4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: New proceeds under Chapter 18 of the Texas Code of Criminal Procedure have been awarded and may be spent by the attorney representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

Solution: Submit a budget to the Governing Body that clearly list and defines the categories of expenditures.

Result: The attorney representing the State can utilize the new proceeds for the official use of his Office.

Issue: Further funds are required in the above-mentioned accounts in order to compensate for salary shortfall, advertise current services that are being provided, and continue the use of subcontractors due the increase of demand of transportation services. 

Solution: Approve line item transfer in the accounts requiring funds.

Result: Line item transfer will result in having sufficient funds for salaries, continue with high demand of transportation services, as well as provide local veterans and their families with information of free services provided by the Webb County Veterans Service Office. There are no increase in salaries and line item transfer of grant funds will have no impact on General Fund.

a.   Discussion and possible action to authorize Webb County to adopt an Order of Acceptance for the dedication of One (1) Roadway Right-of-Way and/or Public Utility & Drainage Easements out of the Ranchitos Centenarios Subdivision, for the purpose of acquiring these necessary easements by Webb County to perform road maintenance and improvements in order to facilitate transportation needs for residents including emergency medical services and school bus pickups for students, and for use, extension and/or provision of proper drainage, and/or utility services; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. 8.   Economic Development
 
a.   Discussion and possible action to approve the appointment of Mr. James Flores, Economic Development Director, as the Labor Standards Officer to the Texas Community Block Grant Program Contract No. CDV21-0485 grant and authorize the Webb County Judge to sign all relevant documentation. This action will have no impact on the County’s General Fund. [Requested by James Flores, Economic Development Director]

Issue: Labor Standards Officer must be appointed to comply with funding agency requirements.

Solution: Appointment will allow department to oversee the labor portion of the project and allow compliance of fair housing and equal opportunity activities with contract.

Result: Economic Development Department will assure compliance with requirements from funding agency.

b.   Discussion and possible action to approve a Resolution regarding various compliance matters required by the Texas Department of Agriculture Texas Community Development Block Grant #CDV21-0485 and authorize County Judge to sign all relevant documentation. This action will have no impact on the County’s General Fund.

Issue: Civil Rights and other compliance requirements must be implemented by Webb County to be in compliance with grand funding agency program requirements.

Solution: Civil Right must be implemented and will allow compliance of Citizen Participation Planned Grievance Procedures; Section 3 Policy; Code of Conduct; Limited English Proficiency; Excessive Force Policy; Section 504 Policy; and Fair Housing Policy.
 
Result: Economic Development Department will assure compliance with requirements from funding agency.

a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

15.   Discussion and possible action to accept and award Request for Proposal (RFP) 2022-001 "Three (3) Year Contract for Vending Machine Services" to the highest ranking proposer, Laredo Vending Co., for both cold beverages & snack machines to be located at Webb County facilities accessible to both County employees and general public in accordance with the Texas Local Government Code, Section 262, Sub-Chapter C (Competitive Bidding in General) and any other matters incident thereto.

Issue: Commissioners Court authorized re-soliciting to secure additional vendor participation. A total of three 3 proposals were submitted by deadline.   

Solution: Consider awarding to the highest ranking proposer, Laredo Vending Co., for both cold beverage & snacks machines.
 
Result: 
If awarded, Civil legal will initiate the terms and conditions of the service agreement and return to Commissioners Court for final approval and execution of service agreement.

Commissioners Court has the authority to award the contract to the responsible bidder who submits the lowest and best bid or reject all bids and publish a new notice.  Local Government Code § 262.027, Awarding of Contract.
 


Issue: Two (2) formal bids were submitted for this formal solicitation. Bids received from two local contractors: Romo Contractors, LLC and Quantcorp Construction, LLC. Total base bid with alternates was $437,400.00 and $535,653.00 respectively.
 
Solution: Consider awarding to lowest and responsible bidder for Base Bid and Alternates and option to select Alternates.
 
Result: If awarded by Commissioners Court, construction contract preparation would be initiated by Civil Legal.

17.   Discussion and possible action to authorize services between ClearGov (Buy-Board Contract No. 607-20) and Webb County for annual subscription services in an amount not to exceed $34,500.00 annually with a one-time setup fee of $7,200.00 to generate online digital budget books and not limited to related financial data collection such as capital budgeting, personnel budgeting and operational budgeting in accordance with the Texas Local Government Code; Sections 271.101, 271.102, Sub-Chapter F. Cooperative Purchasing Programs and to further authorize the transfer of funds from the General Operating Fund (1001-1130-001-431007-010 -Operational Reserve) to the County Judge’s subscription account and any other matters incident thereto. Issue: The Budget Officer is recommending the subscription services in order to prepare annual digital budget books online to streamline the process, by utilizing professional software for collection of budget data from our financial system, automation of budget reports, and to produce a more effective and efficient public record to view.
 
Solution: Authorize the annual subscription services under a cooperative contract, in addition the purchase of services also qualifies under the CFR 200.320 Methods of Procurement for non-competitive procurement for micro-purchases and single source due to copyrights, patents and other proprietary reasons.
 
Result: Proceed with order of subscription services as authorized by Commissioners Court.

18.   Discussion and possible action to approve the allocation of a Part Time funding to Department 1180 (Risk Management) for two slots not to exceed the amount of $25,000, and any other matters incident thereto. [Account #1001-1130-001-431007-015 (Operational Reserve-Wage Classification Study)]

Issue:
During a previous meeting the court approved part-time funding for the Webb County Health Clinic.

26.   Discussion and possible action to accept the grant award and enter into an agreement for the FY 2022 Community Development Block Grant Community Resiliency Program Fund under the Texas Department of Housing and Community Affairs in the amount of $4,600,000.00 and authorizing the County Judge to act as the County’s Executive Officer and Authorized Representative in all matters pertaining to the County’s participation in the CDBG Community Resiliency Program. This funding will allow Webb County to construct a Public Health Center. All required documents were sent for review to the Economic Development and the Solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. This grant does not require cash match. 

Issue: Precinct 1 does not have a public health center.

Solution: To accept grant award for the FY 2022 Community Development Block Grant Community Resiliency Program Fund under the Texas Department of Housing and Community Affairs.

Result: This award will allow for Webb County to construct a public health center to assist residents of Precinct 1.
