Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 10th day of November 2022. Present also were Ms. Amber Lecea, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

  Treasurer's Accounting Manager, Sergio Ramirez gave a presentation of Bills and Disbursements that included the Recap of Checks//EFT's, Payments Released, and Payment Ratifications for the period of 10/21/2022 - 11/10/2022.
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 1 Jesse Gonzalez to approve Payment Ratification

  Treasurer's Accounting Manager, Sergio Ramirez presented the Liability Disbursements of County payroll for the period of 10/07/2022 - 10/20/2022 and 10/21/2022 - 11/03/2022 along with the Casa Blanca Golf Course payroll of 11/04/2022 and estimated payroll for 11/18/2022.
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 1 Jesse Gonzalez  to approve the Casa Blanca estimated Payroll not to exceed $45,000.00

  Human Resources Director, Mr. Ernesto Guajardo presented the Wage and Pay Scale Budget Amendments.
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 1 Jesse Gonzalez to approve by order the Wage and Pay Scale Budget Amendments.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

b.   AI-14081    Discussion and possible action to approve payment for memberships of non-profit state associations for fiscal year 2023 as required by Local Government Code Section §89.002 subject to funding availability and any other matters incident thereto.
 
Issue: Local Government Code §89.002 requires that the Commissioners Court may spend, in the name of the county, money from the county's general fund for membership fees and dues of a nonprofit state association of counties if:
(1) a majority of the court votes to approve membership in the association;
(2) the association exists for the betterment of county government and the benefit of all county officials;
(3) the association is not affiliated with a labor organization;
(4) neither the association nor an employee of the association directly or indirectly influences or attempts to influence the outcome of any legislation pending before the legislature, except that this subdivision does not prevent a person from providing information for a member of the legislature or appearing before a legislative committee at the request of the committee or the member of the legislature; and
(5) neither the association nor an employee of the association directly or indirectly contributes any money, services, or other valuable thing to a political campaign or endorses a candidate or group of candidates for public office.

Solution: Obtain court approval as required.

Result: State associations approved by Commissioners Court will be processed for payment timely.

Issue: New proceeds under Chapter 18 of the Texas Code of Criminal Procedure have been awarded and may be spent by the attorney representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

Solution: Submit a budget to the Governing Body that clearly list and defines the categories of expenditures.

Result: The attorney representing the State can utilize the new proceeds for the official use of his Office.

e.   AI-14105    Discussion and possible to approve an addendum to Law Enforcement Support Office (LESO) approved by the Webb County Commissioners Court on June 13, 2022, between the State of Texas LESO Program and Webb County; and authorizing the County Judge to sign and execute all relevant documents, and any other matters incident thereto. Issue: A new Executive Order was issued earlier this year that impacts some of the policies and procedures of the Texas LESO Program in which Webb County participates. 

Solution: Approval of addendum to comply with new federal requirements.  

Result: The Webb County Sheriff’s Office will continue to be able to participate in the LESO Program.
 
Previous Court Action:   Agreement is approved on an annual basis.  Annual agreement was approved this year by the court on 6/13/2022. 
 
Background:  An Executive Order (EO) was issued earlier this year impacting some of the policies and procedures of the LESO Program. Due to these changes/updates, LESO has implemented an Addendum to the State Plan of Operation.

f.   AI-14107    Discussion and possible action to enter into a Memorandum of Understanding (MOU) for the FY 2022 Edward Byrne Justice Assistance Grant (“JAG”) funded by the Department of Justice (“DOJ”) between Webb County for the benefit of the Webb County Sheriff’s Office and the City of Laredo acting on behalf of the Laredo Police Department, which will support equipment, training/travel, and supplies for law enforcement operational purposes. Issue: State mandates the filling of vacancies when applicable term ends as per Administrative Code Chapter 5 Rule 5.215.

Solution: Vacancies will be filled.

Result: The Agency will comply with Texas Department of Housing & Community Affairs  Texas Administrative Code, Chapter 5 Rule 5.215.

d.   AI-14154    Discussion and possible action to accept Amendment No. 19 for the Health and Human Services Commission (HHSC) (Contract #000158100) for additional funds for the fiscal year 2023 in the amount of FIFTY-NINE THOUSAND NINE HUNDRED NINETY-SEVEN AND SIXTY NINE CENTS ($59,997.69), FY23 total Budget 589,463.10, and authorizing the County Judge to sign all relevant documents. This action will not have an impact to the General Fund. Documentation has been reviewed by Webb County Economic Development Department and is compliant with SPOC policies and procedures. [Grant Account #2371-5150-521-330300]

Issue: Texas Health and Human Services Commission (Region 11, HHS Contract No 000158100) is adding additional funds for the fiscal Year 2022-2023 budget by adding funding these funds we will have a total budget amount of $589,463.10 for the home delivered meals program.

Solution: The discussion and possible action is to accept Amendment #19 with the current HHSC contract to provide Home-Delivered Meals to the elderly, home-bound residents of Webb County.

Result: The HHSC addition will provide an additional estimated 11,299 Home Delivered Meals from October 1, 2022, through September 30, 2023.

Solution: Accept the grant award from the Office of the Governor, Public Safety Office.

Issue:  In the past decades, many crime victims, such as victims of sexual assault and domestic violence, were unaware if their respective crime perpetrators were able to post bail and released from the corrections system. In late 1993, one particular victim who had been raped, assaulted, and stalked in Jefferson County was unaware that her former boyfriend had been released and was subsequently ambushed by him after she left work. She was shot Seven (7) times at point blank range and killed on that day, her 21st birthday.

