On March 16, at the Attorney General's request, Gov. Greg Abbott utilized Section 418.016 of the Government Code to suspend certain requirements of the Texas Open Meetings Act (TOMA) in light of the ongoing COVID-19 emergency. Tex. Gov't. Code Ann. Section 418.016 (Vernon 2017). The Governor suspended provisions of TOMA that require a quorum of the governing body and the general public to be together in a single location in order to allow videoconference or telephonic meetings.

CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. a.   Discussion and possible action to enter into a Twelve (12) month (October 1, 2020 thru September 20, 2021 for Units 71, 73, 74, & 75) and (November 1, 2020 thru October 31, 2021 for **Unit 80 only), Self-Service Storage Rental Lease Agreements between South Meadow Self Storage and Webb County/Webb County Tax Assessor’s Office for FIVE (5) 10 x 20 Storage Units (Space numbers (71, 73, 74, 75 & 80) at a cost of ONE HUNDRED EIGHTY DOLLARS ($180.00) each being a rental amount of ONE THOUSAND EIGHT HUNDRED DOLLARS ($1,800.00) for each unit per month/year for a total of NINE THOUSAND DOLLARS ($9,000.00) in rent for the 5 units over the term of the agreement paid in advance and receiving two (2) months free rent discount, and authorizing the County Judge to sign and execute all relevant documents, and any other matters incident thereto. 7.   Economic Development
 
a.   Discussion and possible action to apply for the FY 2021 Regional Solid Waste Grant from the Texas Commission on Environmental Quality (TCEQ) South Texas Development Council, in the amount of Twenty Thousand Dollars ($20,000.00) in grant funds towards the proposed Solid Waste Management Project for solid waste clean-up activities in the colonias; and authorizing the Webb County Judge to sign all pertinent contract documentation.

Issue: Rural areas of Webb County have been experiencing illegal dumping offenses in the Colonias. The tires become a breeding ground for mosquitoes and snakes posing a danger to the community.

Solution: Remove the tires by collaborating with the Road and Bridge Department.

Result: The Department will implement four clean-up activities where the monies will be used for tire collection and disposal. The removal of the tires will control mosquito and snake population near the Colonia homes. Click to View
 
b.   Discussion and possible action to authorize the acceptance of a Fiscal Year 2021 Local Border Security Program (FY 21 LBSP) grant award in the amount of $18,000 from the Office of Homeland Security Grants Division (HSGD) as developed, written, and submitted by and for the Webb County Constable Pct. 3 Office for its peace officer's overtime and applicable fringe benefits to provide enhanced border security in the Laredo/Webb County area and entering into the grant agreement; authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fluidity of border crossings, heavy commercial activity, and interdependence of the international border communities’ economies. These socio-economic pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.  
 
Solution: Grant award to provide enhanced border security in Laredo/Webb County in order to fulfill State of Texas local border security program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas.  

Result: Enhanced/increased patrol and investigative capacity for certified peace officers working at the Webb County Constable Pct. 3 Office. Click to View
 
c.   Discussion and possible action to enter into an Engineering Services Agreement with Porras Nance Engineering for engineering services for the Mirando Water Well Project, including but not limited to, developing plans, specifications, bid documents, cost estimates, construction staking and construction administration for the Mirando City Water Well Project (TxDCBG #7219095) in the amount of NINETY-SIX THOUSAND DOLLARS ($96,000.00) and any matters incident thereto; authorizing the County Judge to sign all relevant documents. 11.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value for the purpose it was originally intended for and/or surplus property that that is no longer needed by the department and may have some usefulness for the purpose it was intended and would be transferred for use by another County department or auctioned online to the general public and/or donated as permitted by law.
 
Solution: Attempt to sell the County surplus or salvage property by competitive bids or auction, dispose or destroy property that cannot be sold through auction and/or competitive bids because it has deemed worthless or dispose through and/or competitive bids because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.
 
Result: Generate revenue from sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets turned in by County departments. Click to View

13.   Discussion and possible action to authorize the Webb County Economic Development Department to submit a Contract Modification/Budget Modification #1 to the Texas Department of Agriculture, Texas Community Development Block Grant Contract #7219095 (Mirando Water Well Project) to transfer $42,000 from the Construction to the Engineering line item. Issue: Funds will be carried over from construction accounts to ensure there are additional funds to cover engineering costs.

Solution: By Commissioners Court approval, the engineering line item will have an additional $42,000 to cover costs.

16.   Discussion and possible action to amend the parking fee schedule approved on February 24, 2020 for the TexMex Parking Lot project and any other matters incident thereto.

Issue: On February 24, 2020, commissioners court approved a no parking charge to those Webb County citizens called for jury duty. Jurors would be handed a ticket voucher in order to avoid any parking fees on exit.

Solution: Consider amending the order by not requiring ticket vouchers to be handed out to all citizens called for jury duty and to further allow the parking gates to remain open every jury Monday only.

Result: District Clerk will be able to operate more efficiently and will not have to designate staff to hand out ticket vouchers to hundreds of jurors as they are being released. Click to View

18.   Discussion and possible action to approve the purchase of Two (2) 2021 StarCraft Allstar 7.3L V8 27’ 24-Passenger Bus equipped with an audio and video package and a backup monitor system from Creative Bus Sales for a total not to exceed $203,062.00 for the Webb County Community Action Agency El Aguila Rural Transit System pursuant to Sections 271.101 and 271.102 of the Texas Local Government Code, Cooperative Purchasing program; State of Oklahoma Contract SWO797. Issue: Grant funding is available to purchase the two buses for use by Webb County Community Action Agency El Aguila Rural Transit System. 
 
Solution: Authorize the purchase utilizing cooperative pricing through The State of Oklahoma Contract that is accepted and used in the State of Texas as a cooperative contract.
 
Result: Purchase the grant funded vehicles to enhance community outreach services to those in Citizens in need of transportation within Webb County boundaries and in accordance with El Aguila's Rural Transportation guidelines. Click to View

Issue: Tragic local, state, and national events have eroded public trust in law enforcement agencies and their officers. Body Cameras will reinforce lost trust in local law enforcement at Constable Pct 3 office.

23.   Presentation by the United States Marine Corps Reserve representative Enrique Marks to invite the Commissioners Court, Elected Officials and County Departments to partake in the Toys for Tots initiative with possible action to place a toy donation box at county buildings/departments; and any other matters incident thereto. The Marine Corps distributes toys to the less fortunate children across the country, this year, due to COVID-19 the need is greater than ever, the hope is to make the holidays brighter for many families.
