4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

 
CONSENT ITEMS
 
5.   Civil Legal Division
 
a.   Discussion and possible action to enter into a Non-Financial Memorandum of Understanding (MOU) between the United Independent School District (UISD) Pregnancy, Education, and Parenting Program (PEP) and Webb County for the Webb County Head Start/Early Head Start Program. This MOU provides a common understanding of the collaboration and relationship between the local Head Start/Early Head Start Program and the PEP Program. It establishes clear expectations and a reliable way of relating to one another for mutual cooperation. The term of the MOU shall be affective upon the execution of the MOU and ending on when either party terminates the agreement, and authorizing the County Judge to sign and execute all relevant documents. b.   Discussion and possible action for to enter into a sixty (60) month (March 1, 2018 through February 28, 2023) Data Service Agreement between Webb County and Smart Com Telephone, at a monthly cost of Six Hundred Thirty Four Dollars ($634.00) for a total cost of Thirty Eight Thousand Forty Dollars ($38,040.00) for data service for County Offices in the quad city area, subject to annual budget appropriations, authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. 6.   Community Action Agency
 
a.   Discussion and possible action to authorize Webb County Community Action Agency to enter into an annual vendor agreement with Reliant Energy Providers (listed below) for the implementation of Community Services Block Grant (CSBG) and the Comprehensive Energy Assistance Program (CEAP). These vendor agreements are a Texas Department of Housing and Community Affairs (TDHCA) requirement for the implementation of the programs.

Issue: The Webb County CAA will enter into an annual vendor agreement with Retail Energy Providers for the implementation of the Community Services Block Grant (CSBG) and the Comprehensive Energy Assistance Program (CEAP).

Solution: These vendor agreements are a Texas Department of Housing and Community Affairs (TDHCA) requirement for the implementation of the programs.

Result: The Texas Department of Housing and Community Affairs (TDHCA) will provide funding to be used for payment of qualifying low income clients home energy expenses.

b.   Discussion and possible action to authorize the Webb County Community Action Agency to enter into an annual agreement with Neighbor to Neighbor with  Direct Energy, Limited Partnership (Direct Energy), CPL Retail Energy, Limited Partnership (CPL Retail Energy) WTU Retail Energy, Limited Partnership (WTU Retail Energy) First Choice Power, Limited Liability Company (First Choice Power) and/or Bounce Energy, Limited Partnership (Bounce Energy). Effective as of January 1, 2018. The purpose of the agreement is to assist low income clients to pay their electric home energy expenses thru the Neighbor to Neighbor Program.

Issue: Webb County Community Action Agency will enter into an annual agreement with the Neighbor to Neighbor Program. The agreement shall become effective on January 1, 2018, and shall continue in effect for an initial term through December 31, 2018 and may be renewed annually each January with the signatures of both parties.

Solution: The Neighbor to Neighbor Program will provide funding to the Retail Energy Providers low income clients pay their electric home energy expenses. 

Result: Qualifying recipients will receive  assistance from the Program no more than  $700.00, in any calendar year.

b.   Discussion and possible action to enter into a weapon exchange program with Kirkpatrick Guns and Ammo for new department weapons at no cost to Webb County, in accordance with the Texas Local Government Code, Section 263.152 (Disposition)(A)(2) for the purpose of purchasing new service weapons, and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto.

Issue: A cache of forfeited weapons in our inventory that serve no purpose in a law enforcement capacity.

Solution: The exchange of forfeited weapons for three new rifles at no cost to the County or this Office.

Result: Use of these new weapons will be for official law enforcement purposes and with a lower risk of liability to the County.

10.   Economic Development
 
a.   Discussion and possible action to authorize the submission of a Fiscal Year 2019 Local Border Security Program (FY 19 LBSP) grant application as developed, written, and submitted by the Webb County Sheriff’s Office to the Office of the Homeland Security Grants Division (HSGD) in the amount estimated between $150,000 -$200,000 for peace officers' overtime and applicable fringe benefits to provide enhanced border security in the Laredo/Webb County area, and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require a match; and, thus, will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]
 
Issue: The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fluidity of border crossings, heavy commercial activity, and interdependence of the international border communities’ economies. These socio-economic pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.
 
