Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 21st day of October 2022. Present also were Ms. Amber Lecea, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

  County Treasurer, Mr. Raul Reyes gave a presentation of the Bills and Disbursements for the period of 10/07/22 - 10/20/2022, that included the Recap of Checks, and EFT's.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: New proceeds under Chapter 18 of the Texas Code of Criminal Procedure have been awarded and may be spent by the attorney representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

Solution: Submit a budget to the Governing Body that clearly list and defines the categories of expenditures.

Result: The attorney representing the State can utilize the new proceeds for the official use of his Office.

Issue: Additional funds are necessary to cover program expenses for Veterans Treatment Program, Year 4 of SAMHSA Grant No. TI081929.

Solution:Approve carry over of unobligated funds from year 3 as previously approved by the funding agency.

Result: Ensure funding within accounts for the remainder of the grant period ending May 30, 2023.

a.   AI-14026    Discussion and possible action to approve a reimbursement agreement between Webb County (on behalf of the Webb County Sheriff's Office) and the Organized Crime Drug Enforcement Task Force (OCDETF) during the performance period of October 1, 2022 through September 30, 2023 for an amount not to exceed Nineteen Thousand Eight Hundred Forty Dollars and Seventy Five Cents ($19,840.75) in overtime for Webb County Sheriff’s Office deputies through the OCDETF Investigation/Strategic Initiative and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. Estimated applicable fringe benefits in the amount of Five Thousand Two Hundred Dollars ($5,200.00) for this overtime will be covered by State forfeiture funds; and, thus, this agreement will have no impact to the general fund. The campaign discourages drinking and driving in Webb County. d.   AI-14030    Discussion and possible action to authorize and ratify the purchase of televised commercial advertisement from FOX Laredo for the FOX National Football League (NFL) Sunday Football Television advertising in Laredo by the Webb County District Attorney’s Office, for the “Make the Right Call” campaign. The campaign discourages drinking and driving in Webb County. The FOX advertisement package commercial ads commence August 2022 and follow the entire season through the end of February, 2023, at a total cost of Thirty Four Thousand Five Hundred Dollars ($34,500.00) for a total of Two Hundred Sixty-Three (263) ads. The Webb County District Attorney’s Office will be featured in the advertisement and authorizing the Webb County Judge to execute all relevant documents, and any other matters thereto. 8.   Economic Development
             
a.   AI-14035    Discussion and possible action to accept the award and enter into an agreement with the Texas Office of the Governor - Criminal Justice Division (CJD) DC - Specialty Courts Program Grant No.  444810, in the amount of ONE HUNDRED EIGHTY EIGHT THOUSAND SEVEN HUNDRED SEVENTY FOUR DOLLARS ($188,774.00) beginning September 1, 2022 - August 31, 2023, for the Webb County Adult Drug Court Program, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. There is no cash/in-kind match required, therefore there is no financial impact to the general fund. All required documents were sent for review to the Economic Development Department and the acceptance of the grant award is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Notice of Award from the Office of the Governor for the Adult Drug Court Program was received on October 6, 2022, acceptance by Commissioners Court is required to activate grant funding. 

Solution: Accept the Notice of Award to proceed with additional treatment services provided to eligible participants of the Drug Court Program.

Result: If accepted, funding will provide additional treatment services to eligible Drug Court participants.

b.   AI-14051    Discussion and possible action to accept a grant in the amount of $71,635.00 from the Office of the Governor as developed, prepared, written, and submitted by the Justice of the Peace, Pct. 4 in conjunction with the Webb County Sheriff’s Office Grant Writer to continue to pay the grant-funded salary fringe benefits and training and travel of the Truancy Juvenile Case Manager in order to continue to divert at-risk truant juveniles from entering into the criminal justice system; and designating the Webb County Judge as the authorized official and any other matters incident thereto. Thus, this grant will continue to have no impact on the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Jose R. Issue: Truancy can be considered a gateway to juvenile delinquency and is a nationwide problem that negatively affects not only the delinquent youth and their families but also adversely impacts schools, neighborhoods, and the local community at large. In addition, youth at-risk for juvenile delinquency who enter into the juvenile justice system tend to face limited future career, educational, and other socio-economic prospects, especially in the South Texas area.

Solution: Grant award to continue to fund a currently grant-funded truancy case manager in order to continue to provide prevention, diversion, and intervention strategies through the court of the Justice of the Peace, Precinct 4 in Laredo/Webb County area.

Result: This grant will allow Juvenile Case manager to focus on diversion strategies to steer at-risk juveniles from the juvenile and criminal justice system.

c.   AI-14021    Discussion and possible action to authorize the acceptance of a Fiscal Year 2023 Local Border Security Program (FY 2023 LBSP) grant award in the amount of $140,000 from the Office of Homeland Security Grants Division (HSGD) as specifically developed, written, and submitted by and for the Webb County Sheriff’s Office for its peace officers’ overtime and applicable fringe benefits to provide enhanced border security in the Laredo/Webb County area, and authorize the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fluidity of border crossings, heavy commercial activity, and interdependence of the international border communities’ economies. These socio-economic pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.

Solution: Grant award to provide enhanced border security in Laredo/Webb County in order to fulfill State of Texas local border security program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas.

Result: Enhanced/increased patrol and investigative capacity for certified peace officers working at the Webb County Sheriff’s Office.

Result: The Webb County Sheriff’s Office will have increased capacities and enhanced capabilities.
             
e.   AI-14055    Discussion and possible action to authorize the acceptance of a Fiscal Year 2023 Local Border Security Program (FY23 LBSP) grant award of $18,000, from the office of Homeland Security Grants Division (HSGD) as developed, written, and submitted by and for the Webb County Constable Office Pct.3 for its peace officer’s overtime and applicable fringe benefits to provide enhanced border security in the Laredo/ Webb County area and entering into the grant agreement; authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. Issue: The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fluidity of border crossings, heavy commercial activity, and interdependence of the international border communities' economies.  These socio-economic pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.
 
Solution: Grant award to provide enhanced border security in Laredo/ Webb County and the area in order fulfill State of Texas Local Border Security Program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas.
 
Result: Enhanced/increased patrol for certified peace officers working at Webb County Constable Pct. 3.

Issue: Webb County is proposing the following road project; BID (ITB) No. 2022-015 Mangana Hein Road Extension Project. As stated in Commissioner Court on October 11, 2022, Item 28, funding has been identified for the excess budget earmarked for this project.

Solution: The Engineering Department is proposing to transfer funds from the 2020 County Transportation Infrastructure Fund (C.T.I.F.) Grant, left over from previously completed overlay projects, to accomplish this road project. The Texas Department of Transportation (TxDOT) has approved the transfer of C.T.I.F. funds.

Result: County Mangana Hein Road will be maintained for use by county residents, first responders and school district.

Issue: Since 2006, Webb County has participated as the Inter-Governmental Transfer (IGT) entity for Laredo Medical Center and Doctors Hospital of Laredo. The IGT submitted allows hospitals to receive federal matching funds that are used to offset the cost of uncompensated care that hospitals provide to Medicaid and uninsured patients.
 
Solution: Commissioners Court approval is needed in order to submit IGT contributions on behalf of local hospitals as requested by the State of Texas.
 
Result: The authorization of IGT will allow local hospitals to access matching federal funds for FY 2022-2023 to offset uncompensated care costs as well as receive incentive payments from the State of Texas for successful completion of 1115 Waiver project requirements.
