Commissioners Court Special Meeting

Let it be remembered that a special meeting of the Webb County Commissioners Court was held at 11:30 a.m. at the regular meeting place with the following members present to wit:

Tano E. Tijerina,                                 County Judge
Jesse Gonzalez,                                 Commissioner, Pct. 1
Rosaura "Wawi" Tijerina,                    Commissioner, Pct. 2
John C. Galo,                                      Commissioner, Pct. 3

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 9th day of January 2018. Present also were Mrs. Virginia M. Rodriguez, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.
             
CALL TO ORDER BY THE HONORABLE TANO E. TIJERINA, WEBB COUNTY JUDGE
             
1.   Roll Call by Honorable Margie Ramirez-Ibarra, Webb County Clerk
  Roll Call by Mrs. Lucina D. Perez, Chief Deputy County Clerk on behalf of the Honorable Margie Ramirez Ibarra, Webb County Clerk.
  Motion by County Judge Tano E. Tijerina, seconded by Commissioner, Pct. 1 Jesse Gonzalez to excuse Cmr. Canales
  Vote: 4 - 0 Motion Carried

3.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member will be allowed a total of Three (3) minutes within which to make any/all public comments.

4.   AI-6943    Approval of payroll and accounts payable; and any other matters incident thereto.
  County Treasurer, Ms. Delia Perales presented the Recap of Checks, Ratification of Checks, and Payroll.
  Motion by County Judge Tano E. Tijerina, seconded by Commissioner, Pct. 3 John C. Galo

5.   AI-6939    Discussion and possible action to approve the following carry over budget for Grant Fund 2368 (CSBG) in the amount of 4$276,046.12; and any other matters incident thereto. Due to the sixty (60) days allowed to finalize the fiscal year-end balance of the recently completed fiscal year and the continued posting/possible transfer of pending encumbrances from the previous fiscal year to the new fiscal year; this budget amendment may be in variance with the final total eventual amount of grant revenue to be carried over. furthermore, this agenda item is required by court policy but does not impact the grant; therefore, does not require notification to/approval by the funding agency. Thus, there is no financial impact to either the general fund or the grant.

Issue: Additional funds are needed in accounts to cover schedule and unexpected expenses.

Solution: Approve line item transfer request.

Result: To ensure funding for the remainder of the current fiscal year.
  CAA Executive Director, Mr. Javier Ramirez stated that the 4 in front of the amount needs to be omitted. It should read in the amount of $276,046.12.
  Motion by County Judge Tano E. Tijerina, seconded by Commissioner, Pct. 1 Jesse Gonzalez to approve item #5 as is

6.   AI-6941    Discussion and possible action to select a law firm from the top three highest ranking law firms and to award RFQ#2017-005 "Special Counsel for Webb County - Opioid Litigation" to provide legal services to investigate and if appropriate, initiate litigation against manufacturers and distributors of prescription opioids that have wrongfully caused opioid addiction in Webb County, and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. [Requested by Commissioners Court]
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 2 Rosaura “Wawi” Tijerina to select The Cicala Law Firm PLLC
  Vote: 4 - 0 Motion Carried
             
7.   AI-6944    Discussion and possible action to rescind the action taken on January 8, 2018, item #30 and authorize the Purchasing Agent to solicit for an annual contract for Colonia and other County road improvements to include slurry road hardening materials and equipment usage. Scope of work will be on a as needed basis and subject to funding availability, and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. [Requested by Commissioners Court]
  Motion by County Judge Tano E. Tijerina, seconded by Commissioner, Pct. 3 John C. Galo to approve item #7 and to have a sample performed first of a quarter minimum

Judge Tijerina withdrew his motion.

No action taken.
