COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
Honorable Tano E. Tijerina, Webb County Judge
 
6.   Discussion and possible action to purchase One (1) mobile intensive care ambulance that will be utilized to primarily serve the Oilton, Mirando City, Aguilares, and Bruni areas of Eastern Webb County. This purchase is possible with funds provided through a Tax Abatement Agreement between Webb County and Javelina Wind Energy entered on December 13, 2013 (as per Section 9, Subsection a). Purchase is not to exceed $150,000 in funding. [Account #001-2100] [Co-Sponsored by Rosaura "Wawi" Tijerina, Commissioner Pct. 2]

Issue: To purchase an ambulance for replacement of the Webb County Sheriff’s Ambulance utilized to serve Eastern Webb County. Ambulance currently utilized is eighteen (18) years old and replacement parts are no longer available.

Solution: Purchase a new mobile intensive care ambulance in an amount not to exceed $150,000.

Result: Vehicle will be used to enhance emergency medical response in the Quad City area.
 
7.   Discussion and possible action to enter into an interjurisdictional Mutual Aid Agreement between Webb County and La Salle County to share resources, personnel, and equipment in the event of a natural or man-made emergency or disaster that exhausts local capabilities; with authority to execute given to County Judge.

Problem: The communities of Webb County and La Salle counties are vulnerable to property damage, injury, and loss of life in the event of an emergency or disaster resulting from natural or man-made hazards.

Solution: Pursuant to Chapter 791, Texas Government Code (Interlocal Cooperation Act); Chapter 418, Texas Government Code (Texas Disaster Act of 1975), and Chapter 362,Local Government Code, Webb County and La Salle Counties would like to enter a mutual aid agreement whereby resources, personnel, and equipment are shared in the event that local resources are depleted during an emergency event or disaster.


Result: Formal agreement will allow for better coordination of effort so that adequate equipment and manpower is available during an emergency or disaster event. Operational plans may be adopted pursuant this agreement and in accordance with the "Texas Disaster Act" and other applicable provision of laws

8.   Discussion and possible action to approve the posting and filling of the following Slot at La Presa Community Center, subject to the availability of payroll funds; and any other matters incident thereto, effective October 13, 2015:

9.   Report by Administrative Services department regarding recent random drug test screening of county employees and their adherence with drug testing policy; with discussion and possible action to amend the current drug and alcohol county policy in place for random drug testing to ensure immediate compliance; and any other matters incident thereto.  [Executive Session may be requested pursuant to Texas Government Code, Title 5, Subchapter D, Section 551.071 (A) (B) (Consultation with Attorney) and Section 551.074 (Personnel Matters)]
 
10.   Discussion and possible action to authorize the Purchasing Department to conduct a physical inventory of all county property and equipment at all county community centers; and any other matters incident thereto.

11.   Discussion and possible action to authorize a transfer of the duties, responsibilities and oversight of the Veterans Transportation Services Program to the offices and staff of Commissioner Precinct 4; with further action to include the transfer of the transportation van utilized to provide the service and all other veteran documentation and information related to the program; and any other matters incident thereto.
 
Issue: Veterans Transportation Program was temporarily suspended due to budget constraints and unavailable grant funds.
 
Solution: Propose to utilize current department & staff to operate Veterans Transportation Program.
 

Result: Continue providing needed transportation services to our veterans.
 
Commissioners Court Administrator
 
12.   Discussion and possible action to adopt a resolution in support of a constitutional amendment for increased state funding for transportation; and any other matters incident thereto.

Issue: The 84th Texas Legislature passed historic legislation proposing a constitutional amendment on the November 3, 2015 state ballot affecting the state’s roads, highways, and bridges.

Solution: Adopting the resolution will dedicate certain sales and use tax revenue and motor vehicle sales, use, and rental tax revenue to the state highway fund to provide funding for non-tolled roads and the reduction of certain transportation-related debt. This resolution would also allow existing sales tax revenues to be used to repay the principal of and interest on general obligation bonds issued by the state.

Result: This additional funding will aid in maintaining the current infrastructure and will ease funding new projects without the need to add any additional fees or increase taxes.
 
