6.   Discussion and possible action to authorize the outside county engineering firm of Leyendecker, Naiser & Viera (LNV) to provide monthly activity reports to the commissioners court regarding all work associated with their services at the Rio Bravo Water & Wastewater Plant; and any other matters incident thereto.

7.   Discussion and possible action to request that Southern Golf Properties, Inc. provide an immediate action and improvement plan for the Casa Blanca Golf Course; and any other matters incident thereto.
 
8.   Discussion and possible action to authorize a $1,000 contribution from Account #007-0101-7426 (Community Promotions) to the South Texas Afghanistan Iraq Veterans Association, a 501 (C)(3) corporation, to provide financial for their Pancho's Posada "Warriors Supporting Warriors" event, which took place on December 5, 2015 at the Laredo Lemur's Unitrade Stadium.

9.   Discussion and possible action to approve an Order and Resolution of the Webb County Commissioner's Court whereby Webb County elects to participate in Tax Abatements and formally adopts the amended policy, Guidelines, Criteria and Methodology governing Ad-Valorem Tax Abatements by Webb County, Texas as previously passed and approved by the Webb County Commissioners Court on November 23rd, 2015; and any other matters incident thereto.

Issue: On November 23, 2015, the Webb County Commissioners Court approved the revised and amended Policy Guidelines, Criteria, and Methodology governing Tax Abatements in Webb County but due to an oversight failed to include a formal Resolution and Order whereby Webb County elects to become eligible to participate in tax abatements, and Webb County formally adopts the amended Tax Abatement



Policy, Guidelines, Criteria and Methodology. Chapter 312 of the Texas Tax Code requires that the guidelines governing Tax Abatements be re-adopted every two (2) years by a formal Resolution and Order of the Commissioner’s Court. 

Solution: The passage of a formal Resolution and Order of the Webb County Commissioner’s Court formally adopting revised and amended Policy Guidelines, Criteria and Methodology governing Tax Abatements retroactively to November 23rd, 2015 as previously approved by the Webb County Commissioner’s Court, would be in compliance with the Texas Tax Code and be in the County’s best interest to promote positive economic growth and job creation and additional investments in Webb County.

Result: This Resolution and Order to formally adopt the revised and amended Policy Guidelines, Criteria and Methodology governing Tax Abatements in Webb County made effective retroactively to November 23rd, 2015 complies with Ch. 312 of the Texas Tax Code.
 
10.   Discussion and possible action to cancel the Commissioner’s Court meeting scheduled for December 28, 2015 at 9:00 a.m. due to scheduling conflicts and holiday; and any other matters incident thereto.
 
11.   Discussion and possible action to review the current financial accounts with encumbered funds that have not been spent; with further action that those funds be unencumbered and allocated for debt service or another county purpose; and any other matters incident thereto.
 
Issue: On September 14, 2015, Commissioners Court approved the review of all special accounts that had encumbered funds that had not been spent over an extended period of time.
 
Solution: After reviewing these particular funds, it would be in the county’s best interest to unencumber these funds and allocate them for another county purpose.
 
Result: Redistributing funds will help alleviate the shortfall in other accounts with pending expenses.
 
12.   Discussion and possible action to authorize a one-time waiver of the required annual audit of books and records for the Webb County-City of Laredo Regional Mobility Authority (WC-CL RMA); and any other matters incident thereto.

Issue: The Webb County-City of Laredo Regional Mobility Authority (WC-CL RMA) is required to provide an annual audit of its books and records conducted by an independent certified public accountant. This new entity, however, has not generated revenues or incurred other financial obligations which would be the underlying subject of the audit.

Solution: A one-time waiver of this audit requirement may be granted for this year if the county and city officials both agree.

Result: This waiver will allow the WC-CL RMA to be excepted from the required audit this year.
 
13.   Discussion and possible action to approve the line item transfers identified in the back-up information so that 2015 year-end expenses can be paid and charged to the appropriate line items that did not have sufficient funds at the time the expense was presented for payment approval.
 
Issue: Departments have incurred expenses for which they do not have sufficient balance in the appropriate department line item.

