COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
Economic Development
 
6.   Discussion and possible action to appoint Five (5) new Board members including officers to The Webb County Housing Finance Corporation and designate the County Treasurer’s office to receive and reconcile the Housing Finance Corporation’s monthly bank statements and authorize the County judge to execute all relevant documents; and any other matters incident thereto. [Co-Sponsored by Tano E. Tijerina, County Judge]

Issue:
The term of appointment for the original 5 members has expired and new Board member appointees have to be selected.

Solution: The County Commissioners Court will need to appoint 5 new Housing Finance Corporation members in order to enable the Corporation to hold valid meetings, appoint new officers and make decisions on Corporation sponsored activities.

Result: The Corporation’s current bank balance is approximately $129,600 and decisions have to be made on specific activities and the eligible use of these funds.
 
7.   Discussion and possible action to approve and adopt a Resolution of the Commissioners Court of Webb County, Texas for the implementation of a Single Point of Contact (SPOC) policy and procedures effective March 1, 2016 for the development and submission of all future grant applications from the County of Webb, Texas.
 
Issue: There is a need to manage grant funded projects' development and submission to ensure all applications submitted focus “is in the best interest to Webb County”.   
 
Solution: Implement a “Single Point of Contact” policy for grant development and submission as an effort to reinstate the original goal of focus and responsibility in lessening the burden on the Webb County taxpayer.  
 
Result: These Single Point of Contact procedures will place accountability on the department developing the grant application, identify responsibility before the Commissioners Court gives its approval to develop the application.  These procedures will outline regimentation and function-focused grant funded activities that are in the best interest to Webb County.
 
Fire Suppression & EMS Services
 
8.   Discussion and possible action to accept a donation from Electric Transmission Texas, LLC (ETT) in the amount of $2,000.00, to be utilized in the purchase of firefighting equipment, including firefighting foam; and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. [Account #001-2203-6205 (Materials & Supplies)]

Issue: Donation check issued by Electric Transmission Texas, LLC  to support the mission of the Webb County Volunteer Fire Department.

Solution: Deposit check into Materials and Supplies line item, Account #001-2203-6205.

Result: Continue working relationship with ETT and purchase needed firefighting equipment and supplies.

Community Action Agency
 
12.   Discussion and possible action to accept grant contract #58160002358 award for the Comprehensive Energy Assistance Program (CEAP) from the Texas Department of Housing and Community Affairs (TDHCA) for the Program Year 2016. Contract Start Date - January 1, 2016 to Contract end date December 31, 2016, in the amount of ONE MILLION ONE HUNDRED THOUSAND ONE HUNDRED SEVENTY- FOUR DOLLARS ($1,100,174.00), and authorizing the County Judge to sign all relevant documents. [Fund #911]

Issue: Approve grant contract award for the CEAP Program from TDHCA for PY- 2016 in the amount of $1,100,174.00.

Solution: The Comprehensive Energy Assistance Program (CEAP) provides direct client services to eligible elderly, disabled and low income residents of Webb County.

Result: The services are intended to assist eligible Webb County residents with up to 8 highest remaining calendar months of energy consumption. The CEAP allocation for contract #58160002358 is for Twelve months.
 
13.   Discussion and possible action to  renew a  Twelve (12) month (March 1, 2016 through February 28, 2017) agreement with Ecolab for pest elimination services for the Meals on Wheels/Elderly Nutrition program. The cost will be Seventy Dollars ($70.00) per month. There will be no impact to the General Fund. [Accounts #953-4201-6201 (Utilities), #955-4222-6201 (Utilities) and  #952-4216-6201 (Utilities)]

Issue: Pest control services are not able to eliminate  pest problem inside and around the Meals on Wheels/Elderly Nutrition program kitchen facility. 

Solution: The Meals on Wheels/Elderly Nutrition programs must contract a pest elimination service as oppose to pest control services.

Result: Ecolab  provides the elimination of pests inside and around kitchen facility.     

