On March 16, at the Attorney General's request, Gov. Greg Abbott utilized Section 418.016 of the Government Code to suspend certain requirements of the Texas Open Meetings Act (TOMA) in light of the ongoing COVID-19 emergency. Tex. Gov't. Code Ann. Section 418.016 (Vernon 2017). The Governor suspended provisions of TOMA that require a quorum of the governing body and the general public to be together in a single location in order to allow videoconference or telephonic meetings.

CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. 9.   Honorable Victor Villarreal, County Court at Law 2 Judge
 
a.   Discussion and possible action to adjust pay rates for County Court-at-Law II DWI Court Program Staff associated with SAMHSA Grant Award Number 1H79TI081049-01 (TI-18-008) and request County Judge to execute all other matters incident thereto. The Fiscal Year 2020-2021 budget includes a one-step increase in the salary for the Project Director slot, and salary with one-step increase for the Case Manager slot. Both of these positions do not fall under the County’s Wage Plan, and are funded 100% by grant funds. Both positions are also subject to annual evaluations by the Department Head, and are entitled to additional increases under the grant. There will be no impact to the General Fund.

10.   Economic Development
 
a.   Discussion and possible action to accept a grant in the amount of $29,067.94 from the Office of the Governor as developed, prepared, written, and submitted by the Justice of the Peace, Pct. 4 in conjunction with the Webb County Sheriff’s Office to continue to pay the grant-funded salary and fringe benefits of the Truancy Juvenile Case Manager in order to continue to divert at-risk truant juveniles from entering into the criminal justice system; and designating the Webb County Judge as the authorized official and any other matters incident thereto. The total amount needed to continue to pay the case manager as a full time employee totals to $58,376.53. The difference to cover the remaining salary and fringe benefits of the full-time employee (Slot # 2886) of $29,308.59 will be paid from the Office of the Justice of Peace special fund (Fund 2009) and will cover the entire remaining 50.2061% of Juvenile Case Manager’s salary and fringe benefits. Thus, this grant will continue to have no impact on the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Jose R. Issue: Truancy can be considered a gateway to juvenile delinquency and is a nationwide problem that negatively affects not only the delinquent youth and their families but also adversely impacts schools, neighborhoods, and the local community at large. In addition, youth at-risk for juvenile delinquency who enter into the juvenile justice system tend to face limited future career, educational, and other socio-economic prospects, especially in the South Texas area.

Solution: Grant award to continue to fund a currently grant-funded truancy case manager in order to continue to provide prevention, diversion, and intervention strategies through the court of the Justice of the Peace, Precinct 4 in Laredo/Webb County area.

Result: This grant will allow Juvenile Case manager to focus on diversion strategies to steer at-risk juveniles from the juvenile and criminal justice system.

b.   Discussion and possible action to accept a Justice Assistance Grant Program (JAG) grant award as developed, written, presented, and submitted by the Webb County Sheriff’s Office to the Criminal Justice Division (CJD) Office of Governor (OOG) in the amount of $26,232.55 for overtime (OT) for officers working in the Mental Health Unit to assist and provide transport services to citizens undergoing emotional and/or mental health crises; authorizing the County Judge to enter into the grant agreement and to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Martin Cuellar, Webb County Sheriff; Grant Fund #2738]

Issue: The local Laredo/Webb County community continues to constitute a medically and mental health underserved area, which requires mentally ill youth and adults to travel to out-of-town facilities in order to receive these needed mental health services.

Solution: Grant award to provide overtime and applicable fringe benefits for the members of the Mental Health Unit to transport mental health patients to these out-of-town facilities so that they may receive the care that they require.