Solution: Grant application to provide enhanced border security in Laredo/Webb County in order to fulfill State of Texas local border security program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas.
 
Result: Enhanced/increased patrol and investigative capacity for certified peace officers working at the Webb County Sheriff’s Office.

b.   Discussion and possible action to authorize the Economic Development Department to assist in the development and submission of a grant application to the Texas Indigent Defense Commission for the TIDC FY 2019 Discretionary Grant – Webb County Integrated Defense Project for $377,472 in grant funds requiring a cash match of $373,164 over the four (4) year grant period. The required match shall be committed in a four-year sliding scale (1st year - 80%/20%, 2nd year - 60%/40%, 3rd year - 40%/60% and 4th year - 20%/80%). All required documents were sent for review through the Economic Development Department, and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) policy. Issue: The Public Defender’s Office is in need of an immigration attorney and a mental health social worker.

Solution: The Public Defender’s Office proposes to apply for the Texas Indigent Defense Commission FY 2019 Discretionary Grant. To qualify for this grant, it is necessary to first submit a Letter of Intent for this multi-year grant that requires a county cash match. The Texas Indigent Defense Commission (TIDC) pays up to 80% of the total project cost for the 1st year ($154,435.20), 60% the second year ($111,518.40), 40% for the third year ($74,345.60), and 20% for the fourth year ($37,172.80). Webb County will be responsible for 20% of the cost of the project the 1st year ($38,608.80), 40% the second year ($74,345.60), 60% the third year ($111,518.40), and 80% in the last year ($148,691.20). The cash match from the County for the four year period will be a total of $373,164.00 and will come from the General Fund.

Result: This grant will allow the Public Defender’s office to provide clients and Assistant Public Defenders consultation services on complex immigration issues, and early intervention for clients with mental illness/mental retardation with the goal of keeping the clients from re-entering the criminal justice system.

c.   Discussion and possible action to accept a grant award in the amount of $28,546.78 (OAG Contract No. 1877927) for the Fiscal Year (FY) 2018 Statewide Automated Victim Notification Service (SAVNS) from the Office of the Texas Attorney General (OAG) for the automated notification of crime victims for a period of Twelve (12) months beginning on September 1, 2017, through August 31, 2018, for a total amount of Twenty-Eight Thousand Five Hundred Forty-Six Dollars and Seventy-Eight Cents ($28,546.78) and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. There is no cash match; and, thus, there is no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.  [Fund 2712 (Texas SAVNS Contract)] [Requested by Martin Cuellar, Webb County Sheriff]

Issue:  In the past decades, many crime victims, such as victims of sexual assault and domestic violence, were unaware if their respective crime perpetrators were able to post bail and released from the corrections system. In late 1993, one particular victim who had been raped, assaulted, and stalked in Jefferson County was unaware that her former boyfriend had been released and was subsequently ambushed by him after she left work. She was shot Seven (7) times at point blank range and killed on that day, her 21st birthday.

Solution: As a result of community outrage, an automated telephone notification system for crime victims and other concerned citizens was instituted: Victim Information and Notification Everyday (VINE) Service. This nationwide system is funded for Texas counties through the Texas Office of the Attorney General (OAG) and is currently utilized by Webb County.

Result: The crime victims of Laredo/Webb County can enroll in this program and will be provided with automated notification upon an offender’s custody status change, such as release, transfer, and/or relevant district court dates.

e.   Discussion and possible action to enter into contract 5311 State Grant Amendment No. One (1) Minute Order 115125 for Grant FY 2018 with the State of Texas, acting through the Texas Department of Transportation; wherein Webb County accepts an increase of FORTY ONE THOUSAND ONE HUNDRED FIFTY DOLLARS ($41,150.00) for El Aguila Rural Transportation Program and authorizing the County Judge to sign all relevant documents. f.   Discussion and possible action to authorize the acceptance of a grant award in the amount of $5,490 for an application that was prepared, written, and submitted by the Webb County Sheriff’s Office to a foundation for law enforcement firearms for certified peace officers working at the Webb County Sheriff's Office and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The Webb County Sheriff’s Office must continually equip its sworn officer force with an important array of duty gear, other critical safety equipment, and essential, but costly expendable supplies, such as ammunition, utilizing limited local funds.  Moreover, the vast majority of federal and state grants do not allow for the purchase of firearms as an eligible grant expense.

