Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular virtual meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 8th day of January 2021. Present also were Mrs. Rosa E. Herrera, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

Martinez, Treasurer's Office presented the Presentation of Bills and Disbursements for the Period of 12/11/2020 - 01-07-2021, the Liability Disbursement of County Payroll for the Period of 12/18/2020 - 12/31/2020 and the Casa Blanca Golf Course for the period ending 12/18/2020, 1/1/2021. 
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 1 Jesse Gonzalez to ratify the site bills and overage on Golf Course, the report and the estimated payroll not to exceed $30,000.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: Budget increase is needed to cover fringe benefits from overtime worked under the U.S. Marshals for Fiscal Year 2021. 

Solution:  Seek authorization to increase expenditure budget.

e.   AI-11426    Discussion and possible action to ratify, by Order, end of fiscal year 2020 budget amendments; necessary to process year-end invoices or services rendered on or before September 30, 2020; and any other matters incident thereto.

Issue: Various departments and offices depleted funds within departmental budget line items; nonetheless, multiple invoices were received for goods or services after the fiscal year-end which required apply date of FY-2020.

Solution: In order to process year-end transactions and pay invoices, funding was identified as approved by Commissioners Court on September 28, 2020, to allow Auditors Office and Budget Officers to enter and post budget amendments.

Result: Funds were transferred to cover pending invoices and properly classify transactions in FY-2020.

f.   AI-11428    Discussion and possible action to amend, by Order, the 2021 Capital Project funds budgets to the fiscal year-end 2020 available carry-over balances, and any other matters incident thereto.

Issue: The proposed Capital Project budgets were based on estimates as of August 2020.  Capital Project budgets require the correct available balances for 2021.

Solution: Capital Project budgets will have the appropriate funding to perform their intended purpose.

Result: With these budget amendments, the Capital Project budgets will have the correct available balances for October 1, 2020.

Issue: The federal agency has approved a budget line item transfer within grant funds for the FY 2019 OPSG.  

Solution: Request a line item transfer by the court so that the line items in the budget matches the new grant budget.

Issue: The County will need to determine to what extent, if any, it will be required to rebate certain investment earnings.
 
Solution: Contract with HSAM so that the County can continue to be compliant with monies needed to be paid pursuant to Internal Revenue Codes.
 
Result: Agreement between Webb County Hilltop Securities Asset Management, LLC will provide the professional services to aid in meeting the County’s obligations.

d.   AI-11442    Discussion and possible action for approval to submit a request for a contract extension for Contract Number #61200003237 for the Program Year 2020 Community Services Block Grant (CSBG) from Texas Department of Housing and Community Affairs (TDHCA) extending contract for an additional 90 days to March 31, 2021 and authorizing the County Judge to sign all relevant documents for request and approval of contract extension. Issue: Approve CSBG Contract extension request from Texas Department of Housing and Community Affairs (TDHCA) for the Program Year 2020.
 
Solution: The Community Services Block Grant (CSBG) provides support services to eligible elderly, disabled and low-income residents of Webb County.
 
Result: The support services are intended to assist eligible Webb County residents to transition out of poverty.
             
e.   AI-11450    Discussion and possible action to ratify contract extension request to Contract Number #58200003175 for the Program Year 2020 Comprehensive Energy Assistance Program (CEAP) from Texas Department of Housing and Community Affairs (TDHCA) extending contract for an additional 90 days to March 31, 2021 and authorizing the County Judge to sign all relevant documents for request and approval of contract extension. This action will not have an impact to the General Fund.
 
Issue: Approve CEAP Contract extension request from Texas Department of Housing and Community Affairs (TDHCA) for the Program Year 2020.
 
Solution: The court approval will allow the Webb County Community Action Agency provide direct services to eligible low-income residents of Webb County under CEAP program.
 
Result: These funds are intended to assist qualifying clients with their home energy expenses.

Issue: Funds were not transferred at the beginning of the fiscal year, and an additional $4,000 is being requested on Expert Witness account to be able to cover expenses approved by the Court for trial.  

Solution: Transfer money from another line item to be able to cover pending and future expenses. 

Result: Funds will be available to pay pending and future invoices.

Issue: Elections department is in great need of a reliable vehicle to be used for transporting and delivering elections equipment, transport election Judges to sites and move equipment to storage.

Result: Elections department will have a reliable vehicle to use for transportation purposes. 
             
