4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

5.   Auditor
 
a.   Discussion and possible action to approve, by Order, the following budget amendment (line item transfer) for the 406th Judicial District Veterans Treatment Program (SAMHSA Grant #TI08-1929-01) by increasing the Fund Balance Account #2354-259700 in the amount of $3,000.00 from revenues received from the Veterans Treatment Program Jury funds. These expenditures are allowable as costs for the development and maintenance of drug court and veterans court programs operated within the county. There will be no impact to the General Fund. Issue: Frequent drug and alcohol testing is part of the 10-Key components of a Veterans Treatment Program as indicated by the National Association for Drug Court Professionals Organization.  Drug testing services are rendered to all participants.

Solution: The Veterans Treatment Program fees allows funds to be utilized for services provided to the VTP participants, specifically, drug and alcohol testing services. 

Result: All participants will continue to be drug tested in order to monitor abstinence and compliance while participating in the 406th Judicial District Veterans Treatment Program.

Issue: Merchandise sales at the golf course are running significantly above the budget – for the period ending 2/29/20 sales are 81% over budget ($11K).  In order to continue to support this sales level, we are requesting line item transfers from the Food and Non-Alcoholic Beverage COS categories.  The aggregate transfer amount requested above is $10,000.  Unfortunately sales in the restaurant are below budget allowing for this re-allocation.

Solution: Transfer as requested above.

Result: There will be sufficient funds in all budget line items to pay requested items.

7.   Civil Legal Division
 
a.   Discussion and possible action to authorize Webb County to enter into a Five (5) year agreement with AT&T for switched Ethernet services at a monthly rate of $7,821.63 pursuant to Section 271.101 and 271.102, Subchapter F, Cooperative Purchasing Program, Texas Local Government Code; DIR –TEX-AN-NG-CTSA-005; and any other matters incident thereto; and have the County Judge sign any relevant documents. Issue: Webb County is no longer under contract with AT&T for our Fiber ASE.
 
Solution: Sign all relevant documents to enter into a new service agreement with AT&T.
 
Result: Webb County will have more bandwidth and will pay less by signing the new agreement.

8.   Community Action Agency
 
a.   Discussion and possible action to approve submitting the application for participation in the LTSS Managed Care Organization – Superior Health Plan provider network. The Meals on Wheels program will continue contract rate up to $6.12 per unit and provide 16,130 home delivered meals, and authorizing the Webb County Judge to sign any relevant documents and any other matters incident thereto. There will not be an impact to the General Fund.

Issue: The LTSS MCO - Superior Health Plan provider application must be updated for continued participation the provider network.

Solution: The approval of the Commissioner's Court will authorize the LTSS MCO network provider (Superior Health Plan) to enter into a service agreement to provide additional home-delivered meals.

Result: The Meals on Wheels program will continue to provide home-delivered meals through a partnership with LTSS Managed Care Organization - Superior Health Plan.

10.   Honorable Tano E. Tijerina, Webb County Judge
 
a.   Discussion and possible action authorizing the Purchasing Agent to add a new cell phone device and phone line including data service in accordance with the current approved AT&T FirstNet Plan for the Webb County Emergency Management Department pursuant to Sections 271.101 and 271.102, Texas Local Government Code, Cooperative Purchasing program DIR Agreement TSO-3420 at a monthly rate of $44.99 plus surcharges and other fees, and one time fee for the device in the amount of five hundred forty-nine and ninety-nine cents ($549.99); and subject to annual budgetary appropriation.  [Accounts #1001-3120-001-441001 (Telephone) & #1001-3120-001-461000 (Materials & Supplies)]

Issue: A cellular phone with FirstNet access is needed for the communications officer who travels regularly and is on call after hours and on weekends to respond to emergency incidents.

Solution: A county issued cell phone will ensure that the Communications Officer is available at all times.

Result: The Communications Officer will be easily accessible on a 24/7 basis.

11.   Honorable Esther Degollado, District Clerk
 
a.   Discussion and possible action to approve the purchase of Twenty (20) Dell Laptops and Twenty (20) Microsoft Licenses from Dell and SHI to continue the e-filing process for all civil, family and criminal cases pursuant to Sections 271.101 and 271.102, Texas Local Government Code, Cooperative Purchasing program DIR-TSO-3763 and DIR-TSO-4092 respectively in the amount of Thirty-Nine Thousand Four Hundred Ninety-One Dollars and Zero cents ($39,491.00). Issue:
With news of COVID-19 rapidly changing, there is a possibility of employees needing to work from home and at this time, the department is not equipped with the proper tools to do so

Solution: The purchase of laptops will allow employees to work from home, if necessary.

Result: Working from home, the department will still be able to assist the courts and attorneys with the E-Filing process.

