4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: New equitable shared funds have been awarded to the District Attorney's Office and may be spent after a budget for the expenditure of the proceeds has been submitted to the Governing Body. The budget must be detailed and clearly define the categories of expenditures.

Issue: Deputies are currently utilizing Bullet Proof Vest Body Armor that is 5 or more years old, and some Deputies currently do not have Bullet Proof Vest Body Armor. Bullet Proof Vest Body Armor is recommended to be exchanged every 5 years or less.

Solution: Transfer the monies to complete the purchase of 21 Body Armor vest, to be worn on a daily basis.

Result: The Deputy's probability of survival is increased from a 53% chance without any type of Body Armor to an 83% chance with Body Armor.  (Data Source

9.   Civil Legal Division
 
a.   Discussion and possible action to approve a contractual amendment to the Inter-Governmental Service Agreement (IGSA) regarding the Laredo Processing Center in Laredo, TX into ICE IGSA 70CDCR18DIG000010 in order to incorporate the Wage Determination changes set out by the Department of Labor for Assistant Shift Supervisor and Senior Detention Officer; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. This will have no impact on Webb County's General Fund and there is no requisition with this Amendment. [Requested by the Webb County Sheriffs' Office, LPC Account #1001-209250-185]

Issue: A modification is required pursuant to the Department of Labor’s (DOL) Wage Determination (WD) 2015-5239 at CoreCivic’s Laredo Processing Center located  in Laredo, TX; IGSA 70CDCR18DIG000010.

Solution: Incorporate DOL WD # 2015-5239 Revisions into IGSA 70CDCR18DIG000010 (Laredo Processing Center privately owned by CoreCivic)

Result: Approval will not cost the County any money and said IGSA will comply with the  DOL Wage Determination.

b.   Discussion and possible action to authorize a Memorandum of Understanding (MOU) between Webb County for benefit of the Webb County Jail and The Rape Crisis Center (RCC) which will provide a Prison Rape Elimination (PREA) support hotline at no cost to Webb County which will assist the Webb County Jail with identifying and aiding victims of sexual violence or concerns regarding mental health needs of inmates; and authorizing the County Judge to execute all relevant documents related to this MOU; and any other matters thereto.  [Requested by Jorge L. Trevino, Jr. on behalf of the Webb County Sheriff’s Office]
 
Issue: The Webb County Jail would like to provide additional services to Webb County Jail inmates/detainees and obtain training related to this MOU. 
 
Solution: The Rape Crisis Center (RCC) has extended the offer to provide no cost services to Webb County which includes a hotline, free relevant training to correctional officers, free posters and literature for the jail on how detainees/inmates may request services.

Result: Webb County will receive PREA Services free of charge along with any training.

13.   Economic Development
 
a.   Discussion and possible action to accept the Substance Abuse and Mental Health Services Administration (SAMHSA) Grant Award, 5H79TI081059-02, year 4 of a 5 year continuation grant, in the amount of FOUR HUNDRED THOUSAND DOLLARS ($400,000.00) beginning September 30, 2021, for the Webb County Adult Drug Court, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. There is no match required, therefore there is no financial impact to the general fund. All required documents were sent for review to the Economic Development Department and the acceptance of the continuation grant is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue:
Notice of Award for Webb County Adult Drug Court, SAMHSA Grant year 4 was received on 07/30/2021, thus acceptance by Commissioners Court is required.

Solution: Accept  the Notice of Award for the Adult Drug Court and proceed with continuity of co-occurring substance abuse services to Webb County population and adjacent counties.

