Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Present also were Ms. Virginia Martinez, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

County Treasurer, Ms. Delia Perales presented the Recap of Checks, Ratification of Checks, Ratification of Payroll for November 20 with corrections returned to the Auditor's, List of Corrections sent back to the Auditor's, and Side List pending approval.

Ms. Perales presented the monthly report for October 2015.

5. Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member will be allowed a total of Three (3) minutes within which to make any/all public comments.

Mrs. Ibarra informed the court of the newly preserved Commissioners Court Meeting Minutes dating back from 1873-1912. She showcased a book to show what the records look like now that they've been professionally conserved.

AI-3625  Discussion and possible action to authorize Webb County acting by and through the Webb County Attorney’s Office to commence and enter into formal contractual negotiations only, with El Portal Center, LLC., for the terms, conditions, criteria and/or other necessary requirements as needed for entering into a possible ad-valorem tax abatement agreement with said company, for the redevelopment of the existing retail center on the property formerly known as the “River Drive Mall” to allow for the construction of a retail outlet shopping mall on the subject property by the company, and any other matters incident thereto.

14. AI-3567  Discussion and possible action to enter into a One (1) year (September 30, 2015-September 29, 2016)  Program Evaluator Contract between Webb County and La Familia Consulting and Counseling Services for the 406th District Court Adult Drug Court Program at a cost not to exceed TWENTY FIVE THOUSAND DOLLARS ($25,000.00); and any other matters incident thereto. [Requested by Margarita H. Garza, 406th Drug Court Program Administrator; Account #351-1004-6022]

Issue: According to the National Association for Drug Court Professionals monitoring and evaluation measure the achievement of program goals and gauge effectiveness are part of the 10 Key Components that prove to be effective for Drug Court Programs.

Solution: The Program Evaluator will monitor the performance and compliance of the project with model fidelity to keep court personnel and all program staff aware of the program standards and issues. This includes preparing and submitting monthly and annual performance reports as required by SAMHSA.

Result: The evaluator will ensure the program is in full compliance with grant requirements to meet goals and objectives for the success of the program.

15. AI-3610  Discussion and possible action to authorize the 406th Judicial District Court Veterans Treatment Program to submit a grant application for the "Veterans Treatment Court Grant" offered by the Texas Veterans Commission which will enhance the services currently being provided by the Veterans Treatment Program. There are no matching funds required.

Issue: The Texas Veterans Commission has been authorized to issue grants, from funds appropriated under the Fund for Veterans’ Assistance, in support of Veterans Treatment Courts in order to address the needs of veteran participants and their families. 

Solution: The 406th Veterans Treatment Program’s fiscal responsibility and obligation to submit a Request for Application to the Texas Veterans Commission Fund for Veterans’ Assistance 2016-2017 Veterans Treatment Court Grant. 

Result: Enabling the 406th Veterans Treatment Program to provide additional services and/or enhance the services currently being provided.

16. AI-3516  Discussion and possible action to approve payment to RZ Communications in the amount of $900.00 for services rendered.
[Account 001-2503-6403 (Repair & Maintenance - Vehicle)]

Issue: RZ Communications was contracted to remove Lights, strobe lights, sirens, center console, radar, cage partition, radios, antennas, and other accessories. A PO was not provided due to the lack of funds in the Repair and Maintenance Vehicle Account [001-2503-6403], however the services were contracted by an employee of the department on August 27, 2015. A General Purpose Request for Payment was submitted on September 17, 2015, on October 7, 2015. Auditors refused to pay because proper procedure was not followed. Services were contracted without going through the County purchasing agent.

Solution: Approve payment to RZ Communications in the amount of $900.00 for the services that were rendered to Constable Pct. 2.

Result: RZ Communications will be paid for their services rendered.

17. AI-3594  Discussion and possible action to approve the renewal of Two (2) existing advertisement contracts with Lamar Advertising for Constables Office Precinct 4 safety message campaign. Contracts to cover the location of the bus shelters and for the fabrication of artwork (vinyls). There is no financial impact on the general budget. Issue: Currently the Webb County Constable's Office Precinct 4 has an existing contract with Lamar Advertising for Six (6) bus shelters with vinyls. These bus shelters currently promote traffic safety issues within our school zones. Soon these contracts will expire; therefore, in an effort to continue our school safety campaign these contracts need to be renewed to continue the remainder of the 2015-2016 school year. 

Solution: Contracts need to be approved by Commissioners Court to continue advertising. First Contract: Six (6) bus shelter locations within precinct 4 for an additional Six (6) months (contract number #2485244 in the amount of $5,400.00) billing cycle of four (4) weeks. Second Contract: Fabrication of 6 vinyl's (artwork) for existing bus shelters (contract number #290114 in the amount of $600.00).  

Solution: With the approval of the submitted renewal contracts, precinct 4 will continue it's proactive measures to remind motorists of safety issues within our school zones and continue to promote a safe and successful school year.

18. AI-3611  Discussion and possible action to exercise the holding over clause under the lease agreement between Moises Gonzalez (LANDLORD) and Webb County (TENANT) for leased premises known as 2900 US Highway 83. The holding over rate of $4,000.00 would be effective December 1, 2015 and would terminate upon vacating the leased premises, all other terms and conditions remain unchanged. Issue: Due to damages sustained by the Probation/Sheriff Boxing Gym building located at 3802 S. Zapata HWY, the Sheriff's athletics division was relocated temporarily to the above mentioned location under a lease rental agreement with Mr. Gonzalez. Initial term was for one (1) year ending March 2014. Subsequent to that the lease agreement was extended for one more year ending March 2015.