Solution: Grant award from a foundation to provide firearms as a supplemental source of this needed equipment and consumable supplies/materials.

Result: The Webb County Sheriff’s Office sworn officer force will be provided with additional firearms and magazines.

b.   Discussion and possible action to accept state tobacco funds provided through the Seven Flags Regional Advisory Council (RAC) Trauma Service Area "T" in the amount of $8,773.60, to be utilized in the purchase of EMS supplies, training, travel, personnel cost, membership to professional/technical organizations, public education, vehicle maintenance and equipment for both stations of the Webb County Volunteer Fire Department. Smith d/b/a Intentional Leadership Consultants for the development of a Community Needs Assessment as required under the Texas Healthcare Transformation and Quality Improvement Program/1115 Waiver for the submission of an updated Regional Healthcare Partnership (RHP) plan for Region 20 at a total cost of up to Twenty Thousand Dollars ($20,000.00) in accordance with Local Government Code Section 262.024 (Discretionary Exemptions) (4) Professional Services, and authorizing the Webb County Judge to sign all relevant documents; and any other matters incident thereto. Funds for the Community Needs Assessment will come from the RHP20 Anchor Fund and will have no impact to the General Fund. [Account #2002-5100-001-432001 (Professional Services)]

Issue: The 1115 Waiver renewal request was approved by the Centers for Medicare and Medicaid Services (CMS) to extend the DSRIP program for four (4) years through September 30, 2021. An updated Regional Plan needs to be submitted by each anchor entity and include an updated Community Needs Assessments.

Solution: An updated Community Needs Assessment (CNA) must be developed. Intentional Leadership Consultants has prior experience in preparing Community Needs Assessments in other areas as well as preparing applications for grant funding from different government entities.

Result: By contracting with Intentional Leadership Consultants for the development of a Community Needs Assessment, Webb County, as anchors fro RHP20, will be able to submit an updated regional plan as required by CMS.

16.   Water Utilities
 
a.   Discussion and possible action to award a Professional Service Contract in an amount not to exceed $36,000.00 to Porras Nance Engineering for engineering and surveying services to develop construction plans for replacement of existing pressure reducing valves on the El Cenizo 8" and 12" supply mains that no longer function, and authorizing the County Judge to sign and execute all relevant documents; and other matters incident thereto; Texas Local Government Code under 262.024 Discretionary Exemptions section (a) (4) a persona or professional service. Issue: Initial construction of transmission mains and operation of El Cenizo's distribution system has provided very little control and effective operation of the distribution lines as well as non-compliance in use of the existing elevated storage tank. Attempts by our operation have been attempted in recalibrating and replacing existing pressure reducing valves; however, its cost and effectiveness is not warranted.

Solution: Construction of a Motor Operated Valve in feedback with level at the Rio Bravo Elevated Storage Tank and El Cenizo Elevated Storage Tank will provide for the continuous control of service to this community, and provide for compliance with TCEQ requirements.

Result: More efficient water distribution, reducing levels of dead end locations which in turn will lead to improved water quality.

b.   Discussion and possible action to approve the execution of professional services contract for the "Rio Bravo Wastewater Treatment Plant Rehabilitation Design Project" to the sole proposer Garver, LLC pursuant to RFQ 2017-004 in the amount of $137,829.00 for professional engineering services to complete an engineering evaluation for Work Order No.1; the Rio Bravo Wastewater Treatment Plant, and Work Order No.2; Collection System Lift Station evaluation, to determine the best and most efficient manner to implement final improvements to the plants infrastructure and operational process, and authorizing the County Judge to sign and execute all relevant documents; and any other matters incident thereto. This project is included in the departments approved Capital Improvement Plan. Issue: Although currently the Rio Bravo Wastewater Treatment Plant is operational and producing treated effluent that meets the compliance requirements of TCEQ, significant improvements are necessary to assure the plant can meet its regulatory requirements into the future and the prevention of emergency failures. This requires significant improvements of an already failing infrastructure. It will be critical to modify the operations to assure more efficient and therefore less costly operation. Project of expected need were provided onto the approved Capital Improvements Plan.

