Subject:

Discussion and possible action to grant the requested waiver to Clayton Home of San Antonio for liquidated damages forgiveness for contracts SHC 7220013 RECON 01, SHC 7220013 RECON 02 and SHC 7220013 RECON 03 and authorize the County Judge to sign all relevant documents and any other matters incident thereto.

Issue: Clayton Homes of San Antonio has submitted a request to waive liquidated damages incurred as a result of delays to the contract that were outside their control and no fault of their own.

Solution: Grant requested waiver to Clayton Homes of San Antonio and acknowledge that acted in good faith to complete the projects and the delays were beyond their control.

Result: Close out three Reconstruction projects and compensate Clayton Homes of San Antonio for services rendered.