13.   Discussion and possible action to approve the purchase of Thirty-One (31) patches with the Webb County Logo for the remaining Webb County World War II Veterans not to exceed the total amount of $250.00. The patches will be worn on leather vests by the WWII Veterans for several upcoming events. The vests will have other patches from the City of Laredo, Sheriff’s and Veteran Coalition to promote the county and city.  [Requested by County Judge, Tano E. 14.   Discussion and possible action by Resolution of the Webb County Commissioners Court to nominate a candidate as Webb County's member to the Webb County Appraisal District Board of Directors for the 2016-2017 term pursuant as per Section 6.033 of the Texas Property Tax Code. Prior to December 15, 2015, Webb County Commissioners Court will cast its 956 votes in any manner it wishes for those individuals listed on the ballot provided by the Chief Appraiser; and any other matters incident thereto. [Requested by Martin Villarreal, Webb County Chief Appraiser]
 
15.   Discussion and possible action to allow the Budget Officers to transfer among departmental line items the amounts necessary to properly reclassify line item expenses, clear payroll fringe deficits and pay outstanding invoices for goods and services provided for the fiscal year ended September 30, 2015, preliminary lists attached.  Where no departmental line item surplus exists; allow Budget Officers to transfer available surplus balances from other Departments within the corresponding Fund.  Final listing of all the necessary transfers will be provided to the Court on December 14, 2015.

Issue: Departments have incurred expenses for which they do not have sufficient balance in the appropriate departmental line item.

Solution: Allow the Budget Officers to review the affected department’s accounts and determine a suitable account from which monies can be transferred to cover FYE 2015 outstanding invoices.

Result: Outstanding invoices for goods and services for the fiscal year ended September 30, 2015 will be liquidated in compliance with Financial Statement Audit necessary for regulatory agencies and public.
 
16.   Discussion and possible action to authorize the county attorney’s office to provide a Thirty (30) day Notice to Vacate to all tenants currently occupying the county Tex-Mex building located at 1200 Washington St, due to proposed upcoming demolition of said building. Notice should include request to remove any all personal property and equipment; and any other matters incident thereto.
 
17.   Discussion and possible action to approve payment to Texas Border Coalition for membership dues in the amount of $11,263.50. [Account  #001-0200-6007 (Dues & Membership)]

Issue:
Texas Border Coalition works closely with the state and federal government to educate, advocate, and secure funding for transportation, immigration and ports of entry, workforce, education and health care. 

Solution: Obtaining membership and joining this agency, Webb County will band together to focus on priority issues such as transportation infrastructure, border security, immigration, healthcare and workforce development.

Result: Possible programs that can increase economic opportunity and bring the border region's perspective into the state and national debate on issues that affect our community.

18.   Discussion and possible action to authorize Webb County, Texas as Lessor, to enter into a Three (3) year Hunting and Grazing Lease Agreement, with a Two (2) year renewal option with James E. Kainer, as Lessee, for the total sum of $37,290.84, at $16.27 per acre, pursuant to Bid No. 2015-3 “Lease of Cuchillas and Lomas Pastures”, as approved by the Webb County Commissioners Court on September 14, 2015, said pastures combined contain approximately 2,292.00 acres of land as granted to Webb County as school lands by the State of Texas, being out of Abstract 1890, Survey 1687, containing 2,111.39 acres and Abstract 911, Survey 577, containing 174.61 acres.  
 
19.   Discussion and possible action to approve the negotiated Three (3) year lease agreement, November 1, 2015 through October 31, 2018, between Webb County and F.D. Laurel Jr. Properties, LLC. for office space located at 1220 San Agustin, Laredo, Texas, 78040, for the Webb County Economic Development Department for a monthly fee of Two Thousand Three Hundred Dollars ($2,300.00) for the first year, Two Thousand Four Hundred Dollars ($2,400.00) for the second year, and Two Thousand Five Hundred Dollars ($2,500.00) for the third year for a total of Eighty-Six Thousand Four Hundred Dollars and for County Judge to sign all relevant documents; and any other matters incident thereto. 20.   Discussion and possible action to authorize the Webb County Attorney’s Office to finalize the purchase by Webb County, Texas as buyer of a 6.14 acre tract of land out of a 10.14 acre tract of land, situated in Webb County, Texas, from Simeon Development, LTD., as seller, at fair market value plus related title company closing costs; for future use as a Webb County fire station site. Said tract of land being located out of Survey 1713, Abstract 525, E.B. Ragsdale, original grantee, Survey 737, Abstract 275, Rusk Transportation Co., original grantee, and authorizing the Webb County Judge to execute all relevant documents at closing and any other matters incident thereto.  [Closed/Executive Session to deliberate the purchase and value of real property pursuant to section 551.072 of the Texas local government code]

Issue:  Webb County is finalizing the purchase of land for use as a future fire station site by the Webb County Fire Department in northwest Webb County. 