Solution: Review the affected department’s accounts and determine a suitable accounts from which monies can be transferred to cover FYE 2015 outstanding invoices.

Result: Outstanding invoices for goods and services for the fiscal year ended September 30, 2015 will be liquidated in compliance with Financial Audit.

14.   Discussion and possible action to authorize an Inter Local Agreement between Webb County and Webb Consolidated Independent School District (WCISD) for the continued construction of a community and educational training building located in or around Bruni, Texas. Webb County and Javelina Wind Energy, LLC, entered into a Tax Abatement Agreement that required Javelina Wind Energy to contribute $400,000.00 to Webb County for this purpose. Webb County will assist WCISD by administering the funding for this project and will provide oversight necessary to ensure that the available funds are used for this specific project.
 
15.   Discussion and possible action to accept the dedication of One (1) Roadway right-of-way easement out of Pueblo Nuevo Subdivision, and to authorize the County Judge to execute all relevant documents; and any other matters incident thereto. 17.   Discussion and possible action to enter into a Twelve (12) month (December 14, 2015 through December 13, 2016) Maintenance Agreement between Toshiba Business Solutions and the Webb County Juvenile Probation Department for a Toshiba E-Studio 352 Copier at a cost of Ninety Dollars and Seventy-Five Cents ($95.75) per quarter for a total amount of Three Hundred Sixty Three Dollars ($363.00) over the term of the agreement, and authorizing the County Judge to sign and execute all relevant documents. 18.   Discussion and possible action to enter into a Twelve (12) month (December 14, 2015 through December 13, 2016) Maintenance Agreement between Toshiba Business Solutions and the Webb County Juvenile Probation Department for three (3) Toshiba E-Studio 603T and a Toshiba E Studio 853 at a cost of Two Hundred Eighty-One Dollars and Sixty Cents ($281.60) per quarter for a total amount of One Thousand One Hundred Twenty-Six Dollars and Forty Cents ($1,126.40) over the term of the agreement, pursuant to Texas Local Government Code, Subchapter F., Cooperative Purchasing Program; Sections 271.101 and 271.102, subject to annual budget appropriating and authorizing the County Judge to sign and execute all relevant documents. 19.   Discussion and possible action to approve a renewal of a 457 (B) Governmental Plan Document with Nationwide Retirement Solutions, Inc. as the plan administrator and where Webb County serves as the plan sponsor for Webb County employees currently participating and those wishing to participate in Nationwide 457 (B) Deferred Compensation Plan, and authorizing the County Judge to execute all relevant documents; and other matters incident thereto. 20.   Discussion and possible action to enter into a VCR Grant Agreement No. 512XXF7144 with the State of Texas, acting through the Texas Department of Transportation, wherein Webb County accepts a grant amount of $7,396.00 and $1,480.00 of TDC's (Transportation Development Credits) for the El Aguila Rural Transportation program and authorizing the Webb County Judge to execute all relevant documents.

21.   Discussion and possible action to approve a budget amendment to increase expenditure funds for Overtime (Account #166-2500-5003) in the amount of $10,000 from the available funds in the Federal Forfeiture Fund #166. Available funds from Fund 166 are currently $53,789.97.

Issue: Funding is needed for deputy constables to work overtime in order to have additional community policing and after-hours process serving. 


Solution: Budget amendment to Increase funds for Overtime expenditures.

Result: The budget amendment increase will provide funding to cover overtime pay.

22.   Discussion and possible action to approve a budget amendment to increase expenditures in the amount of $3,000.00 to Account #171-2502-6708 which currently has a balance $0.00. Available funds from Fund 171 (Federal Forfeiture) are currently $18,669.65. 

Issue: Precinct 4 is in need of purchasing two (2) body armor (vests) for two full time employees who have not been issued these body armor vests. 

Solution: The increase of funds will allow for the department to purchase the two (2) vests.

Result: Once purchased, the vests will be issued to the deputies and aide in increasing officer safety.  
 
23.   Discussion and possible action to approve a budget amendment to increase expenditure in the amount of  $1,000.00 to Account #171-2502-6706 which currently has a balance of $140.00. Available funds from Fund 171 (Federal Forfeiture) are currently $18,669.65.

