10.   Discussion and possible action to approve a Memorandum of Understanding (MOU) between the Texas Department of Housing and Community Affairs (TDHCA) and Webb County, to provide vacant office space for an employee of TDHCA at the Colonia Self-Help Center located at 8116 Highway 359; and any other matters incident thereto.  There will be no impact to the General Fund. 13.   Discussion and possible action to implement a health insurance claims diversion program as a One (1) year pilot utilizing tele-health and telemedicine to help reduce insurance claims; and to further authorize the purchasing agent to solicit Request for Proposals (RFP's) for said program, and to further request recommendation from health insurance consultant; and any other matters incident thereto. 
 
14.   Discussion and possible action to take court action with regards to setting the salary of employees slot numbers #0175, #0176, #0177, titled Court Coordinator, with the office of the County Court at Law 1, in accordance with Section 74.104(a) of the Government Code; as recommended by the county attorney's office; with further discussion and action to approve the effective rate of pay and start date for the employee(s) assigned to those slot(s), and to make further corrections, as necessary, with any other employee(s) slot that fall within scope of Section 74.104, that may have been affected during this process; and any other matters incident thereto. Issue: Since before the FY 2015 Budget was adopted, our office had originally requested an increase of funds to both our 005 and 009 Part Time Fund accounts. Due to an oversight, the funds were not inputted into their respective line items. The monies requested for Fund 005 were approved through our Archival Plan on September 8, 2014. Please note that Funds 005 and 009 are special funds and their accrued revenues are collected by the Webb County Clerk's Office through all recorded official public records.

Solution: We respectfully request that the Commissioners Court grant the re-approval of the two line item transfers.

Result: With approval of the line item transfers, our current part-time personnel will be able to continue employment until the end of the FY. Any and all changes made through these accounts do not directly or indirectly impact the general fund.

Solution: Fill job opening of newly vacant positions. These slots will be filled from within, adhering to any and all Civil Service Rules and Regulations (internal postings), as well as any and all Wage Plan Policies. This progression of promotions will result in final slots being "Vacant" which will be posted within County or general public (following Civil Service Rules and Wage Plan Policies as well).

Result: The filling of these positions will alleviate overload and allow for efficiency and productivity of work within the department.

Solution: By transferring into Training & Education will allow us to have the funds.

Result: The line item transfer will allow us to cover Judge’s training fee.

19.   Discussion and possible action to approve the submission of a grant application to the Firehouse Subs Public Safety Foundation for a public safety grant to pay for equipment and supplies for the Webb County Sheriff’s Office Triad Elder Service Program in the amount estimated at $13,251; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto.  This grant does not require any type of match.  Issue:  Perpetrators of criminal activities are more likely to target vulnerable individuals in order to commit crimes against these special populations, such as the elderly.   Consequently, law enforcement agencies must take distinctive precautions and provide proactive measures to minimize victimization of older persons.                         Solution:  Grant application so that the Webb County Sheriff’s Office Community Affairs Division will be able to provide crime prevention information and tools to older citizens in the local Laredo/Webb County community.   Result:  The Webb County Sheriff’s Office will be able to increase its proactive measures and enhance its delivery of law enforcement services to the elderly in order to assist this special population and to help prevent the criminal predation of elder citizens in the Laredo/Webb County community. 
 
Building Maintenance
 
20.   Discussion and possible action to approve the posting and filling of the following vacant Slot for Parks & Grounds Department, subject to the availability of payroll funds and any applicable Civil Service guidelines:

Solution: Parks & Grounds Department currently has a crew of eight (8) Groundskeepers. Knowledge required by the position: standard practices, methods, materials, and tools of ground maintenance. Knowledge of irrigation system installation and maintenance. Knowledge in equipment operation and repair.

Result: Assist in ground maintenance of Webb County building grounds, Webb County Community Centers, County Parks and Webb County Cemeteries.      
 
Community Action Agency
 
21.   Discussion and possible action to solicit applicants for Webb County Community Action Agency Executive Director at a salary rate of $75,000.00; and any other matters incident thereto. There will be no impact on the General Fund.

Issue: Webb County Community Action Agency needs an Executive Director to replace Mr. Juan Vargas that will be going to the Economic Development Program.

Solution: To solicit applicants for Webb County Community Action Agency Executive director at a salary rate of $75,000.00.

Result: The Webb County Commissioner's Court will hire the Executive Director for Webb County Community Action Agency.

Issue: Water Plants and Wastewater Plants require permits from the State (Texas Commission on Environmental Quality T.C.E.Q.) in order to legally operate.  Every five (5) years permits are required to be renewed to address any changes that may have occurred.  These permit renewals are required by the State to publish in the newspaper for public viewing in case there are any persons concerned about the operation of the plant.  This year the plants in Colorado Acres (Las Lomas) and the Rio Bravo Wastewater Plant require renewal.
 
