4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

a.   Discussion and possible action to ratify, by order, a budget amendment to the District Attorney State forfeiture fund by increasing the expenditure budget by $10,000; said amount is available from seized funds pursuant to Chapter 18 of the Texas Code of Criminal Procedure. [Requested by Isidro "Chilo" Alaniz, District Attorney; Fund #2161-2260]

d.   Discussion and possible action to approve the following budget amendment on Fiscal Year 21 Project Grant Agreement CAF 2101 (22) 072_20 to allow carryover of One Hundred Ninety-Two Thousand Seventy-Three Dollars ($192,073.00) in grant balance from CAA - El Aguila Fund 2661 into the new Fiscal Year 21-22 starting September 2021. No impact to General Fund. All required documentation has been submitted to the Economic Development Department and the solicitation is compliant with Webb County (SPOC) Single Point of Contact procedures.  [Requested by James Flores, CAA Executive Director]
 
Issue: CAA- El Aguila Rural Transportation 5311 CARES Act grant originally ended August 31st 2021 and was extended by the Texas Department of Transportation (TxDOT) through December 31st 2022. Year-end balance must be carried over into New World system in order to continue the availability of these funds. 
 
Solution: Commissioners Court authorizes budget amendment to carryover year-end balance from CAA - El Aguila STATE grant. 
 
Result: Approval of budget carry over will ensure continuation of transportation services to the rural areas of Webb County.

e.   Discussion and possible action to approve, by Order, the following budget amendment (line item transfer) within Grant funds to cover budget balances form 2021- fiscal year. f.   Discussion and possible action to create a special revenue fund for the District Attorney State Forfeiture Chapter 59 Victim Services Program as per Art. 59.06(t); and any other matters incident thereto.

Issue: In 2019 the Texas Legislature added section "t" to Art. 59.06 CCP, Disposition of Forfeited Property. Art. 59.06(t) provides that the gross amount forfeited shall be used to provide direct victim services.

Solution: Create special revenue fund to account and segregate resources related to Chapter 59 victim services.

Result: Special revenue fund to track and report any State forfeiture assets and expenses associated.

g.   Discussion and possible action to approve, by order, a budget line item transfer in the amount of $267,940.17 from the Operational Reserve - Payroll Savings effective September 30, 2021, and transfer out to Election Service Contracts; and any other matters incident thereto. [Fund #2010 (Election Service Contracts)]

Issue: Bank Reconciliations are pending since November 2020. General ledger records show a cash fund deficit of $267,940.47.

Solution: Budget amendment and transfer of funds from General Fund is needed to complete bank reconciliations and eliminate cash fund deficit thru September 30, 2021.

Result: Elections Office bank account will be reconciled and cash fund deficit eliminated.

6.   Civil Legal Division
 
a.   Discussion and possible action to approve an amendment to the Inter-Governmental Service Agreement (IGSA) Contract 70DCR18DIG000010 (Laredo Processing Center) issued by the federal government in order to incorporate their “Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors” requirements; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. b.   Discussion and possible action to ratify a Professional Service Agreement between Webb County and Dr. Thadeus J. Schulz M.D. for medical examiner services for the performance period of November 7, 2021, through November 15, 2021. This agreement establishes the terms and conditions under which Dr. Thadeus J. Schulz M.D. will provide the professional service of Deputy Medical Examiner in an amount not to exceed Thirty Thousand Dollars ($30,000.00) while the Webb County Medical Examiner (ME) is on leave; and authorizing the County Judge to sign all relevant documents and any other matters incident thereto. [Requested by the Civil Legal Division, Account #1001-1130-001-4320010 (Professional Services)]

Issue: The Webb County Medical Examiner is set to be out on leave and finding a qualified Deputy Medical Examiner was challenging.
 
Solution: Ratify the agreement for a temporary qualified expert to perform duties while the ME is out on leave.
 
Result: Webb County will be able to pay for the qualified expert on duty while the Webb County Medical Examiner was out on Leave.

c.   Discussion and possible action to approve a Professional Master Service, Consulting and Support Services Agreement between Webb County and Trac-N-Trol Inc./Flowatch on behalf of the Utilities Department in order to monitor the system with detailed surface water monthly operating reports (S.W.M.O.R.), for a three year (3yr.) term effective retroactively from October 1, 2021 thru September 30, 2024, at the rate/fee of $1,500.00 per month, and authorizing the Webb County Judge to execute any and all relevant documents and any other matters incident thereto. d.   Discussion and possible action to enter into a Memorandum of Understanding (MOU) for the FY 2021 Edward Byrne Justice Assistance Grant (“JAG”) funded by the Department of Justice (“DOJ”) between Webb County on behalf of the Webb County Sheriff’s Office and the City of Laredo acting on behalf of the Laredo Police Department, which will support equipment, contractual services and supplies for law enforcement operational purposes. The proposed amount Webb County Sheriff’s Office will receive is Thirty-Three Thousand Four Hundred Fifteen Dollars ($33,415). 7.   Community Action Agency
 
a.   Discussion and possible action to authorize the Community Action Agency Department to prepare and submit a Contract Amendment with Budget and Performance Statement Modification to the Texas Department of Housing and Community Affairs - Office of Colonia Initiatives (TDHCA-OCI). (Self-Help Center - TDCP Contract #7220013) and authorizing the County Judge to sign and any all relevant documents. This will not impact the general fund. 