 
Engineer
 
14.   Discussion and possible action to update the County Transportation Infrastructure Fund Project priority list for the Texas Department of Transportation (TxDOT).

Issue: After review of project priority list by the Texas Department of Transportation (TxDOT), Engineering and Road & Bridge Departments, the priority list has been updated to ensure that there is no overlap with projects that have already been completed or that have been allocated funds by TxDOT.

Solution: Provide an updated list of the County Transportation Infrastructure Fund (CTIF) project priority list as requested by grant program guideline on a bi-annual basis.

Result: Comply with the County Transportation Infrastructure Fund (CTIF) grant program guidelines and ensure that there is no overlap with projects that have already been completed through local or state funds, or that have been allocated funds for future letting by TxDOT.
 
 
15.   Discussion and possible action to adopt the 2016 Webb County Emergency Operations Plan, composed of the Basic Plan and Twenty-Two annexes, contingent upon review and approval by the Texas Department of Public Safety, Division of Emergency Management, Planning Section.

Issue:  The Webb County Emergency Operations Plan (E.O.P.) was last updated in June 2011 and must be updated and resubmitted to the Texas Division of Emergency Management at least every (5) years. The E.O.P. consists of the Basic Plan and Twenty-two annexes which are assigned to the appropriate county officials and department heads for update, approval and signature.

Solution: This agenda item will streamline the E.O.P. approval process and allow for the annexes to be executed by the designated signatories as soon as the review and approval process is completed at the state level.

Result: Efficient process for approval and adoption of the 2016 Webb County Emergency Operations Plan that will allow the county to meet the June 2016 5-year update deadline.
 
16.   Discussion and possible action to correct and rescind the awarded contractor listed from HRM Environmental to Velocity Dynamic Incorporated, as the sole source provider of the existing activation systems in the amount of $29,340.00 for Three (3) new Liquid Polymer Activation Systems for replacement of existing polymer chemical pumps at the Rio Bravo Water Treatment Plant that have been repaired multiple times and have become obsolete and ordering an exemption to the competitive bidding statue [Local Government Code Section 262.024 (a) 7 (Sole Source)]. [Account #745-3001-8801-7 (Capital Outlay Water Utilities)]

Issue: Purchase of complete  pump systems are required under manufacture policies to be issued to manufacturer instead of manufacturer representative.  All prior approved conditions maintain as previously presented. The Rio Bravo Water Treatment Plant currently utilizes only two liquid polymer activation system pumps to provide polymer to the clarification process and provide for the necessary rapid settling required in water treatment.  These two units have been repaired multiple times and although still in service, it is highly recommended that these units be replaced along with the installation of a third as originally designated for redundancy of service.

Solution: Purchase Three (3) new systems of the existing brand of activators effective in the plant.

Result:  This will provide us with Three fully active systems that can provide the current activation requirements in the treatment process as well as a third emergency redundant system for continued service demands.


 
 
17.   Discussion and possible action to approve and award a contract to IIIPG Enterprises, Inc., for the demolition of the Tex-Mex Building in the amount of $80,000.00. [Account #743-8001-8801-12 (Series 2013)]

Issue: Building is old and in very poor condition resulting in excessive amount of money to keep it operational.

Solution: Demolish building to make room for new construction.

Result: Much needed relocation of key departments such as; Tax Assessor Collector who is in need of a larger workspace and possibly the District Attorneys office, as well as increasing parking for the County.
 
 
18.   Discussion and possible action to approve Engineering Contract with LNV Engineering, Inc., in the amount not to exceed $38,000.00 for the Colorado Acres-Highway 59 Water Improvement Project with funds from the Texas Department of Agriculture, Texas Community Development Block Grant #7215510 and; authorize the County Judge to sign all relevant documentation. This action will have no impact on the County's General Fund. [Account #645-8001-6022]

Issue:  Water storage and dispenser improvements.