Solution: Transfer funds to provide for advertisement costs from the Laredo Morning Times.

Result: Advertise and comply with State requirements.
 
23.   Discussion and possible action to ratify the Agreement between Webb County and S&B Infrastructure, LTD, to provide professional services related to the County Energy Transportation Zone (CERTZ) that was executed in Commissioner Court on April 28, 2014.

Issue: Commissioner Court approved the execution of an agreement with Totem, LLC on February 10, 2014 to provide management and oversight services related to the County Energy Transportation Reinvestment Zone (CETRZ) but the agenda item approved did not include the authority to execute an agreement with the subcontractor S&B Infrastructure, Ltd.  Under the agreement approved, "Totem shall subcontract provision of all engineering services including PS&E for work under the grant to S&B Infrastructure, Ltd" and "Owner [Webb County] shall be responsible for the payment of all engineering services."  In order for Webb County to pay the Subcontractor (S&B) directly, a separate agreement was executed between Webb County and S&B.

Solution: Commissioner Court approval to ratify the agreement with S&B Infrastructure for professional services related to the County Energy Transportation Zone (CETRZ).

Result: Proper record of the approval to execute the agreement with S&B Infrastructure will ensure that invoices are processed for payment and enable the County to submit requests for reimbursement of 90% of the amount paid for services to the Texas Department of Transportation (TxDOT) County Transportation Infrastructure Fund (CTIF) that falls under the CERTZ umbrella.
 
Head Start
 
24.   Discussion and possible action to approve the 2014 - 2015 Head Start/Early Head Start Local Self-Assessment results and the Program Improvement Plan. 
Issue: As per Head Start Performance Standard 1304.51(a)(2)(i), Head Start and Early Head Start programs must conduct a Self-assessment of their effectiveness and progress in meeting program goals and objectives and in implementing Federal regulations. 

Solution: Participate in, review, and approve the 2014 - 2015 Program Improvement Plan. 

Result: The Webb County Head Start and Early Head Start program will be in 100% compliance with all local, State, and Federal regulations at all times. 
 
25.   Discussion and possible action to approve the 2015 Training & Technical Assistance Plan. 

Issue:  The Head Start and Early Head Start program is mandated to have a staffing plan that addresses staff qualifications, job descriptions, staffing levels, and linkage to education and training that will allow staff to advance through various roles with increasing levels of responsibility and compensation.

Solution:  Approve and implement the 2014 TTA Plan.

Result:  The program will have an approved plan in place to address staff's training needs related to their duties. 
 
26.   Discussion and possible action to extend pay periods for One (1) Licensed Vocational Nurse, One (1) Health Assistant, Two (2) Specialized Services Assistants, One (1) Part Time Substitute Teacher, One (1) Food Transporter, One (1) Bus Driver Supervisor, Four (4) Bus Drivers, and Twelve (12) Area Service Managers for the 2014 - 2015 Fiscal Year.

Issue: Due to payroll savings from leave without pay, vacant positions, FMLA, and the like, funds are available in the Personnel  and Fringe Benefits line items that will be returned to the Federal government if not used for payroll. 

Solution: Authorize the extension of pay periods to benefit program operations in the summer months. 


Result: The Early Head Start and the Child Care Partnership programs will have support staff assistance in the summer month, and the Head Start program will have assistance from additional personnel to complete summer projects and help with program planning for Pre-service trainings, curriculum packets, child folders, and classroom set-up. 
 
27.   Discussion and possible action to approve the 2014 - 2017 Head Start and Early Head Start Strategic Plan.

Issue: Head Start programs are mandated to develop multi-year (long-range) program goals and short-term program and financial objectives that address the findings of the Community Assessment, are consistent will the philosophy of Head Start and Early Head Start, and reflect the findings of the program's annual self-assessment. 

Solution: Provide input, discussion, and feedback for program planning and approve the 2014 - 2017 Strategic Plan. 

Result: The Head Start program will develop and implement a systematic, ongoing process of program planning via a Strategic Plan and in consultation with the Webb County Commissioner's Court and the Policy Council. 
 
28.   Discussion and possible action to approve the posting and filling of the following Slots:

29.   Discussion and possible action to approve the "Head Start/Early Head Start Refunding Application" for the 2015 - 2016 fiscal year in the amount of $9,796,195 (Federal Share) and $2,449,050 (Non-Federal Share) for a total amount of $12,245,245, with the discontinuation of Teaching and Mentoring Communities (Texas Migrant Council) as a delegate agency for the Early Head Start program. 
 
Indigent Healthcare Services
 
30.   Discussion and possible action to authorize the transportation of Webb County colonia residents via the El Aguila Rural Transit System to the Operation Lone Star event which is tentatively scheduled to be held July 27th to July 31st at Alexander High School; and any other matters incident thereto. Residents will be able to receive FREE health and medical services such as immunizations for children, diabetic screening, blood pressure screening, hearing and vision screenings and sports physicals. The funding for the transportation costs will come from the Indigent Health Care Services Department. [Requested by Nancy Cadena, Indigent Health Care Services Director; Account #001-4101-7002 (Medical Services)]

Issue: Operation Lone Star is an event that provides free medical services to under-served communities throughout South Texas. Since this event takes place in north Laredo, many Webb County residents who live in rural areas are unable to attend this beneficial event due to the lack of transportation.

