webb County Community Supervision and Corrections Department in accordance with the Webb County Purchasing Policy, Section 4.1 Inventory Policy and Procedures (e.) transfer, and any other matters incident thereto.

Issue: The Webb County Community Supervision and Corrections Department is in need of a reliable vehicle for its Absconders unit. The vehicle will be used to apprehend offenders with outstanding arrest warrants and to locate offenders that do not report to their supervision officers as scheduled.

Solution: Approve the transfer of the 2015 Chevy Tahoe.

Result: The Webb County Community Supervision and Corrections Department will get additional law enforcement resources to continue its efforts in apprehending offenders with outstanding arrest warrants and to locate offenders that do not report to the supervision officers as scheduled.

12.   Economic Development
 
a.   Discussion and possible action to apply for the FY 2021 - 2022 CARES Act Grant Round 2 for Webb County Community Action Agency from The Texas Department of Transportation (TxDOT) in the amount of SIX HUNDRED THIRTY TWO THOUSAND THREE HUNDRED TWENTY EIGHT DOLLARS ($632,328.00). This grant does NOT require a County Match. All required documentation has been submitted for review to the Economic Development Department and the solicitation is compliant with Webb County Single Point of Contact (SPOC) procedures. No impact to the General Fund. [Requested by James Flores, CAA Executive Director]

Issue: TxDOT has allotted monies as part of the COVID19 Emergency Relief Response in order to cover operational expenses, capital expenses and resilience projects at 100% for Webb County CAA- El Aguila Rural Transportation with NO County Match. 

Solution: This grant is calculated to cover expenses for CAA El Aguila from January 1, 2021 through December 31, 2022.

Result: Continuation of transportation services throughout the rural areas of Webb County allowing for safe and reliable response to the transportation needs of rural Webb County during the on going COVID-19 pandemic.

b.   Discussion and possible action to authorize the submission of a grant application for the Fiscal Year (FY) 2020 Operation Stonegarden (OPSG) as prepared and submitted by the Webb County Sheriff’s Office to the Office of the Governor Homeland Security Grants Division in an amount estimated at $2,249,244 for overtime, associated fringe benefits, equipment, supplies, fuel, helicopter maintenance/fuel, vehicle/tire maintenance, data services, Management & Administration (M&A), and maintenance of OPSG-acquired assets for local law enforcement agencies; and any other matters incident thereto. There is no cash match; and, thus, no cost to Webb County. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Complex and dynamic law enforcement challenges exist in the Southwest border area of the United States, including Laredo/Webb County. For example, transnational criminals seek to exploit existing law enforcement jurisdictional boundaries by conducting their illegal enterprises across traditional jurisdictional divisions. The 2014 Texas Gang Threat Assessment expounds, “Gang activity remains widespread throughout all regions of Texas…Gang activity is also prevalent in the Texas counties adjacent to Mexico and along the key smuggling corridors, since Texas-based gangs are used for cross-border smuggling and trafficking in the state. Many transnational gangs operating in Texas….engage in criminal activity in Mexico as well as in Texas and elsewhere” (Texas Department of Public Safety April 2014).

Solution: Grant application: (1) to ensure first responders are equipped with enhanced tools/equipment/resources needed to confront well-funded criminal organizations and (2) for the coordination of law enforcement efforts between various local and federal law enforcement agencies.

Result: Enhanced capabilities of local law enforcement responders; further coordination of response across local and federal jurisdictions.

c.   Discussion and possible action to rescind action taken by Commissioners Court on January 25, 2021, Item #12 (i) under the District Attorney Isidro Chilo Alaniz; and further approve the submission of a grant application to the Office of the Governor Public Safety Office Criminal Justice Division for a County Innovations Grant estimated at $250,000 over the term of the contract. The County Attorney's Office along with the District Attorney's Office will utilize this funding opportunity to prevent, investigate, and/or prosecute the commercial sexual exploitation of people in Texas. This formal request shall authorize the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in this grant. There is no cash match requirement for this grant. All grant documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Contract term: October 1, 2021, to September 30, 2022. [Requested by Marco Montemayor, County Attorney]

Issue: There is a need for resources to address the issue of sexual exploitation in our community. Persons who have suffered abuse in childhood or adolescence are susceptible to being sexually trafficked or exploited. There is a need to train those involved in the criminal justice system on how to identify potential and current victims and stop the cycle of exploitation. The Office of the Governor of Texas has provided available resources through a grant opportunity to enhance awareness, intervention and prevention of this serious issue.

Solution: Authorize the submission of the grant application as set forth above to ensure that the County Attorney's Office, District Attorney's Office, CPS Court and 406th District Court may create a diversion program for potential and current victims of sexual exploitation.

Result: The County Attorney's and District Attorney's Office will have the opportunity to receive additional resources to continue its work in identifying and fighting for victims of sexual exploitation. This will also result in a reduction of criminal activity related to sexual exploitation in our community.