Solution: Utilize the Texas Community Development Block Grant received from the Texas Department of Agriculture to improve the plant.

Result:  Water Plant improvements to the Water Plant Facility (U.S. HWY 59).
 
Information Technology
 
19.   Discussion and possible action to enter into an agreement between Webb County and White Box Technologies Inc. for the development of a software interface at a total cost not to exceed THIRTY-SIX THOUSAND EIGHT HUNDRED THIRTY DOLLARS ($36,830.00) to have data exchanged between application systems used by the Sheriff’s Office, District Attorney’s Office, District Clerk & County Clerk's Offices; and authorizing the County Judge to sign and execute all relevant documents. [Account #605-0500-8801]

Issue: In order to have data exchanged between application systems used by the Sheriff’s Office, District Attorney’s Office, the District Clerk & County Clerk's Offices, a software interface must be developed and implemented.

Solution: Acquire the services of a vendor to develop and implement the software interface.

Result: The agencies mentioned above will have integration between their applications allowing for a more efficient and streamlined process.
 
Planning
 
20.   Discussion and possible action to issue a “Certificate of Compliance with Plat Requirements” to authorize an electrical service connection pursuant to Section 232.028(b)(2), and (b)(3), L.G.C., to an unplatted 1.0 acre tract of land, more or less, as described in Vol. 1757, Pgs. 794-796 of the Webb County Deed Records being out of and part Part E-1 of the A.M. Bruni Estate Partition Survey (a.k.a., Old Milwaukee East subdivision) located in Porcion 32, Abstract 296, Antonio Treviño Original Grantee; said tract being a further division of a 2.0 acre tract known as Tract F-2 described in Vol. 908, Pgs. 485-486, Webb County Official Public Records (ID 4411).

Issue: Regulatory compliance with development provisions of state and local regulations with particular emphasis on the Model Subdivision Rules. Commissioners Court must certify to certain property conditions before any electrical connection may be authorized.

Solution: As reflected in agenda backup, staff has verified compliance and recommends approval. Please note that water and sewer services are in place to authorize electrical connection.
 
Result: If approved, applicant may connect property to electrical services. If not approved, electrical connection to property is prohibited.

21.   Discussion and possible action to award Request for Proposal (RFP) 2016-52. Three (3) year contract for Generator Maintenance and Repair to the following, effective February 22, 2016:

23.   Discussion and possible action to authorize the Interim Purchasing Agent to solicit qualifications for the following professional services:

24.   Discussion and possible action to award Request for Proposal (RFP) 2016-53 Webb County Youth Village Surveillance Camera Project to Simplex Grinnell in the amount of $179,830. [Account #604-0101-8103 (Building Improvement Fund)]

Issue: The Youth Village Department is equipped with cameras used to monitor juveniles and staff on a 24/7 basis. 

Solution: The additional cameras will be beneficial for the department to safeguard the public, residents and staff from any altercations. Result: These additional cameras will help maintain a safe environment for the public, residents, and staff.
 
25.   Discussion and possible action to authorize the Interim Purchasing Agent to purchase One (1) 2016 Chevrolet Tahoe and One (1) Chevrolet Suburban from Holiday Chevrolet in an amount not to exceed $85,000.00; pursuant to Sections 271.101 and 271.102, Subchapter F, Cooperative Purchasing Programs, Texas Local Government Code, State of Texas contract MY16 071-072-AT. [Requested by Martin Cuellar, Sheriff; Accounts #178-2001-8801 ($56,606.00), #168-2006-8801 ($9,618.00)and #170-2006-8801 ($18,580.00)]

Issue:
No capital outlay funding is available in the general fund to purchase units for the Financial Special Investigation Group (FSIG).

Solution: Utilize FSIG seized funds to purchase units for investigative and operational purposes.

Result: The Sheriff’s Office is purchasing new patrol units to better serve the Community of Webb County through funding seized by the FSIG; Units will be utilized to further support the mission and goals of FSIG.

