Commissioners Court Special Meeting

Let it be remembered that a special meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Tano E. Tijerina,                                 County Judge
Jesse Gonzalez,                                 Commissioner, Pct. 1
Rosaura "Wawi" Tijerina,                    Commissioner, Pct. 2
John C. Galo,                                      Commissioner, Pct. 3
Jaime Alberto Canales,                       Commissioner, Pct. 4

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the **th day of ***ber 2017. Present also were Mrs. Virginia M. Rodriguez, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.
 
             
CALL TO ORDER BY THE HONORABLE TANO E. TIJERINA, WEBB COUNTY JUDGE
             
1. Roll Call by Honorable Margie Ramirez-Ibarra, Webb County Clerk
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by County Judge Tano E. Tijerina to excuse Cmr. Canales
  Vote: 5 - 0 Motion Carried
             
2. Pledge of Allegiance
  9:01 a.m. - Cmr. Canales present.
             
3. Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member will be allowed a total of Three (3) minutes within which to make any/all public comments.
  No one signed up for Public Comment.

4. AI-5401  Discussion and possible action to formally accept the voluntary letter of resignation of Jesus “Chuy” Garza, Judge of the Webb County Court at Law No. 2, delivered to the Webb County Judge’s office and effective on January 25, 2017; and any other matters incident thereto.
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 4 Jaime Alberto Canales
  Vote: 5 - 0 Motion Carried
             
5. AI-5402  Discussion and possible action to determine the method and criteria to appoint a person to fill the vacancy of Judge of the Webb County Court at Law No. 2, as authorized by Section 25.009 of the Texas Government Code; and any other matters incident thereto.
  Motion by Commissioner, Pct. 2 Rosaura “Wawi” Tijerina, seconded by Commissioner, Pct. 4 Jaime Alberto Canales to authorize Ms. Colessides, Mr. Medford, and Mr. Uribe to begin to assemble the criteria in conjunction to speaking to the Commissioners Court and have it ready by the next meeting to adopt

6. AI-5405  Discussion and possible action to approve an Order as authorized by Section 41.011 of the Texas Government Code titled Private Practice in County or District Office prohibiting any district or county attorney, including their assistants, employed by Webb County, to engage in the private practice of law or to conduct a private practice of law by using the district or county office provided by the county; and any other matters incident thereto.
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by County Judge Tano E. Tijerina to the extend provided by law

7. AI-5403  Discussion and possible action to retain the professional services of outside legal counsel to review and finalize the master service agreement (MSA) and letter of understanding between the county and the county’s medical and dental health insurance provider, AETNA; and any other matters incident thereto.  [Account #001-0109-6022 (Professional Services)]
  Motion by County Judge Tano E. Tijerina, seconded by Commissioner, Pct. 2 Rosaura “Wawi” Tijerina this is not only for the execution of the contract but also for day-to-day questions

8. AI-5407  Status report from county attorney’s office regarding Cause No. 2016CVQ002694 D1, styled Rancho Viejo Waste Management, LLC., vs. Rhonda M. Tiffin, Webb County Planning Director and Floodplain Administrator, in her official capacity; with discussion and possible action to confirm that all legal issues are being addressed effectively; and any other matters incident thereto. [Executive Session is requested pursuant to Texas Government Code, Title 5, Subchapter D, Section 551.071(1)(A) (Consultation with Attorney regarding pending litigation)] [Requested by Tano E. Tijerina, Webb County Judge]
  County Attorney's Office, Mr. Jorge Trevino stated that notice was received from the opposing counsel regarding the withdrawal of their lawsuit against Webb County.