Issue:  With the current balance in the Canine account, we will not be able to continue to maintain the daily needs of the two (2) canines within our department. The fund increase will allow for necessary purchases for dog food and allow for continued maintenance of the narcotic & explosive canine care.

Solution: The increase of funds will allow for the department to meet the demands of the daily needs of the canines.  

Result: Secured funding will allow for the department to continue utilizing the canines in operation to assist in law enforcement efforts to ensure the communities safety. 
 
Honorable Martin Cuellar, Sheriff
 
24.   Discussion and possible action to approve a Memorandum of Understanding between Webb County Sheriff's Office and the Southern District of Texas (79), United States Marshals Services; Project JLEOTFS4 for overtime expenses for performance period October 3, 2015 through September 30, 2016 for an amount not to exceed $12,000.00 and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. [Cash match will be covered by Fund 168 (State Forfeiture Fund)]

Issue: Collaboration between Federal,State and local law enforcement agencies is necessary to pursue and dismantle organized crime organizations along the Texas border and within our Community.

Solution: Accept Federal assistance to continue local participation in USMS investigations, strategic initiatives and prosecution of organized crime.

Result: Disruption of organized crime activity along the Texas border and in Webb County; prosecution of individuals responsible for organized crime.
 
25.   Discussion and possible action to approve a software license agreement between Webb County and Indigent Health-care Solutions, Ltd., effective December 1, 2015 and terminating September 30, 2017 at a rate of $1,059 per month for discounted pricing on medical services for Webb County Jail inmates and authorizing the County Judge to execute all relevant documents and any other matters incident thereto. [Account #001-2060-6411]

Issue: 
Webb County inmates who do not qualify for indigent health care services must be paid by the County Jail budget.   Costs for various types of medical services for inmates can total in excess of $1 million dollars annually.  

Solution:  Continue paying Indigent Health-Care solutions at an annual investment cost of $12,708.00 in order to obtain Medicaid pricing for medical services such as lab/x-ray, in/out patient services, physician fees and other medical services provided for ailments being experienced by County inmates.



Result: County will save a significant amount of money using Indigent Health Care Solution services.  In Fiscal year 2015 the County saved approximately $1.1 million in medical related costs for treatment.

 
26.   Discussion and possible action to enter into an Annual Maintenance Contract between Thyssenkrupp Elevator Corporation and Webb County Sheriff’s Office for a period of Thirty Six (36) months effective October 1, 2015 for a total amount of ONE THOUSAND THREE HUNDRED FIFTY DOLLARS ($1,350.00) per month over the term of the agreement for Three (3) elevator units and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. [Account #001-2060- 6402 (Repairs & Maintenance of Equipment- Sheriff)]

Issue: 
The County Jail currently has 3 elevators that are used around the clock.   As a result of high traffic use the elevator(s) require preventive maintenance in in some cases repairs that can be costly to Webb County.

Solution: Continue paying for elevator maintenance services to cover around the clock services, peak and off-peak rates and other fees that without a contract would be charged at a higher rate to the County.

Result: Secure a Platinum Premier Maintenance agreement to cover three (3) elevator units at the County Jail.
 
Honorable Patricia A. Barrera, Tax-Assessor- Collector
 
27.   Discussion and possible action to approve the following refunds:

a) The amount of $39,229.94 to CoreLogic Tax Service, Accounts #21600763060 through #98600004700, mortgage accounts had been adjusted or paid prior to receiving payment for tax year 2015.

b) The amount of $2,625.14 to Farias & Farias Inc, Account #92960001010, account had been paid prior to receiving Check #3586.

Issue: Accounts #21600763060 through #98600004700 had either been adjusted through a supplement or had been paid prior to receiving the payment from CoreLogic Tax Service resulting in an over-payment of $39,229.94. Account #92960001010 had been paid prior to receiving Check #3586 from Farias & Farias Inc resulting in an over-payment of $2,625.14.

Solution: Refund said amounts to both entities for their over-payments.

Result: The monies will ultimately be reimbursed to the appropriate taxpayers.
 
