Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 20th day of January 2022. Present also were Mrs. Rosa E. Herrera, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: The HIDTA Grant contract ended December 31, 2021, with some line items reflecting deficits.

Solution: Request a budget amendment to eliminate the deficits.

Result: The line items will have sufficient funds to eliminate the deficits.

Issue: The Substance Abuse and Mental Health Services Administration approved the County Court at Law II formal request for carryover in the amount of $100,000.00.

Solution: Approve agenda item in order to appropriate new revenues and expenditures to be used for the purpose of program expenditures.

Result: County Court at Law II will continue to provide uninterrupted services to clients in the DWI Court Program.
             
6.   Bruni Community Center
             
a.   AI-12948    Discussion and possible action to accept a donation of one (1) Spectra GE Black and White Electric Stove (Model #164D3852G012) from Ms. Nelda Cortinas for the purpose of using it at the Bruni Community Center for public use and to further authorize the Purchasing Agent to auction the inoperable gas stove that will be replaced by donation in accordance with the Texas Local Government Code; Section 263.152 (Disposition)(1) and any other matters incident thereto.
 
Issue: Currently the Bruni Community Center’s Gas stove is inoperable and department is seeking funding solutions to acquire a new one.
 
Solution: Secure approval from Commissioners Court to accept the reference donation for public use and to add to Webb County’s property records.
 
Results: Donation of stove will be used for Community Center activities open to the general public and inoperable gas stove will be placed up for auction by the Webb County Purchasing Agent.
             
7.   Civil Legal Division
             
a.   AI-12949    Discussion and possible action to enter into a One (1) year lease agreement (February 1, 2022 through January 31, 2023) between Webb County and the City of Laredo for the use of a four (4) City of Laredo owned lease spaces by the Webb County Headstart/Early Headstart Program as follows: Lease space #1, located at 2200 Zacatecas St., (Tatangelo Head Start) at a monthly rental rate of $654.12; Lease space #2, located at 3501 Eagle Pass; (Villa Alegre Head Start) at a monthly rental rate of $948.27; Lease Space #3, located at 2802 McDonell Ave., (Coordinator’s Annex) at a monthly rental rate of $565.93, and approval of a month to month lease agreement/ tenancy for Lease space #4, located at 2518 Cedar Ave., (Jesus Garcia Head Start), Laredo, Texas at a monthly rate of $954.88; for a combined total monthly rental rate of ($3,123.20) for all four lease spaces over the rental term and authorizing the County Judge to execute all relevant documents and any other matters incident thereto. 8.   Community Action Agency
             
a.   AI-12943    Discussion and possible action to approve the posting and filling of the following full-time slot with benefits, to be funded from the Comprehensive Energy Assistance Program Grant (CEAP) Account #2362-5150-3303000 and Community Services Block Grant (CSBG) Account# 2368-5170-3303000. This position will be 100% grant funded and there will be on impact to the General Fund.

9.   Economic Development
             
a.   AI-12926    Discussion and possible action to approve the submission of a grant application to the Office of the Governor Public Safety Office Criminal Justice Division for a County Innovations Grant estimated at $250,000 over the term of the contract. The Webb County Trafficking Emergency Network Diversion Program will utilize this funding opportunity to prevent, investigate, and/or prosecute the commercial sexual exploitation of foster youth in Webb County. This formal request shall authorize the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in this grant. There is no match requirement for this grant. All grant documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Contract Term: October 1, 2022 to September 30, 2023. [Requested by Child Protection Court, Selina L. Mireles, Associate Judge]

Issue: There is a need for resources to address the issue of sexual exploitation in our community. Persons who have suffered abuse in childhood or adolescence are susceptible to being sexually trafficked or exploited. There is a need to train those involved in the criminal justice system on how to identify potential and current victims and stop the cycle of exploitation. The Office of the Governor of Texas has provided available resources through a grant opportunity to enhance awareness, intervention and prevention of this serious issue.

Solution: Authorize the submission of the grant application as set forth above to ensure that the County, CPS and Child Protection Court, may create a diversion program for potential and current victims of sexual exploitation.