Result: Acceptance funds will allow the Webb County Adult Drug Court to continue to enhance and expand its services to all qualifying candidates.

b.   Discussion and possible action to authorize the acceptance of the Fiscal Year 2022-2023 Biennium State Aid and Targeted Grants Contract from the Texas Juvenile Justice Department in the amount of Two Million One Hundred Nine Thousand Six Hundred Sixty-Four ($2,109,664.00) Dollars State Aid; and $26,294.00 Targeted Grant B - Border Children's Justice Project, for the Webb County Juvenile Department. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.  [Requested by Gerardo Liendo, Chief Juvenile Probation Officer]

Issue:  The Texas Juvenile Justice Department has made available and offered state financial assistance monies to the Webb County Juvenile Department to assist in the provision of basic juvenile probation services and/or the operation of a pre-adjudication secure detention facility. 

Solution:  Approval and acceptance of the grant will allow the Webb County Juvenile Probation Department to continue providing, developing, and supporting community-based juvenile probation services and programs and meet program objectives.

Result:  Approval of grant will enhance the department's capabilities to expand and supplement services available to and provide for juveniles under the jurisdiction of the juvenile department, assist in reducing delinquency, increase offender accountability, and rehabilitate juvenile offenders through a comprehensive, coordinated, community-based juvenile probation system.

c.   Discussion and possible action to approve the submission of Grant Amendment No. 3 to Contract #58990003318 for the Comprehensive Energy Assistance Program (CEAP) from Texas Department of Housing and Community Affairs (TDHCA) for the fiscal year 2021 to amend the Administration and Direct Services budget; designating the Webb County Judge as the authorized official to sign all relevant documents; and any other matter incident thereto. All required documents were sent to for review through the Economic Development Department and the amendment is in compliant with the Webb COunty Single Point of Contact (SPOC) procedures. Issue: Approve Amendment #3 for the Comprehensive Energy Assistance Program Contract from Texas Department of Housing and Community Affairs for the Fiscal Year 2021 transfer from various accounts to Utility Assistance.

Solution: The Comprehensive Energy Assistance program provides direct client to eligible elderly, disabled and low income residents of Webb County.

Result: The services are intended to assist eligible Web County residents up to 8 highest remaining calendar months of energy consumption.

d.   Discussion and possible action to approve the submission of Grant Amendment No.2 to contract #58210003406 for the Comprehensive Energy Assistance Program (CEAP) from Texas Department of Housing and Community Affairs (TDHCA) for the Fiscal Year 2021 to transfer from Administration and Training Travel Allowance to Utility Assistance; designating the Webb County Judge as the authorized official to sign all relevant documents; and any other matter incident thereto. Issue: Approve Amendment # 2 for the Comprehensive Energy Assistance Program Contract from Texas Department of Housing and Community Affairs for the Fiscal Year 2021 transfer from Administration and Training to Utility Assistance.

Solution: The Comprehenisve Energy Assistance Program provides direct client services to eligible elderly, disabled and low income residents of Webb County.

Result: The services are intended to assist eligible Webb County residents for remaining calendar months of energy consumption. The Comprehnsive Energy Assistance Program allocation for this contract is for 12 months.

e.   Discussion and possible action to ratify the acceptance of award and enter into agreement with the Texas Department of Housing & Community Affairs for the Texas Emergency Mortgage Assistance Program (TEMAP) in the amount of FIVE HUNDRED THOUSAND DOLLARS ($500,000.00). All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures; and authorizing the County Judge to sign all relevant documents; and any matters incident thereto. [Requested by James Flores, Economic Development Director]
 
Issue: There is a great need for mortgage assistance in Webb County due to the financial hardships created by the COVID-19 Pandemic.
 
Solution: This grant will allow Webb County to assist eligible non-entitlement residents throughout Webb County, Texas affected by COVID-19 with mortgage assistance.
 