Administrative Services
 
28.   Discussion and possible action to authorize reimbursement payment for appellate fees in the amount of $169.77 to Molly Higgins Santos for filing of Petition for Review in the case entitled Webb County v. Adriana Perez, civil action number 15-0666, pending in The Supreme Court of Texas and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. [Account #001-0114-9201]
 
29.   Discussion and possible action to approve and adopt the revised Webb County Government Classification/Step Increase policies; with possible action to clarify or amend said policy to reflect that all such proposed requests must be authorized by commissioners court; and any other matters incident thereto. [Requested by the County Policy Committee]

Issue: Commissioners Court approved a Classification/Step increase policy for Webb County. The current policy needs to be clarified with regards to requests to promote, transfer, or reclassify an employee position within a department.

Solution: A county department who seeks to promote or reclassify a non-civil service position must first seek approval from the court prior to submitting any requested changes to their department slots.  County policy needs to reflect this change.

Result: This policy change will help ensure compliance by all departments and avoid unauthorized changes to the current approved county classification/step increase policy.
 
Building Maintenance
 
30.   Discussion and possible action to approve the transfer of One (1) 2008 Ford Extended Cab Super Duty Truck from Building Maintenance to the Water Utilities Department.

Unit: 06-02, VIN #1FTWW30558EA93909, License #103-2880, Year: 2008, Make: Ford, Model: Extended Cab Super Duty, Mileage: 98697.3 (as of December 2, 2015).

Issue: Vehicle was going to salvage auction.

Solution: Transferring of the used vehicle from Parks and Grounds to the Water Utilities Department.

Result: Utilities Department will benefit from the use of a heavy duty truck.
 
31.   Discussion and possible action to recognize the Building Maintenance employees, to include; Parks & Grounds, Custodial and Administrative Staff for their hard work, dedication and service to all County Buildings and Departments. [Co-sponsored by Tano Tijerina, Webb County Judge]

32.   Discussion and possible action to establish the appropriation budget for the Child Welfare Board according to the requirements of Texas Department of Family and Protective Services and The Texas Family Code 264.005.

Issue: The proposed budget for 2015 – 2016 included the estimated revenues and require the appropriations.

Solution: Authorize expenditures of the Child Welfare for appropriate purposes and to ensure that the fiscal records are maintained for State and Federal Audits. 

Result: The Texas Family Code 264.005 provide for the appointment of County residents to a Child Welfare by the County Commissioners Court for the purpose to carry out the duties between the Texas Department of Family and Protective Services (DFPS), Child Welfare and the County. 
 
Community Action Agency
 
33.   Discussion and possible action to approve the posting and filling of the following Slots, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective December 14, 2015:

Solution: Request is being submitted to fill slots.

Economic Development
 
34.   Discussion and possible action to accept the recommendation of the Webb County Recreational Master Plan Review Committee to approve and adopt the 2015 - 2025 Webb County Recreational Master Plan for submission to the Texas Parks and Wildlife Department (TPWD) and authorizing the County Judge to sign all relevant documents. 
 
Issue: The TPWD requires that Webb County prepare and submit a Recreational Master Plan every ten (10) years and updates every five (5) years which represents up to twenty (20) points out of one hundred (100) points in future indoor or outdoor TPWD recreational applications.
 
Solution: Webb County Economic Development staff and the Webb County Recreational Master Plan Review Committee members have prepared the 2015 - 2025 Webb County Recreational Master Plan.
 
Result: Webb County will be eligible for up to twenty (20) points out of one hundred (100) points in indoor or outdoor TPWD recreational applications. Furthermore, Webb County shall achieve the following identified goals: To provide equitable distribution of recreational opportunities throughout the County of Webb; to address the infrastructure restoration needs of existing county-owned recreational facilities; utilization of county-owned land as the most effective means of improving recreation and recreational activities; and to inventory/identify, protect and maintain physical, cultural and natural resources that are unique to Webb County
 
Engineer
 
35.   Discussion and possible action to approve an increase in funding to Account #742-8001-8801-12 in the amount of $9,800.00. This account is for the Community Supervision & Corrections Department/Police Athletic League (C.S.C.D./PAL) renovation project on Hwy 83S.  These funds are needed to cover a shortfall in Purchase Order No. 15-0002814 (SIMPLEXGRINNEL). [Account #742-8001-8801-12 (Rebuild Restitution Center-Series 2013)]

Issue: $9,800.00 were used as part of the funds needed to repair stucco and redo skin coat on building exterior when 14 exterior windows in very poor condition were replaced using General Contractor savings.