Result:The Texas Emergency Network Diversion Program will be in compliance with SPOC, and with the submission rules and regulations set forth by the funding agency.

c.   AI-12899    Discussion and possible action to continue paying grant funded personnel under the High Intensity Drug Trafficking Area (HIDTA) Task Force Agreement, DEA Narcotics Task Force until notification about grant continuation award from the U.S. Department of Justice Drug Enforcement Administration. This grant has been active for the past 27 years and is anticipated to continue. [Requested by Martin Cuellar, Webb County Sheriff; Grant Fund Account #2906]

Issue: HIDTA is a multi-agency task force that continues to gather intelligence and disrupts the illicit flow of narcotics and money laundering activities along the South Texas Border region. South Texas HITDA is an alliance of over 57 federal, state and local law enforcement agencies working together to combat drug trafficking and related crimes.  Historically the Grantor has always submitted award letters to local law enforcement agencies between the months of February and March; Nonetheless, the grants are retroactive to January 1st of each calendar year.
 
Solution: For the Webb County Sheriff's Office to continue supporting HIDTA by employing grant funded investigators and continue corroborating with other law enforcement agencies to push forward the mission and goals of the South Texas HIDTA task force.
 
Result: The Webb County Sheriff's Office will continue to employ two (2) HIDTA funded investigators who will actively participate and help the task force fight against the continued flow of illicit drugs and related crime within the South Texas region.
             
d.   AI-12945    Discussion and possible action to approve the submission of a grant application to the Office of National Drug Control Policy for the continuation of a High Intensity Drug Trafficking Area (HIDTA) Grant estimated at $530,150 over the term of the contract. This formal request shall authorize the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in this grant. There is no cash match requirement for this grant; however, the District Attorney's Office requests additional funding in the form of cash match to cover expenditures in excess of the grant award. The cash match in the amount of $118,998 is requested each year through the county's budget process. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: There is evidence that trafficking in narcotics and dangerous drugs exists in Laredo, Texas and that such illegal activity has a substantial and detrimental effect on the health and welfare of the people of Texas.

Solution: Gather and report intelligence data relating to trafficking in narcotics and dangerous drugs. Conduct undercover operations and engage in other traditional methods of investigations.

Result: Disrupt the illicit drug traffic in Laredo by immobilizing targeted violators and trafficking organizations.

e.   AI-12934    Discussion with possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Adult Drug Court Program to the Office of the Governor, Public Safety Office, Criminal Justice Division Specialty Courts Grant Program, FY2023 in an amount not to exceed Three Hundred Thousand Dollars ($300,000) and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any kind of match; and will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Margarita Herrera-Garza, DCP Program Director]

Issue: To expand the Webb County Adult Drug Court program in capacity and treatment services to 40 new clients. Additional services include Drug testing, monitoring services, co-occurring substance abuse and family services and case management that are all essential and contribute to the rehabilitation of each client.
 
Solution: If awarded, Drug Court will expand its current capacity and services to individuals who meet eligible criteria. 

Result: Webb County Drug Court Program will remain in compliance with SPOC and with the submission of rules and regulations set forth by the funding agency.

f.   AI-12929    Discussion and possible action to authorize the Economic Development Department to develop and submit a Fiscal Year 2021 Staffing for Adequate Fire and Emergency Response (SAFER) Grant application to the U.S. Department of Homeland Security for up to $2,800,000.00, and authorizing the County Judge to act as the Authorized Representative in all matters pertaining to the County's request for funding. The purpose of the application is to supplement the Webb County Volunteer Fire Department with a minimum of twelve (12) frontline firefighters. This application does not require a cash match.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Fire Suppression & EMS Services]

Issue: As the Webb County Volunteer Fire Department expands to insure the safety of Webb County residents, so does the demand for paid, certified, frontline firefighting personnel.

Solution: The acquisition of grant funds will offset Webb County personnel expenses for a three-year period.

Result: A healthy budgetary outlook for Webb County and the volunteer fire department.

