Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 22nd day of September 2023. Present also were Ms. Amber Lecea, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: New proceeds under Chapter 18 of the Texas Code of Criminal Procedure have been awarded and may be spent by the attorney representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

Solution: Submit a budget to the Governing Body that clearly list and defines the categories of expenditures.

Result: The attorney representing the State can utilize the new proceeds for the official use of his Office.

a.   AI-15310    Discussion and possible action to enter into a Professional Medical Services Agreement between Webb County on behalf of its Headstart/Early Child Headstart Program and (P.I.L.L.A.R.) for the children enrolled in the programs. This agreement establishes the terms and conditions under which PILLAR will be providing the medical services such as physical exams, hearing, vision and blood pressure screenings for the qualified children enrolled in the program. b.   AI-15326    Discussion and possible action to approve Amendment No.1 for the Comprehensive Energy Assistance Program Emergency Supplemental (CEAP ES) Contract Number# 58930004003 from the Texas Department of Housing and Community Affairs (TDHCA) FY-2023. This amendment is a grant increase from $548,060 to $849,249, for a total increase of THree Hundred-One Thousand One Hundred Eighty-Nine Dollars ($301,189). Authorizing the County Judge to sign all relevant documents for request and approval of contract amendment. This action will not have an impact to the General Fund.

Issue: Texas Department of Housing and Community Affairs (TDHCA) has awarded Amendment No. 1 to Contract Number #58930004003 under the (CEAP Supplemental) Program.

Solution:The court approval will allow Webb County CAA to provide emergency assistance to low-income households of Webb County under the CEAP Supplemental program.

Result: These funds are intended to assist eligible Webb County residents meet their immediate household energy needs.

c.   AI-15328    Discussion and possible action to approve Amendment No. 3 for the Comprehensive Energy Assistance Program (CEAP) Contract Number# 58230003850 from the Texas Department of Housing and Community Affairs (TDHCA) FY-2023. This amendment is a grant increase from $2,241,892 to $2,801,111, for a total increase of Five Hundred Fifty-Nine Thousand Two Hundred Nineteen Dollars ($559,219). Authorizing the County Judge to sign all relevant documents for request and approval of contract amendment. This action will not have an impact to the General Fund.

Issue: Approve CEAP Contract Amendment No.3 request from Texas Department of Housing and Community Affairs (TDHCA) for the Program Year 2023. 

Solution: The court approval will allow the Webb County Community Action Agency to provide direct services to eligible low-income residents of Webb County under the CEAP program. 

Result: These funds are intended to assist qualifying clients with their immediate home energy expenses.

d.   AI-15331    Report by Community Action Agency to the Court in accordance with our annual CSBG Organizational Standard requirements. A Comprehensive Risk Assessment has been conducted for Community Action Agency Social Services to ensure that the work environment is free from health and safety threats. This assessment has helped generate appropriate awareness of hazards amongst both employees and managers. 

Issue: By conducting a comprehensive risk assessment we can identify potential hazards and their associated risks.

Solution: Regular checks of the site facilities and equipment will be conducted, employee awareness to safety rules and adherence to security measures. 

Result: CAA Social Services will continue implementing effective control measures that will protect staff and clients by preventing accidents.

8.   Honorable Victor Villarreal, County Court at Law 2 Judge
             
a.   AI-15340    Discussion and possible action to approve the posting and filling of the Webb County Court-at-Law II Juvenile Drug Treatment Court Program Case Manager slot, Department of Justice Grant associated with grant opportunity number 15PJDP-23-GG-00869-DGCT. Webb County Court-at-Law II Juvenile Drug Treatment Court Program, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective October 1, 2023. All salary and fringe will be paid 100% by grant funds. There will be no impact to the General Fund. This item has been reviewed by Economic Development and has been found to be in compliance with Single Point of Contact (SPOC).

9.   Economic Development
             
a.   AI-15303    Discussion and possible action to ratify the acceptance of the grant award with the Apache Corporation for the FY 2023-2024 Apache Tree Program Grant Application for the donation of trees in the Bruni Community Center, Precinct 2 and the Fred M & Anita Bruni Community Center, Precinct 4; and authorizing the County Judge to act as the County’s Executive Officer and Authorized Representative in all matters pertaining to the County’s participation in the Apache Tree Grant Program. All required documents were sent for review to the Economic Development and the Solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. This grant does not require cash match. 

Issue: Community Centers are limited to greenery.

Solution: To accept grant award of Tree donation from Apache Tree Grant Program.