26.   Discussion and possible action to approve an Amendment to the Memorandum of Understanding between the Laredo Independent School District and Webb County Head Start for Dovalina, Heights, Sanchez Ochoa, and JC Martin Elementary School campuses. This Amendment will allow the Webb County Head Start program to provide a daily PM snack through the Child and Adult Food Program effective August 23, 2015 until each agreement is terminated. This item also authorizes the County Judge to execute all relevant documents; and any other matters incident thereto. [Requested by Aliza Oliveros, Head Start Director]
 
27.   Discussion and possible action to enter into a Thirty-Six (36) month (February 22, 2016 through February 21, 2019) Authorized Provider Agreement between Webb County for Head Start Department and The American Red Cross for training courses for employees, members and/or clients at a total cost of TEN THOUSAND EIGHT HUNDRED DOLLARS ($10,800.00) and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. 28.   Discussion and possible action to approve the renewal "Lease of Building for Office Space for Webb County Constable Pct. 4" to Godot, LTD.  The current lease agreement is for the office space of 1,724 square feet in area and is located at 9901 McPherson, Suite 102. The proposed renewal lease agreement is for Two (2) years with monthly rentals of $3,063.00 and security deposit in the amount of $2,973.36. 

Issue: The current lease agreement for the office space located at 9901 McPherson will expire on March 22, 2016.

Solution: Approve renewal lease agreement provided by Godot, LTD.

Result: With the renewal of the lease agreement daily operations of the Constable's Office Precinct 4 will not be interrupted.   
 
29.   Discussion and possible action to approve the creation of a new Federal Fund for the Constables Office Precinct 4 to deposit forfeiture funds from the United States Department of Treasury Joint Law Enforcement Operation (JLEO); and any other matters incident thereto. 

Issue: The Webb County Constable's Office of Precinct 4 is eligible to receive funds in the amount of $6,610.99 from ICE Equitable Sharing Fund. Currently the equitable sharing fund account for the constable's office is designated for funds received from the DEA.

Solution: Approve creation of the account to have a separate accounting for ICE and DEA equitable sharing funds.

Result: With the approval of the account, future equitable sharing funds from ICE will have direct account for ACH payments.

30.   Discussion and possible action to authorize the submission of a Violent Crimes Against Women Criminal Justice and Training (VAWA) grant application to the Criminal Justice Division (CJD) Office of Governor (OOG) in the amount estimated at $7,309 for training, equipment, and supplies for investigators working at the Webb County Sheriff’s Office serving victims of violent crimes against women and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires a Thirty-Five (35%) percent cash match, or a $3,936 cash match.  [Account #170-9501-9301 (Transfer out from Forfeiture Funds)]

Issue:  Violence against women is among the most intractable and deadliest criminal justice problems in the United States, especially domestic violence and in the South Texas area. According to published statistics, the number of American women between 2001-2012 who were murdered by current or ex male partners in the United States was 11,766. That's almost double the amount of casualties lost during wars in Afghanistan and Iraq. Women who will be victims of severe violence by an intimate partner in their lifetimes number 1 in 4.  (“30 Shocking Domestic Violence Statistics That Remind Us It’s An Epidemic”  Vagianos 10/23/2014)


Solution:  Grant application to enhance the tools, techniques, and training to those investigators who follow-up to calls for assistance, conduct interviews with these victims, file incident reports, provide these victims information/referrals to service providers, initiate arrests of perpetrators, refer cases for prosecution, and prepare testimony/evidence for trial in cases of domestic violence, sexual assault, dating violence, and stalking.

Result: Enhanced law enforcement services, including investigative techniques, to deal with emergent criminal trends, such as cyber stalking, and improved efficacy of the law enforcement response to the needs of victims of violent crime.

31.   Discussion and possible action to approve the transfer of employee and Slot #0088 (Payroll Technician) from Department #0300 (Treasury) to Department #1120 (County Clerk) with Annual Salary of $42,467 (12/Y), subject upon the availability of payroll funds and any applicable Civil Service guidelines, effective February 23, 2016:

Issue: There is a need for Personnel at the County Clerk's Office.

