Discussion and possible action to approve the execution of a Data Use Agreement, HHSC –Information Security and Privacy Initial Inquiry and Form 3254-A – Community Services Contract Amendment between the Texas Department of Health and Human Services System,(T.D.H.H.S.S.) which includes the Texas Department of Health and Human Services Commission and Webb County on behalf of the Webb County Meals on Wheels Program acting as “Contractor” to facilitate the access to, creation, receipt, maintenance, use, disclosure or transmission of Confidential Information, and describe Contractor’s rights and obligations with respect to the Confidential Information and the limited purposes for which the “Contractor” may create, use, disclose, and/or have access to Confidential Information from the system, and authorizing the Webb County Judge to sign any relevant documents and any other matters incident thereto. Agenda Items will not have an impact to the General Fund. [Requested by Javier Ramirez, C.A.A. Director (Fund 2371)]

Background:

This agreement between Webb County/Webb County Meals on Wheels Program (“Contractor”) and the Texas Department of Health and Human Services System,(T.D.H.H.S.S.), requires the execution of a Data Use Agreement facilitate and provide for rules, procedures and disclosure requirements for the receipt, maintenance and/or delivery of “Confidential Information” between the parties.

Previous Court Action:

The Webb County Meals on Wheels program previously approved all relevant forms in accordance with Title 40, Texas Administrative Code (TAC) 49.203 rules to comply with contract.