Solution: Work resulted in the need to install new skin coat over old stucco on walls to cover damage after new window installation.

Result: Building exterior appearance has been greatly improved and this will improve appraisal value.
 
 
36.   Discussion and possible action to assign an account and allocate funds for payment of project costs related to RFP 2015-11, Rio Bravo Soccer Field to Castle Engineering & Testing, LLC., in the estimated amount of $1,740.00 for construction materials engineering and testing. 

Issue: Required construction materials engineering and testing services needed.

Solution: Testing and observations in the categories of Earth Monitoring/Soil Testing and Concrete Sampling/Testing.

Result: Field test results will be reported to on-site representatives at the time of testing and written reports of the tests performed will be submitted to the Engineering Department for record keeping.
 
37.   Discussion and possible action to accept a contract with ASTEX Environmental Services in the estimated amount of $8,965.00 for the Asbestos Air Monitoring & Project Management for the demolition of the Tex-Mex Building as previously approved in Commissioner Court, August 24, 2015; and any other matters incident thereto.  [Account #743-8001-8801-12 (Series 2013)]

Issue: 
Building has asbestos flooring, mastic, pipe insulation and joint compound.  These materials must be abated by a Licensed Asbestos Contractor before building can be demolished.

Solution: Asbestos will be removed by a Licensed Asbestos Contractor.

Result: Building can be demolished without danger to the public or the crews working the site.
 
 
38.   Discussion and possible action to approve payment in the amount of $1,545.50 to the City of Laredo for the Rezoning of the New Webb County Fire Station. [Account #001-0109-6022 (Professional Services for General Fund)]

Issue: Current Zone AG is for Agriculture Buildings only.

Solution: Rezone area (lot) as B1 in order to build New Fire Station.

Result:  Compliance with Planning and Zoning.
 
39.   Discussion and possible action regarding authorization to proceed with submittal of a request for hearing to the office of the Chief Clerk of the Texas Commission on Environmental Quality (T.C.E.Q.) to discuss and contest enforcement action against Webb County for alleged violations. Initiation of a request for hearing does not waive any availability of entering into an Agreed Order and completion of Supplemental Environmental Program with T.C.E.Q.
 
40.   Discussion and possible action to allocate funds and ratify payment of emergency equipment and repair services provided by Pump Mechanical Technical Services, LLC. in the amount of $41,132.56 for the repair of the Casa Blanca Golf Course irrigation system. [Fund 746-Series 2013]

Issue: Failure of the irrigation pumping system and associated equipment at the Casa Blanca Golf Course.

Solution: Emergency repairs and the purchase of equipment and parts were needed for the operation of the irrigation pump system at the Casa Blanca Golf Course that included two (2) 50HP motors and pumps, one (1) 5HP motor and pump, and other related equipment, and labor.

Result: Repair of irrigation pumping system.
 
 
Fire Suppression & EMS Services
 
41.   Discussion and possible action to approve the payment of invoice #W74104 in the amount of $402.50 to Ferrara Fire Apparatus, Inc. for repairs done to Unit 0412, 2000 Pierce Navistar International fire engine. Repairs to fire engine’s pressure governor were completed on October 16, 2015.  [Account #001-2203-6403]

Issue: Pressure governor was malfunctioning and failed to engage with throttle. This rendered the fire pump useless at a fire scene.

Solution: Fire engine technician was on scene for maintenance on Ferrara fire trucks, and the department asked that he fix Unit 0412.

Result: Pressure governor was fixed, fire pump works, and Ferrara’s invoice will be paid.