Issue: The Texas Department of Housing and Community Affairs has offered additional funding in the amount of $350,000 for the Self-Help Center -TCDP Contract #7220013 Self-Help Center Program. Additionally, recent rule changes which include increased maximum cost limits for rehabilitation, reconstruction and new construction activities are being implemented, require a Contract Amendment with Budget and Performance Statement Modifications to adjust the number of homes that can be completed with the new funding limits and the number of beneficiaries that will be assisted.  The Texas Department of Housing and Community Affairs requires a Resolution issued by the Commissioner's Court to consider this Contract Amendment Request.

Solution: Commissioners Court pass a Resolution authorizing the submission of this Contract Amendment with Budget and Performance Statement Modification as required by the Texas Department of Housing and Community Affairs.

Result: Webb County can proceed to assist qualified colonia residents with housing rehabilitation, reconstruction or new construction through the Self-Help Center Grant.

8.   Honorable Esther Degollado, District Clerk
 
a.   Discussion and possible action authorizing Purchasing Agent to add one (1) new cell phone device including data services for the Webb County District Clerk's Central Jury Room pursuant to Sections 271.101 and 271.102, Texas Local Government Code, Cooperative Purchasing Program DIR Agreement TSO-3420 at a monthly rate of $39.99 plus surcharges and other related fees per line with AT&T FirstNet plan and subject to annual budgetary appropriations. Issue: A cell phone for the Central Jury Room is necessary to receive confirmations of all the notifications sent to potential jurors. At this time, all confirmations are going to the personal cell phone of the Chief Deputy.

Solution: Purchase a cell phone specifically for Jury use.

Result: Approve the purchase of a cell phone for the Central Jury Room to relieve the personal cell phone of the Chief Deputy.

9.   Economic Development
 
a.   Discussion and possible action to accept award ARP 2201 (22) 107_21 and enter into an agreement with the Texas Department of Transportation for Webb County Community Action Agency - El Aguila Rural transportation in the amount of SEVEN HUNDRED SEVENTY SEVEN DOLLARS ($777.00) and authorizing the County Judge to sign all relevant documents. This grant does NOT require a County Match.  All required documentation has been submitted to the Economic Development Department for review and the solicitation is compliant with Webb County (SPOC) Single Point of Contact procedures. [Requested by James Flores, CAA Executive Director]
 
Issue:
 El Aguila Rural Transportation is a grant funded agency.
 
Solution: Federal grant fund acceptance will benefit operational expenses.

b.   Discussion and possible action to ratify a contract amendment with a performance statement modification and budget modification to the Texas Department of Agriculture Community Development Block Grant Mirando Water Well Contract No. 7219095 for the purpose of constructing an additional water Well #5, and authorizing the County Judge to sign all relevant documents. [Requested by James Flores, CAA and Economic Development Director; Account #1001-1160-001-463904-015]

Issue: Based on the results of the 36-hour pumping test required by Texas Commission on Environmental Quality (TCEQ) Public Water System Review Team, our Project Engineer, Wayne Nance, has recommended we drill an additional well; Well #5. Unfortunately, the design capacity of the Production Well #4 is less than the 35 GPM necessary to meet TCEQ’s installed well capacity vs service connections standard.

Solution: To drill an additional water well to have enough water gallons per minute (GPM) to supply water for all service connections. 

Result: TCEQ water service connection requirement will be met.

c.   Discussion and possible action to accept a Fiscal Year (FY) 2021 Justice Assistance Grant (JAG) grant award from the Department of Justice as prepared, written, coordinated by the Webb County Sheriff’s Office Grant Writer in conjunction with the City of Laredo in the amount of $33,415; and authorizing the Webb County Judge to execute all relevant documents related to this grant; and any other matters incident thereto. This grant does not require any type of match, and, thus, has no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Supplemental equipment, contractual services, and supplies will allow the Webb County Sheriff’s Office to provide better and more enhanced law enforcement services.
 
Solution: Grant award to provide supplemental equipment, contractual services, training/travel, and supplies for the Webb County Sheriff’s Office. 
 
Result: The Webb County Sheriff’s Office and its staff will be equipped with needed new, updated technology, equipment, training/travel, contractual services, and supplies.

d.   Discussion and possible action to authorize Webb County Fire with the assistance of the Economic Development Department to develop and submit a U.S. Department of Homeland Security, FY 2021 Assistance to Firefighters Grant for up to $300,000.00, for new personal protective equipment to outfit 30 firefighting personnel, and 16 self-contained breathing apparatus (SCBA) with cylinders; and authorizing the County Judge to act as the Authorized Representative in all matters pertaining to the County's request for Assistance to Firefighters Grant Program funding and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This application requires a five percent (5%) cash match should the application be funded, amount shall not exceed the sum of Fifteen Thousand Dollars ($15,000). All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Submission of Assistance to Firefighters Grant (AFG) Application to benefit the Webb County Volunteer Fire Department through the acquisition of personal protective equipment for firefighters, and SCBA. 