Solution: Since renovations are nearing completion it would not be favorable to Webb County to renew lease agreement for another year or any other term that would exceed the estimated time of completion.
 
Result: Therefore, exercising the HOLDING OVER clause would provide a month to month rental payment without any financial commitments beyond the vacancy of this leased property.

19. AI-3595  Discussion and possible action to approve a refund in the amount of $14,887.83 to National Tax Search LLC, Agent for Wells Fargo Bank NA. Account #92225001010, it had previously been paid prior to receiving check #3031.

Issue: The aforementioned account had previously been paid by another company prior to receiving check #3031 from National Tax Search LLC, Agent for Wells Fargo Bank NA, which resulted in the over-payment of $14,887.83.

Solution: Refund said amount to National Tax Search LLC for the over-payment.

Result: The monies will ultimately be reimbursed to the appropriate taxpayer.

Issue: The aforementioned account was included twice in a listing of accounts provided by the taxpayer to be paid with Check #20229 which resulted in the over-payment of $7,006.66.

Solution: Refund said amount to Plains Capital Bank for the over-payment.

Result: The monies will ultimately be reimbursed to the appropriate taxpayer.

Issue:  Chiller system provides air conditioning to Webb County Building including the Justice Center, Administration Building and County Courthouse. Fuel must be purchased for regular maintenance of cooling towers.

Solution: Enter into an agreement with NALCO for annual supply of fuels needed for regular maintenance of equipment.

Result: Proper maintenance of functioning equipment that provides air conditioning to major County buildings.

Administrative Services Director, Ms. Cynthia Mares stated that under Slot# 2838 Lead Custodian the correct Hourly Rate Range and Grade should be $12.44 - $13.07 A-E.

AI-3607  Discussion with possible action to award RFP 2015-06 to Municipal H2O in the amount of $10,500.00 for year One (1) of a Three year contract for development and maintenance of a Risk Management Program (RMP) as required by the Environmental Protection Agency (EPA) for the Water and Wastewater Treatment Plants regarding Safe Use and Maintenance of Hazardous Chemicals. [Account #801-3001-6402]

Issue: Although the Water and Wastewater Treatment Plant was required to implement a RMP several years back, the program has never been implemented and our systems have never been inspected by EPA. However, due to the improvement in training and safety, not only with our employees but the first responders and the public, it is highly recommended we pursue this RFP and acquire the required services.

Solution: Specialized companies have been practicing for several years to provide the necessary support and compliance guarantees to small system to comply with these requirements. These companies can provide a compliance set-up service for each facility, which includes Compliance Audits, Hazard Assessments, a prevention program and monthly training of employees to maintain compliance.

Result: Hiring of the most qualified and best value will guarantee meeting compliance with the Environmental Protection Agency's required Risk Management Plan.

Issue: The I.T. Department determined during a site visit that 3 of our department computers are no longer under warranty and the warranty on 2 other computers will expire on April 2016. Current computers are operating at a very slow speed and any replacement parts would not be available or covered by warranty.

Solution: To purchase new computers to replace outdated ones.

Result: Department staff will have computers that will improve efficiency and productivity.

Issue: When the Fernando Salinas Community Center (520 Reynolds) was designed, the network cabling was determined to be a customer provided item. This cable needs to be in place in order for computers and telephones to be connected in the offices.

Cmr. Sciaraffa wished all the Webb County Family a Happy Thanksgiving.

Cmr. Tijerina congratulated Mercy Ministries on their 1st Annual Mercy Milagros Fundraiser held on November 12. She congratulated Bruni Community Center Director and Larga Vista Community Center Director for their hard work in organizing the Thanksgiving Feast. Cmr. Tijerina congratulated Dr. Cecilia Moreno on being named President of the Laredo Independent School District Board of Trustees. She thanked United South High School for their invitation to the Young Women's Conference on November 17. Cmr. Tijerina congratulated Korean War Veteran Mr. Ernesto Sanchez on being recognized as a distinguished citizen by the Lucy Meriwether Chapter of the Daughters of the American Revolution. She congratulated Representative Richard Pena Raymond on being honored by the Arc of Texas in Austin with 2015 Leadership Award. Cmr. Tijerina congratulated Mrs. Ana Benavides Galo for being appointed Texas Parks and Wildlife Commission. She wished everyone a very Happy Thanksgiving. Cmr. Tijerina sent her heartfelt condolences to the family of Jose Rogelio "Pepe" Santos, Jose Luis Ortiz, Maria Antonietta Villarreal, Cruz "Mickey" Gonzalez, Alfredo "Freddy" Sanchez, Paula Cadena, Leticia Adriana Menchaca, Ramiro Ruben Torres, Jose Perez, Esther Hernandez, Hector "Toro" Benavides, and Rudy Peralta.

Judge Tijerina congratulated Cmr. Sciaraffa on his dance. He congratulated Dr. Cecilia May Moreno on being named President of the LISD Board. Judge Tijerina mentioned that November is National Adoption Month. He reminded everyone of the Commissioners Court agenda item submission procedure. Judge Tijerina mentioned that he was growing his beard in honor of No-Shave November which helps raise cancer awareness and support. He sent out his prayers to all those dealing with cancer. Judge Tijerina wished everyone a very Happy Thanksgiving and thanked all the Webb County Family.