Solution: The Indigent Health Care Services Department will provide transportation to residents in the rural areas by utilizing the services of El Aguila to allow as many people to take advantage of this event.

Result: Webb County has a high number of uninsured and underinsured residents. By providing transportation to this event, many residents will be able to receive medical services that they would otherwise not have available or accessible to them. Last year round-trip transportation was provided to a total of 78 colonia residents. The total cost for transportation was $234.

Issue: On April 27, 2015, the Commissioners Court approved the purchase and installation of two (2) 48-niche columbaria as requested by the Laredo Veterans Coalition with funding coming from Account #001-4101-7003 Indigent Burials.

Solution: The line item transfer requested will cover the cost of the two columbaria as approved by the Commissioners Court at the April 27, 2015 meeting

Result: The Indigent Burials account balance will be recompensed to cover ongoing expenses for the remainder of the 2014-2015 fiscal year.

Issue: Larga Vista Community Center has had the same tables and chairs for about 11 years and due to the wear and tear we are in need of new ones.

Solution: Our solution would be to purchase new tables and chairs for daily program use that include: Elderly Nutrition Program, Kids Café, ESL Classes, INEA Classes, ANSPAC Women Empowering Classes, Texas A&M Promotora Classes and Head Start meetings.

Result: These fund transfers would allow us to purchase these tables and chairs and continue to provide high quality assistance to Webb County.

Issue:  The software and hardware equipment is needed to host the Tyler Odyssey project for the new judicial case management and jail management applications purchased by Webb County.

Result:  Acquiring this software and hardware equipment will result in allowing Tyler Technologies to install and configure their software which will provide new and improved software services for the judicial and jail management process.

35.   Discussion and possible action to approve the purchase of Twenty-Five (25) Dell Computers and software from Dell and SHI for all Justice of the Peace Judges to be used for training, pursuant to Sections 271.101 and 271.102 Subchapter F., Cooperative Purchasing Program, Contract DIR-SDD 1951 and DIR -SDD 2503 in the amount of $37,464.75. [Requested by  Judge Jose “Pepe” Salinas, Justice of the Peace Pct. 4. [Account #016-1044-6224 (Technology Fund)]

Issue: In the near future Tyler Technologies needs to train all Justice of the Peace Offices and a training room must be equipped. 



Solution: To purchase the requested equipment.   

Result:  By purchasing these computers, the employees from the Justice of the Peace Offices will have the equipment needed to receive training.

 
 
36.   Discussion and possible action to award Request For Proposal (RFP) 2015-08 to Azar Services in the amount of $99,080 and approve funding from 604-0101-8103; the court approved the solicitation of the RFP for the remodeling of the County Court at Law #1 offices. 

Issue: County Court at Law #1 offices have not been remodeled in a number of years and remodeling was needed.

Solution: The RFP identified the needs of the department.

Results: The department will be able to provide improved serves with the reorganization of the office facilities and clients will receive improved services from improved facilities.

Discussion and possible action to purchase Three (3) 2015 Chevrolet Tahoes from Holiday Chevrolet DBA Johnson Grayson Automotive, Inc. pursuant to Sections 271.101 and 271.103 Sub-chapter F. Cooperative Purchasing Program, State of Texas Contract #071-A1-2014/15 in the amount of $150,156.25. [Requested by Sheriff Martin Cuellar; Grant Account #344-2001-8801 - $144,000.00 and State Forfeiture Account #168-2001-8801 - $6,156.25]

Issue: Funding is available through Operations Stone Garden Funds to purchase three (3) law enforcement units for border operations.

Solution: Purchase units to utilize grant funds approved through Homeland Security/FEMA.

Result: Enhanced community policing along border areas in Webb County.
 
Closed Session/Executive Session
 
38.   Status report with discussion and possible action on the compensation of a 15 year longevity pay awarded by Commissioners Court to a group of employees on August 13, 2001 which is still pending settlement; and any other matters incident thereto. [Executive session is requested pursuant to Texas government Code Title 5, Subchapter D, Section 551.071 (Consultation with Attorney) and Section 551.074 (Personnel matters)]
 
Issue: Webb County employees that were awarded longevity pay subsequently transferred to other positions within Webb County. The possibility exists that the longevity pay was not applied as initially instructed by Commissioners Court.
 
Solution: The Auditor’s office has to audit the payroll records of these employees and determine the amount each is owed. Then each employee should be paid as approved by past Commissioners Court.
 
Result: Determine and approve final back pay payments that are owed.
