Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 11th day of December 2015. Present also were Ms. Virginia Martinez, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

Issue: Webb County requested to solicit request for qualifications from legal counsel with fees for legal work to be based on a contingent fee.
 
Solution: The firm will be required to research, investigate, analyze, and advise Webb County on any potential legal cause of action for defective construction or warranty claims against all contractors, subcontractors, agents for the original construction of  the Rio Bravo Water Treatment Plant.

40. AI-3696  Discussion and possible action to allocate funds and ratify payment of emergency equipment and repair services provided by Pump Mechanical Technical Services, LLC. in the amount of $41,132.56 for the repair of the Casa Blanca Golf Course irrigation system. [Fund 746-Series 2013]

Issue: Failure of the irrigation pumping system and associated equipment at the Casa Blanca Golf Course.

Solution: Emergency repairs and the purchase of equipment and parts were needed for the operation of the irrigation pump system at the Casa Blanca Golf Course that included two (2) 50HP motors and pumps, one (1) 5HP motor and pump, and other related equipment, and labor.

Result: Repair of irrigation pumping system.

9. AI-3682  Discussion and possible action to approve an Order and Resolution of the Webb County Commissioner's Court whereby Webb County elects to participate in Tax Abatements and formally adopts the amended policy, Guidelines, Criteria and Methodology governing Ad-Valorem Tax Abatements by Webb County, Texas as previously passed and approved by the Webb County Commissioners Court on November 23rd, 2015; and any other matters incident thereto.

Issue: On November 23, 2015, the Webb County Commissioners Court approved the revised and amended Policy Guidelines, Criteria, and Methodology governing Tax Abatements in Webb County but due to an oversight failed to include a formal Resolution and Order whereby Webb County elects to become eligible to participate in tax abatements, and Webb County formally adopts the amended Tax Abatement

Policy, Guidelines, Criteria and Methodology. Chapter 312 of the Texas Tax Code requires that the guidelines governing Tax Abatements be re-adopted every two (2) years by a formal Resolution and Order of the Commissioner’s Court. 

Solution: The passage of a formal Resolution and Order of the Webb County Commissioner’s Court formally adopting revised and amended Policy Guidelines, Criteria and Methodology governing Tax Abatements retroactively to November 23rd, 2015 as previously approved by the Webb County Commissioner’s Court, would be in compliance with the Texas Tax Code and be in the County’s best interest to promote positive economic growth and job creation and additional investments in Webb County.

Result: This Resolution and Order to formally adopt the revised and amended Policy Guidelines, Criteria and Methodology governing Tax Abatements in Webb County made effective retroactively to November 23rd, 2015 complies with Ch. 312 of the Texas Tax Code.

11. AI-3635  Discussion and possible action to review the current financial accounts with encumbered funds that have not been spent; with further action that those funds be unencumbered and allocated for debt service or another county purpose; and any other matters incident thereto.
 
Issue: On September 14, 2015, Commissioners Court approved the review of all special accounts that had encumbered funds that had not been spent over an extended period of time.
 
Solution: After reviewing these particular funds, it would be in the county’s best interest to unencumber these funds and allocate them for another county purpose.
 
Result: Redistributing funds will help alleviate the shortfall in other accounts with pending expenses.

The Commissioners Court presented certificates of appreciate to the Building Maintenance employees in recognition of their hard work, dedication, and service to all Webb County Buildings and Departments.

12. AI-3643  Discussion and possible action to authorize a one-time waiver of the required annual audit of books and records for the Webb County-City of Laredo Regional Mobility Authority (WC-CL RMA); and any other matters incident thereto.

Issue: The Webb County-City of Laredo Regional Mobility Authority (WC-CL RMA) is required to provide an annual audit of its books and records conducted by an independent certified public accountant. This new entity, however, has not generated revenues or incurred other financial obligations which would be the underlying subject of the audit.

Solution: A one-time waiver of this audit requirement may be granted for this year if the county and city officials both agree.

Result: This waiver will allow the WC-CL RMA to be excepted from the required audit this year.

13. AI-3681  Discussion and possible action to approve the line item transfers identified in the back-up information so that 2015 year-end expenses can be paid and charged to the appropriate line items that did not have sufficient funds at the time the expense was presented for payment approval.
 
Issue: Departments have incurred expenses for which they do not have sufficient balance in the appropriate department line item.

Solution: Review the affected department’s accounts and determine a suitable accounts from which monies can be transferred to cover FYE 2015 outstanding invoices.

Result: Outstanding invoices for goods and services for the fiscal year ended September 30, 2015 will be liquidated in compliance with Financial Audit.

Webb County and Javelina Wind Energy, LLC, entered into a Tax Abatement Agreement that required Javelina Wind Energy to contribute $400,000.00 to Webb County for this purpose. Webb County will assist WCISD by administering the funding for this project and will provide oversight necessary to ensure that the available funds are used for this specific project.

Issue: Funding is needed for deputy constables to work overtime in order to have additional community policing and after-hours process serving. 