12.   Economic Development
 
a.   Discussion and possible action to authorize the submission of a grant application to the Office of the Texas Attorney General in the amount at $5,200 as developed and submitted by the Webb County Sheriff's Office for training and equipment/supplies for the Webb County Sheriff’s Office Internet Crimes Against Children (ICAC), and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff] 
 
Issue:  The psychological, emotional, and physical damage caused by child predators and inflicted on innocent victims, their families, and communities can be deeply destructive and have far-reaching consequences that can last a lifetime. Furthermore, throughout the United States, criminal cases built against child predators can be extremely complex, technologically challenging, and legally complicated.
 
Solution:  The Webb County Sheriff’s Office cybercrimes law enforcement unit has successfully worked with multiple federal, state, and local law enforcement agencies, including the Office of the Attorney General, to arrest child predators in the Laredo/Webb County area. Grant application to supplement the successful endeavors of the Webb County Sheriff’s Office cyber crimes against children task force to protect the children and youth of the Laredo/Webb County community against child predation.

Result: The Webb County Sheriff’s Office will continue to enhance its ability to work proactively not only to catch individual child predators, but to produce an overall inhospitable environment for cyber crimes against children in Laredo/Webb County for the further prevention of child predation in our community.

b.   Discussion and possible action to apply for a FY 2019 – 2020 Federal 5339 Bus and Bus Facilities Grant for Webb County Community Action Agency from The Texas Department of Transportation (TxDOT) in the amount of SEVENTY ONE THOUSAND EIGHT HUNDRED TWENTY SEVEN DOLLARS ($71,827.00).  This grant does NOT require a County Match.  All required documentation has been submitted for review to the Economic Development Department and the solicitation is compliant with Webb County Single Point of Contact (SPOC) procedures.  No impact to the General Fund. [Requested by James Flores, CAA Executive Director]
 
Issue: CAA- El Aguila Rural Transportation is a grant funded agency. Annually, TxDOT allots monies to replace vehicles that are projected to exceed their useful life benchmark (ULB) by 2021.   
 
Solution: This grant will allow us to upgrade fleet as designated by TxDOT.
 
Result: Decrease in agency’s vehicle maintenance cost and continuation of services throughout the rural areas of Webb County.

c.   Discussion and possible action to authorize the acceptance of a grant award by the NRA Foundation the amount of $3,252 as developed, written, and submitted by the Webb County Sheriff's Office for firearms for their certified peace officers, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]
 
Issue: The Webb County Sheriff’s Office must continually equip its sworn officer force with an important array of critical equipment.

Solution: Grant award to provide firearms as a supplemental source of this needed equipment.
 
Result: The Webb County Sheriff’s Office's  sworn officer force will be provided with needed equipment.

d.   Discussion and possible action to authorize the acceptance of a High Intensity Drug Trafficking Areas Grant (HIDTA Program) from the Executive Office of the President, Office of National Drug Control Policy in the amount of $530,150 for the continued salary and fringe benefits of seven Task Force Investigators; and authorizing the Webb County Judge to act as the County’s Executive Officer and Authorized Representative in all matters pertaining to the County’s participation in this grant. There is no cash match requirement for this grant; however, the District Attorney's Office requests additional funding in the form of cash match to cover expenditures in excess of the grant award. The cash match in the amount of $100,125 is requested each year through the county's budget process. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Contract Term: January 1, 2020 to December 31, 2021. [Requested by Isidro "Chilo" Alaniz, District Attorney; Account #1001-1160-001-463903-025 (Federal Matching Narcotics Task Force DEA)]

Issue: 
There is evidence that trafficking in narcotics and dangerous drugs exists in Laredo, Texas and that such illegal activity has a substantial and detrimental effect on the health and welfare of the people of Texas.

Solution: Gather and report intelligence data relating to trafficking in narcotics and dangerous drugs. Conduct undercover operations and engage in other traditional methods of investigations.

Result: Disrupt the illicit drug traffic in Laredo by immobilizing targeted violators and trafficking organizations.

e.   Discussion and possible action to approve and authorize the Webb County Commissioners Court the appointment of Mr. James Flores, Economic Development Director, as the Labor Standards Officer and designation for Civil Rights Officer to the Texas Community Block Grant Program #7219095 grant and authorize the Webb County Judge to sign all relevant documentation. This action will have no impact on the County's General Fund. [Requested by James Flores, Economic Development Director]

Issue: Labor Standards & Civil Rights Officer must be appointed to comply with funding agency requirements.

Solution: Appointment will allow the department to oversee the labor portion of the project and allow compliance of fair housing and equal opportunity activities with contract.