10.   Economic Development
             
a.   AI-11398    Discussion and possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Sheriff's Office to the Office of the Governor Criminal Justice Division in the amount estimated at $35,000 for overtime and applicable fringe benefits for members of the Mental Health Unit to provide mental health services, including commitments, executions of court orders, and transports to mental health facilities as well as grant funding for training/consultant services to provide supplemental instruction to deputies of the Sheriff's Office on responding to mental health scenarios/crisis intervention; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff; Grant Fund #2738]

Issue: The local Laredo/Webb County community continues to constitute a medically and mental health underserved area, which requires mentally ill youth and adults to travel to out-of-town facilities in order to receive these needed mental health services

Solution: Grant application to provide training and consultant services to provide supplemental instruction on responding to crisis intervention/mental health matters for the officers of the Webb County Sheriff's Office as well as overtime and applicable fringe benefits for the Mental Health Unit to transport mental health patients to these out-of-town facilities so that they may receive the care that they require.

Result: Grant funding will allow officers of the Sheriff's Office to receive supplemental training on crisis intervention and members of the Mental Health Unit to undertake complex and time consuming activities and requirements, including execution of court orders, mental health commitments, and the actual transports to out-of-town mental health facilities, so that the mentally ill patients, their families, and the overall community can be better served.

b.   AI-11399    Discussion and possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Sheriff's Office to the Office of the Governor Criminal Justice Division in the amount estimated at $25,000 for equipment, minor tools, and supplies for the officers and canines of the K9 unit; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: K9s and the Officers who handle them perform a myriad of important law enforcement duties.  However, due to the complexity, diversity, and wide depth/breath of important law enforcement/criminal justice functions all Sheriff’s Offices perform, there are finite financial resources available to provide for these types of specialized divisions.    

Solution:  Grant application to provide supplemental resources for equipment, minor tools, and supplies in support of the K9 unit.   

Result: Grant funding will allow members of the K9 Unit to be equipped with supplemental resources.

Issue: Violence against women is among the most intractable and deadliest criminal justice problems in the United States, especially domestic violence and in the South Texas area. According to published statistics, the number of American women between 2001-2012 who were murdered by current or ex male partners in the United States was 11,766. That's almost double the amount of casualties lost during wars in Afghanistan and Iraq. Women who will be victims of severe violence by an intimate partner in their lifetimes number 1 in 4.  (“30 Shocking Domestic Violence Statistics That Remind Us It’s An Epidemic”  Vagianos 10/23/2014).

Solution: Grant application to enhance the tools, techniques, and training to those investigators who follow-up to calls for assistance, conduct interviews with these victims, file incident reports, provide these victims information/referrals to service providers, initiate arrests of perpetrators, refer cases for prosecution, and prepare testimony/evidence for trial in cases of domestic violence, sexual assault, dating violence, and stalking.

Result: Enhanced law enforcement services, including investigative techniques, to deal with emergent criminal trends, such as cyber stalking, and improved efficacy of the law enforcement response to the needs of victims of violent crime.

Solution:  Grant Application for continued pay of salary for Juvenile Case Manager, in order to provide prevention, diversion, and intervention strategies through the court of the Justice of the Peace, Precinct 4 in Laredo/Webb County area.

Result: Increased focus on diversion strategies to steer at-risk juveniles from the juvenile and criminal justice system.

Issue: Various criminals with felonious charges, such as but not limited to murder, robberies, sexual assault of minors, all gang-related felonies, and aggravated assaults with deadly weapons, abscond from the local jurisdiction in order to avoid justice for their crimes. Due to the limited manpower and other resources of local law enforcement agencies, these criminal can sometimes continue to successfully evade arrest with impunity.

Solution: Through joint law enforcement overtime (OT) operations, members of the U.S. Marshal’s Service Multi-Agency Task Force can continue to assist other local law enforcement agencies, such as the Laredo Police Department and the Zapata County Sheriff’s Office, to conduct necessary investigations, covert surveillance and undertaken arrests of absconders who have outstanding warrants for their felonious crimes. 

Result:  Webb County/Laredo citizens will be safer once these criminals are captured and taken out of the local community in order to face justice for their felonious crimes.

Issue: The ADR hearing is based on a complex legal issue and would benefit the County to have an expert provide expert advise and testimony in said hearing.
 
Solution: Retain the professional services of Margo Frasier. 

Result: Finalize legal questions surrounding the contested employment issue and will result in a binding ruling from an arbitrator.