Solution: Transfer Employee and Slot 0080 (Payroll Technician) from Dept. 0300 (Treasury) to Dept. 1120 (County Clerk)

Result: Both departments have agreed to this transfer together with accruals.

32.   Status report with discussion and possible action from county staff regarding any/all outstanding invoices owed by Webb County that are more than Sixty (60) days overdue; and any other matters incident thereto.

33.   Discussion and possible action to authorize the purchase and installation of an aerosol sprayer/fogger and associated equipment, supplies, licensing and personal protection equipment (PPE) by the Environmental Health and Sanitation Department (Dept. 010-2204) for vector (mosquito) control activities in the unincorporated areas of Webb County to be undertaken in an effort to reduce/minimize public health threats related to mosquito-transmitted diseases; total cost (excluding PPE perishables and adultcide) not to exceed $15,000.00; acquisition subject to all purchasing and procurement policies of Webb County; and any other matters incident thereto. Issue: 
Webb County is at increased risk of vector-borne diseases. Two predominant mosquito species exist in Webb County, the Aedes aegypti and Aedes albopictus, which are responsible for the transmission of two new diseases to North America - Chikungunya and Zika.  In the event of an outbreak locally, the county does not possess equipment to control adult mosquitoes.

Solution:  Acquire adultcide equipment and supplies to assist vector control activities along with on-going surveillance efforts that control mosquito larva and breeding areas in Webb County.

Result:  The proposed equipment will facilitate county efforts to reduce/minimize public health threats as well as provide combative measures in response to an outbreak of mosquito-transmitted diseases.

34.   Discussion and possible action to authorize that any and all internal controls put in place by the auditors office in the current financial software program that directly affect funds and accounts under the purview of Commissioners Court, be removed and changed so that the budget officers can have the access necessary to provide the financial accounting directives authorized by the court; and any other matters incident thereto.
 
35.   Discussion and possible action to transfer all unencumbered funds from Accounts #603-0101-8801 (Capital Outlay Fund) and #604-0101-8103 (Permanent Improvement Fund) into Fund 605-3001-8801-7 in an effort to reconcile available account balances and to improve transparency of financial accounting from the county’s general fund; and any other matters incident thereto.

36.   Discussion and possible action to commence the Veterans Out-of-Town Transportation Assistance Program, which will provide out-of-town transportation for veterans to evaluation and medical appointments.

Issue: Many of our local veterans do not have transportation or are not capable of driving to VA medical appointments outside of the county lines. Many of the VA evaluation appointments, which are part of the process for receiving a VA compensation rating, are usually in the cities of San Antonio, Harligen, Corpus Christi, and McAllen. In addition, when veterans need a specialist for certain medical issues that can not be treated at the local VA clinic, they are often referred to VA hospitals and specialty clinics which are located in San Antonio, Harligen and Corpus Christi.



Solution: The commencement of the Veterans Out-of-Town Transportation Program will allow for the veterans to attend VA scheduled medical appointments outside of the Webb County lines.

Result: Veterans will be able to receive proper health care, most of the time at no cost to them through VA specialty clinics and VA hospitals located in San Antonio, Harligen and Corpus Christi. It will also allow for veterans that are struggling financially to receive VA compensation ratings that in some cases can life changing.

37.   Discussion and possible action to authorize the Interim Purchasing Agent to solicit Requests For Proposals (RFP's), for "Appraisals" for all unoccupied county-owned buildings located in the downtown area for possible sale of said properties for the further improvement of the downtown area, including the Juan Francisco Farias Building which is jointly owned with the City of Laredo; and any other matters incident thereto. 38.   Discussion and possible action to authorize the Purchasing Agent to solicit Request for Qualifications (RFQs) to masterplan Laredo International Fair & Exposition Grounds (LIFE).
