Discussion and possible action to accept a salary supplement for the District Attorney effective September 1, 2015 as provided by House Bill 9 of the 84th Texas Legislature. The annual supplement will be in the amount of $3,640 plus related fringe benefits which will be paid by the County but reimbursed in whole by the State. The entries to the current budget will be to increase the payroll cost line item (001-1100-5001) by $303.33 and create a new line item (001-0300-3528-2) for the reimbursement of $358 for the month of September 2015. The FY 2015-2016 County Budget should include the same entries but for the annual amount including fringe benefits; and any other matters incident thereto.







Issue: The 84th Legislature raised the retirement contribution of all State Employee Retirement System Participants from 6.6% to 9.5% starting September 1, 2015. To keep state employees from seeing a reduction in take home pay, the Legislature gave all state employees a raise, except to felony prosecutors. The State Legislature added a last minute rider to the State budget where the State is providing a salary supplement to counties for their elected felony prosecutors.

Solution: Increase the current budget expenditure line item 001-1100-5001 by $303.33 to pay the supplement to the elected felony prosecutor and create a new revenue line item (001-0300-3528-2) to budget for the State reimbursement.

Result: The felony prosecutor supplement pay and the reimbursement from the State will be budgeted accordingly.

This is not a pay raise; it is offered to offset the reduction in take home pay that the prosecutor will see in his or her state paycheck on September 1, 2015. Counties will be reimbursed for this additional cost by the State Judiciary Section.
