2019 updated Webb County Flood Damage Prevention Order adoption

Discussion and possible action to adopt the 2019 Webb County Flood Damage Prevention Order effective immediately, as authorized by the Webb County Commissioners Court on June 24, 2019 as necessary to clarify and streamline floodplain management procedures, establish policies relating to appeals or variances, integrate regulations relating to floodways and critical facilities, and to simplify local regulations relating to Approximate A Zones and other development to ensure local regulations meet or exceed the minimum requirements of the National Flood Insurance Program (NFIP), Subchapter I, Texas Water Code and best practices; and any other matters incident thereto.
Background:
The proposed revisions to the Webb County Flood Damage Prevention Order has been developed to meet minimum requirements of the National Flood Insurance Act as well as to provide adequate land use controls to enhance local floodplain management regulations to promote public health, safety and general welfare; minimize public and private losses due to flood conditions; provide increased flood protection for critical facilities; clarify or streamline existing procedures; and to ensure local regulations meet or exceed the minimum requirements of the National Flood Insurance Program (NFIP) and Texas State law.  The proposed revisions are consistent with the provisions of Chapter 16, Subchapter I of the Texas Water Code; Chapter 232, Subchapter B of the Texas Local Government Code and meet or exceed the minimum requirements of the NFIP.
 
On June 24, 2019, the Commissioners Court authorized staff to begin proceedings necessary to update the 2008 Flood Damage Prevention Order including the publication of a Takings Impact Assessment  (TIA) to initiate a 30-day public comment period in accordance with Chapter 2007 of the Texas Government Code.  The TIA was published in the Laredo Morning Times on June 27, 2019.  Although persons have called with inquiries during the public comment period, at the writing of this agenda request, no formal public comments have been received by the Department. 
 
Adjustments have been made at the request of FEMA Region 6 to ensure conformance and staff has edited grammatical errors.  The final version of the proposed order is attached in the agenda backup which highlights all edits in yellow.  With the conclusion of the 30-day public comment period on July 28, 2019, the Floodplain Administrator recommends the Court’s adoption with an immediate effective date.