Result: Grant funding will allow members of the Mental Health Unit to undertake complex and time consuming activities and requirements, including execution of court orders, mental health commitments, and the actual transports to out-of-town mental health facilities, so that the mentally ill patients, their families, and the overall community can be better served.

c.   Discussion and possible action to accept a grant award by the U.S Department of Justice (DOJ) in the amount of $26,232.55 as developed, written, and submitted by the Webb County Sheriff's for the acquisition of portable radios, and authorizing the County Judge to  enter into the grant agreement and to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Since the tragedy of 9/11, the urgent need for expanded and enhanced interoperable communications for first responders in the United States was understood to help save the lives of both first responders and the citizens they serve.
 
Solution: Grant application for the acquisition of interoperable equipment utilizing to provide enhance interoperable communications for the Webb County Sheriff’s Office.

Result: The Webb County Sheriff’s Office will have increased interoperability capacities.

d.   Discussion and possible action to accept a Violent Crimes Against Women Criminal Justice and Training (VAWA) grant award as developed, written, presented, and submitted by the Webb County Sheriff’s Office to the Criminal Justice Division (CJD) Office of Governor (OOG) in the amount of $7,000 for training, travel, and supplies for investigators and patrol officers working at the Webb County Sheriff’s Office serving victims of violent crimes against women and authorizing the County Judge to enter into the grant agreement and to execute all relevant documents; and any other matters incident thereto. This grant does not require a cash match; and, thus, this grant will have no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Martin Cuellar, Webb County Sheriff; Grant Fund #2605]

Issue: Violence against women is among the most intractable and deadliest criminal justice problems in the United States, especially domestic violence and in the South Texas area. According to published statistics, the number of American women between 2001-2012 who were murdered by current or ex male partners in the United States was 11,766. That's almost double the amount of casualties lost during wars in Afghanistan and Iraq. Women who will be victims of severe violence by an intimate partner in their lifetimes number 1 in 4.  (“30 Shocking Domestic Violence Statistics That Remind Us It’s An Epidemic”  Vagianos 10/23/2014).

Solution: Grant award to enhance the tools, techniques, and training to those investigators who follow-up to calls for assistance, conduct interviews with these victims, file incident reports, provide these victims information/referrals to service providers, initiate arrests of perpetrators, refer cases for prosecution, and prepare testimony/evidence for trial in cases of domestic violence, sexual assault, dating violence, and stalking.

Result: Enhanced law enforcement services, including investigative techniques, to deal with emergent criminal trends, such as cyber stalking, and improved efficacy of the law enforcement response to the needs of victims of violent crime.

e.   Discussion and possible action to authorize the submission of a grant application to the Office for Victims of Crime, U.S. Department of Justice developed, written, and submitted by and for the Webb County Sheriff's Office in the amount estimated at $5,000 for community awareness project activities to take place during the 2021 National Crime Victims’ Rights Week; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The rights of crime victims are enshrined in the federal code (Section 3771 of Title 18 of the U.S. Code, Crimes and Criminal Procedure), the Texas Constitution (Article I Section 30), and the Texas Code of Criminal Procedure (Chapter 56).  However, many victims of crime are unaware of their mandated rights as well as the services that are specifically available to them to facilitate needed restitution, recovery, privacy, dignity, and justice.
 
Solution: Grant application to highlight the rights of and services for crime victims in the Laredo/Webb County area during the 2021 National Crime Victims’ Right Week.
 
Result: The general public and any victims of crime will become more aware of the services available to them in the Laredo/Webb County area.

f.   Discussion and possible action to authorize the submission of second grant application for Meals on Wheels America in the amount of Fifty Thousand Dollars ($50,000.00). This grant does not require a County Match. All required documentation has been submitted for review to the Economic Development Department and the solicitation is complaint with Webb County Single Point of Contact (SPOC) procedures. No impact to the General Fund. [Requested by Community Action Agency; Account #2371-5260-521-441211-010]

Issue: CAA Meals on Wheels is a grant-funded agency. Meals on Wheels America identified Webb County Community Action Agency as a possible recipient for additional funding for items needed during COVID-19 pandemic.

Solution: This grant will allow us to deliver shelf stable ready meals to elderly; health compromised and handicapped/disabled residents of Webb County, Texas.