Solution: As a result of community outrage, an automated telephone notification system for crime victims and other concerned citizens was instituted: Victim Information and Notification Everyday (VINE) Service. This nationwide system is funded for Texas counties through the Texas Office of the Attorney General (OAG) and is currently utilized by Webb County.

Result: The crime victims of Laredo/Webb County can enroll in this program and will be provided with automated notification upon an offender’s custody status change, such as release, transfer, and/or relevant district court dates.
             
g.   AI-14125    Discussion and possible action to authorize the acceptance of a grant award in the amount of $206,380 and as completed and submitted by the Webb County Sheriff’s Office to the Bureau of Justice Assistance (BJA) for a FY 2021 State Criminal Alien Assistance Program (SCAAP) grant for reimbursement of costs already incurred for the incarceration of undocumented criminal aliens at the Webb County jail; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any cash match; and, in fact, is a reimbursement of costs already incurred. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Although immigration matters, including illegal immigration, are constitutionally established as existing under the legal jurisdiction and regulation of the federal government, state prisons and local detention facilities, such as the Webb County jail, incurs significant costs incarcerating undocumented foreign aliens who commit crimes in the United States. This includes but is not limited to supervision, housing, feeding, clothing, any medical and transportation expenses, and other associated detention costs.

Solution: Grant award to obtain reimbursement of a small percentage of the incurred correctional officer salary costs associated with detaining undocumented criminal aliens who had at least one felony or two misdemeanor convictions for violations of state or local law and who were incarcerated at the Webb County jail for at least four (4) consecutive days during the reporting period of July 1, 2019 through June 30, 2020.

Result: Webb County will be reimbursed by the federal government a limited percentage of the amount

However, many victims of crime are unaware of their mandated rights as well as the services that are specifically available to them to facilitate needed restitution, recovery, privacy, dignity, and justice.

Solution: Grant application to highlight the rights of and services for crime victims in the Laredo/Webb County area during the National Crime Victims’ Right Week.

Result: The general public and any victims of crime will become more aware of the services available to them in the Laredo/Webb County area.

Persons who have suffered abuse in childhood or adolescence are susceptible to being sexually trafficked or exploited. There is a need to train the community, caregivers, law enforcement, those involved in the criminal justice system on how to identify potential and current victims and stop the cycle of exploitation. The Office of the Governor of Texas has provided available resources through this grant opportunity to enhance awareness, intervention, and prevention of this serious issue.

Solution: Accept award and enter into an agreement to set forth the aforementioned, and ensure that Laredo/Webb County, CPS, and the Child Protection Court, continues the TEND diversion program for potential and current youth victims of sexual exploitation for a second year.

Solution: Work with Brighton Group, LLC who was recently contracted to provide Project Management Services for ARPA related projects.  Brighton Group’s agreement was fully executed and filed with the County Clerk on September 12, 2022. 
 
Result: ARPA related projects will continue to move forward in the initial phases of procurement with the assistance of Brighton Group to secure background and scope of services information for solicitation purposes and to ensure compliance with the State of Texas Procurement laws and the Code of Federal Regulations §200.318 - §200.327 (General Procurement Standards).

Issue: Due to recent reports of accidental misfires without trigger being touched with the Sig Sauer P320 weapons, the Sheriff’s Office is recommending to trade in the existing inventory and replace with Glocks.   
 
Solution: Low bidder provided a credit of $68,100.00 for the 215 county owned weapons.   Adjusting the original purchase price from $106,344.87 to $38,244.87. Recommendation is to proceed with purchase after Court approval.

Solution: Authorize the purchase to proceed with the replacement of potentially defective weapons and its accessories.

Issue: Current Master License Agreement expired 09/30/2022. The amendment will provide continuous web based services for e-procurement services to both internal and external customers.  Vendors and the public in general will continue to have access to view, register and participate in public solicitations authorized by Webb County.  Registered vendors will also continue to receive automatic notifications on all solicitation commodities they selected during the registration process.  E-procurement software provided by IONWAVE also provides auto tabulations of electronic scoring by evaluation committee members and other beneficial procurement features to better manage the solicitation process from start to finish.    
 
Solution: Consideration to approve the amendment to continue services provided by IONWAVE and approved through The Interlocal Purchasing System (TIPS).  Budget for year one is in place under the Purchasing Departments Professional Service Account.

  Brighton Group Senior Project Administrator, Joseph Palacios presented a status report on the following ARPA projects:
  1. Colorado Acres Microfiltration System Installation & Upgrades to Water Well;
  2. Webb County On-Site Sewage Facilities (OSSF) and Electrical Assistance Program Down payment Assistance Program for Utility and Septic services for eligible colonia residents located along Highway 59 of the county.

39.   AI-14146    Presentation and discussion by the Rio Grande International Study Center to collaborate jointly with Webb County and the City of Laredo for the submission a grant application to the National Park Service for its “Outdoor Recreation Legacy Partnership” program for the purposes of a project referred to as Project Uno – Conservation Park Project located in the Zacate Creek Watershed; with possible action to provide cash match assistance; and any other matters incident thereto.   Representatives for the Rio Grande International Study Center gave a presentation.

Tijerina, seconded by Commissioner, Pct. 2 Rosaura “Wawi” Tijerina to allow for the Rio Grande International Study Center to work with our granting office with the goal of reaching a 10 million dollar match that includes partners like the City of Laredo and other state and local grants that can be looked for