Result: If approved, funding would provide mortgage assistance for eligible non-entitlement residents affected by COVID-19.

f.   Discussion and possible action to ratify the County Court-at-Law II DWI Court Program submission of a Year 4, non-competing Continuation Grant Application for SAMHSA Grant #TI-081049 (TI-18-008) in the amount of Four Hundred Thousand Dollars ($400,000.00) and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant solicitation has been reviewed, and is compliant with SPOC. There will be no impact to the General Fund. [Requested by County Court at Law #2 - DWI Court Program]

Issue: The grant application was submitted on June 11, 2021 so as not to lose the grant funds. Grant funds have been already awarded for the next 5 years. The grant is currently entering year 4 out of the 5. However, it is required by the funding agency to submit a non-competing continuation application for each individual year of the grant. Thus, since it is the intention of County Court-at-Law II to continue to renew services under the grant over the next 5 years, a non-competing continuation application will be submitted by the DWI Court Program to continue services for year 4. 

Solution: Ratify the submission of the continuation application as submitted in order to allow DWI Court Program, to continue to offer services under the grant for year 4. 

Result: Webb County Court-at-Law II will continue to remain in compliance with SPOC, and with the submission rules and regulations set for by the funding agency.

Residents are complaining about road conditions due to previous thunderstorms.  Previously, Webb County does not have a Right of Way due to owner being a minor under a Trustee.  Owner is of age and is able to sign Right of Way. 

Solution: Budget Officer approved Ministerial Budget Amendment for the procurement of Title Search.

Result: Approve and ratify so that road in Ranchitos Los Centenarios can be maintained by the Road & Bridge Department.

a.   Discussion and possible action to accept the 2021 - 2022 grant (Year 3 of a 5 Year Funding Cycle) for the Early Head Start Child Care Partnership program in the amount of $864,237.00 (Federal), with an in-kind match of $216,059.00 (Non Federal), for a total of $1,080,296.00 to serve 72 eligible children and their families from September 1, 2021 through August 31, 2022 in Webb County. Acceptance of this grant award includes approval of salary adjustments and the filling of new/revised positions, as documented in the narrative of the grant application. Click to View
 
b.   Discussion and possible action to accept the 2021 - 2022 grant (Year 3 of a 5-Year Funding Cycle) for the Head Start and Early Head Start program in the amount of $11,215,902 (Federal), with an in-kind match of $2,803,977 (Non-Federal), for a total of $14,019,879 to serve 1,218 Head Start and 72 Early Head Start eligible children and their families from September 1, 2021 through August 31, 2022 in Webb County. Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value and/or some usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

b.   Discussion and possible action to rescind award of Invitation to Bid (ITB) 2022-18 Annual Contract for Refuse Collection to Southern Sanitation approved on July 26, 2021 - item # 32 and any other matters incident thereto.
 
Issue: Vendor was awarded more than 50% of Webb County sites based on low bid.  Vendor refused the award and placed a condition to have all sites awarded to Southern Sanitation.  Vendor was asked to reconsider their position but declined.
 
Solution: Consider recommendation to rescind award to Southern Sanitation. 
 
Result: Trashco Ltd. will remain the sole vendor servicing Webb County departments for refuse collection.

c.   Discussion and possible action to authorize the Purchasing Agent to solicit formal Requests for Qualifications for a roofing consultant to prepare design plans, technical specifications and provide site presence and construction oversight for the removal and installation of a new waterproof roofing system based upon existing conditions at the Webb County Justice Center Building and any other matters incident thereto.
 
Issue: The Justice Center Building roof has leaked on multiple occasions during heavy rains.  Webb County does not have the expertise to perform a thorough inspection of the roof and/or to prepare detail specifications and plans for vendors to submit formal bids for the removal and installation of a new roof to prevent further damage to County property due to water penetrating the roof during heavy rains.
 
Solution: Authorize the solicitation of a professional roof consultant to prepare a detailed assessment of roof condition and to further prepare plans and technical specifications to remove existing roof and install a new roofing system to prevent any further damage to building and its contents. 
 
Result: Proceed with the formal solicitation of RFQ and return to court with a recommendation to award.

Solution: Time is of the essence in soliciting requests for another Chief Medical Examiner.  An increased salary for both positions should be considered for next fiscal year in an effort to attract more qualified candidates.