Solution: First we must determine the level of degradation and cost for rehabilitation with alternatives of Best Practices that could be implemented here that will provide us with more consistent and effective service for our customers. This engineering project will provide us with alternatives to this implementation.

Result: Information and alternatives to be considered for entering into an rehabilitation design for construction bidding.

20.   Discussion and possible action to grant an exception to Rule 9.03(a) of the Webb County Policy and allow the accrual of 8 hours of sick leave and 8 hours of annual leave to three grant funded employees of the 406th Veterans Treatment Program who lost their January accruals due to an adjustment in department hours for safety reasons, and any other matters incident thereto.

Issue: On January 16, 2018, Judge Hale gave a directive to adjust the hours for the department due to the inclement weather forecasted for the Laredo area for January 17, 2018.  Employees were instructed that in the event a County closure was declared, they would not be deducted the hours, but if not, they were to use leave.  Due to unforeseen circumstances in their personal lives, the affected employees did not have any sick leave or annual leave accruals and, therefore, inadvertently (took) more than 4 hours of unpaid leave. 

Solution: The Commissioners Court granting an exception to Rule 9.03(a) of the Webb County Policy in order to allow the three affected employees to accrue the 8 hours of sick leave and 8 hours of annual leave they would have accrued for the month of January 2018. 

Result: The affected employees will be able to accrue the leave hours for the month of January.

22.   Discussion and possible action to enter into negotiations and enter into separate agreements with United States Federal Government for the detention of federal inmates/detainees at the, Webb County Jail, Laredo Processing Center and the Webb County Detention Center; pursuant to the Texas Local Government Code §272.005, these contracts known as I.G.S.A. are set to establish the reimbursement for the detention of federal prisoners on a tiered per diem basis; and any other matters incident thereto, and authorizing the County Judge to sign any relevant documents thereto. [Requested by Webb County Sheriff Martin Cuellar]

Issue: Representatives of the federal government (I.C.E.) have approached the County requesting we enter into two I.G.S.A. contracts with them. Texas Local Government Code §272.005 permits the county to enter into agreement without violating the purchasing act. The previous I.G.S.A. Contract is set to expire February 28, 2018 with I.C.E and without an agreement, the County will not receive reimbursement for federal detainees or prisoners. Separate contracts will be needed in relation to the, Laredo Processing Center and the Webb County Processing Center. In addition, the reimbursement for detaining federal inmates/detainees will aid the public by detaining individuals who have committed offenses while creating a flow of revenues for the county.

Solution: Enter into a new agreement with the federal government that will set a reimbursement amount for the detention of federal detainees/prisoners.

Result: Two new IGSA agreements will allow Webb County reimbursement for the detention of federal prisoners/detainees that are being held at either the Laredo Processing Center or the Webb County Detention Center. The public will be served by and through this agreement by protecting the community from individuals who have been detained for committing offenses and the federal government will bear the burden of paying for the detention of the individual.

25.   Discussion and possible action to authorize a Memorandum of Understanding (MOU) between Webb County and The Rape Crisis Center (RCC) which will provide a Prison Rape Elimination (PREA) support hotline at no cost to Webb County which will assist the Webb County Jail with identifying and aiding victims of sexual violence or concerns regarding mental health needs of inmates; and authorizing the County Judge to execute all relevant documents related to this MOU; and any other matters thereto.  [Requested by Jorge L. Issue: The Webb County Jail would like to provide additional services to Webb County Jail inmates/detainees and obtain training related to this MOU. 
 
Solution: The Rape Crisis Center (RCC) has extended the offer to provide no cost services to Webb County which includes a hotline, free relevant training to correctional officers, free posters and literature for the jail on how detainees/inmates may request services.

Result: Webb County will receive PREA Services free of charge along with any training.

Issue: On January 22, 2018, Commissioners Court authorized the Purchasing Agent to reject all bids and rebid project due to bids exceeding grant budgets.