Solution: The Economic Development Department will develop and submit the application on behalf of the Webb County Volunteer Fire Department.

Result: Well- equipped firefighters to respond safely to emergency incidents, and meet required standards.

a.   Discussion and possible action to accept a donation from Electric Transmission Texas, LLC (ETT) as per Local Government Code 81.032, in the amount of $2,000 to be utilized in the following line items: Administrative Travel and Uniforms; and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. Issue: Donation check issued by Electric Transmission Texas, LLC to support the mission of the Webb County Volunteer Fire Department.

Solution: Deposit money accordingly, $1,000 into Administrative Travel and $1,000 into Uniforms.

Result: Continue working relationship with ETT, and meet department needs.

Solution: Request is being made to post and fill the vacant slots and any remaining vacant slot created by promoting from within.

Result: This action will allow our department to potentially promote from within, fill the remaining vacant slots, and allow our department to continue to function efficiently and effectively.

13.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

Issue: The Webb County Sheriff's Office will be utilizing federal grant funds to purchase a VECTOR LPR Rapid Deployment Trailer to gather data for investigative purposes.
 
Solution:
Authorize the grant supported equipment in order to provide the Webb County Sheriff's Office with the necessary investigative tools.
 
Result: Proceed with the grant funded purchase.

15.   Discussion and possible action to authorize the Economic Development Department to develop and submit an application for the Texas Department of Housing and Community Affairs under the Community Development Block Grant Community Resiliency Program Fund in the amount of up to $5,000,000.00 and up to $1,200,000.00 coming from match funds and to approve a resolution authorizing the submission of an application to construct a new public health facility in Pct. 1 and authorizing the County Judge as the authorized signatory for the Community Resiliency Program; and authorize the Webb County Judge to sign all relevant documentation.

Issue: Pct. 1 does not have a public health facility.

Solution: If approved, Pct. 1 will have a new public health facility. 

Result: This grant will allow for Webb County to construct a new public health facility to assist residents of Pct. 1.

16.   Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective November 22, 2021:

18.   Discussion and possible action to approve and adopt the revised Self-Help Center (SHC) Housing Rehabilitation/Reconstruction and New Construction Guidelines for SHC Contract Number 7220013.

Issue: Texas Department of Housing and Community Affairs (TDHCA) has proposed rule changes for the Self-Hep Center Programs.  Webb County needs to revise the Self-Help Center Program's Guidelines to coincide with the proposed rule changes.  The current grant Contract Number is 7220013.

Solution: Webb County Commissioners Court approves the Self-Help Center's revised guidelines.

Result: Webb County's Housing Assistance Guidelines for the Self-Help Center Program Contract Number 7220013 will be up-to-date with recent TDHCA rule changes.

19.   Discussion and possible action to authorize the Purchasing Agent, upon completion of plans, specifications and estimates, to solicit bids for the following overlay projects, as approved by the Texas Department of Transportation (TxDOT) Prioritized List and in accordance with the Texas Government Code; Section 2269.101 (Contracts for Facilities: Competitive Bidding) and to further designate the Webb County Engineer to prepare the construction documents required for this project in compliance with Section 2269.102 (Use of Architect or Engineer); and any other matters incident thereto. Solution: Assistant County Engineer is currently working on plans which will be ready upon approval from Commissioner Court to proceed with Purchasing Policies and Procedures. 

Result: County Roads will be maintained for use by Webb County Residents, First Responders and School District.

20.   Discussion and possible action to request further direction from Commissioners Court regarding the Becerra Creek bridge structure; and any other matters incident thereto. 21.   Discussion and possible action to increase funding for an additional $7,222.83, (including FICA, Workers Comp and Unemployment) from the 2022, Texas Indigent Defense Commission (TIDC) multi-yearly grant for over-time pay for staff while we receive potential applications for a suitable candidate with additional action to approve the necessary budget amendment of $1,444.57, which is 20% for the additional amount required. A letter requesting the budget change and a brief explanation why the funding increase is needed is required by the TIDC is to be submitted and signed by the county judge.[Grant Fund #2704; Cash Match Account #1001-1160-001-463910-005] [Funding source: #1001-1130-001-431007-015 Operational Wage Classification Study)]

Issue: We are experiencing very low interest in applicants for the position of Weekend Indigent Defense Coordinator.  The employment announcement has been in circulation for about 7 weeks. We have never experienced a low number of applications for our office in the past. We were forwarded 6 applications. The one applicant that was considered has secured employment.

Solution: We would like to increase the original grant funding with an additional $7,222.83, in order to compensate our hourly existing staff we currently have to work the weekend schedule. The TIDC will provide $5,778.26, and Webb County will provide a cash match of $1,444.57.  The TIDC is requiring a brief letter to be signed by the county judge requesting the budget change and explanation why the additional funds.

Result: Increasing grant funding will help provide funding for staffing for the indigent defense process during the weekend, while we continue to post the job announcement for possible potential candidates.