Result: To provide trees to the Community Centers for Precinct 2, and Precinct 4.

b.   AI-15305    Discussion and possible action to accept a grant award in the amount of $30,285.26 (OAG Contract No. C-01191) for the Fiscal Year (FY) 2024 Statewide Automated Victim Notification Service (SAVNS) from the Office of the Texas Attorney General (OAG) for the automated notification of crime victims for a period of Twelve (12) months beginning on September 1, 2023, through August 31, 2024, and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. There is no cash match; and, thus, there is no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Sheriff; Fund #2712 (Texas SAVNS Contract)]

Issue:  In the past decades, many crime victims, such as victims of sexual assault and domestic violence, were unaware if their respective crime perpetrators were able to post bail and released from the corrections system. In late 1993, one particular victim who had been raped, assaulted, and stalked in Jefferson County was unaware that her former boyfriend had been released and was subsequently ambushed by him after she left work. She was shot Seven (7) times at point blank range and killed on that day, her 21st birthday.

Solution: As a result of community outrage, an automated telephone notification system for crime victims and other concerned citizens was instituted: Victim Information and Notification Everyday (VINE) Service. This nationwide system is funded for Texas counties through the Texas Office of the Attorney General (OAG) and is currently utilized by Webb County.

Result: The crime victims of Laredo/Webb County can enroll in this program and will be provided with automated notification upon an offender’s custody status change, such as release, transfer, and/or relevant district court dates.
             
c.   AI-15308    Discussion and possible action to approve the acceptance of the Substance Abuse and Mental Health Administration (SAMHSA) Grant Award #1H79TI085855-01 (Program Announcement 93.243, Funding Opportunity No. TI-23-007) Grants to Expand Substance Use Disorder Treatment Capacity in Adult and Family Treatment Drug Court, in the amount of FOUR HUNDRED THOUSAND DOLLARS ($400,000) per year for a 5-year grant cycle beginning September 30, 2023, for the Webb County Adult Drug Court Program, and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. The acceptance of the grant does not require any kind of match; therefore, there is no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Margarita Herrera-Garza, Drug Court Program Director]

Issue: Webb County Adult Drug Court SAMHSA Grant Application was selected for funding, a Notice of Award was received on 09/08/2023.

Solution: Acceptance of the SAMHSA Webb County Adult Drug Court Program Grant requires Commissioner's Court approval.

Result: if Accepted, the Webb County Adult Drug Court Program will expand substance use disorder treatment and recovery support services to all eligible individuals in Webb County.

d.   AI-15288    Discussion and possible action to approve the 2024 Formula Grant Indigent Defense Resolution. The purpose of the grant is to maintain quality, cost-effective criminal defense system that meets the needs to the local communities and the requirements of the constitution and state law. Webb County will be eligible to receive a portion of the funding. This is a yearly on-going grant. There will be no impact to the general fund. All required documents were forwarded to the Economic Development Department for review and the solicitation is compliant with the single point of contact procedure. [Requested by Pre-Trial Services]

Issue: The Texas Commission on Indigent Defense offers funding for counties eligible to receive funding through the Formula Grant process.

Solution: Webb County may receive a portion of the Formula Grant depending on the population

Result: This is an on-going grant application that is submitted every year.  Webb County has been receiving funding through this grant since my tenure.

e.   AI-15289    Discussion and possible action to authorize the acceptance of the Fiscal Year 2023-2025 Biennium State Aid and Targeted Grants Contract from the Texas Juvenile Justice Department in the amount of Two Million Five Hundred Fifty Nine Thousand Eight Hundred Ninety Nine Dollars ($2,559,899.00) State Aid; and $26,294.00 Targeted Grant B - Border Children's Justice Project, for the Webb County Juvenile Department. This grant requires a State Aid cash match of Two Hundred Seventeen Thousand Three Hundred Dollars ($217,300.00) from Account #1001-1160-001-463906-005, and Border Project cash match in the amount of Twenty-six Thousand Eight Hundred Ninety Dollars ($26,890.00) from Account #1001-1160-001-463906-015.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.  [Requested by Gerardo Liendo, Chief Juvenile Probation Officer; $217,300.00 State Aid cash match - Account #1001-1160-001-463906-005 and $26,890,00 Border Project cash match - Account #1001-1160-001-463906-015]

Issue: The Texas Juvenile Justice Department has made available and offered state financial assistance monies to the Webb County Juvenile Department to assist in the provision of basic juvenile probation services and/or the operation of a pre-adjudication secure detention facility.

27.   AI-15333    Discussion and possible action to authorize the increase in change fund for the Webb County Tax Office for the amount of $2,900 as per Local Government Code 130.902 and any other matters incident thereto.

Issue: Mini-Vault Funds have diminished due to new teller boxes being opened, which are funded from the mini-vault. This causes for mid-day change runs, and at times, during our busiest days/hours, causes a disruption in our work flow.

Solution: Commissioners Court approves the increase of change fund for our department.

Result: Authorization of a change fund increase will allow our department to have the necessary currencies ($1.00, $5.00, $10.00 and Coins) on hand to issue to our tellers when needed when payments are taken in cash, and ability to create new teller boxes.