Indigent Healthcare Services
 
43.   Discussion and possible action to authorize Inter-Governmental Transfers (IGT's) to the State of Texas in connection with the Texas Healthcare Transformation and Quality Improvement Program/1115 Waiver in amounts not to exceed a total of $1,200,000 for Fiscal Year 2015-2016. [Accounts #001-4100-6714-3 (Hospital Inpatient) and #001-4100-6714-4 (Hospital Outpatient) from Fiscal Year 2015-2016 Budget]

Issue: Since 2006, Webb County has participated as the Inter-Governmental Transfer entity for Laredo Medical Center and Doctors Hospital of Laredo. The IGT submitted allows our local hospitals to receive matching funds from the federal government that is used to offset the uncompensated care that both hospitals provide.

Solution: The Commissioners Court may approve (quarterly, bi-annually, or yearly) contribution amounts that Webb County will submit on behalf of both hospitals.

Result: The authorization of IGT will allow local hospitals to access matching federal funds for FY 2015-2016 to offset uncompensated care costs as well as receive incentive payments from the State of Texas for successful completion of 1115 Waiver project milestones and metrics.

44.   Discussion and possible action to enter into an agreement with New World Systems for the upgrade of New World Logos 400 to New World Logos.Net, and authorize Webb County Judge Tano Tijerina to sign all relevant documents; and any other matters incident thereto. New World Systems is a sole source provider for this upgrade pursuant to 262.024 (a) (7) Texas Local Government Code. (Sole Source - discretionary exemption). The agreement covers the cost for all services required for the implementation process, training, estimated travel expenses, and annual maintenance subscription for the following ten years. Unless approved by the Commissioners Court, the cost for services, training and estimated travel expenses shall not exceed $550,000.00 to be divided in Three (3) years to be funded from Account #603-0101-8801 (Capital Outlay) and any difference to be funded from Account #001-2985 (General Fund Balance) and subscription costs shall be spread out over Ten (10) annual payments for a total of $1,234,110.00 to be funded from Account #001-0500-6411 (Repairs & Maintenance - Software). [Co-Sponsored by Leticia Gutierrez, Interim Purchasing Agent and Leroy Medford, Commissioners Court Administrator] 
 
Issue: New World Systems –Logos 400 is a twenty years old system that does not offers the functionality of today’s products.

Solution: To upgrade to New World Systems.Net product

Result:  New World Logos.Net has features that will allow Webb County Departments to be more efficient by providing analytical tools for budget preparation, a user friendly presentation of the financial information to improve fund tracking, authorization levels in the procurement process depending on commodity codes, e-suites that will allow Webb County Employees to “self-serve” with services like payroll information, w-2 reprints, online benefit enrollment, etc. This software will also allow Webb County to provide online payments to the public.
 
 
Larga Vista Community Center
 
45.   Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective December 28, 2015.

Result: When fully staffed we set the standard for high quality assistance.

Issue: Webb County Medical Examiner is in need of an organization to provide tissue recovery for those families who which to donate their love ones tissue. 

Solution: Authorization to solicit RFP's for Tissue Recovery Services for Webb County Medical Examiner's Office

Result: Enter a formal agreement with a reputable tissue recovery organization who will provide these needed service. 
 
Planning
 
48.   Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines:

49.   Discussion and possible action to issue a “Certificate of Compliance with Plat Requirements” to authorize an electrical service connection pursuant to Section 232.029(c)(2), Local Government Code, to an unplatted 2.124 acre tract of land, more or less, out of Tract B-3-6, Botines Subdivision, as further described in Vol. 3661, Pgs. 241-4, Webb County Real Property Records (ID 4367) contingent upon the execution and recording of the required owner’s affidavit pursuant to Sec. 232.029(e), Local Government Code.
 
Issue: Item is a regulatory compliance issue regarding real property development provisions of state law and local regulations with particular emphasis on the Model Subdivision Rules enacted for residential subdivisions.  Commissioners Court must certify to certain property conditions before utility service connections may be authorized.
 
Solution: As reflected in agenda backup, staff has verified most compliance matters but is pending the execution of the required affidavit by owner.  Staff recommends the Court’s contingent approval of this certificate pending the owner’s execution of required document.
 