14.   Fire Suppression & EMS Services
 
a.   Discussion and possible action to authorize Webb County Fire with the assistance of the Economic Development Department to develop and submit a U.S. Department of Homeland Security, FY 2020 Assistance to Firefighters Grant for up to $200,000.00, for new personal protective equipment to outfit 30 additional firefighting personnel, hoses for fire trucks, and a removable skid for a military vehicle; and authorizing the County Judge to act as the Authorized Representative in all matters pertaining to the County's request for Assistance to Firefighters Grant Program funding. This application requires a five percent (5%) cash match should the application be funded, amount shall not exceed the sum of TEN THOUSAND DOLLARS ($10,000).  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Account #1001-3140-001-431009 (Stipends)]

Issue: Submission of Assistance to Firefighters Grant (AFG) Application to benefit the Webb County Volunteer Fire Department through the acquisition of personal protective equipment for firefighters, hoses for fire trucks, and a removable skid unit for a military vehicle.

Solution: The Economic Development Department will develop and submit the application on behalf of the Webb County Volunteer Fire Department.

Result: Well- equipped firefighters to respond safely to emergency incidents, and meet required standards.

a.   Discussion and possible action to enter into a Six (6) month Professional Services Agreement (February 1, 2021 through August 31, 2021) between Webb County on behalf of Webb County Head Start/Early Head Start Program ("Head Start") and PILLAR to provide Trauma-Based Treatment training and services for Head Start employees, parents and/or clients at an hourly rate of Four Hundred Dollars ($400.00) and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. b.   Discussion and possible action to enter into a Non-Financial Memorandum of Understanding (MOU) between MHP Salud and Webb County on behalf of the Webb County Head Start/Early Head Start Program. This MOU provides a common understanding of the collaboration and relationship between the local Head Start/Early Head Start Program and the MHP Salud. It establishes clear expectations and a reliable way of relating to one another for mutual cooperation. The term of the MOU shall be for is for 9 months, commencing on December 1, 2020 and ending on August 31, 2021 and authorizing the County Judge to sign and execute all relevant documents. Issue: The Bruni Public Health Facility has been completed but is pending to be furnished and equipped so that services can begin to be provided by community partners.

Solution: Chapter 288 of the Texas Health & Safety Code limits the use of the Local Provider Participation Funds but does authorize its use to subsidize indigent programs.  The purpose of this facility is to increase access to medical care in a medically underserved community.

Result: Items needed to fully furnish this facility can be purchased so that it can be available to community partners to provide services to area residents.

19.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage or surplus property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value or some usefulness for the intended purpose is no longer needed by the department.
 
Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by State law.
 
Result: Generate revenue from public sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

23.   Discussion and possible action to allow purchasing agent to enter into an agreement between Ez Go Division of Textron Inc.(Buy Board #611-20) and Webb County for a forty-eight (48) month term for the lease of 80 new golf carts not to exceed $137.00 per month per cart for eighty carts for the use at Casa Blanca Golf course and in accordance with Texas local government code Sub Chapter F Cooperate Purchase programs; Section 271.101 and 270.102.; and further authorize a line item transfer from Account #1001-1130-001-431007-010 (Operational Reserve) for the difference to finish out the 2020-2021 Fiscal Year; and authorize the County Judge to sign and execute the lease agreement and any other matters incident thereto. Issue: The golf course is experiencing higher volume in rounds and in need for more golf carts. Currently, there are 48 carts on hand and of those only 42 are in operation dn 6 are on repair status. We have the need and opportunity to replace the entire fleet of golf carts with 80 new ones with new fleet.

Solution: Authorize the execution of a 48-month operating agreement under state cooperative contract which has met all cooperative bidding requirements of the State of Texas

Result: The golf course will have enough carts to facilitate the growth and demand of increased rounds of golf at Casa Blanca and to better serve our community with larger tournament quantities.

Issue: Elevator improvement was completed as detailed under contract specifications.

Solution: Commissioners Court authorizes the release of retainer fee for the modernization of the Justice Center elevators.

Result: Schindler Elevator Corporation will be paid for services rendered.

Issue: Only one proposal was submitted for formal invitation to RFP named above. 
 
Solution: Request direction from Commissioners Court on what action is being requested next for this formal solicitation.  Consideration to interview sole proposer company at a future meeting, reject proposal and resolicit or any other action that is in the best interest for Webb County.
 
Result: Move forward with the direction / action of Commissioners Court as approved during the February 8, 2021 regular meeting.

31.   Discussion and possible action to approve a professional service agreement between Nuestra Salud Health Clinic (NSHC) and Webb County for general medical services for Webb County Employees and dependents enrolled in the employee health plan basic medical services at a fixed cost of One Hundred Dollars per hour not to exceed twenty hours per week and grant a discretionary exemption by order under the Texas Local Government Code, Section 262.024 (Discretionary Exemptions) (A.) (4) Personal or Professional Services and to further authorize the Civil Legal Department to negotiate the legal terms and conditions of this agreement; and any other matters incident thereto. Subject to available funds under Health Account; these funds were provided to the County through the Wellness and Clinical Operational Support category and therefore, will have no impact on the General Fund. Issue: To establish a pilot program delivering basic medical services to employees and their dependents with no co-pay nor claims filed on our insurance plan.

Solution: The entering of the agreement will establish the foundation for continued basic medical services to employees and their dependents with no out-of-pocket cost to the employee.

Result: The integration of medical services with a wellness program to promote employee engagement in maintaining good health.