11.   Purchasing
             
a.   AI-12928    Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

b.   AI-12937    Discussion and possible action to approve and consent to a contract assignment from Family Chevrolet (Awarded Bid No. 2022-01 for Auto Parts on July 12, 2021, Item 17.b.) to Sames Chevrolet as authorized in the original agreement between Webb County and Family Chevrolet in accordance with Section 15 (Prohibitions against Assignment) and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto.
 
Issue: Family Chevrolet has submitted written consent to assign its agreement over to Sames Chevrolet.
 
Solution: The Agreement between Webb County and Family Chevrolet permits assignment so long as it is in writing.
 
Result: Webb County will continue to receive its products for Auto Parts.

9.   Economic Development
             
b.   AI-12898    Discussion and possible action to authorize the acceptance of a grant award from the Firehouse Subs Public Safety Foundation as developed, prepared, written, and submitted by the Webb County Sheriff’s Office Grant Writer for the purchase of 41 Point Blank Ballistic Vests valued at up to $34,809 for the Sheriff’s Office peace officers; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund.  All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. Issue: According to the Officer Down Memorial Page, law enforcement continues to be one of the most dangerous professions in the United States.
 
Solution: Grant award so that the Webb County Sheriff’s peace officers be provided with a supplemental source of safety equipment.
 
Result: The Webb County Sheriff’s Office law enforcement officers will be able to utilize critical safety and life-saving equipment.

Issue: Items where not needed to complete the project. Therefore, a total of $6,300.00 will not be necessary to complete contractual activities. In addition, contractor needed extra time to complete actives, due to issues with rock and caliche, which slowed down the process. 

Solution: Approve change order #3 that will allow for the contractor to complete contractual activities.

Result: Contractor will finish construction within contract timeframe.

21.   AI-12953    Discussion and possible action to approve an Order and Resolution for the purpose of authorizing a public property finance contract issued under the Local Government Code Section 271.005 (Authority to Contract for Personal Property) between Government Capital Corporation and Webb County for the purpose of financing three (3) Automated Side Load Refuse Trucks for the Road and Bridge Department with a proposed financing term of Five (5) annual payments of $203,792.88 at an interest rate of 2.888%, with first annual payment due 12 months after signing; and to further authorize the Civil/Legal Department to finalize all related legal documents with final authorization from the County Judge and any other matters incident thereto. [Debt Service Account & Road & Bridge Capital Outlay Account]
 
Issue: There is currently no funding in the Road and Bridge 2021-2022 FYE budget for the purchase of this heavy equipment.
 
Solution: Approve the recommended financing option being provided by Government Capital Corporation for the three (3) refuse trucks for the Road and Bridge Department.  Funding option includes a 5-year term with first payment due 12 months after signing and annually thereafter. 
 
Result: Once the finance agreement is executed, it will take 3-5 business days to receive the wired funds that will be allocated to the Road and Bridge Capital outlay account and recorded under long term debt service.  Once funds are allocated to the general fund account, the Purchasing Agent will authorize the order through an official purchase order.  Estimated time of delivery is 12 months.

Issue: Currently the County has 2013 models that have had reoccurring mechanical programs putting a strain on the operations for refuse collection. Road and Bridge Director is recommending that the units be replaced.
 
Solution: Purchase new refuse trucks from cooperative vendor.  2023 models will take up to 12 months to build and deliver after ordering.
 
Result: If approved, the refuse trucks will be ordered once the financing is secured and allocated to the Road and Bridge capital outlay account.

Issue: When the Rio Bravo Water Treatment Plant as built and put online in 2006 the generators were installed and programmed with natural gas as the primary source for power and the electrical utility generators to be used as a secondary backup power source.  We currently have system running with electrical utility due to the cheaper cost compared to natural gas powered generators, which are more expensive to run due to the high cost of natural gas.  The dual source power programming is will give the Utilities Dept. to automatically switch from one source of power i.e.; gas to electric or electric to gas as the main power source for the generators in the event of a power outage.

Solution: Approve and authorize the Backup Generator upgrades to our Transfer Switch Station.

Result: Department will have the ability to automatically transfer from electrical to natural gas power for the Backup Generators in the event of a Power Outage and ensure continuance of utility services to both Rio Bravo and El Cenizo.
