Commissioners Court Special Meeting

Monday, December 20, 2021 at 9:30 A.M.
Let it be remembered that a special meeting of the Webb County Commissioners Court was held at 9:30 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 16th day of December 2021. Present also were Mrs. Rosa E. Herrera, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

3.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, Individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

4.   AI-12845    Discussion and possible action to approve a construction contract with C-A Native Contractors, Inc. for the building relocation project for the Laredo and Lobo Tower Sites in an amount not to exceed $173,142.50 and to approve by order an exemption under the Texas Local Government Code; Section 262.024 (Discretionary Exemptions)(a)(7) sole source by using AEP approved vendors and to further authorize the Civil Legal Department to execute a construction contract and any other matters incident thereto [Requested by Civil Legal Department; Account #1001-1130-001-431007-010 (Operational Reserve) and #1001-1130-001-470000 (Capital Outlay)]
 
Issue: Under the current System Purchase Agreement between Webb County and Motorola, these tower and site improvements are the responsibility of Webb County. 
 
Solution: Use AEP approved vendors, AEP shelters are being transferred over to Webb County.  Three (3) price proposals were secured from AEP approved vendors.  Recommendation to award to the lowest bidder.  
 
Results: Proceed with awarded vendor to initiate the removal, transportation and installation of two (2) AEP shelters for tower sites at both Laredo and Lobo locations pursuant to Systems Purchase Agreement approved by Commissioners Court on October 26, 2020.

5.   AI-12846    Discussion and possible action to approve an amendment to the System Purchase Agreement (Radio Systems with Maintenance and Lifecycle Services) with Motorola Solutions, Inc. and Webb County, for the purpose of installing a Communications System; current contract for $5,454,190.00 will increase by the amended price of $823,170.16; and authorizing the County Judge sign all relevant documents and any other matters incident thereto. [Requested by the Webb County Sheriff’s Office]

6.   AI-12833    Discussion and possible action to ratify an agreement with SecureWorks, Inc. for Emergency Incident Response Service, including digital forensic analysis, malware analysis and reverse engineering, for the county’s network at a cost of up to $28,350.00 for up to 60 hours of service and any matters incident thereto; authorizing the County Judge to sign all relevant documents. [Requested by IT Department; Account #1001-1130-001-432001 (Professional Services)]

8.   AI-12842    Discussion and possible action to amend the Court's action taken on December 13, 2021, Agenda Item #24, by approving a one year parking lease, with  three (3) one year options, for five (5) parking spaces (County parking lot, 1200 Washington St.) at One Hundred Dollars per space, payable in arrears and upon invoicing with the U.S. Attorneys Office Southern District of Texas to be effective January 1, 2022 through January 31, 2022 (initial term) instead of February 1, 2022 through January 31, 2023 and any matters incident thereto; authorizing the County Judge to sign all relevant documents. [Requested by Commissioners Court]

Issue: Election Security has been an issue for the last few years, and the Elections Office has taken the initiative of implementing new voting equipment as well as cyber security training to help combat the issue.

Solution: Through the acceptance of this award, Webb County will expand funds for the EAC awarded to prevent, prepare for, and respond to the Cyber-attacks, domestically and internationally for the 2022 Election cycle. 

Result: The Webb County Elections Office will have additional resources to protect the 2022 elections from the effects of the Cyber-attacks.

11.   AI-12838    Discussion and possible action to enter into a twenty-two (22) year lease ("initial lease term" - Two years for Development Phase and Twenty years for Construction and Operation Phase) of the Webb County School Lands (Cuchillas and Lomas Pastures) located off Highway 59, Webb County, Texas, with GrandSolar Texas Two, LLC (Lessee), if Lessee exercises options to extend the lease for an additional four (4), six (6) month terms during the “Development Phase” of the Project  and two-five (5) year terms  during the “Construction and Operation Term Phase” of the Project the total possible Lease Term (if all Options are executed) is Thirty-Four (34) years, for the purpose of constructing and operating a three hundred  (300MW) megawatt Solar  Energy Project on said school lands in the amounts of Twenty Five Thousand Dollars ($25,000.00) per year to lease the school lands during the “Development Term” escalating 1.5% annually during the Development Phase and payments during the “Construction and Operational Term” (remainder of the Lease Term) of Three Hundred Fifty Dollars ($350.00) per acre for the Project Foot Print (with guarantee “rent” payments for 1,900 acres) with said “rents” escalating 2% per year during the “Construction and Operational Term”, and any matters incident thereto. [Closed Session/Executive Session is requested pursuant to Government Code §551.0725 Deliberation Regarding Contract (Lease) Being Negotiated; Closed Meeting]
