Discussion and possible action to authorize the County Purchasing Agent to solicit bids for the lease of a 3.1 acre tract of county property, located under IH 35 approximately north of the junction of IH 35 and U.S. 83, for mineral development as authorized by Chapter 71 of Texas Natural Resources Code, and any other matters incident thereto.

Issue: Minerals in land belonging to the County may be leased to any person under the Texas Natural Resources Code (State law) pursuant to a bidding process to the person who submits the highest and best bid as determined by the Court.

Solution: Direct the Purchasing Agent to solicit bids for the lease of the 3.1-acre tract of county property for mineral development.

Result: The Court may award the lease of mineral development of the 3.1-acre tract to the bidder who submits the highest and best bid for the development of the tract as determined by the Court.

Background:

An Oil and Gas Company has approached the County concerning an interest in a 3.1-acre tract for mineral development as the county owns the mineral rights to the tract. Because of the current price of oil and gas, it may be advisable for the Commissioners Court to solicit a potential oil and gas lease for said tract.