Solution: The purchase of this tract of land will be for used as future Webb County fire station site in by the Webb County Fire Department.   The Webb County Commissioner’s Court had previously accepted the donation a 4.00 acre tract of land, located directly adjacent to the 6.14 acre tract of land proposed to be purchased.

Result: Provide the land needed to begin the construction of the much anticipated Webb County Fire Station.
 
21.   Discussion and possible action to approve a renewal of Title IV-E Child Welfare Services Contract #23940437 and Title IV-E Legal Services Contract #23940438 with the Texas Department of Family and Protective Services requiring Webb County to maintain a Child Welfare Board and providing for the reimbursement for certain expenditures made by Webb County relating to foster children, and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto.

22.   Discussion and possible action to authorize the Economic Development Department to develop and submit a Sexual Assault Justice Initiative (SAJI) grant application to the U.S. Department of Justice’s Office of Violence Against Women (OVW) in an amount not to exceed four hundred thousand dollars ($400,000.00) over a two-year term for the purposes of enhancing the community’s response to sexual violence; and authorizing the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in the Sexual Assault Justice Initiative. This action will have no impact on the County General Fund. [Co-Sponsored by Frank Sciaraffa, Commissioner Pct. 1]

Issue: The community currently lacks the services of a Sexual Assault Response Team (SART), vital to the prosecution of sexual assault crimes.

Solution: The County of Webb, together with the Webb County District Attorney’s Office and other community stakeholders, seek funds to enhance the community’s response to sexual violence by ultimately creating and implementing a SART.





Result: The development and submission of a Sexual Assault Justice Initiative grant application for a two-year program that will address sexual violence. The program will be a multipronged approach, partnering several community stakeholders to help serve and protect victims of sexual violence. The proposed program will function using the Full-Time Equivalency (FTE) system; no new hires are proposed. 
 
Honorable Monica Notzon, 111th District Court Judge
 
23.   Discussion and possible action to approve the purchase of the following items to set up offices for Honorable Selena Mireles, newly appointed Judge of the Child Protective Court.  Items to be purchased include desk, credenza, filing cabinet, executive chairs and 2 side chairs, printer/scanner/fax machine in an amount not to exceed $8,000.00. [Account #603-0101-8801]

Issue: Judge Mireles was recently appointed to preside over Child Protective Court, the previous Judge will be taking his furniture with him.

Solution: Purchase office furniture for Judge Mireles.

Result: Secure funding to purchase furniture.
 
Honorable Jesus Garza, County Court at Law 2 Judge
 
24.   Disscussion and possible action for approval of budget for fiscal year 02 of the Juvenile Drug Treatment Court Program/SAMHSA grant #TI-025482. Budget amount is $325,000/year for a period of Three (3) years beginning September 30, 2014 and ending on September 29, 2017. Grant funds are for the operation of the Webb County Court at Law 2 Juvenile Drug Treatment Court Program. There are no changes to the budget being proposed.
 
 
25.   Discussion and possible action to approve the acceptance of the SAMHSA grant award Grant No. TI-026095-01 and authorize the Webb County at Law 2 DWI Court Program to continue to expand its program services pursuant to Sec. 124.002 of the Texas Government Code. Substance Abuse & Mental Health Services Administration (SAMHSA) Grants to Expand Substance Abuse Treatment Capacity in Adult Drug Courts Grant Period: September 30, 2015 - September 29, 2018. This grant does not require any match.
 
Honorable Martin Cuellar, Sheriff
 
26.   Discussion and possible action to ratify the acceptance a grant award from the Bureau of Justice Assistance (BJA) for Fiscal Year 2015 State Criminal Alien Assistance Program (SCAAP) in the amount of $98,568 for reimbursement of costs already incurred for the incarceration of undocumented criminal aliens at the Webb County jail; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant is a reimbursement of expenses already incurred at the Webb County jail and does not require any cash match.