Result: The Economic Development Department will assure compliance with requirements from funding agency.

f.   Discussion and possible action to approve a Resolution regarding various compliance matters required by the Texas Department of Agriculture Texas Community Development Block Grant #7219095, and authorizing the Webb County Judge to sign all relevant documentation. This action will have no impact on the County's General Fund. [Requested by James Flores, Economic Development Director]

Issue: Civil Rights and other compliance requirements must be implemented by Webb County to comply with grant funding agency program requirements.

Solution: Civil Rights must be implemented and will allow compliance of Citizen Participation Planned Grievance Procedures, Section 3 Policy, Excessive Force Policy, Section 504 Policy, Limited English Proficiency and Fair Housing.

Result: The Economic Development Department will assure compliance with requirements from funding agency.

g.   Discussion and possible action to approve a Resolution authorizing the Honorable Tano E. Tijerina, Webb County Judge and Honorable Jesse Gonzalez, Webb County Commissioner Pct. 1, as authorized signatories to the Texas Community Block Grant Program #7219095 grant, and authorize the Webb County Judge to sign all relevant documentation. This action will have no impact on the County's General Fund. [Requested by James Flores, Economic Development Director]

Issue: Two signatures are required on all draw-down requests for reimbursements. 

Solution: This will allow by resolution the individuals listed above as authorized signatories for the Request for Payment Form A203 where two (2) signatures are required for reimbursement of funds.

Result: This will allow Webb County to receive reimbursement for funds spent under this water system improvements grant from TDA.

h.   Discussion and possible action to proclaim April 2020 as the 52nd Anniversary of Fair Housing Month, April 13-17, 2020 as Fair Housing Week and designating the Webb County Community Action Agency to monitor Fair Housing Webb County. [Requested by James Flores, Economic Development Director]

Issue: In order to continue to apply for grants, it is a federal requirement that Webb County promotes Fair Housing within its jurisdiction.

Solution: Promotion Fair Housing in Webb County and designating a week during the month of April will help citizens of Webb County to know of their legal rights in housing discrimination.

Result: The federal requirement for Fair Housing will be met by promoting Fair Housing within Webb County's jurisdiction. This will allow Webb County to continue to apply for grants.

13.   Fire Suppression & EMS Services
 
a.   Discussion and possible action to accept EMS County Assistance funds provided through the Seven Flags Regional Advisory Council (RAC) Trauma Service Area "T" in the amount of $6,299.00, to be utilized in the purchase of EMS supplies, training, travel, membership to professional/technical organizations, public education, vehicle maintenance and equipment for all three stations of the Webb County Volunteer Fire Department, and authorizing the County Judge to sign all relevant documents; and other matters incident thereto. Issue: State funding provided through Seven Flags RAC for EMS needs/operations.

Solution: Utilize monies for purchase of supplies, training, travel, equipment and its maintenance.

Result: Properly stocked emergency units ready for response, and well-prepared personnel.

Result: Final drainage and road improvements are scheduled to be completed by July 2020.

b.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage property that has no value for the purpose it was originally intended for and/or surplus property that is no longer needed by the department and could be transferred for use by another County department or auctioned online to the general public and/or donated as permitted by law.
 
Solution: Attempt to sell the County surplus or salvage property by public auction, dispose or destroy property that cannot be sold through auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.
 
Result: Process all surplus or salvage property in accordance with state law and Webb County Procurement Policy.

c.   Discussion and possible action to transfer a 2007 Ford F-150 Truck, VIN #1FTRF12W47NA28443 from Road and Bridge to Indigent Health Care Department and any other matters incident thereto. [Requested by Indigent Health Care Department]
 
Issue: Indigent Health Care Services is requesting One (1) unit be transferred for operational use and returned to Purchasing Department for auction once leased units authorized by commissioners court are received by Webb County.
 
Solution: Transfer One (1) unit scheduled for auction to Indigent Health Care Services on a temporary basis.
 
Result: Temporary assignment of unit will fill current void in departments transportation requirements due to vehicular accident causing damage to department unit that is no longer operational.

21.   Discussion and possible action to create a special revenue fund for the Webb County Emergency Management Plan COVID-19 in accordance with Texas Government Code 418.108(d) Declaration of Local Disaster and establish a budget, by order, for revenues and expenditures associated with COVID-19 in the amount subject to availability of funds and only for potential allowable reimbursements from State or Federal funds; and to create a TCP Payroll Code for accountability of personnel time; and any other matters incident thereto.

Issue: Webb County has declared a local disaster due to the Coronavirus (COVID-19) and need to segregate and establish budget for potential reimbursable expenditures related to the Emergency Management Plan.

Solution: Create special revenue fund to account and segregate resources related to Emergency Management Plan related to COVID-19.  Appropriate revenues and expenditures to be used for the purpose of Declaration of Local Disaster.

Result: Finalize special revenue fund and budget to track and report any expenses associated with COVID-19 for potential reimbursement.