Result: If approved, applicant may connect property to electrical services after execution of all documents.  If not approved, electrical connection to property is prohibited.
 
Purchasing
 
50.   Discussion and possible action to authorize the payment of the difference in cost from a 2015 to 2016 Model Chevrolet Tahoe Police Pursuit SUV  and the upgrade of a two way 800MHZ Antenna & Coax Cable to Holiday Chevrolet DBA Defender Supply (State of Texas Contract: 071-A1-2014-2015) in the amount of $3,603.00. [Requested by Martin Cuellar, Sheriff; Account #170-2001-8801]

Issue: When the procurement process initially started, the vehicle model year quoted was 2015. At the time the order was issued all 2015 models were out of stock and the only models available were 2016. The difference in pay after negotiations with the vendor is $1,748.50 per vehicle. The current price for 2016 models stands at roughly $34,500.00.

Solution: Pay the difference in cost between 2015 and 2016 models, and the upgrade for the antenna

Result: Vehicles can be delivered.
 
51.   Discussion and possible action  to award Bid 2015-4 “Rehabilitation of Homes Webb County Self-Help Center” to the lowest responsible bidder for the Self-Help Center Program, (Contract #712003) and authorize the County Judge to sign all relevant documents. This activity is Grant Funded and will have no impact to the County’s General Fund.

Result: Upon completion of these homes, the Self-Help Center Program will have successfully completed the Rehabilitation Activity required under this Grant Program. 
 
52.   Discussion and possible action to award RFQ 2015-004-1 Qualification for Legal Counsel to Norman Jolly, PC (sole proposer). 
 
Issue: Webb County requested to solicit request for qualifications from legal counsel with fees for legal work to be based on a contingent fee.
 
Solution: The firm will be required to research, investigate, analyze, and advise Webb County on any potential legal cause of action for defective construction or warranty claims against all contractors, subcontractors, agents for the original construction of  the Rio Bravo Water Treatment Plant.
 
Result: Award the contract. 
 
Road & Bridge
 
53.   Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective December 14, 2015:

Issue: Position became vacant when employee holding position was transferred.

Result: The filling of this position will alleviate work load in the cleaning/maintenance area.
 
54.   Status report from Road & Bridge department regarding county refuse collection services with discussion and possible action to approve changes to the current refuse collection schedule and to initiate a process to impose refuse collection fees for refuse pickup and containers in an effort to offset expenses in providing the service; and any other matters incident thereto.
 
Veteran's Office
 
55.   Discussion and possible action to accept a contract agreement from the Texas Veterans Commission for a Series 16-A Fund for Veterans' Assistance (FVA) General Assistance Grant awarded in the amount of $50,000 for the purpose of extending current transportation services offered to Webb County veterans and their families; effective date of contract shall be January 1, 2016; designating the Veterans' Service Officer all grant administration/implementation duties under this grant and the County Judge as the County's Chief Executive Officer and authorized representative to act in all matters in connection to this project. This action will not impact the County General Fund.
 
Issue: The current capacity of the Webb County Veterans Service Office, via Veterans Transporation Assistance Program, cannot afford for the transportation of veterans to out-of-town destinations to specialty hospitals and clinics frequently visited by local veterans.
 
Solution: An additional vehicle and auxiliary staff to allow for out-of-town travel are needed in order to fulfill the needs of the veterans in Webb County.
 
Result: The acceptance of the Series 16-A General Assistance Grant from the Texas Veterans Commission for a One-year transportation program to transport veterans to specialty hospitals and clinics throughout South Texas.

56.   Discussion and possible action to approve a contract for legal services by and between Webb County and Norma Jolly, PC., as sole proposer pursuant to RFQ 2015-004-1 F Qualification for legal counsel to investigate and pursue possible legal action or any defective construction and/or warranty claims against all contractors, subcontractors, agents, pertaining to the original construction of the Rio Bravo Treatment Plant; and any and all other matters incident thereto. [With possible Closed/Executive Session for Consultation with Attorney to discuss pending and/or contemplated litigation as per Section 551.072 (1)(A) Texas Government Code] [Requested by Marco A.