Result: If approved, funding would allow Meals on Wheels Program to expand home delivery meal services per household to eligible participants of ready meals to the most vulnerable population during COVID-19 pandemic.

g.   Discussion and possible action to authorize a change to the grant Authorized Representative (AR) for SAMHSA TI081059-01 from the 406th Judicial District Court, Honorable Judge Oscar J. Hale Jr., and designating the Honorable Tano E. Tijerina, Webb County Judge as Authorized Representative (AR) as it pertains to the Adult Drug Court Program; authorizing the County Judge to act as the Chief Elected Official in all matters pertaining to the County's request. The change in grant AR does not require a change in the approved budget nor does it affect the general fund. All required documents were sent for review through the Economic Development Department and the request is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Judge Oscar J. Hale, Jr., 406th Judicial District Court]

Issue: The 406th District Court is requesting a change in management for the above reference grants.

Solution: Through this proposed change, the 406th District Court will be able to focus on newly adopted court procedures as it relates to jury selection and court proceedings.

Result: If the request is approved, the Adult Drug Court Program and the Veterans Treatment Program will continue to provide outpatient treatment services to individuals in the community.

Hale Jr., and authorizing the 341st Judicial District Court, Honorable Rebecca “Beckie” Palomo as Authorized Representative (AR) as it pertains to the Veterans Treatment Program; authorizing the County Judge to act as the Chief Elected Official in all matters pertaining to the County's request. The change in grant AR does not require a change in the approved budget nor does it affect the general fund. All required documents were sent for review through the Economic Development Department and the request is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Judge Oscar J. Hale, Jr., 406th Judicial District Court]

Issue: The 406th District Court is requesting a change in management for the above reference grants.

Solution: Through this proposed change, the 406th District Court will be able to focus on newly adopted court procedures as it relates to jury selection and court proceedings.

Result: If the request is approved, the Adult Drug Court Program and the Veterans Treatment Program will continue to provide outpatient treatment services to individuals in the community.

i.   Discussion and possible action to ratify the acceptance of grant increase of Thirty-Four Thousand Three Hundred Seventy-Five Dollars ($34,375.00) to contract Amendment No. 2 contract Number 58200003175 for the Comprehensive Energy Assistance Program (CEAP) FY-2020 from the Texas Department of Housing and Community Affairs (TDHCA). Authorizing the County Judge to sign all relevant documents. Grant account #2362-5150-330300. This action will not have an impact to the General Fund. Documentation has been reviewed by Webb County Economic Development Department and is in compliant with SPOC policies and procedures. b.   Discussion and possible action to dispose of five modular buildings known to this program as Jesus Garcia I, II, and III and Magic Corner I and II.  As of August 2011, the Webb County Head Start Program has been gradually integrating classrooms with the two local independent school districts (ISD). Currently, the program has twenty-three (23) classrooms integrated with Laredo ISD and twenty-one (21) classrooms integrated with United ISD. Head Start students benefit from the instruction of an ISD certified teacher, a Head Start Teacher Assistant, and a Head Start support staff. This integration allows for augmented instruction with the implementation of Head Start Program Performance Standards and the State of Texas Day Care Licensing regulations which are overseen and implemented by Head Start employees. With each new integration, the use of dated modular buildings that are placed on rented property is being phased out. If approved for disposition, the program plans to follow the Webb County Purchasing Rules and Regulations for property transfer (donation - no value to be received) to a local, non-profit agency named Volunteers Serving the Need (VSTN). a.   Discussion and possible action to approve the Texas County & District Retirement System (TCDRS) Plan Agreement for Plan Year 2021 with a retirement plan rate of 12.30% effective January 1, 2021.
 
Issue: The current retirement plan rate for the county is 12.30%. The rate will not change in year 2022, due to Covid-19, the county will have a cushion for the investment loss.
 
Solution: Rate remains the same and will not impact the county with a negative effect of Covid-19.
 