Solution: ITB 2018-001 was advertised and 2 bids were secured by Purchasing Agent.  Bronze Builders was the low bidder.

Result: Authorize County Staff to proceed with construction contract execution and construction of the 3 project homes funded by Texas Community Development Program Grant.

27.   Discussion and possible action to authorize the Purchasing Agent to advertise for bids for rifle resistant body armor for eligible peace officers working at the Webb County Sheriff's Office; the Offices of the Constable, Pct. 1-4; the District Attorney’s Office; and the Webb County Attorney’s Office in accordance with the Texas Local Government Code, Sub-Chapter C. Issue: On 1/22/2018, Commissioners Court approved and accepted a grant award in the amount of $184,973 for the purchase of rifle resistant body armor for the Webb County Sheriff's Office; the Offices of the Constable Pct. 1-4; the District Attorney’s Office; and the Webb County Attorney’s Office.

Solution: Authorize the Purchasing Agent to solicit for bids in accordance with State procurement laws.

Results: Secure formal bids and present lowest and responsible bidder to Commissioners Court for final approval.

28.   Discussion and possible action to approve the purchase of 296 Sig Sauer 9mm handguns for the Webb County Sheriff's Office for a total of $34,109.00 and further approve a discretionary exemption under Section 262.024 (7)(a) sole source from the Local Government Code. Issue:
There is a higher cost and a longer waiting time when ordering ammunition for 357's. In addition, it is becoming common practice across the State for law enforcement agencies to carry 9 mm weapons.  Partnering agencies can exchange the same ammunition if all service weapons are standardized in the event a mass shooting occurs. 

Solution: Authorize the purchase of 296 Sig Sauer 9 mm handguns for Sheriff Deputies.  Funding was budgeted under fund 3015.

Result: Authorize the Purchasing Agent to proceed with the purchase, standardize the service weapon all Sheriff Deputies carry, lower cost on ammunition and enhance public safety by equipping our law enforcement officers with the recommended service weapon.

29.   Discussion and possible action to approve the trade in of 250 service weapons in accordance with the Texas Local Government Code, Section 263.152 (Disposition)(A)(2) for the purpose of purchasing new service weapons for the Webb County Sheriff's Office. The trade in value of the weapons will provide a $92,875.00 reduction in the cost to purchase the Sig Sauer 9 mm service weapons. [Requested by Joe Lopez III, Purchasing Agent]

Issue:  State law requires for Commissioner Court to approve any offer of County property as a trade-in for new property of the same general type if the Commissioners Court considers the action to be in the best interest of County.

Solution: Approve the trade in of service weapons to secure a $92,875.00 credit toward total cost of new service weapons.

Result:
Comply with State law and minimize expenditures by trading in older service weapons for new weapons.

Result:
Replace 2014 model golf carts with 2018 models to offset maintenance repairs and avoid a straight out purchase that requires a cash commitment upfront.

The application approval process is completed within 60 business days of receipt. Webb County Constable Pct. 3 will comply with all the conditions and provisions of 14 CFR part 107.

Issue: Webb County Constable Pct. 3 will need to apply for a certificate of waiver from The Federal Aviation Administration (FAA) to fly the drone.

Solution: Webb County Constable Pct. 3 will be in compliance with The Federal Aviation Administration if Commissioner's Court approves to allow Constable Pct. 3 department to apply for 107 certificate of waiver.

Issue: RVWM has failed to obtain all necessary local permits as required by local, state, and federal law. The currently application as modified and preliminary decision by TCEQ is contrary to the Law. By not protesting TCEQ will not be aware of ongoing noncompliance with regulatory requirements. Before a permit is issued there is a time frame in which an individual or local community can submit their written protest to a permit. The filing of the brief and request for a contested public hearing is not litigation it is the formal review process for the issuance of TCEQ’s permitting.
 
Solution: File a brief and request a contested public hearing delineating local concerns and deficiencies as set out through the public notice published by TCEQ, issued on January 26, 2018.  As a result, TCEQ will be formally advised of local issues and have the necessary information to render an informed decision prior to issuing a final permit.

Result: TCEQ will have information that will aid them in their final determination regarding permit.