Solution: Budget amendment to Increase funds for Overtime expenditures.

Result: The budget amendment increase will provide funding to cover overtime pay.

Issue: Precinct 4 is in need of purchasing two (2) body armor (vests) for two full time employees who have not been issued these body armor vests. 

Solution: The increase of funds will allow for the department to purchase the two (2) vests.

Result: Once purchased, the vests will be issued to the deputies and aide in increasing officer safety.

Issue:  With the current balance in the Canine account, we will not be able to continue to maintain the daily needs of the two (2) canines within our department. The fund increase will allow for necessary purchases for dog food and allow for continued maintenance of the narcotic & explosive canine care.

Solution: The increase of funds will allow for the department to meet the demands of the daily needs of the canines.  

Result: Secured funding will allow for the department to continue utilizing the canines in operation to assist in law enforcement efforts to ensure the communities safety.

Issue: Webb County inmates who do not qualify for indigent health care services must be paid by the County Jail budget.   Costs for various types of medical services for inmates can total in excess of $1 million dollars annually.  

Solution:  Continue paying Indigent Health-Care solutions at an annual investment cost of $12,708.00 in order to obtain Medicaid pricing for medical services such as lab/x-ray, in/out patient services, physician fees and other medical services provided for ailments being experienced by County inmates.

Result: County will save a significant amount of money using Indigent Health Care Solution services.  In Fiscal year 2015 the County saved approximately $1.1 million in medical related costs for treatment.

Solution: Continue paying for elevator maintenance services to cover around the clock services, peak and off-peak rates and other fees that without a contract would be charged at a higher rate to the County.

Result: Secure a Platinum Premier Maintenance agreement to cover three (3) elevator units at the County Jail.

Solution: An additional vehicle and auxiliary staff to allow for out-of-town travel are needed in order to fulfill the needs of the veterans in Webb County.
 
Result: The acceptance of the Series 16-A General Assistance Grant from the Texas Veterans Commission for a One-year transportation program to transport veterans to specialty hospitals and clinics throughout South Texas.

Solution: The Commissioners Court may approve (quarterly, bi-annually, or yearly) contribution amounts that Webb County will submit on behalf of both hospitals.

Result: The authorization of IGT will allow local hospitals to access matching federal funds for FY 2015-2016 to offset uncompensated care costs as well as receive incentive payments from the State of Texas for successful completion of 1115 Waiver project milestones and metrics.

Issue: $9,800.00 were used as part of the funds needed to repair stucco and redo skin coat on building exterior when 14 exterior windows in very poor condition were replaced using General Contractor savings.

Solution: Work resulted in the need to install new skin coat over old stucco on walls to cover damage after new window installation.

Result: Building exterior appearance has been greatly improved and this will improve appraisal value.

Cmr. Tijerina congratulated Mr. Jose Luis Flores, City of Laredo Airport Manager, Mr. Gerardo "Gerry" Schwebel, IBC Executive Vice President, Ms. Sandra Barrera, Workforce Solutions for South Texas, Ms. Lupita Cepeda, AT&T External Affairs, and Mr. Miguel Conchas, Laredo Chamber of Commerce for being honored by the Laredo Community College during their 2nd Annual Impact Economic Development Forum. She extended her sincere appreciation to Conoco Phillips for their contribution of gifts to the participants of the Bruni Community Center and their Kids Cafe. Cmr. Tijerina thanked the Texas A&M Colonias Program, United Healthcare, and Bronze Star Ambulance and Maximus for their contribution to the Larga Vista Community Center. She sent out her heartfelt condolences to the family of Barbara Castillon Garza, Lucia "Lucy" Del Barrio, and Julio Lopez. Cmr. Tijerina wished all her colleagues and all Webb County employees a very Merry Christmas and Happy New Year.

Cmr. Canales encouraged everyone in the community to join together in an anti-bullying effort with our schools. He wished everyone a Merry Christmas and a Happy New Year.

Cmr. Galo congratulated Senator Judith Zaffirini for receiving the J.C. Montgomery Child Safety Award for the Texas Office of Prevention of Development and Stability for her decades of leadership in juvenile justice, children's mental health, and infant death. He mentioned that UISD would be hosting a 5K Run/Walk dedicated to Karina Villarreal and Adriana Gonzalez on January 16 at the Student Activity Center. Cmr. Galo congratulated Natalia Martinez from Clark Elementary School for winning 1st in a State Wide Drawing Competition. He congratulated Alexander High School Senior Ayeesha Mohammed for organizing Laps for Cures to raise funds for St. Jude Children's Research Hospital. Cmr. Galo wished everyone a very Merry Christmas and Happy Holidays. He sent all his heartfelt condolences to all those who have lost loved ones within the last two weeks.

Judge Tijerina sent his heartfelt condolences to 106th year old Ms. Bernarda Garcia. He wished everyone a Merry Christmas and a Happy New Year. Judge Tijerina stated that there would be some changes occurring next year with the pre-agenda meetings.
