Discussion and possible action to approve and authorize a proposed settlement agreement and payment of penalty in the amount of $2,100.00 for the pending enforcement action/litigation between the Texas Commissioner on Environmental Quality ("TCEQ") and Webb County regarding the Webb County Water Treatment Plant in Docket No. 2020-0213-PWS-E Enforcement Case No. 58904, by and between "TCEQ" and Webb County, and authorizing the County Judge to execute any and all relevant documents; and any other matters incident thereto. [Executive Session may be requested pursuant to Texas Government Code, Title 5, Subchapter D, Sections 551.071(1) (a) & (b) (Consultation with Attorney regarding pending litigation and about a settlement offer)] [Account #7200-7050-001-432001-085 (Professional Services Laboratory Testing)]

Issue:
These are violations that occurred during 2019 for Total Trihalomethanes ("TTHM") for Stage 2 Disinfection Byproducts ("DBP2") at Site 1 were 0.085 milligrams per liter ("mg/L") for the third quarter of 2019 and 0.083 mg/L for the fourth quarter of 2019.

Solution: These reporting Violations are been resolved by closely monitoring our Chlorine residuals during our Disinfection Process System as ("TTHM") can be produced with Free Chlorine because there are Organic Matters in the Raw Water System.

Result: Our Annual required Maximum Contaminant Levels ("MCL") for Trihalomethanes ("TTHM") will decrease and will be below the required 0.080 mg/L by the next annual average quarter 2020 and eleminate any other violations to this matter.