Result: The plan rate remains the same.

Issue:
Currently, Section 415 of the Internal Revenue Service (IRS) amended the limitation cap of the total amount of annual retirement benefit payments
 
Solution:
Adopting TCDRS 415 Agreement will allow the county to make up for payments that would have been reduced by Section 415.
 
Result: Adoption of this Agreement, will place the county in compliance with TCDRS and IRS Mandates.

a.   Discussion and possible action to authorize Webb County to enter into a Five (5) year agreement with Insight Public Sector, Inc. for a software subscription at an annual cost of $41,472.00 with a total cost of $207,360.00 pursuant to Sections 271.001 and 271.102 of the Texas Local Government Code, Cooperative Purchasing Program (Contract No. DIR-TSO-4167); and further authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. Issue: Dual authentication is a security feature that Webb County does not have at this time.

Solution: Approve and procure the requested items.

Result: Purchased items will enhance cybersecurity protection for Webb County's IT network infrastructure.

a.   Discussion and possible action to issue a “Certificate of Compliance with Plat Requirements” to authorize an unplatted 2.67 acs tract of land, more or less, out of Tract Forty (40), La Presa Subdivision #1, situated in Porcion 42, Abstract 285, Eugenio Sanchez, as further described in Vol. 4788, Pgs. 068, Webb County Deed Records. (ID 10690).
 
Issue: Item is a regulatory compliance issue regarding real property development provisions of state law and local regulations with particular emphasis on the Model Subdivision Rules enacted for residential subdivisions.  Commissioners Court must certify to certain property conditions before utility service connections may be authorized.

Solution: As reflected in agenda backup, staff has verified compliance matters and recommends the Court’s approval of this certificate.

Result: If approved, applicant may connect property to electrical utility services.  If not approved, utility connection to property is prohibited.

a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value for the purpose it was originally intended for and/or surplus property that that is no longer needed by the department and may have some usefulness for the purpose it was intended and would be transferred for use by another County department or auctioned online to the general public and/or donated as permitted by law.
 
Solution: Attempt to sell the County surplus or salvage property by competitive bids or auction, dispose or destroy property that cannot be sold through auction and/or competitive bids because it has deemed worthless or dispose through and/or competitive bids because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.
 
Result: Generate revenue from sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets turned in by County departments.

b.   Discussion and possible action to approve the execution of a "Webb County Agricultural Grazing and Hunting Lease for the Cuchillas & Lomas II Pastures" Webb County School Lands (W.C.S.L.) located on Hwy 59 East, as per Court’s prior award of “Webb County Request for Proposal R.F.P. 2020-013” to the highest ranking proposer, James E. 16.   Honorable Martin Cuellar, Sheriff
 
a.   Discussion and possible action to accept a FY 2018 Operation Stonegarden (OPSG) Supplemental Funding for the overtime and fringe benefits for radio dispatchers working at the Webb County Sheriff’s Office for a total amount of $30,000, and authorizing the Webb County Judge to enter into the grant agreement and to execute all relevant documents in all matters related to this grant; and any matters incident thereto. This grant has no cash match; thus, there is no impact on the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Grant Account #2465]
 
Issue: Local law enforcement working in international border communities must work within limited budgetary constraints to provide both proactive and responsive law enforcement services while transborder criminal organizations possess unlimited funding to avoid detection/disruption of their activities utilizing their proceeds obtained through illegal but highly lucrative drug trafficking and other unlawful enterprises.
 
Solution: Supplemental grant award to provide supplemental overtime and fringe benefits to assist the Webb County Sheriff’s Office in providing enhanced border security for the residents/citizens of Laredo/Webb County.
 
Result: The Webb County Sheriff’s Office and its radio dispatchers will be able to work more effectively and for longer hours with these supplemental funds.

Solution: Enroll eligible employees and all County officials in TAC's DIR certified Cybersecurity course at no cost to the County.