Issue:  Although immigration matters, including illegal immigration, are constitutionally established as existing under the legal jurisdiction and regulation of the federal government, state prisons and local detention facilities, such as the Webb County jail, incurs significant costs incarcerating undocumented foreign aliens who commit crimes in the United States. This includes but is not limited to supervision, housing, feeding, clothing, any medical and transportation expenses, and other associated detention costs.

Solution:  Grant award for reimbursement of a small percentage of the incurred correctional officer salary costs associated with detaining undocumented criminal aliens who had at least one felony or two misdemeanor convictions for violations of state or local law and who were incarcerated at the Webb County jail for at least four (4) consecutive days during the reporting period of July 1, 2013 to June 30, 2014.

Result:  Webb County will be reimbursed by the federal government a limited percentage of the amount of its already incurred costs of detained foreign criminals incarcerated at the Webb County jail.
 
27.   Discussion and possible action to accept a grant award in the amount of $18,959 from the Bureau of Justice Assistance (BJA) for a Fiscal Year 2015 Body-Worn Camera Policy and Implementation of New Body Worn Cameras (BWC) Program for the policy development/implementation and purchase of Body Worn Cameras for the Webb County Sheriff’s Office and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto.  This grant requires a Fifty (50%) percent match, or an $18,959 cash match from Sheriff's Forfeiture funds. [Account #168-2001-9301]


Issue:  Tragic local and national events have eroded public trust in law enforcement agencies and their officers.  Recent violence has again focused attention on controversial confrontations between certain citizens and law enforcement officials; and, this violence has further fomented distrust between community members and the officers sworn to protect them.

Solution:  Grant award to leverage federal resources so that the Webb County Sheriff’s Office will be able increase transparency and accountability through the grant-funded implementation of a comprehensive, holistic body-worn camera system for its sworn officer force.

Result:  The Webb County Sheriff’s Office will be able to achieve greater transparency and accountability in its service and protection of the Laredo/Webb County public and taxpayers while leveraging federal grant funding to implement a complex technological system that would otherwise require substantial initial start-up costs to be paid through the Webb County budget.
 
28.   Discussion and possible action to accept a grant award from the Office of the Governor Criminal Justice Division for a Violent Crimes Against Women Criminal Justice and Training in the amount of $12,637 for training, equipment, and supplies for investigators working at the Webb County Sheriff’s Office serving victims of violent crimes against women and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires a Thirty-Five (35%) percent cash match ($6,805 cash match), which will be provided by the Webb County Sheriff’s Office.  [Account #168-9501-9301 (State Forfeiture Funds)]

Issue:   Violence against women is among the most intractable and deadliest criminal justice problems in the United States, especially domestic violence and in the South Texas area.  According to published statistics, the number of American women between 2001-2012 who were murdered by current or ex male partners in the United States was 11,766. That's almost double the amount of casualties lost during wars in Afghanistan and Iraq.  Women who will be victims of severe violence by an intimate partner in their lifetimes are 1 in 4.  (“30 Shocking Domestic Violence Statistics That Remind Us It’s An Epidemic”  Vagianos 10/23/2014)

Solution:  Grant award to enhance the tools, techniques, and training to those investigators and patrol officers who initiate contact with these victims, respond to calls for assistance, file incident reports, provide these victims information/referrals to service providers, investigate cases/incidents, initiate arrests of perpetrators, refer cases for prosecution/follow up cases of domestic violence, sexual assault, dating violence, and stalking.

Result:  Enhanced law enforcement services, including patrol response and investigative techniques, to deal with emergent criminal trends, such as cyber stalking, and improved efficacy of the law enforcement response to the needs of victims of violent crime.
 
Honorable Delia Perales, Treasurer
 
29.   Discussion and possible action to request and approve a payment reimbursement from the County Attorney regarding an overpayment due an oversight at the Treasurer's office. [Executive Session may be requested pursuant to Texas Government Code, Title 5, Subchapter D, Section 551.071 (A) (B) (Consultation with Attorney) and Section 551.074 (Personnel Matters)]

 
Administrative Services
 
30.   Discussion and possible action to approve the Insurance Committee recommendation for the Retiree Program. The County Contribution will be from $100.00 to $517.50 and the Retiree Contribution will be from $350.00 to $381.00 and $812.00 per dependent per month. 
 
 
Community Action Agency
 
31.   Discussion and possible action to approve Bethany House and Lulac Council #624 as Representative Organizations for Category "C" for the Webb County Community Action Agency Advisory Board; and any other matters incident thereto.

