Subject:

Discussion and possible action to enter into an Inter-local Agreement with the City of Laredo as necessary to formalize Webb County’s authority to provide garbage collection services, impose solid waste regulations, and collect service fees for customers located outside the corporate limits but within the ETJ (extra-territorial jurisdiction) of the City of Laredo, and authorize the County Judge to execute said Agreement; and, any matter incident thereto. [Requested by the Solid Waste Review Committee]

Issue: Without statutory authority or a cooperative agreement to regulate solid waste management within the ETJ of a municipality, Webb County cannot provide solid waste services in the City of Laredo’s ETJ. On August 1, 2016, the Laredo City Council took action to approve the necessary authorities for the County to provide solid waste service in the ETJ; however, an official cooperative agreement still needs to be finalized.

Solution/Result: Approve the proposed agreement which provides the necessary authorities for Webb County to provide solid waste service, impose fees for said service, and includes the ETJ area under the same rules, terms, fees, and effective dates as imposed for areas located beyond the ETJ limits. Such action eliminates any potential disruption of county solid waste services and provides a uniform solid waste management plan for the entirety of the unincorporated area of Webb County.