Issue: State mandates of filling vacancies when applicable terms end as per Texas Administrative Code, Chapter 5 Rule 5.215.

Solution: Vacancies will be filled.

Result: We will comply with the TDHCA -Texas Administrative Code, Chapter 5 Rule 5.215.
 
32.   Discussion and possible action to accept and approve the By-Laws change and recommendations from the Webb County Community Action Agency Advisory Board as endorsed and approved by them during the September 23, 2015  board meeting. Proposed change applies to Article V Section 1 Category "A".

Issue: These proposed changes are being recommended by the Texas Department of Housing and Community Affairs (TDHCA) staff.

Solution: CAA will comply with the Texas Administrative Code Chapter 5 Subchapter B ( Community Services Block Grant) Rule 5.213.

Result: Once approved by the Governing board a signed copy of the  By-laws will be given to each board member.
 
Economic Development

Engineer
 
34.   Discussion with possible action to award a project to Select Energy Services of Laredo, Texas in the amount not to exceed $20,160.00 for repair and equipment replacement of the water well at Colorado Acres.

Issue:  The well at the Colorado Acres Reverse Osmosis Water Treatment Facility is currently inoperable.  We are unable to proceed with the cost evaluation and preliminary engineering for installing a new RO treatment unit until the capacity and quality of the water is examined while the well is in operation.

Solution:  Receive proposals for the well repair inclusive of new pump and motor and initiate project completion.

Result:  Well is returned to full operation and we can continue with examination of RO treatments, facility repair and/or replacement.

36.   Discussion and possible action to convert Slot #2049, Full Time Classroom Aide, with an hourly rate of $8.49 to Part Time Classroom Aide, with an hourly rate of $8.49, for 20 Pay Periods, and to post and fill this Slot, subject to the availability of payroll funds. 

Issue: The Head Start program has a long term plan of phasing out (via attrition) full time Classroom Aide positions and converting them to part time positions.

Solution: Convert the vacant Full Time slot to a Part Time slot; post and fill the position. 

Result: The program will be on target with the long term plan of phasing out Full Time Classroom Aide positions. 
 
Planning
 
37.   Discussion and possible action to approve a title change only to Slot #1292, Fund 010, Dept. 0102 (Planning) as follows:

Issue: Although there is no change in the wage grade of the proposed title change since both position titles are equally classified under Grade 12, the existing title of the position does not reflect the either assigned duties or the certified job description.  The Webb County Civil Service Commission approved the job description for this position on October 2, 2015 comparable to those descriptions approved for all other Administrative Assistant positions contingent upon the Court’s approval of the title change.
 
Solution/Result: Approve the title change as requested to obtain uniformity in the assigned duties and certified job description for the position.  
 
38.   Discussion and possible action to approve the filling and posting of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective October 13, 2015:

Pre-Trial Services
 
39.   Discussion and possible action to approve the 2016 Formula Grant Indigent Defense Resolution. The Texas Commission on Indigent Defense has budgeted $24,000,000, for Fiscal Year 2016, to develop and maintain quality, cost effective indigent defense system that meet the needs of local communities and the requirements of the Constitution and state law. This amount is shared by other counties throughout the state. Webb County will be eligible to receive a portion of the funding.
 
Purchasing
 
40.   Discussion and possible action to purchase Three (3) vehicles (Two (2) Early Head vans for home visitors and One (1) for food transporter) for Head Start Department from Toyota of Laredo and Family Chevrolet in the amount of $77,444.19. [Requested by Aliza Oliveros, Head Start Director; Accounts #903-4208-8801 and #909-4208-8801]

Issue: Head Start Program was provided funding for the purchase of three vehicles (2 Early Head vans for Home Visitors and 1 for Food Transporter).

Solution: Purchase of vehicles

Result: The Head Start program will have three additional vehicles to carry out grant functions.

42.   Discussion and possible action to Reject and Re-bid RFP 2015-15 Tex-Mex Building Asbestos Removal project due to over budget.  [Request by Luis Perez Garcia, County Engineer]

Issue: Webb County solicit Request for Proposals for Asbestos Removal for Tex-Mex Building.

Solution: All asbestos abatement work will be accomplished by and EPA accredited and Texas licensed asbestos abatement contractor.

Result: Project needs to be done before the Tex-Mex Building is demolish.
